Govt threatens to pull funding for Chch downtown plan
The government is threatening to cancel its funding for a plan to make central Christchurch more pedestrian and cycle friendly if changes are not made. The Minister supporting Greater Christchurch Regeneration, Gerry Brownlee, said the government was paying 60 percent of the funding for the Accessible City plan, but last week he was granted authorisation by Cabinet to suspend its funding. Mr Brownlee said the plan, which has been partially implemented, risked creating a dysfunctional central city. “Its absurd. I’m hearing all the time from people who are going to have lunch or coffee in the central city and simply can’t park their car. Or end up parking such a long way away from it that they decide they may as well just drive to one of the suburban malls.”

Mike Leach taught Fairfield College students for 34 years. Some of the things he was involved in at Fairfield were outdoor education and building drama sets. He was a geography and social sciences teacher, and also a Dean. On Wednesday, as he cycled through the rain down Te Rapa Straight, the father of two’s life was cut short in a collision. The 67-year-old was killed when his bike and a B-train truck and trailer collided at the Te Rapa Road and Sunshine Avenue intersection at lunchtime on Wednesday. […] Quite a few people witnessed the crash on Wednesday, Waikato road police Senior Sergeant Gill Meadows said. “There are a number of people who were quite traumatised by the incident and we have referred them to Victim Support. There is quite a bit of work to be done on that particular incident.” Initial inquiries showed that the Halls refrigeration B-train truck was heading north along Te Rapa Straight when it went to turn left at the roundabout into Sunshine Avenue. “He was in the lane to turn left, and the cyclist was going straight ahead, and was on the left side of the truck. But we are still doing inquiries in regards to that.” There is a cyclist lane that runs along the straight, feeding into the roundabout. The crash occurred metres from shops and cafes at 11.30am.

Civil proceedings against Maria Frances Smith were due to be heard at the High Court in Dunedin tomorrow morning, with the council listed as the plaintiff, but the case has been adjourned until February 4.

Dunedin City Council to take widow of sole Citifleet suspect to court

The Dunedin City Council has launched civil proceedings against the widow of the man believed to be responsible for the $1.5 million Citifleet fraud. The council lodged the proceedings against Maria Frances Smith, the widow of Brent Bachop, with the Dunedin High Court. A hearing, understood to be about Bachop’s estate, was originally set down for Thursday but will now happen in February.

No-one charged with $1.5m Dunedin council fraud case

No-one will be charged with the $1.5 million Dunedin City Council Citifleet fraud, a final police report reveals. Dunedin Police have released the final report into the fraud, involving the theft of more than 150 council vehicles and misused fuel cards, after the earlier release of an investigation report to Fairfax Media. That report was reviewed by Detective Senior Sergeant Malcolm Inglis, who concluded there was “insufficient evidence to charge any of the purchasers of the vehicles with the offence of receiving”.

“No other charges have been identified.” –Police report

Deloitte interviewed 62 people in relation to the theft of the vehicles from the council and the “majority of those persons were council employees”, the police report said.
● The council was expected to release a response to the police report on Thursday afternoon.

Dear Mr Morris,

There are serious DCC issues underpinning the Code of Conduct process.

DCC Bureaucracy has run many months of self-investigations costing quarter of a million dollars, which this Councillor has not been allowed to see the results of.

Unbelievable claims that the acknowledged $1.6++ million worth of fraud was all perpetrated by one man only, now dead.

Months of Police investigation leading nowhere, with no prosecutions because they only looked at missing vehicles and anticipated that all receivers had to say was they thought the dead man had authority to sell in the way he did. And they all did. This despite many assurances from CEO Bidrose to me from the beginning that there would be a full and wide investigation.

My requests to the Serious Fraud Office [including discussion of 3 year plus investigation of Landfill frauds by local Police] to do the job local Police are seem not to be up to. CEO Bidrose claims SFO had been asked to investigate but SFO have no knowledge of this when I ask them to investigate.

Police investigation only claimed to be widened by Police management after my exposing of their very narrow investigation. Still no prosecutions, or Police interest to date in my offered evidence of Citifleet maintenance contract fraud, credit card fraud etc.

Mayor Cull and CEO Bidrose saying that no public comment allowed while investigations ongoing, but commenting themselves that it was all down to just one man and that the public can have confidence in the living remainder of the DCC organisation.

Mayor Cull accepting non-confirming [devoid of any evidence] Conduct complaints against me.
Crs. Thomson and Staynes add tampered evidence to one of their complaints but not the other – both immediately accepted again by Mayor Cull.

Mayor Cull falsely claims it is within his authority to choose the membership of the Code of Conduct committee against me. Is defeated.
Mayor Cull chooses again, this time with majority Councillor rubber stamp.

CEO Bidrose fails to ensure proper meeting and Code of Conduct processes over many weeks, fails to read my related email, finally culminating in hallway loudness. My full apology should have been printed and still should.

Audit and Risk committee fails to address major DCC problem of contract fraud, identifying 17 types of fraud but not including contract or tender fraud which I have been complaining of repeatedly.
Audit and Risk chair refuses ultra vires to allow any discussion or debate on 40 page pivotal financial report confirmed agenda item which I had previously indicated in the meeting I wanted to speak to.
Cr. Calvert also wished to speak to it but the Chair abused her authority and shut it down. This along with a history of other A&R suppression was the cause of this loudness and my final exit from this committee.

These are all real issues with stories you should be interested in Mr Morris, but instead you bypass the reasons “Whatever the reasons for your frustration…” miss the important issues and ask 5 inane questions about my behaviour.
These are the actions of a gossip columnist, not a reporter.

I have sent my response to today’s Code of Conduct decision just sprung on me to you since I can not rely on ODT reporter Chris Morris to accurately present it.
Fortunately most interested parties read your blog anyway.

I am innocent of the Code of Conduct claim that I have misled the non-pubic Audit and Risk committee regarding the Citifleet fraud investigations.
The guilt lies with those DCC staff and some elected representatives who for years failed to act on my Citifleet fraud and other whistle-blowing allegations despite the DCC records evidence available to them. Some of this evidence has recently emerged in the Deloitte reports which I continue to seek.
If my allegations and evidence had been appropriately acted on, many matters of grave concern would have been dealt with when the record shows I raised them as early as 2011.
DCC staff refusal even now to let me see the full main unredacted Deloitte Citifleet Fraud report, or the Deloitte staff report, or the digitised relevant DCC records evidence, further increases my suspicion of a cover-up.
Questions regarding the role of new DCC CEO Bidrose as senior manager of Citifleet prior to becoming CEO, and of what she knew of my allegations in the years prior are some of the many questions yet to be answered.

What has been shown is that the Police investigation was certainly very narrowed up until my complaint of this narrowing to CEO Bidrose and the Police investigating officer, some six months after the Citifleet manager’s sudden death. Subsequent claims by Area Commander Jason Guthrie that the investigation has been widened have not been supported by Police following up on the evidence I tried to interest them in: the Citifleet maintenance contract fraud, DCC credit card use fraud, etc. or by any convictions, or other widened investigation action that has been visible to me.

The two loudness claims, evidence of which I have not been allowed to see and therefore defend, both come back to the shutting down of the wider DCC contract fraud debate, and the resulting multiple abuses of Code of Conduct process to try and shut me down.

The four prescribed penalties suggested in the Code of Conduct report are:

1 -Censure
– the Mayor has already done this on pubic and non-public occasions.

2 -Request Apology
– I already apologised for loudness at the time

3 -Suspension of voting right only in Committees, not Council
– abuse of my representative function, but a wet bus ticket given my continuing right to debate

4 -Dismissal from positions of Deputy Mayor, Chairperson or deputy chairperson of a committee
– Mayor Cull already did this at the beginning of the triennium.

The Mayor’s recommended members of the Code of Conduct Committee have run an expensive Kangaroo Court with only my loss of two months committee voting rights to be recommended. It will be interesting to see if enough Councillors will vote for that.
It will also be interesting to see what the voting public think – do they want wide investigation and full disclosure or do they just prefer good news stories from the DCC.

Dear Sirs,

Three separate Code of Conduct issues have been raised against me this year following my Code of Conduct complaint against Mayor Cull which Deputy Mayor Staynes decided, without giving his reasons to me, not to refer to you.
There has been an uncomfortable mix of assertions and facts in the limited evidence that has been presented regarding the claim that I misled over Citifleet investigations, which I would like you to consider.

Provable facts include my long mostly non-public attempts to clean out dysfunctional management at the DCC since I was first elected in 2004. Partial success keeps me going.
I never expected whistle blowing to be popular, but neither did I expect such personal attacks for my trouble on behalf of our ratepayers.

Regarding the Citifleet frauds, my records show my many 2011 complaints to senior DCC management of: inappropriate DCC vehicle disposal, Citifleet manager selling vehicles to himself, credit card fraud, vehicle maintenance tender fraud, and tyre fraud are all well documented.
What is equally clear is that nothing was done to seriously investigate these complaints which all turned out to have substance until almost 3 years later when the Citifleet manager’s ‘sudden death’ resulted in new CEO Sue Bidrose ordering the DCC accountants Deloittes to investigate.
Dr. Sue Bidrose had been the most senior manager in charge of Citifleet and many other DCC departments prior to becoming CEO. It is my view that whatever evidence she might have given is not only inadmissible in terms of process because I had not been advised in advance of her evidence or her intention to give evidence, but that Dr. Bidrose is compromised because of her years as the senior manager of Citifleet prior to the Citifleet manager’s sudden death.

In the month following the Citifleet manager’s sudden death I repeatedly urged CEO Bidrose and head of Governance Sandy Graham to resist the temptation to minimize the frauds’ fallout by narrowing the investigation or by blaming it all on the dead manager. Although later admitting that the initial request for investigation related mainly to missing vehicles, CEO Bidrose gave me assurances from the beginning that Deloittes and then later Police would conduct a wide investigation. This provably did not happen with the Police, and I have no evidence other than yet another management assurance that it has or will really happen.

CEO Bidrose also gave me assurances from the beginning of the investigations that if I could provide hard evidence of DCC staff stealing even one dollar she would ensure prosecutions followed. Unfortunately the DCC records evidence which I have sought to complete hard evidence cases against both DCC staff and those involved outside the DCC has been denied me by CEO Bidrose, despite my making LGOIMA requests for it last year, namely: both the full unredacted Deloittes report, the Deloittes staff report, and the digitised evidential files which Deloittes collated for their investigation.
In that month following the Citifleet manager’s death I became very concerned when CEO Bidrose did not achieve a proper Police investigation apparently ‘because Police lacked the resources’, and that only the accounting investigation by Deloittes was to take place. I was relieved that Deloittes’ investigator Kyle Cameron seemed to have a good grasp of the many Citifleet complaints that had been made to me during his detailed interview of me, and that subsequent to the Deloitte reports Police were to investigate fully after all.
My concerns about Police having a belated investigation three months later are recorded, as are my concerns that Police requested that no public statements be made about Citifleet while their belated investigation was in progress. This despite Mayoral and CEO public statements that the Citifleet frauds were all the work of one now dead man.

I have highlighted with evidence to the SFO and CEO Bidrose the extreme slowness of a previous Dunedin Police investigation into DCC Landfill frauds that took more than three years before one individual was finally prosecuted, and I have written to the Serious Fraud Office unsuccessfully urging them to have an outsider’s independent investigation into the Citifleet frauds because local Police seem unable to do the job. CEO Bidrose claimed that the SFO had been contacted re the Citifleet frauds, but curiously the SFO’s Sara Morris said to me that no request from the DCC to investigate had been received by the SFO prior to my request for them to investigate.

My worst fears for the hoped for DCC investigation were realised when the Police investigating officer Detective Mathew Preece interviewed me at my home six months after the Citifleet manager’s tragic death, in what he described as the last week of his investigation. Detective Preece said that the scope of his investigation was only the missing vehicles and that he had already interviewed all other people he intended to interview. He said that all those he interviewed regarding missing vehicles offered the defence that they thought the deceased Citifleet manager was authorised to dispose of the vehicles in the way that he did, and that subsequently there would be no prosecutions of anybody.
I told Detective Preece that I had received many Citifleet complaints for years regarding not only vehicle disposal but fraudulent Citifleet credit card use, tyre supply, fuel supply, and fraudulent Citifleet maintenance contracts and that I had a motor trade business owner and others prepared to give evidence on these issues.
That night I wrote the following email to CEO Bidrose, Head of Governance Sandy Graham and to Detective Preece voicing my concern at the very limited scope of the investigation, and the investigating officer’s understanding that he could not investigate anything else because he did not have any wider complaint from the DCC to act on.

Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

and that consequently none of these fraud areas is being investigated!

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Can you please also now with urgency, forward to me all instructions to Deloitte regarding the Citifleet investigation as previously requested in my email of 26/10/14 as below.

Is it possible to meet with you at any time tomorrow at your convenience to learn whether you have broadened the DCC Police complaint or not?

I am deeply disturbed by what I have seen in parts of the investigation conclusions appearing without covering page or any details identifying them as parts of the Deloitte findings in non-public parts of the Audit and Risk subcommittee meetings.

I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

I can confirm that DCC staff did not (and have not) in any way attempted to restrict, curtail, or limit the scope of the Police investigation stemming from the Deloitte report either at the 1 September meeting or at any other time.

At no stage has any undue influence been exerted by DCC staff on Police as to what should be investigated and what should not be investigated.

At the 1 September meeting it was agreed that the focus of the enquiry would be limited to activity around the 152 vehicles as this was considered to be the most likely aspect to potentially lead to a criminal prosecution.

To avoid any confusion, from the outset the Dunedin City Council has been clear in it’s desire that Police investigate matters arising from the Deloitte report independently, fully, and thoroughly as Police sees fit. The DCC has also been very clear in it’s desire that if any individual(s) are identified as being involved in criminal activity linked to the matters within the Deloitte report that those people be held accountable for that criminal activity.

I hope this clarifies the situation.

Area Commander Guthrie’s response above says that “DCC staff did not (and have not) in any way attempted to restrict…the Police investigation”, but then goes on to say that …”it was agreed that the focus of the enquiry would be limited to activity around the 152 vehicles…”!

Commander Guthrie’s subsequent claim that the Police investigation would be widened has thus far failed to result in my being contacted to provide the further evidence I have already tried to give Detective Preece regarding credit card fraud, vehicle maintenance contract fraud etc. The lack of any prosecutions after so much time adds to my concern.
This seems to me to be another example of management claiming one thing but investigating officers doing another.

I am yet to be convinced either by Police taking an interest in my offered evidence or by any Citifleet related Police prosecutions that a serious Police investigation has really been effectively widened despite stated intention to widen, even at this now very late stage. I do not dispute Police management intentions, but see them as quite different to actual Police investigating actions, which seem to me to be more interested in sidelining me as a critic of their investigation than getting to the bottom of Citifleet fraud.

Regarding the two other loudness Code of Conduct claimed complaints, I do not recognise them and I remain far from content that CEO Bidrose and Cr McTavish at least have made ‘loudness’ statements to your Code of Conduct Committee [Cr. McTavish read hers] but not provided these statements to me in advance so that I could defend them. I see these loudness complaints as politically motivated attempts to ambush me outside of proper Code of Conduct process, and I do not accept that they can have any force.
The two staff that might have had reason to complain of my loudness, namely CEO Bidrose and Sandy Graham, have made no complaint and both have independently assured me that they did not make any complaint, CEO Bidrose with a hug, and Sandy Graham with an eye-roll.

I particularly resent the swearing allegation that no Councillor has admitted to claiming, despite Mayor Cull’s publicly repeatedly saying in the ODT that my swearing had been claimed by a Councillor. I note the irony that when Code of Conduct complaining Cr. Thomson left an earlier Audit and Risk meeting in a huff using the ‘F word’, that no complaint was forthcoming from anybody.

I take this opportunity to register my complaints regarding the running of this Conduct hearing.
1 – That the loudness complaints should never have been recognised as complying by the Committee for want of evidence.
2 – That I was not permitted to record the public part of the hearing in which I spoke, but that Media were allowed to take short-hand and thus given the opportunity to misquote me with impunity.
3 – That no reason was given when asked for, for not being able to record the pubic hearing.
4 – That parts of the hearing evidence were in public, but that apparently some evidence parts were non-public.
5 – that I have been given an extract only from your draft report, on grey paper marked confidential, ensuring that I can not as a result comment on it. The claim that “This is to ensure that the principles of natural justice and due process are observed.” is absurd, given that natural justice and due process have been absent throughout.

Looking forward to having this wasteful exercise in enmity drawn to a conclusion.

The statement that the CEO Sue Bidrose had “years as the senior manager of Citifleet prior to the Citifleet manager’s sudden death” is incorrect. Sue had Regulatory Services (which included Citifleet, Building Control, Environmental Health, Parking Services) added to her General Manager portfolio for less than five months in 2013, immediately prior to being appointed CEO. This is clearly not “years” and needs correcting. Cr Vandervis’ assertions that Sue’s evidence to the Conduct Committee was therefore compromised is not supported by the facts.

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

Re purchase of Mazda Bounty vehicle that it is alleged Mr Bachop sold to himself, surely complete information on this type of transaction must be on Council records?

Sorry I have no dates for this, but the vehicle type, Mazda Bounty should hopefully be enough to establish DCC ownership and subsequent disposal.
Re DCC vehicle disposals, can you confirm which business or businesses the DCC disposes of fleet vehicles through currently, and which businesses have been used in the last 5 years.
In case you are wondering, these info requests are not fishing expeditions but responses to repeated allegations form a number of Dunedin businesses, many focused on Mr Bachop.
I have had no personal dealings with Mr Bachop and do not even know what he looks like.

Thank you for 2010 DCC credit card spending list.
I am now looking for 2007 credit card spending by Brent Bachop, especially September 2007. I wish to have the details confirmed on a purchase of Falken tyres size 195/65-15 as fitted to an Alfa Romeo.
Could you also forward 2008 and 2009 credit card spending.
Also of interest is the sales, sale prices and sold-to information on the sales of all Mazda Bounty vehicles, especially one that Mr Bachop allegedly sold to himself.
Sorry I have no dates for this, but the vehicle type, Mazda Bounty should hopefully be enough to establish DCC ownership and subsequent disposal.
Re DCC vehicle disposals, can you confirm which business or businesses the DCC disposes of fleet vehicles through currently, and which businesses have been used in the last 5 years.
In case you are wondering, these info requests are not fishing expeditions but responses to repeated allegations form [sic] a number of Dunedin businesses, many focused on Mr Bachop.
I have had no personal dealings with Mr Bachop and do not even know what he looks like.

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.
Let me know if you need any more info.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Background
Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are required.

A Dunedin city councillor says the council should have investigated its fraught Citifleet unit three years ago, when he expressed concerns that it shut out firms like car auctioneer Turners. Lee Vandervis said that in 2011 he alerted council chief executive of the time Paul Orders that the Dunedin branch of Turners was consistently shut out of contracts it sought, mainly for the disposal of used cars. The city council said in June this year it was investigating practices within its vehicle fleet unit Citifleet.
Unit team leader Brent Bachop had died suddenly in late May. His death has been referred to the coroner.
A subsequent Deloitte investigation, commissioned by the council, unravelled a vast network of alleged fraudulent activity, some with selected car dealers and other individuals, over 11 years, equating to more than a million dollars in lost council revenue. Some of the activity involved profits from the disposal of second hand Citifleet vehicles allegedly being pocketed instead of being paid into council coffers.
Vandervis said he was concerned about Bachop’s business dealings when he was told by Turners and other Dunedin businesses they were having difficulty even engaging with Citifleet. He began pressing Orders on the issue and made a raft of requests for information around Citifleet. Vandervis suggested Orders meet the manager “to attempt to normalise a Turners/DCC business relationship”. Vandervis said Turners’ staff had expressed “long and on-going frustration at trying to deal with Citifleet vehicle disposals”.

Message: In discussions with Sir Julian [Smith], apparently the ODT Editor has said, since Mr Cannan’s comment, that the actual reason for non-publication of my ‘Citifleet Years of Inaction’ letter was that I already had a letter printed on a similar topic recently.
My previous letter was not however on a similar topic or recent. My first letter which was printed, was sent on 24 August on the topic of Coroner and Police inaction.
My second ‘Citifleet Years of Inaction’ letter that the ODT have chosen not to print was on the topic of CEO Paul Orders’ inaction in 2011, and Mayoral misrepresentation.
It is a shame that most people will not now get the true story.
Feel free to publish so that at least some people get to know some of what has been misrepresented.

Why is the coroner taking more than 3 months to deliver a verdict on the DCC Citifleet manager’s sudden death?
Why have the Police only just begun an investigation when so much evidence has been floating around for years and was so tragically highlighted over 3 months ago?
I have been asking for Citifleet manager and other tender process investigations recorded back at least as far as 2011.
Justice delayed is justice denied. Or with so much public money gone is that perhaps the reason?

I also set up a meeting to resolve DCC/Turners issues between CEO Orders and Turner’s Auckland based national accounts manager Asgar Kachwalla in November 2011. It seems that little was done until CEO Bidrose began an investigation almost three years later. Perhaps the ODT should be doing some more investigating of its own. [confirming email example below].

A formal complaint was laid with the Police last week following an independent investigation by Deloitte which began in late May. Citifleet Team Leader Brent Bachop died suddenly on 21 May. His death has been referred to the Coroner.

Deloitte was engaged by the DCC on 23 May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets.

Dr Bidrose says, “The matter is now with the Police and on their advice, and the advice of the Crown Solicitor, we are not releasing the Deloitte report at this stage, to ensure we do not prejudice any Police investigation.

It appears the alleged fraud was possible because of inadequate internal checks and balances within the DCC. Dr Bidrose says, “We are changing things here at the DCC and it is these changes that uncovered this alleged fraud, which occurred over at least a decade. This reinforces the need for these changes which, frankly, are long overdue.” Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. However, this will be an ongoing process that will take time.

“I want to emphasise that this is an organisation in which people can have confidence. The people who work here are overwhelmingly decent, hard-working public servants committed to the best interests of the city. We are committed to getting to the bottom of any issues and ensuring we have best practice across the board. The changes are well underway – in fact it was in making these changes that we uncovered the alleged fraud.”

Dr Bidrose says the DCC has employment processes underway relating to a small number of staff, primarily around the lack of checks and balances which should have been in place. Mayor of Dunedin Dave Cull says the fact these issues have been found now after more than a decade shows the Council has been right to push for more transparency and tighter processes. “We tasked Sue, and the previous Chief Executive Paul Orders, with reviewing DCC practices so any problems or issues could be fixed as part of our accountability to ratepayers. Paul started with our companies and made a huge improvement in their governance and oversight. Now Sue and her staff are having the same impact inside the DCC.”

Dr Bidrose says a wide range of work has been completed to tighten up DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A first review of internal audit work across the DCC has been completed.
● The risk management framework has been reviewed.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff so they know what may be signs of fraud.
● Increasing further the transparency of purchase card use.
● A review of key DCC policies, such as those relating to fraud and cash handling.
● Review the procurement/tendering processes across the DCC.
● A review of internal processes around issues such as the staff receiving gifts, tickets or hospitality.

The Deloitte report has been sent to both the Serious Fraud Office and DCC insurers QBE. To date, the investigation has cost about $200,000.

Background: Citifleet is responsible for the management of all DCC vehicles, the operation of an internal courier service and an internal chauffeuring service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are needed.

Police probe into missing council cars

Police will investigate a suspected fraud involving dozens of Dunedin City Council cars allegedly sold and the proceeds pocketed. Sources say ratepayers may have lost as much as $1 million as a result of the alleged activity. Dunedin Inspector Jason Guthrie confirmed police had received a complaint from the council “in relation to a significant historical fraud matter involving the council’s vehicle fleet”. “The complaint is being assessed and will be investigated further,” Guthrie said. This investigation was likely to take months. Stuff understands the council’s Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was among an alleged network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit.

Dunedin council’s vehicle network revealed

Investigations into alleged vehicle fraud at the Dunedin City Council Citifleet/Citipark unit have unravelled a vast network of vehicle transactions over the past 11 years, an informed source has told Stuff. The probe has been under way for more than a month. Accountancy firm Deloitte was commissioned to investigate whether dozens of Dunedin City Council fleet vehicles had been sold and the proceeds pocketed. The investigation was sparked when discrepancies appeared in the number of fleet vehicles recorded by the council’s fleet unit Citifleet/Citipark.

The investigation has shocked those in the Dunedin car retail, automotive, and enthusiast community.

Stuff has been told this week the council gave Deloitte investigators a list of council vehicle movements through a network of buyers and subsequent owners over the 11 years. It included buyers of the vehicles, who now owned the vehicles, and how long they had owned them. At least three people, who took ownership of many vehicles, are among those in a network under suspicion of being involved in the fraudulent activity.
Stuff understands Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was allegedly among the network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit. Bachop had worked in the unit for more than 20 years, the past 10 or so as manager.

An inquiry into the disappearance of dozens of Dunedin City Council vehicles – and allegations of missing hundreds of thousands of dollars – is now a fraud investigation, council chief executive Dr Sue Bidrose has confirmed. Dr Bidrose stopped short of implicating individual council staff, at least for now, saying yesterday the focus was on “all aspects” of the processes and practices within its Citifleet department.

Council fleet probe investigates fraud

Dunedin City Council has confirmed that a probe trying to find missing fleet vehicles has become a fraud investigation. The council called in financial specialists from Deloitte four weeks ago for what it now calls a far-reaching investigation of its Citifleet and Citipark departments. The inquiry is centred on what appears to be a discrepancy in the number of council-owned fleet vehicles. The investigation followed the sudden death, six weeks ago, of the departments’ longstanding team leader, Brent Bachop. Council chief executive Sue Bidrose has for the first time described Deloitte’s work as investigating possible fraud. Asked why the police were not doing the investigating, Dr Bidrose said the police were aware of the situation, but the council will need to have evidence of wrongdoing before referring the issues on.

The Dunedin City Council has launched an investigation into its Citipark/Citifleet unit. The unit is responsible for the council’s parking services and also for its management of its fleet of vehicles. Council chief executive Dr Sue Bidrose would not be drawn on the reason for the investigation which is being carried out by accountancy firm Deloitte. The investigation had just started and was being incorporated into a wider review of key accounting practices within the council, which was initiated last year. She said it would be inappropriate to release further details, such as what has sparked the probe. A council spokesman confirmed the unit’s manager Brent Bachop died suddenly last month. Dunedin police said his death had been referred to the coroner.
