Not planning any action over Mayoral comments today because action over Mayor Cull previously defaming me as shonky’ finally got an unreserved apology from him but cost a lot of time and ratepayers money as did the farcical Code of Conduct sideshow. Shame that after all the evidence that I have provided especially what has been confirmed regarding my 2011 Citifleet allegations, that our new Procurement Policy still has not resulted in an independent Procurement manager position to oversee all individual managers’ contracting behaviour . Unfortunately my email programme died last Thursday and is still inoperative. Cheers Lee

DVML’s Terry Davies has gone deliberately quiet on all SECRET SANTA help his company gives to Otago Rugby, more evidently so following recent purchase of The Highlanders by local parochials.

Yesterday’s dish-out to ORFU (“charitable status”) is just another *feel good* cover to the multimillion-dollar transgressions charged to Dunedin ratepayers, for PROFESSIONAL RUGBY operations.

MAKING IT WORK
Remember fubar stadium is costing ratepayers over $25 million per annum. The ‘blistering handiwork’ of Mayor Dave Cull and his cronies, Greater Dunedin.

As part of the Community Access Service Level Agreement with Dunedin City Council, DVML has annual funding of $750,000 to allocate for community events/activities to be held at Forsyth Barr Stadium and the Dunedin Centre. The funding provides financial support to people, community groups and/or organisations that have a charitable status or are a not for profit organisation, to enable community users to utilise the facilities, resources and equipment across the venues.

The September funding applications have now been processed with 53 events/activities by 24 organisations receiving funding. A total of $267,819.60 has been allocated as follows:

I experienced Fleetwood Mac at Western Springs, Auckland in the 1980s, there is no way I want to see them live now in a crap-for-sound covered stadium at Dunedin. This cat has already eaten the cream. I might see them at Mt Smart, however.

How much has DCC/DVML paid to the promoter to get the band here?
They’ve spent $350,000 on tired roller Rod Stewart, who has yet to perform.

Fleetwood Mac to play Stadium

The rumours are true — Fleetwood Mac is coming to Dunedin. It was confirmed yesterday the group, one of the world’s best-selling bands, will perform its only South Island show at Forsyth Barr Stadium on Wednesday, November 18. Tickets costing between $100 and $300 plus fees will go on public sale from 10am on April 1, and a bumper crowd is predicted to pump millions of dollars into Dunedin’s economy. The British-American group’s Dunedin show will feature all five original band members, with Christine McVie having reunited with Mick Fleetwood, John McVie, Lindsey Buckingham and Stevie Nicks.

Lee Vandervis releases emails #Citifleet investigation

What if? Dunedin has received a total of 17 emails from Lee Vandervis, including two with email attachments. A further three emails have been withheld from publication due to privacy reasons, and which may be actionable.

The first batch of seven emails feature at this post, with the remaining ten emails (some repeats to different recipients as Mr Vandervis follows up with Kyle Cameron of Deloitte, responsible for the Citifleet investigation) to be added at Comments after being photographed and stitched back together to retain threads.

To be noted, this is part document proof of Cr Vandervis’ efforts from 2011 forward to elicit information on suspicion of fraud occurring at Citifleet. The emails show DCC Senior Management were aware of fraud allegations well prior to 2013/14, despite Council’s formal media statements to the contrary last year. They also support the obvious need that existed for a wider fraud investigation in regards to Council tendering processes, service contracts, traffic of car parts and tyres, staff credit card spending (by multiple available cards) and more – quite apart from disposal of at least 152 Council vehicles in the period 2003-2013, the set arbitrary window for investigation by Deloitte.

The DCC chief executive having taken a fraud complaint to Dunedin police was advised police had insufficient resources for follow up. There was then a three-month gap before police received the Deloitte investigation report commissioned by the Council. Three months is long amount of time to minimise and remove critical evidence within Council and about town. Dunedin City Council knows that. Deloitte knows that. Dunedin police know that. We can assume the Council’s insurers know that, yet they paid out $1 million in two instalments, for the ‘lost’ vehicles only [see DCC media release]. The three-month gap in itself is a suspicious if not criminal activity against Dunedin ratepayers and residents.

It is completely ludicrous that our little Cr Thomson is today making public comment on DCC’s new Whistleblower Policy – given Cr Thomson as chair of DCC Finance Committee has had every opportunity to treat his colleague, Cr Vandervis, the Council’s most notoriously effective Whistleblower, with all fairness and due respect but has actively failed on that count, time and time again.

What is it with Cr Thomson, our import from Southern District Health Board and former Otago District Health Board. Doesn’t the Councillor see it as his mission to relieve Dunedin Ratepayers from the living hell of the nearly unsurpassable multimillion-dollar mountain of corruption and fraudulent activity perpetuated at the Council and through its CCOs. Whitewash is not removal, Councillor.

A quietly spoken SDHB informant tells me Susie Johnstone, a chartered accountant, was wheeled in by the Health Board after the Swann fraud, for mop up. Well, Detectives, who wheeled her in and what was the nature of the mop up?

Separately, following Cr Thomson’s uptake into local body politics, Ms Johnstone was recommended for the position of independent chair of the DCC Audit and Risk Subcommittee.

The ARS committee is now to deal with Whistleblowing (no surprises there). As we have already published in previous months, via intimations of the Draft Whistleblower Policy: the DCC contact for Whistleblowers has been a Balclutha woman, whether actively.

Connections regularly multiply. The timing of Council’s announcement of its new Whistleblower Policy is sheer craziness in light of yesterday’s illegitimate farce of a conduct hearing, held at the expense of the DCC Chief Whistleblower. A woman from Balclutha was a witness at the hearing….

Ruth Stokes has been appointed to the position of Infrastructure and Networks General Manager. She brings with her experience in senior policy development, planning and project management and has worked in both the public and private sectors. DCC Chief Executive Dr Sue Bidrose says she’s very pleased to announce Mrs Stokes appointment. “Ruth is a successful general manager with a financial background, strong public service values and a reputation for delivering. Her mix of skills will be an asset to the DCC.”

Mrs Stokes will take on the responsibilities of departing General Manager Tony Avery.

Mrs Stokes is the General Manager Operations for the Queenstown Lakes District Council (QLDC). She has been in that role for the past 16 months and Chief Executive Lakes Leisure (a council controlled organisation) prior to that. Before moving to Queenstown she worked at Auckland Council, Westpac and KPMG in various roles. She holds a Bachelor of Commerce from the University of Auckland and a Post Graduate Certificate in public management from Victoria University of Wellington. Mrs Stokes has a background in infrastructure planning, development, recreation, parks, and aquatics.

“The way these assets and facilities are managed often make a major difference to the perception of a city. I think the job is a terrific opportunity to work as part of Council’s leadership team to help Dunedin become the great small city it strives to be.”

She has enjoyed her time in Queenstown, and will stay in touch with her friends and colleagues. “But I am really looking forward to moving to Dunedin and experiencing the advantages the city has to offer. I am keen to meet the DCC leadership team, the Councillors, the stakeholders and the staff. Dear Editor,
Despite all the evidence, contributors like Bev Diehl still have everything wrong regarding the Stadium.
We do not “have it” – it has us till it is paid for. In the meantime the lenders have it and us by the debt short and curlies.
It is not “an asset” but a rates liability. We are not having major artists, they occasionally have us, as in the estimated $6 million Elton took back overseas for his one-off no-charge use of the Stadium. The mostly empty stadium has other events, mostly rugby, which are heavily subsidised by rates bail-outs and differential, Community Access fund, Event Attraction fund, and millions in interest, staff and maintenance payments. The DCC Stadium Review Committee was stacked with Stadium Management who recently succeeded in again increasing funding for their already wasteful operational spending.
Everything can never “fall into place”, until Stadium operational costs are reduced to the bare minimum required for the rare large events that only the Stadium can host, now that Carisbrook has been levelled.

Earlier in the year it was announced that the stadium was to be reviewed and that all options would be considered, including mothballing.
Now with the recent release of the Stadium Review only two options are presented, namely, the status quo and the most extreme option of demolition.
1. Why were the options of sale and mothballing not reported on?
2. Did the Stadium Review committee look at the sale and mothballing options? If so, I request a copy of the findings. If not, why not?
3. Whose decision (names) was it to not include mothballing as an option?
4. Did the NZRU and/or ORFU have any input into the Review? If so, I request a copy of all documentation.
5. Who (names) from the NZRU/ORFU was consulted/involved in the Review?
6. Did any member of NZRU and/or ORFU influence/pressure/request that the mothballing option be removed/excluded from the Review? If so, who (names)?
7. Mayor Cull has publicly stated that the demolition option was included in the Review to show the “lunatic fringe” that demolition is not a realistic option.
a) Who (names) are the “lunatic fringe”?
b) If Mayor Cull is unable to name members of the “lunatic fringe” then why was the demolition option considered?
c) Why were the mothballing options not considered when well informed stadium critics had publicly called for this option? ie. Why was the extreme option from an unidentified “lunatic fringe” considered over the mothballing option proposed by identifiable well informed stadium critics, like myself, who have been proven correct in their predictions?
8. What part did Sir John Hansen play in stifling the mothballing option?
9. Will the mothballing options now be reviewed?

Stadium demolition option only for ‘lunatics’

Dunedin’s mayor has said the city council only included an option to demolish the city’s stadium to shut down “a lunatic fringe”. In an interview with Mary Wilson from Radio New Zealand, Dunedin mayor Dave Cull said demolition was included in a review of stadium funding, ownership and operation “to put to bed the frequent and strident claims of a lunatic fringe”. Cull described the opposing group as “a small vociferous band of critics all the way along through this process who have said it would be much better to knock [the stadium] over”. “So, we said ‘okay, we’ll look at that option, we’ll cost it, and that should put it to bed once and for all’,” he said in the interview. As it turned out demolition proved unworkable economically, Cull said.
City councillors are to gather for an extraordinary meeting on Monday to discuss its recommendations out of the review, including one that ratepayers stump up $18.1 million extra over the next 10 years to keep the arena afloat.

Dunedin city councillors are preparing for a fresh war of words over Forsyth Barr Stadium, following confirmation it needs another $1.81million a year from ratepayers. The extra costs, together with a nearly $1million budget hole to be plugged by mid-2015, would see nearly $20million in extra ratepayer funding pumped into the venue over the next decade.

DVML: Two directors gone before release of stadium review

Last week at DCC I was asked if I knew Rolfe and Brown had left DVML, I did not although I was aware of the advertising for new directors (see previous posts).
In the ODT story we’re privileged to see the misguided views of Ms Rolfe in lights (what an asset… not meaning the lights!) —hard being the token woman, brain cells would help. And Mr Brown why he can easily think of better boards to decorate, it’s very wise that he moves on.
Public release of the council’s stadium review is now past due. Of course, Dunedin City Holdings Ltd chairman Graham Crombie has diligently attempted to water down the report. A pale shadow by the time it hits the council table then goes public. The unpalatables. And Mr Hansen?

Confirmation DVML losing two directors

An outgoing director responsible for Dunedin’s Forsyth Barr Stadium says she is leaving with high hopes for the future of the venue.
Jen Rolfe, a Dunedin Venues Management Ltd board member, is one of two directors confirmed to have resigned, along with Peter Brown. The pair’s exit, to be signed off at a DVML board meeting next week, were confirmed yesterday in response to questions from the Otago Daily Times.

Dunedin Mayor Dave Cull says the future funding model for Forsyth Barr Stadium will be more transparent to put an end to a “money-go-round” draining the council’s coffers. But it was still too soon to say whether ratepayers would end up carrying more of the cost, before the public release of the review’s findings next month, he said. Mr Cull was commenting after appearing to suggest, in the council’s latest newsletter, that a funding increase could be possible for Dunedin Venues Management Ltd.

The Council has started planning for the 2015 budget. Next year is also a Long Term Plan (LTP) year. The LTP is a 10 year plan that is refreshed every three years. In addition, the Government has imposed new and urgent requirements on councils around certain important policies. The three work streams are interconnected so there is a huge amount to consider and decide on. The extra work wouldn’t be so demanding if the 2015 budget weren’t already challenging.
While the Council has a financial strategy limiting rates increases to 3%, we face reducing dividend streams from our Council companies, probable higher requirements to get the Forsyth Barr Stadium on to a sustainable footing, greater government regulatory requirements and on going Council reviews. These place considerable demands on resources.
We also need to continue to implement our key strategies. For instance, the Economic Development Strategy aimed at job and business creation, the cycleway network addressing safety and transport options, debt reduction and heritage building enhancement. Our strategic framework is the interconnected road map to the future of our city. Without it Dunedin goes backwards. So savings will be made, tough choices taken and development momentum maintained at the same time. The 2015 budget will be a delicate balancing act.

“FYI DUNEDIN” The latest FYI landed in my letterbox on Friday. Reading from the ‘Mayor’s Desk’ I was taken by Dave’s verbose message. The Council has started planning for the budget. “The work would be demanding if the 2015 budget weren’t already challenging.”

He says: “While the Council has a financial strategy limiting rates increases to 3%, we are facing reducing dividend streams from our Council companies, probable higher requirements to get the Forsyth Barr Stadium on to a sustainable [there’s that word] footing, greater government regulatory requirements and on going Council reviews. These place considerable demands on resources….”

Does he read that stuff? Indeed, did ‘HE’ write it or some muppet in the PR department? A real ‘Churchillian’ rally to the flag entreaty. Nowhere does he address the solution to the main points of the strategies. Are there any real solutions? I don’t know. But I will make some guesses. As I see it, three things are possible.

First, and ideally, there is a massive rush of blood to the head and Dave and all councillors do the right thing and call a halt on all plans, projects and lock the cheque book in the top drawer till future finances allow it to come out again. ‘Fugetaboutit’ it is not in his genome to know anything about prudence.

Second, there will be a massive shift in the rates quotient, on the plea of: ‘jeez’ times have got really tough, and the business cycle has turned against DCHL’s enterprises and the dividend stream is going to be much less than expected. So, it’s shoulders to the wheel and all must do their bit for the good of the city. We must not let it go backwards. Not a hint of reducing the department’s demands and dreams.

Third, a massive change of plan on the debt reduction front. It currently sits north of ($610 million) and we know that the city entered into a ‘multi note facility’ up to but not exceeding ($850 million). So there is around $240 million of freeboard available. Just a silent, unobtrusive drift upwards could be justified, again to tide us over till better times return.

Realistically, there is not one major programme which could not be deferred till the ship is brought back into balance. “Without it Dunedin goes backwards.” News for you Dave, Dunedin is going backwards now! and all your nonsense is accelerating the process.

“STOP!” You already are stuck with the one big “Tar Baby”, in the FB Stadium. If you think you can get that onto a ‘sustainable’ (that word again) footing without pouring vast additional capital into it then you are dreaming. Patronage is the proof in the pudding. It never has reached anything like a feasible level, and is actually in decline at the principal activity, rugby. It is being intravenously dripped to the maximum by around $8 million pa by Aurora now, and we are served notice that this could be in jeopardy due to DCHL’s situation. You have already upped the ratepayers’ input to $2m pa to supposedly shorten the payback period. The rent to DVL is heavily subsidised due to DVML’s inability to generate enough to pay out of revenue. If you look at the DVL reports it is treading water furiously. It has reduced its stadium debt from $146.6 million over four years to $138.586 million, and at the same time brought forward a ($13.656m) deficit. To me that looks like $5.642m backwards. That is notwithstanding capital call ups of the $2 million from the shareholder for the attempt to shorten the loan period. The directors of DVL have comfort in the knowledge that when DVL was established it was capitalised on the basis of 245,000,000 $1 shares, of which to date only 79,688,931 have been called and fully paid up. So you can see that 165,311,069 shares are still available to be called. Dave, you just don’t seem to realise the predicament which the ratepayers (shareholders) are in. That you believe that the FB Stadium can ever crawl out of the financial swamp is tantamount to your understanding of the position.

So, I wonder just how many good folk will be taken in by your ‘glib’ summary as outlined in the FYI bulletin? My guess, not many.

Is it our collective good fortune that “Don’t you know who I am?!?!” Sir John Hansen is ending his tenure as chairman for the sympatico boards of DVML and DVL?

Although, here is evidence that the Fubar Stadium GOES ON………..

We know public release of the Stadium Review initiated by DCC chief executive Sue Bidrose is pushed out until November. It’s all VERY messy, that nothing will DIE —regrouping the DVML board for the $20 million pa loss-making stadium won’t turn the structure into crushed aggregate and salvaged steel (for sale) at pumpkin hour.

A few bunnies will apply. We’ve had bunnies all along at DCHL —look what that’s cost Dunedin ratepayers and residents. Same applies for DVL and DVML. No change will happen while the stadium continues to drain the finances of Dunedin City Council under Liability Cull’s mayoralty of disasters and increased spending.

More than 50 applications were received for the DCHL Board. DCC: Forensics for kids

Fairfax Media has obtained Audit NZ letters of management to the DCC from 2005 to 2012, released under the Local Government Official Information and Meetings Act. The letters show that in the years 2007-2010 auditors consistently urged the DCC to tighten up its risk-management policies and processes.

Audit NZ expressed concern over what it indicated could be inadequate controls over several internal processes, including verifying signatures of those authorised to sign invoices and purchase orders, independent review of creditor files, and controls of sensitive areas such as sale of council assets to staff. Dunedin council officers ‘not kids’

The Dunedin City Council (DCC) appears to have ignored calls by Audit New Zealand to improve its risk and fraud processes, saying its officers were “supposedly people with integrity … not kids”.

The DCC revealed in June it was investigating a suspected major fraud within its Citifleet unit. The fraud was suspected to have been carried out over a decade. Citifleet team leader Brent Bachop died suddenly in May. His death has been referred to the coroner. Council chief executive Dr Sue Bidrose said the alleged fraud of $1.5 million included alleged illegal transactions resulting in the loss of profits from the sale of 123 council fleet vehicles. The findings have been passed to the Dunedin police for further investigation.

Fairfax Media has obtained Audit NZ letters of management to the DCC from 2005 to 2012, released under the Local Government Official Information and Meetings Act. The letters show that in the years 2007-2010 auditors consistently urged the DCC to tighten up its risk-management policies and processes. It appears Audit NZ was compelled to repeat similar advice over the period and noted the DCC met only minimum requirements.

Council managers’ response to the Audit NZ findings in 2010 was to say the council had considered creating an audit and risk committee but concluded its finance and strategy committee adequately performed the role. In December 2010 Audit NZ raised the issue of reviews of areas “susceptible to fraud”, but management commented that specific audits in the “most sensitive areas” had found “no transactions of concern or deficiencies in controls”.

Dunedin Mayor Dave Cull concedes a chance to detect the alleged $1.5 million Citifleet fraud may have been missed, after the council twice overlooked advice from Audit New Zealand. The revelation came in Audit New Zealand’s annual reports to the council, obtained by the Otago Daily Times, which highlighted gaps in council processes dating back to 2003. […] The findings have triggered finger-pointing between past and present council staff, councillors and Audit NZ, but council chief executive Dr Sue Bidrose said responsibility for failing to detect the alleged fraud rested with the council.

DCC public finance forum 12.8.14 (ten slides)

The ten powerslides presented by DCC group chief financial officer Grant McKenzie, as discussed at the public finance forum held earlier this month are available for download (see PDF below).

Public notices advertising the forum and the warm invitation extended by Cr Richard Thomson, chair of the Finance Committee, were unfortunately met with low attendance on the night. Few of the well-known vocal commentators on DCC’s financial position, or indeed, leaders of the Otago Chamber of Commerce, bothered to show. Those individuals lose a measure of credibility. Where were all the beleaguered ratepayers and residents? The local ‘interested’ accountants, economists, board directors, investors, and successful business people? Their apologies? Has everybody drowned with rising sea levels or been knocked from their bikes on the one-way? Blame Dave Cull.

Rob Hamlin and ‘JimmyJones’ did make the effort to be there, solidly plying their observations and questions in debate. Other members of the public also engaged. We didn’t hear the names of people who forwarded questions prior to the meeting, or what their questions were. Notwithstanding, the slides are the Council’s attempt to respond to issues commonly raised, in summary.

The second on 12 August was an opportunity to hear Grant McKenzie who arrived at the Council in January. He proves to be approachable, mild-humoured and self-effacing. Grant explores the expanded GCFO role ably supported by senior finance staff; his already onerous duties include the overlay of current fraud investigations, new systems for accountability and risk management, as well as the stadium review (due in September).

David Ricardo’s Theory of Comparative Advantage has broken down after 200 years, or so I learned at the Lindau forum of Nobel laureates in Bavaria. The theory published in 1817 has been a guiding principle of free trade, taken as a given by every student of economics in the modern era. It has served us well, but just as Newton’s theories ran into limits and were overtaken by Einstein’s relativity, comparative advantage no longer explains the world. Under Ricardo’s model, inequality was supposed to narrow within countries as globalisation accelerated exponentially in the Nineties. Instead it is getting wider. The Gini coefficient measuring the spread between rich and poor is narrowing between countries, but is widening almost everywhere within countries, leading to a corrosive concentration….

DVML catering and commercial kitchens….

FB Stadium: The exclusions included a kitchen fit-out, broadcasting facilities, electronic turnstiles, score boards and replay screens.

FB Stadium: On site commercial kitchens with secondary kitchen facilities on Level Two and Level Four
– Bar areas on Level Two and Level Four
– Suites and lounges on Level Four with air conditioning

Questions, questions.

Why is Dunedin Venues Management Ltd (DVML) getting rid of their employees in order to employ Compass Group (the caterers) employees?

Perhaps because Compass were going to pull out as it wasn’t viable to do business at the Stadium? If Compass pulled out they would make Dunedin City Council pay them back the $3 million they invested in catering equipment at the stadium?

Oi! What events?!
