Read: The Otago power network is THAT DEGRADED – caused by various rugby supporting and clip-ticket gentlemen, whose names we all know so well. Described by civil words (not cuss words) that start with F and C.

The “laundry” was well and truly harsh, leaving the network in threadbare tatters…. while private pockets were filled. That’s One Billion Dollars worth of power asset the Otago ratepayers have had to pay for TWICE. Talk about ‘power’ and corruption, Bryce Edwards (?) – Dunedin in the last 30 years was built on it, solidly at source.

The “gents” might like to explain where all the money went, and how the hell they think they can make us pay for their near limitless mismanagement and fully reckless endangerment (to workers, citizens and the regional economy) over three decades …..without shoving them in deep at the NZ Court system —for processing.

█ Today an Aurora/Delta executive had the audacity (after spinning out their LGOIMA response to the 20th working day, following my request made 26 April) to want to charge me for official information at the vindictive “maximum charge” (their words) of $190.00. Shove that, boys. Other council owned companies have provided the information free of charge and very promptly and courteously.

Tuck it back in your pants Aurora/Delta, or be sliced.

No decision to prosecute Aurora

Worksafe is yet to decide whether it will prosecute Aurora Energy over the state of its power poles. WorkSafe has been looking into Aurora and its sister company Delta since October over accusations dangerous power poles across Dunedin, Central Otago and Queenstown Lakes were putting the public at risk. The government entity gave fresh details about its audit of the two companies in response to an Official Information Act request from the Otago Daily Times. WorkSafe high hazards and energy safety general manager Wayne Vernon said it had completed an “initial” audit of a sample of the network’s assets and provided a report to Aurora. […] “WorkSafe has not to date made a decision to prosecute or not to prosecute Aurora over health and safety issues associated with the state of its poles.” Mr Vernon emphasised prosecution was one of many options available to it, which also included issuing instructions to remove or minimise the potential for danger and issuing an infringement notice.

I have just received the attached table and invoices for Delta’s spending at the stadium. They not only have a $45,000pa corporate suite contracted for 10 years, they also have used ratepayers’ money to purchase Gold tickets to concerts, they have spent thousands of dollars on expensive booze/wines and meals, stadium platters etc whilst watching rugby and concerts at the stadium. All this whilst neglecting the maintenance of basic infrastructure.
I am especially disgusted that this is continuing after the excessive abusive spending by the Carisbrook Stadium Trust which you are all aware of. Disappointingly nothing has changed. My opinion is that’s because no one has ever been held to account for the corrupt behaviour that ensued relentlessly throughout the stadium swindle. Please note that these invoices have been signed off by Grady Cameron and Gary Johnson. You may recall Gary Johnson was Farry’s CST public relations boy who worked for Farry part time on a full time salary – all documented in the CST invoices.
Elizabeth, feel free to post on What if as I am at the airport waiting for a flight to go overseas and will be out of range in two hours time.

As you are aware Aurora pay a subsidy of approximately $7.2 million per annum to subsidise the stadium.

At $5000 per power pole this is equivalent to 1440 power poles per year.

I read in the ODT that Aurora’s excuse for not dealing with the backlog of dangerously compromised power poles was that there were financial constraints but nowhere did it mention the reason for these constraints. It is patently clear that Delta/Aurora/DCHL’s priority over the last few years has been to support a rugby stadium at the expense of public safety by way of subsidies/subvention payments.

It is in the pubic interest that Delta/Aurora are transparent especially now that this has become a public safety issue.

I, therefore, urgently request the following:

The total yearly amount Aurora and/or Delta have paid to DCC/DVML/DVL for the stadium, including grants, subsidies, subvention payments or other, since 2007.

Given the total amount is in the vicinity of approximately $40 million, then it is incumbent on you as CEO of both Aurora and Delta to inform the Worksafe Investigation team that Delta/Aurora/DCHL made stadium payments a priority over replacing dangerous power poles.

Please also send me the name and contact email address of the Worksafe Investigation team leader as I want to ensure that the Worksafe Investigation team receive this relevant information.

Old stadium site ruling questioned

The company that owns the former Carisbrook Stadium site in South Dunedin is calling on the Dunedin City Council to scrap a 10.5m setback suggested for its Burns St frontage. Calder Stewart says the setback will cover 1963sq m of land worth about $600,000, and will not provide the benefits suggested in the second generation district plan (2GP). The company took its concerns to the 2GP hearings last week, as a hearings committee considered what the next district plan will look like. […] Research undertaken by the University of Otago had shown South Dunedin had a low population of native birds because of a lack of habitat, and planting of native or exotic trees there would provide a valuable habitat resource.

Carisbrook was a major sporting venue in Dunedin, New Zealand. The city’s main domestic and international rugby union venue, it was also used for other sports such as cricket, football, rugby league and motocross. Carisbrook also hosted a Joe Cocker concert and frequently hosted pre-game concerts before rugby matches in the 1990s. In 2011 Carisbrook was closed, and was replaced by Forsyth Barr Stadium at University Plaza in North Dunedin.
Floodlit since the 1990s, it could cater for both day and night fixtures. Known locally simply as “The Brook”, it has been branded with the name “The House of Pain”, due to its reputation as a difficult venue for visiting teams.
Located at the foot of The Glen, a steep valley, the ground was flanked by the South Island Main Trunk Railway and the Hillside Railway Workshops, two miles southwest of Dunedin city centre in the suburb of Caversham. State Highway 1 also ran close to the northern perimeter of the ground.
Carisbrook was named after the estate of early colonial settler James Macandrew (itself named after a castle on the Isle of Wight). Developed during the 1870s, it was first used for international cricket in 1883, when Otago hosted a team from Tasmania. It hosted rugby union internationals since 1908 and full cricket internationals since 1955.
The stadium was home to both the Highlanders in Super Rugby and Otago in the ITM Cup through each side’s respective 2011 season. It is also the former home of Otago cricket, which moved to the University Oval at Logan Park in the north of the city after the redevelopment in the early 2000s, and also of Otago United Football team in the New Zealand Football Championship, which moved to the lower-capacity Sunnyvale Park for the 2008–09 season.

I have been reading the annual reports of Dunedin Venues Management Ltd (DVML) and am somewhat uncertain as to the true position regarding the matter of charges/fees for the use of the Stadium. We were given a detailed report in the 2014/15 Annual Plan wherein it [was] disclosed that the DCC/ratepayers would be making a one off lump sum of $2.271m to DVML by way of calling up unpaid capital. Then there is to be $715k per annum paid also by way of calling up unpaid capital. An event attraction fund of $400k per annum, source ratepayers? These two annual sums are I believe revenue to DVML. We won’t talk about the later decision to fund $2m per annum as a rent subsidy to DVL, due to DVML’s inability to meet the $4m rent required towards DVL’s debt reduction.
There is no mention of the Stadium in the 2015/16 Annual Plan with any reference to funding shortfalls even though both DVML and DVL continue to run deficits.

Zeroing in on sports events held in the Stadium (because that is its primary purpose) I see that in 2013 there was (sic) 44 events attracting 205,511 attendees.
In 2014 there were 39 with 206,123 there and in 2015 for 33 events 174,575 turned out in support.

DVML showed revenue of $6.085m in 2012 and $8.205m in 2013. These were of the Stadium only, thereafter it includes the Edgar Centre, the DCC Convention Centre plus the Ice Stadium management. This brought about an increase in revenue to $9.127m for 2014 and $9.960m in 2015. Similar pattern for the operating expenses over those same years.

In order to enable one to get an assessment of where these obviously inadequate revenues come from I would request under the [LGOIMA] the following points;

1. The main events being rugby, which of the ORFU, the Highlander Franchise or the NZRFU staged what events over those years? What was the rental received by DVML from those respective bodies per event and do they figure in the revenue statements?

2. What was the amount of revenue received from the other lesser codes which used the same facilities?

With respect to the Operating Expenses outlined in the reports, 2012 as $3.862m, 2013 $3.589m, 2014 $4.361m and 2015 $5.407m.

Hello Sue,
You will have been aware of my queries expressed recently via the [LGOIMA], re the DVML revenue [breakdown].
Well I would have to say that the reply as received is totally underwhelming. This would have to be the most condescending, snivelling, performance by a highly positioned manager one could expect. Hiding behind a clause in a flawed piece of legislation to deny a citizen stakeholder information which ought to be available, on the grounds that it would compromise the company in carrying out its business without prejudice or disadvantage is nothing but
a complete ‘cop-out’ by a less than forthright person. Unless there is detail showing activities detrimental to achieving maximum returns to the company, then I find it a disingenuous and rude dismissal of an honest request.

Sue, I am dissatisfied with his response but if you think it is the way it should lie, then I would be deeply disappointed. I would appreciate your comments as I treat this as a serious affront.

Ratepayer boxes #saga

Once upon a time, Rugby louts and owners of industrially-zoned land at Dunedin decided they deserved a new Rugby stadium and some personal spending CASH! (ie ratepayer money)

It wasn’t long before DCC was vigorously lobbied from within and without by slimy fatcats, to build a Hopeless Stadium.

The evil plan was to saddle ratepayers with outlandish debt for decades and decades.

It also transpired that the Chin Council thought only slightly about lines in the sand but agreed ‘it’s perfectly alright to rob the poor to support the well-off’ —the practice continues to this very day, Mayor Cull’s merry band of dimwits subsidise DVML and have recently transferred $30m of Hopeless Stadium debt back onto the DCC books.

Going back a treacle-filled step or two… the spendthrift Carisbrook Stadium Charitable Trust (CST), headed by Malcolm Farry, became agent to the Council via a Service Level Agreement (SLA), to see in the Hopeless Stadium construction project and associated fundraising.

[Aside, like it didn’t matter: Farry in his construction safety hat and dayglo vest failed miserably at raising public donations for the Hopeless Stadium.]

Long short… regular as well as ‘other’ payments were made by DCC to CST and co-greedy sods without much corroborating paperwork.

Despite non-accountability and lack of transparency, and the odd crucial missing document, there’s a stash of CST files kept “in storage” somewhere – files to drive a bulldozer through, lawfully the property of the Council, paid for by ratepayers.

Turns out two of DCC’s most senior executives, with Malcolm Farry, appear to have no interest whatsoever in surrendering the files for independent forensic audit. They’ll only retrieve file boxes in batches, while pedalling strongly backwards.

The files are not sealed, seized or safe. Where are they? DCC will not say. Farry won’t say. Fairytales are being told.

The files were long ago officially requested through the Local Government Official Information and Meetings Act (LGOIMA) by Dunedin resident Bev Butler. They’re also subject to the Public Records Act.

The Ombudsmen’s Office is involved, due to deliberate lack of co-operation shown by CST and DCC to supply copy of the original files to Ms Butler in a timely manner.

Have the files been thrown into plastic shopping bags, shredded or dumped? We simply don’t know.

CST and DCC are equally culpable, they’re both prepared to lie and defer – What if? can only imagine the files might be as tidy as this.

If it takes a court order…..

Former ARC Councillor Bill Burrill is not the first dodgy ratbag Councillor to trough from abuses of power to his own pecuniary advantage in recent years. A few years back in 2009 Council Watch was calling for a number of Councillors from the Canterbury Regional Council to be prosecuted and sacked from their positions after an investigation by the Auditor General Lyn Provost found that four individuals had broken the law by acting in conflict with their official role. Back then those Canterbury Councillors failed to declare a conflict on interest that [led] to a financial benefit for themselves by participating in discussion and voting on proposals before Council. Under investigation the Auditor General’s office chose not to prosecute stating that whilst the Councillors should have withdrawn as a matter of principle – they had each received and shared legal advice that they could participate. And here in lies the problem. The Auditor General and Office of the Ombudsmen publish clear guidelines for Councillors and council staff but the reality is that the law is erroneously filled with holes that are exploited and there is precious little oversight of Local Government leading to the Auditor General loathing to bother and the Courts uninterested.

DVML and ORFU refuse to disclose 2012 Otago Rugby deal

Dunedin Venues chief executive Terry Davies was asked to release details of the “Otago Rugby deal” struck in 2012 as part of the Otago Rugby Football Union recovery package.

Surprise! Mr Davies and ORFU don’t want you to know how much DVML pays ORFU for each rugby game played at Forsyth Barr Stadium, and given DVML is struggling to meet the sponsorship commitment (see previous post). Worse, DVML keeps paying even though ORFU is now flush with funds.

Just how are these payments passing through Council-owned books? The money comes from your rates; piling on top of every other subsidy DCC is gifting to the stadium and professional rugby.

The 2012 deal involved David Davies, the previous DVML chief executive. Who else was involved at ORFU, NZRU and DCC? Was the Mayor of Dunedin Dave Cull a signatory? More to come.

What a fine accommodation for professional rugby this aquatic scheme for the Taieri truly is. Shades of the model so well utilised by the earlier trust named after Carisbrook and headed by Malcolm Farry, still operating as a boon to Dunedin city ratepayers. In the months ahead let’s see how many times the new patron leaves out the word ‘Rugby’ (capital R) or the phrase ‘private property development costs on the City’ in favour of philanthropic zeal expressed for healthy retirement living and enhanced aged care facilities (hydrotherapy for aching rugby shoulders and thighs), sunshine and splash for young families – don’t forget schools! – as the Taieri’s high class soils get carved and private forests near Brighton assist the housing build. Yeah, don’t say there’s merely a saint in goggles amongst us, Lord be praised, it’s the second Dollar coming. An epiphany.

We see it as a great benefit to Dunedin people. The 2013 OUSA student survey of Dunedin facilities showed a very high satisfaction with the stadium. […] The financial concerns cannot be ignored. And some of the antagonism caused by the provenance of the stadium remains to be settled. Our experience is that DVML is working to ensure the facility is used. We are working with them as much as possible for our own events but also events the DVML team brings to Dunedin that have student interest.

The Auckland Rugby Union is looking at the possibility of shifting their ITM Cup home games away from Eden Park as paltry crowds hit them financially. Auckland Rugby has been an official tenant of Eden Park since 1925 and historically has always been associated with the ground and sporting success there. The Highlanders were due to arrive in Durban early this morning and begin preparing for their playoff match against the Sharks on Sunday morning. The side ended up sixth in the table after the final round of games in the weekend and will be on the road the entire time it is in the playoffs. Highlanders general manager Roger Clark said the franchise would make a little bit of money out of making the playoffs but the real benefits came to those that hosted the games. He was yet to finalise how much money the team would receive for making the playoffs but it was not significant, he said.

Fresh thinking needed in local government

Perhaps it is time to look at a far-reaching reform of the way local government functions at both local and regional level. There are substantial efficiencies to be gained from integrating many council functions across the councils within the region. More than 10 years ago I did away with all IT functions at the Clutha District Council and merged these with Invercargill City. This model would work for all of the councils across all of Otago and Southland for little more than it currently costs Dunedin City Council to run its IT services.
Some fresh thinking needs also to be applied to the stadium and the first of these should be the monopoly that rugby has over it and the grass surface.

Paul Hudson (65), of Port Chalmers, said that he was “humbled and honoured” for the recognition of his involved with commerce, local government and the community in Dunedin for 50 years.
He worked for Cadbury Fry Hudson between 1973 and 1996 and, as managing director, led Cadbury’s transition to conducting its worldwide business from centralised locations.
He held elected positions on Port Chalmers and Dunedin City Councils between 1980 and 2013, including deputy mayor on both councils.
He was chairman of Dunedin City Holdings, Citibus-Dunedin Transport Ltd and Citiworks, and a board member of City Forests, Aurora Energy and Delta Utility Services.
He was chairman of Dunedin City Holdings for 18 years, when shareholder funds increased from $100,000 to more than $150 million and distributions to Dunedin City Council totalled more than $280 million.
He was council appointee for the Otago Theatre Trust, Dunedin Public Art Gallery Society and its acquisitions committee and the Dunedin Town Hall Organ Trust.
He was appointed treasurer to the Otago branch of the Save the Children Fund 50 years ago. “This was the beginning of my lifelong interest in serving the community.”
The service to the community included work for Port Chalmers Kindergarten, the Aramoana Trust, Regent Theatre, the Otago Arts Society, the Dunedin Council of Social Services and the Dunedin Community House Trust. “My involvement with the establishment of Community House, my early years in Save the Children Fund and various roles and involvement in local government have been very satisfying,” he said.

DCC: Another deadweight pro-stadium councillor #Whiley

Cr Andrew Whiley, isn’t feeling well.
“The impact of this stadium is huge and Dunedin residents need to embrace it and treat it as the asset it is.”
He mentions an economic “win”. —Cough, cough. Strangled cry.
Poor man hasn’t done the sums.

Myth or fancy, “Whiley for Mayor (if Daaave is tired)”……

Rest assured, Cr Whiley, in another sense, that thinking indebted city ratepayers and residents KNOW the impact of the stadium is huge. Moreover, there’s absolutely no doubt they embrace it for WHAT it is.

No. The mayoralty is not for you, Cr Whiley.
You have lined up your ducks as a one-term councillor ONLY.

[…] NSW Premier, Barry O’Farrell, has resigned because he had a ‘massive memory lapse’ about receiving a $3000 bottle of wine after the Liberal’s win in the last NSW election.
They have what they call an ‘Independent Commission against Corruption’ (ICAC) over there. They were able to unearth a ‘thank you’ note Farrell wrote at the time. Another former Liberal Premier was also caught out in 2002. (Sounds like we need a similar body here in NZ)
I note this because it again points to a glaring lack of accountability here… and the $3000 bottle of wine pales into almost insignificance compared to the multiple million dollar rortings going on here at the local government level.
The attitude continues to be ‘Oh well, lessons to be learnt. Let’s move on.’ We continue along this line at our peril. Corruption will grow and become even more insidious than is already apparent if citizens don’t rise up and demand accountability.

The Dunedin City Council says feedback on its draft budget has been “pretty good” despite some disappointing turnouts at public meetings in recent weeks. The council concluded a series of eight public meetings and drop-in sessions with a discussion of cycleway and road-widening work on Otago Peninsula at the Edgar Centre on Tuesday night.
Public submissions on the council’s 2014-15 draft annual plan were “flooding in now” and had reached 427 by late yesterday, council corporate planner Jane Nevill said. That was well above the 262 submissions received by the council on its 2013-14 draft budget.

The draft annual plan sets out the Council’s proposed annual budgets and performance measures for 2014/15 and updates the information for the 2014/15 year that in contained in the Council’s ten year plan or Long Term Plan (LTP) which was put in place last year.
