The jovial CD was driving towards Dunedin this morning…. gave me a wake-up call to foreshadow a new post pending for that old spectre : “L” for Luggate, or learner plates for Delta Directors and Mr Cameron.

Yessss. While the Noble subdivision at Yaldhurst heads for the rocks, it appears DCC Ratepayers have been doubly triply shafted at Luggate. Anyway, won’t steal CD’s thunder. He is in the offing!

ODT: Former Delta sections in Luggate hot property
Part of the big Luggate Park subdivision that lost Dunedin City Council-owned infrastructure company Delta $5.9million before tax in 2012 is being advertised for sale. The 22 sections in “Luggate Heights”, near Wanaka, range in price from $325,000 to $495,000, providing the owner, Willowridge Developments Ltd, with a potential gross return of $9,170,000. Similarly-sized sections at lower altitudes nearby were selling for as little as $128,000 five or six years ago.

Willowridge, owned by Allan Dippie, bought the 50ha, 160-section Luggate Park development last year from Auckland development company Dentils Ltd, which was unsuccessful in attempts to sell the sections. Dentils had bought the development from Delta and Queenstown property developer Jim Boult.

Otago students at Pitt St: No longer drunk possums in trees

Last night I heard (muted) sirens about, nothing more – not realising what was happening a few houses away up Pitt St. My place is tucked in off the road, nothing seemed out of the usual for a Thursday night, ‘student party night’ —just typical city noise that often includes sirens and choppers. Reading through a consent file for 97 Filleul St collected from DCC that afternoon, I was absorbed, completely missing the street action…. On waking this morning, I opened the first message on my phone, from a journalist asking if I’d heard the party on Pitt St last night? Hmm

Dunedin student seriously injured after jumping from roof

A Dunedin student in hospital with life-threatening injuries jumped from a roof just minutes after party-goers were told to turn their music down by noise control officers. Dunedin District Command Centre Senior Sergeant Brian Benn said police were called to the house on Pitt St about 11.30pm on Thursday. “A drunken student tried to jump off a roof. That didn’t end too well for him.” Benn said no one at the party saw the 21-year-old land after jumping from the roof, but when partygoers went to find out what happened they found him with “reasonably serious injuries”. Neighbours said the flat had been quiet during 2016 until Thursday night’s party. “It was a terrible racket,” one neighbour said. St John ambulance spokesman Andy Gray said the student’s condition was updated from serious to critical due to his “life threatening injuries”. He was taken to Dunedin Hospital but the large party continued.

ODT: Student ‘critical’ after jump off roof
A student is fighting for his life after jumping off the roof of a two-storey house at a large Dunedin flat party last night. Senior Sergeant Brian Benn, of Dunedin, said the 21-year-old was seriously injured after “an aerial stunt” at the Pitt St party went wrong.

An associate caught sight of a particularly juvenile and UNSAFE act that occurred next door [at 53]….
The scene.
Two storeyed house with dormer windows in the City Rise, tenanted by university 3rd or 4th year male students.
Constant noise and behavioural issues…. well-known to Noise Control, Campus Watch and Proctor [Police attention very much the next step – these young idiots have been told].

One of them had earlier broken his leg. Following recovery and some time later…. his so-called ‘friends’ egged him on to jump from a dormer roof (at second floor level) into a shallow paddling pool at ground level. He had to think about it for quite a while…. obviously he was facing serious injury or worse if he got it wrong, given the building height and shallowness of the water. Being a mental statistic he jumped – by luck not good management he did not need an ambulance.

What was that about safety nets – let the morons kill themselves, one less noise complaint.

Hi Sue and Sandy,

Further to my previous email please note that, contrary to the response below, several suburbs of Dunedin have again become mini-lakes districts as a result of the 5pm rain we have had yesterday.
In one drive to Calvin’s place, many blocked mudtanks creating mini-lakes were evident in Hilary st, Orbell st, Fea st and Ramsey st with rivers running from these mini-lakes all over the roads, proving widespread failure of our mudtank structures.
The claims below that 95% of mudtanks have been properly cleaned or that this might have been due to a particularly severe rain event, high tide, or a lack of capacity down-stream are obviously not the case.
Unpleasant options beckon.

A DCC department is not a ‘who’.
Can I please have the names of those people who supplied you with the ‘information’ in the response to my mudtanks questions, from both Transportation Operations and Water and Waste.
It is important for me to know who produces such information.

Can you please also advise who is the person in Transportation operations who is ultimately responsible for the audit of contractor performance?

The difficulties I regularly experience in discovering who authors or produces information to Councillors is becoming a serious issue.

Hi Tony,

I have had a verbal and written complaint from the owners of Davies Heat ‘n’ Cool over the flooding of their 1 Donald st premises, and the DCC failure to address the issue of future flooding.
In the past flooding has been so severe that a complete evacuation and insurance claim cleaning of all carpets was necessary.
This because the camber Kaikorai Valley on the intersection with Donald st is so flat that water streaming down the road from the east side of Kaikorai Valley road during extreme rain events crosses the road at the intersection and it all ends up in the two mudtanks on Donald st, which routinely do not cope.
These Kaikorai Valley mudtanks would appear to be have the same problem as those I have previously identified in Roslyn, Pine Hill, central city, and anywhere else I have been in a heavy rain event – namely that they have not been cleaned to the 150mm below outlet pipe as required under the DCC contract.

The ongoing failure of contractors to do the mudtank cleaning for over a year now has escalated to utter abysmal farce.

Both Donald st mudtanks need to be properly cleaned, and a raised subtle berm of asphalt needs to be added to the middle of the Donald st intersection to prevent storm-water from east Kaikorai Valley crossing the intersection at this point and flooding west Kaikorai Valley road/Donald st.

Please let me know how soon both of these issues will take to be addressed.

The complicity of mudtanks and stormwater drains personified

The Otago Daily Times has undergone a momentary and unsubtle change this fortnight. The newspaper is allowing near ‘ruthless’ honesty in Letters and Online Comments, including rightful naming and shaming (carefully expressed, within context) of individuals and politicians that should no longer be residing at the local authority. Rush in while the door’s Open —we know it is, for the cartoonist deftly flies his drone again! At our city council. (Was GT threatened from on high prior to Election Year, with blanket censorship too ?).

This sudden rush of print-blood happens belatedly, as debate ensues over the council’s (stadium-ripper) lack of investment and professional engagement with core infrastructure services, city-wide.

Not insignificantly, projects led by “pets” continue under the radar via budget lines in the council’s Long-term Plan (LTP) and associated Annual Plans. Of course, the “pets” feel safe from scrutiny since they’ve built up “such amazing” community rapport and goodwill (a cultural following!). Nope, own castles, own keeps, feathering own nests (*not yours!) —spending money that’s not theirs with weak justification, benefitting minor consortiums of private business (*not the wider swathe of our suburban and rural populations!). Supported handsomely (wink wink) by the odd motley politician who wants “back in”, riding the “pets” like a bar saddle to the next paid trimester. Although…. that gratuitously camp ballet scene at Tuesday’s Infrastructure Services Committee meeting : where the doorstepper was conveniently exposed doing rehearsed Q&A with a scapegoat in a hotseat, was an undoing. The video is coming! Equally, someone else nutted on about the girth of pipes in a soliloquy that will endure many viewings.

While ODT meets the temperature of its audience – at the same time, the council offers little that’s honest, immediate or genuine for the people it has ill-advisedly brought flood, damage and distress to. Surely, the worst-affected should see financial re-dress from this (highly indebted) can’t-pay council. Wethinks fixing, maintaining and upgrading council-owned infrastructure is Not Quite Enough to assuage the greater collective conscience…. There could be, however, real satisfaction seeing the council get the deep cut and tuck, a razor slash. Bringing an ungainly end to bully girls’ vanity and sly defective green-tinged parlour acts that buck off without trimming a balance sheet.

Dear Editor,

Perhaps Mayor Cull only takes showers and does not realise that a bath won’t empty when the plug hole is blocked.
As the Councillor who was filling hundreds of sandbags into the early hours of June 4th in the tremendous community effort to fight back the floodwaters, I had first hand experience of the high water remaining long after the rain had stopped, and well into the next day. Hundreds of South Dunedin and other Dunedin residents took an appalling bath, followed by further property value damage from Mayor Cull ludicrously suggesting sea-level-rise greenwash as requiring a ‘managed retreat’ from South Dunedin. South Dunedin has great investment potential which should be realised, beginning with a big pump that works.

In the interest of Tenders transparency, last month I enquired of staff whether FH had bought City Care, as City Care’s new ownership remained a closely kept secret and rumours circulated.

Given the City Care appraisal of mudtank maintenance in our Infrastructure Services Committee Agenda, knowing the new ownership of City Care now takes on increased importance.

Who are City Care’s new owners, and do Fulton Hogan have any financial or other interest in or influence over City Care?

In Item 5 a number of other questions arise:

1 – why is there no mention of Mayor Cull’s claimed contribution to flooding from sea-level-rise? Has this been contribution been assessed as nil? If not, why not?

2 – Is it true that City Care applied to do screen clearing prior to the June 3rd flood event, but were not authorised by DCC staff to do so in time for the flood? [28]

3 – Does the statement “a proactive maintenance regime is important to manage and maintain overland flows into the storm water system” mean that without this proactive maintenance, flooding effects will be more damaging due to the restricted ability to drain? [38]

4 – What is the contract specification for cleaning of the mudtank outlet lateral pipes which are compromised when mudtank debris has not been kept “at least 150mm below outlet”? [39]

5 – where/when is the FH ‘30% full proxy’ first recorded in DCC files? [41]

6 – If 26% of draining mudtanks were totally blocked, and a further 36% partially blocked, would this drainage blockage not mean that flooding effects would be made worse as a result? [52]

7 – Does 230T [52] mean 230 tonnes of debris was removed from mudtanks? When was this removed, and by whom, and at what cost to whom? [52]

8 – which ‘water’ “would have been unable to enter the network even if all mudtanks were clear”. Why would this ‘water’ not be able to enter the network? Is this because network screens were blocked or pumps not working adequately? [55]

9 – Was water below road level [57] a major contributor to flooding and damage of houses? Viz, how many houses’ floor levels are below road level in South Dunedin?

10 – What alternative internal management regime is being considered? [61] is an updated resident cellphone-photo-text-alert monitoring system being considered to replace our old fixagram system?

11 – Who have been the successful tenderers for the new separable portion of the Mudtank maintenance contract? And who were the businesses that tendered for this separable portion?

Looking forward to answers that will further inform debate on item 5.

May we know when you requested that the mudtanks were cleaned thoroughly?

I had thought that it was an initiative from Ruth Stokes, as part of the looking into and reporting back on the flood.

I am also interested in your “fact” that the stormwater system is not capable even at optimal condition and performance……. Do you mean that it was not then, or that it would not be even if we made adjustments and sorted out the mudtanks and fixed the screen/pump and made changes which we have signalled to the general stormwater system which flows through South Dunedin?

If council modelling showed the extent of the flooding would be precisely as it was in the event of that magnitude, what relevance had the problems with the screen/pump and the mudtanks? I guess all the problems in South Dunedin during the flood were localised problems and many of them as a result of water lying about, so did our modelling show that as well?

I understood that there was still more work to be done to understand what we could best do particularly about the interconnection between the water from various sources and what we could afford of the options available.

Do you see the governance part of the Council completely blameless in this process?
Since you have apparently arranged for the mudtanks to be cleared, surely you/we could have done something sooner.

Do we have a role at all in your view, apart from advising people they are wrong when it turns out we may have incomplete information?

As seems true for all of the information surrounding this horrible flood, the more information we receive the more questions we have.

Second that the stormwater system in South Dunedin was not capable of handling those. So flooding was very likely. Last year the Parliamentary Commissioner for the Environment issued a report showing that rising ground water, pushed up by sea level rise will increasingly afflict South Dunedin.
It’s most important to recognise that while stormwater and groundwater can each affect the other, they are different and have different causes.
The failure was operational and managerial as Council was repeatedly assured that maintenance was up to scratch.
Council’s challenge now is to address both stormwater and groundwater issues. We have already, at my request, ensured that the stormwater system is in the best shape possible as winter approaches, by having all the mudbanks cleaned properly. Additionally the screen at the Portobello Rd pumping station, which was blocked by debris carried by the overwhelming amount of water, will be replaced by July.
Council will consider that report which has taken such a frustratingly long time to get to us, and determine the next necessary steps.

It is sad that only one of the council appears to have enough bottle to ask you to do in an old fashion way the decent thing

It is with disappointment reading the failure of governance by the council I was a chairman in those days that was the title of a high school board If the school had a problem which effected the community you had to stand up and take the blame
I do not expect the council elected members to clean mud tanks but when there is failure of this size then the expectation of the community that something is seriously wrong with the governance of the council The glib excuses as regards rise in sea level is the catch cry of the council which you as a member are part of
In my view the council members should of put on gumboots and gone out with the CEO and inspected the mud tanks instead of waiting a year for a report It saddens me to find that people in South Dunedin were not accorded this Instead we had articles written that showed how out of touch the council members were These articles were part of the green PR spin which now blights any decision that this particular council makes All that was needed was clean mud tanks and clear governance by the members of the council not excuses I hope that this is a lesson that you as a council member takes on board when making decisions in the future

A series of emails released by Dunedin city councillor Lee Vandervis show he was raising concerns about the state of Dunedin’s mud-tanks as long ago as 2011. Cr Vandervis said he released the emails because only publicity forced the council to change its ways. “This publicity is going to make sure it really is sorted once and for all this time.” The release of the emails follows a report released by the Dunedin City Council last week into last June’s flood, which found 75% of mud-tanks in South Dunedin were not properly maintained.

Council staff were responsible for not properly overseeing mud-tank maintenance in South Dunedin, not councillors or the mayor, a senior staff member says. Council infrastructure and networks general manager Ruth Stokes started today’s council infrastructure services committee meeting by apologising on behalf of council staff for the failings identified in a report on last June’s flood. Dunedin Mayor Dave Cull and Crs David Benson-Pope and Lee Vandervis were among those who had raised mud-tank performance prior to the South Dunedin floods, and been given incorrect information by staff. “For that I would like to, on behalf of the executive, apologise,” Ms Stokes. The failure was a management failure and not governance one, she said.

Mayor Cull says he is outraged at the failure of Fulton Hogan and council staff to adequately ensure that the mudtanks were in working condition. He should also be outraged at his own poor leadership and failure to respond to developing problems. Under his leadership the city continued to build up a backlog of worn-out stormwater pipes and equipment waiting for funding to be allocated. With this lack of funding we have seen the inevitable result of a deteriorating stormwater system. The poor state of the stormwater system was the primary cause of the severity of the flooding at Kaikorai, Mosgiel and South Dunedin last year.

This under-funding of the stormwater renewals is not an accident. Every year the DCC Mayor and councillors decide and vote on this spending – and every year they vote to under-fund the stormwater renewals because they think that a new stadium and a new swimming pool and more bicycle lanes are more important than a functioning stormwater system. The Annual Plan shows that the under-funding will continue next year. Expect the deterioration to continue.

The red or Flanders poppy has been linked with battlefield deaths since the time of the Great War (1914–18). The plant was one of the first to grow and bloom in the mud and soil of Flanders. People in many countries wear the poppy to remember those who died in war or who still serve.

In New Zealand the poppy is most often worn around Anzac Day. Since 1927 Poppy Day has been marked on the Friday before Anzac Day (unless it falls on a Good Friday).

Anzac Day, 25 April, commemorates all New Zealanders killed in war and also honours returned servicemen and women. Anzac Day was first marked in 1916.

One in the eye for blindness: the free app that thinks it’s an eye doctor

A Kiwi eye specialist has invented a simple tool that turns a smartphone into a diagnostic tool – and now it has won the People’s Choice Award at this year’s Innovators Awards. In early May, ophthalmologist Dr Hong Sheng Chiong released a cunning 3D printable gadget that turns a smartphone into a retinal camera for eye examinations. Twenty four hours later, he woke to 150 emails. Another three days, and there had been more than a thousand downloads of his adapter, the OphthalmicDocs Fundus. It hadn’t cost anyone (except him) a penny.
And that’s just how Hong likes it.
By day, Hong runs the eye clinic at Gisborne Hospital. But in his spare time, he is working towards a wider goal: giving doctors in the third world the tools to detect – and therefore treat – preventable blindness.
The OphthalmicDocs Fundus (OphthalmicDocs is the name of Hong’s company; fundus is a scientific name for the retina) is a 3D printable gadget; basically a small arm which holds a condensing lens at one end and attaches to the camera part of a smartphone at the other. It turns a mobile phone into a retinal camera, which can look into the back of the eye, the most difficult area to view. Combined with the OphthalmicDocs Eye App, free eye-testing software containing tests and imaging, the camera puts a portable eye clinic in the hands of a doctor.
Hong says even eye charts on the wall of a clinic can cost thousands of dollars, so he’s converted all the basic vision tests into a smartphone-friendly app format.
Hong believes he has built the first, free, open-source eye equipment in the world. And that’s just how he likes it too.

Dr Hong Sheng Chiong is currently an eye doctor in Gisborne hospital. He completed his clinical training in Ireland before he crossed over to New Zealand where he initially worked as a registrar in neurosurgery and general surgery before he stepped into the world of eye. His main interests are eye regenerative medicine, bioengineering and telemedicine. His exposure to third world medicine in Kenya, Nepal and Malaysia have given him the insight to the burden of preventable blindness. He believes the problem lies in the access to quality eye care. In 2014, he founded OphthalmicDocs, an R&D company that focuses on the development of ultra mobile and economical eye tests and diagnostics devices. He has invented several eye imaging adapters that can be used in conjunction with a mobile application to diagnose and monitor eye diseases. Fighting preventable blindness is his career’s primary mission.

Tim Flannery: Firing Climate Scientists Breaches the Paris Agreement

Tim Flannery, whose spectacularly wrong advice once helped panic Aussie politicians into wasting billions of dollars on useless desalination plants, now thinks firing CSIRO climate scientists will cause Australia to breach the Paris Climate Agreement.

“Cuts to the CSIRO’s climate modelling and measuring research will breach Australia’s obligations under the recent Paris agreement and will result in huge costs to the economy, a report by Australia’s Climate Council has found.

The report adds to a chorus of eminent bodies and individuals criticising the move, which the CSIRO made after almost no consultation with its own scientists or other research institutions.

Earlier in the month it was revealed CSIRO would be cutting up to 350 staff from climate research programs over two years. Over the following weeks, the organisation’s chief executive Larry Marshall explained that would result in a loss of about 50% of the staff working in climate modelling and measuring.

In a report titled “Flying Blind: Navigating Climate Change without the CSIRO,” the Climate Council said governments and businesses relied on the CSIRO’s climate modelling and measuring work to make billion-dollar decisions and if the cuts went ahead, would be relying on “guesswork”.”

In these days of automated weather stations and satellite temperature monitoring, its a little difficult to understand why you need hundreds of scientists to produce a few climate graphs – especially since parallel efforts are in progress in a number of other countries. Perhaps all the scientists are required, to help think up plausible sounding reasons why the historic rate of warming in Australia should be adjusted upwards.

Planning for South Dunedin in the face of the rising sea level

The floods last year in South Dunedin have provoked discussion as to what are appropriate policies that Dunedin should adopt regarding planning for this area.
Concern that rising sea levels as a result of global warming brings urgency to consider this problem.
The area is low lying and even a modest rise in sea level may make the frequency of flooding a serious problem at some time in the future, possibly to the extent that the area becomes unviable as a residential area. A rise of 300mm may increase the danger of severe flooding to an unacceptable level.
A timely but not precipitate response is required. The cost of the response may be huge in both financial and social costs for the city if a solution such as “a retreat from the sea” is undertaken.

But predictions are predictions, they are not yet actual.

We are fortunate in Dunedin to have an accurate and reliable record of sea level. Indeed the safety record of our port attests to this. This record indicates that the sea level in Dunedin is rising at the rate of 130mm per century. Figure 1 shows the sea level as measured at Port Chalmers taken from the “PSMSL Data Explorer” http://www.psmsl.org/data/obtaining/map.html. And note that there is no observable increase in the rate of rise over time.
At this rate it will be 230 years before a 300mm limit is reached, well beyond our planning horizon, say 2100.

However, claims are made that the rate will greatly increase and so pose a threat that we must consider immediately. But note that in order to reach a 300mm rise before 2100 the rate of sea level rise would have to increase by a factor of 270% above that currently observed.
It would be irresponsible in the extreme to undertake extreme action without carefully examining the validity of the claims.
We must consider if and when a response is required. What reasons do we have to expect such a catastrophic rise?

I address four points as to why I do not consider the predictions of catastrophic sea level rise to be well founded.

Validity of predictions

1) As discussed above, the available sea level data gives no indication of an impending catastrophic sea level rise.

2) Rising sea levels are a claimed consequence of rising temperatures. Thus for the prediction of rising sea levels a precondition is that temperatures should be rising. That this should be so is confidently accorded to by the IPCC. However, reality is not quite so simple.
Figure 2 shows the average temperature as recorded at the Musselburgh Pumping station by NIWA in its CliFlo database. http://cliflo.niwa.co.nz/

Although this is a local measurement and rising sea levels are claimed to be a consequence of rising global temperature, the absence of significant warming and no evidence for any increase in the rate of warming must cast doubt on predictions of imminent catastrophic sea level rise.

3) The track record of predictions regarding climate change does not give rise to confidence in the validity of those predictions.
For instance in 2007 the Australian Climate Commissioner, Tim Flannery, claimed that Sydney was “facing extreme difficulties with water”, in 2008 that: “The water problem is so severe for Adelaide that it may run out of water by early 2009.“ and others regarding an endless Australian drought.
These claims were influential in the decision to construct desalination plants in Australian seaboard cities at a cost of about $10 billion. His predictions have not come true, the drought broke and the plants have not been needed. This expense is probably not a complete waste as the plants do provide insurance against future droughts which are sure to occur.
Other predictions that have been made:
– from the UN in 2005, “50 million climate refugees by 2010”
– from Dr David Viner, of University of East Anglia, who confidently asserted that within a few years winter snowfall will become “a very rare and exciting event”.
– and many others too numerous and many too silly to comment on.
All these predictions have failed to eventuate.
I suggest that we should not take at face value the predictions of claimed experts without corroborating evidence such as trends in the historic record or the success of previous predictions.

4) Sea level rise is largely due to melting of continental ice sheets exceeding their gain from snowfall. This is not an easy measurement to make accurately. It has been assumed that melting exceeds accumulation thus contributing to sea level rise. However, recent satellite measurements by NASA cast this in doubt. In fact they indicate that the opposite is the case.

Conclusion

It is critical that we should have a high degree of confidence in the predictions of sea level rise before committing ourselves to very expensive and socially destructive remedial or mitigation policies.
The issue at hand is not one of the reality or otherwise of global warming, we need make no commitment on that issue before deciding the fate of South Dunedin. The climate has changed over the millennia and will continue to do so. The issue is the making of a timely and appropriate response to its flooding problems.
The points I make above are intended to show that the confidence in alarmist predictions is misplaced and are insufficient in themselves to provide a sound basis for planning.
It is clearly unnecessary to address this problem immediately but continued attention is required so that appropriate actions can be taken if the situation is observed to change.

Fortunately in New Zealand the data relevant for making decisions such as that posed by planning for South Dunedin’s future is publicly available and of high quality. Citizens should avail themselves of this the opportunity of consulting the data themselves to draw their own conclusions rather than rely on second hand interpretations.

Report on South Dunedin infrastructure performance during June 2015 flood released

The report on the South Dunedin infrastructure performance during the June 2015 flood event was released today as part of the agenda for the Infrastructure and Services Committee meeting next week.

The report concludes that while a number of factors contributed, the main factor was the highest 24-hour rainfall total in Musselburgh since 1923.

General Manager Infrastructure and Networks Ruth Stokes says the report outlines the known challenges with managing the South Dunedin catchment and highlights concerns about the performance of mudtanks and the Portobello Road pumping station during the event.

“Changes in the South Dunedin catchment since the stormwater network was designed, combined with operational challenges and high ground water levels, all contributed to the effects of the extreme rainfall event that occurred in June 2015.”

Mrs Stokes says the report shows that mudtanks weren’t maintained as required. As a result, a number of steps, including a full review and retendering of road maintenance contracts have been adopted. Other measures include accurately capturing data on the status of the mudtanks, a redesign of the Portobello Pumping station screen and the development of a communications plan to inform the community of the local infrastructure challenges and how to best plan for future events.

“However, given the volume of rainfall and the system at capacity during the June event, the water would have been unable to enter the network even if all mudtanks were clear.”

She says the DCC must now look at what measures can be taken to mitigate such events in future.

The DCC will soon be engaging with the community about these issues and what the long term responses might be.

Readers, tonight’s exposition is to examine the Dunedin City Council (DCC) worldview that does not contemplate a sale of Delta at less than $45M. Your correspondent says that will never happen on any rational economic basis, so the next best thing is to pretend that it would not be in the ratepayers’ best interests to sell at all, seemingly at any price.

However, annoyingly, logic and reasons must intrude at some point, and in the recent report on DCHL asset values, the DCC have a crack at pushing the Delta water uphill.

Item 22 Dunedin City Council Investments and Returns (pp 109 – 123)

Tonight, readers, we shall dwell on and allow the TWO big “strategic reasons”, the DCC propose to retain Delta, to stand in splendid isolation, while readers allow the cool chill of logic to bring these clouds of hot air back to reality.

We shall also overlay some markers over Delta’s financial figures that give support to your correspondent’s contention that Delta is at risk. (careful words needed here, readers !)

Safely camouflaged at para 55 (page 117), deep in the DCC report, the following statements appear : “If Delta were to be sold by the DCC, one likely outcome…. [it could be] purchased by a competing company in the same field. One consideration…. is the potential ‘head office’ job loss to Dunedin if Delta were to be sold to an existing company which is not locally owned.”

Stop right there, readers. The DCC say the first, most important consideration in retaining Delta is to retain the Delta ‘head office jobs’ in Dunedin. At one level we can take this to mean that the DCC are very fearful that the current occupiers of the Delta head office jobs in question would not find similar work in Dunedin. Your correspondent thinks that is a very well-founded fear. But the DCC head of economic development tells us the city is growing and it is hard to attract executive staff to the city…. it is a taxing puzzle why the authors of the report ignore their own staff…. At the next level, your correspondent is vexed at the concern shown by the DCC for the six figure inhabitants of the Delta Head Office suite. (Note, there are 70 people earning in excess of $100,000 at Delta, your correspondent guesses that the Head Office inhabitants occupy the highest echelons of those salaries). This brings a whole new meaning to the (draft) Statement of Intent requirement to be a “socially responsible …. corporate citizen”. At a higher level again, the DCC appear to say that the welfare and future of the head office positions rank ahead of the core task of providing returns to the ratepayers.

Readers, remember that DCC provide these reasons as reasons not to sell Delta even if someone paid the massive premium of 300-400% over the $15.804M shareholders equity (which is about to suffer a severe Noble induced virus).

Your correspondent is very sure these revolutionary themes of Soviet Style central planning and corporate welfarism were not intended in the Delta ‘Statement of Intent’ which is meant regulate how the company is run.

Next up as the DCC apologia for retaining Delta is the statement, “the loss of Delta from the local contracting market, particularly if through acquisition from an existing contractor, would remove an element of competition from an already limited local market”.

This is illogical. Let us count the ways:

1. If competition is “limited” then margins will be high, and demand for skilled staff intense, so any logical purchaser would leave the Delta structure alone to continue its high margin work…. but of course, if there is limited competition and Delta are not making good profits, then there is a problem…. and Delta should be sold to an entity that can generate good profits in a limited market.

2. It can be safely assumed that Delta’s local competitors Fulton Hogan, Downer, SouthRoads, Whitestone, Asplundh, Waste Management, and any of the local power contracting companies are not stupid and they would have no interest in paying the DCC $45-60M for $15.804M of equity (on a good day). If Delta expired, the limited competition just got less, and paydays all round for all left standing. Your correspondent says then that any purchaser is likely to be someone who does not have a presence in the market, and sees potential for profit in this market, allegedly with limited competition. If that were true they would leave Delta as it was, maybe even with some of its precious head office jobs, to continue their (merry and profitable ?) way. (For the time being at least).

3. The bottom line is your correspondent posits that Delta will never be sold in its current form, because its competitors know, even if DCC Treasury does not, that Banks have certain standards for lending money to companies, and an important one is the debt to equity ratio. Delta has $26.9M of debt and $15.804M of equity. That is a debt : equity ratio of 183 % which this correspondent says is far too high for a contracting company. A debt : equity of 100 % or less is usual in this sector. Another is the Liquidity (Quick) Ratio which is Current Assets / Current Liabilities. Contractors should have a minimum of 1.35 and many accountants would say 2. (What would Mr McLauchlan say ….?). Delta has $17.5M of current liabilities and just $220,000 of cash in the bank. This is one seriously undercapitalised contracting company.

Delta will no doubt say their quick ratio is fine because the accounts show $25.244M in receivables, but this includes the very non-current and very illiquid Noble debt of $13.2M. They do have $2.84M of Work In Progress (WIP) which is included under inventories. They then have proper current assets of $0.22M cash, $2.84M WIP, and $12.2M Receivables, ($25.24-13.2M) for a total of $15.08M and a quick ratio of 0.88. The bottom line is : even putting aside the elephantine $26.9M in debt, Delta have serious cash flow issues with a quick ratio of less than 1, and if they have a further problem contract, or even just a delay of a month or two getting paid on a larger contract, they are not just on a cashflow knife edge, but in serious trouble. Delta has basically no cash reserves as at June 2015. Of course, Mr Cameron did not dwell on that factoid in his report….

Readers, the quality of the excuses made in support of retaining Delta are of the same quality as the prediction of its value at $45-60M.

Delta #EpicFail Noble Subdivision : Avanti Finance —Feeding at the Delta Trough

Readers may remember that in an earlier post, ‘Gold Band Finance – The Little Finance Company that did (Delta)’ March 2016 – your correspondent was lacking information on what transpired between Avanti Finance and Delta.

Your correspondent indulged in some dark speculations about what Delta might or might not have done. But recently your correspondent has received email information shining a light on that transaction, a welcome piece of disinfectant as Justice Brandeis would say. While we no longer see through a glass darkly on this matter, the disinfectant metaphor is apt, as yet again, Delta suffers another grievous and substantial financial wound, this time, a deliberate and self-inflicted one. It seems that in order to save or salvage something from the Noble debacle, it is first necessary to destroy the Delta financial reserves.

The conversation must have gone like this : “Dear Avanti, you have gate-crashed our game of Monopoly and you have further erred in somehow gaining a piece of the Noble subdivision that we simply must have ! Poor form, poor form indeed. Now chaps, we can do this the easy way or the hard way ! There is no way in this whole wide world we are prepared to pay you the 37 % per annum interest rate that your friends at Gold Band are charging on their part of the mortgage…. That was then, and this is now !! Take it or leave it, our offer is…. not a penny more than…. 34.50 % !!”

Yes readers, Delta in March 2015, paid Avanti $2.19M for its interest in the Noble Investments (NIL) first mortgage. Avanti had paid Gold Band $1.5M for the same interest just 16 months before in November 2013. A gain of $690,000, or 34.50 % per year. Let’s see, only 350 times the rate of inflation. Avanti made out like a bandit, but then, they are a finance company…. and Delta are, well, Delta.

Delta CEO Mr Cameron confirmed that Delta spent $3.3M “strengthening its position”. We now know how that went : $1.2M to Gold Band, $2.19M to Avanti, which all pans out, taking into account a rounding error.
What we do not know is the timing of the $3.3M, but that is not a central issue at the minute.

Readers should bear in mind that if the situation is resolved by June 2016, then the first mortgage of $1.75M lent by Gold Band around 2004, could have spawned the amazing sum of $11.8M, and at least $9.1M. Gold Band and Cup Investments (CIL) will have lent out $1.75M and received $3.1M plus $2.7M received from Avanti and Delta. That is a total of $5.8M. Huge. Delta have paid $3.3M for a part security and if they are charging around the same interest as the others, then their figure will be around $5.5-6M. That is, the first mortgage securities of Gold Band and Delta will consume the first $10M of the mortgagee sale. Not looking good for Delta’s core debt of $11.35M of lower ranked securities….

Perhaps then the Otago Daily Times might sense that Delta paying $1M plus over the face value to Gold Band and Avanti for part of a first mortgage in an attempt to get a better recovery on their lower ranked securities is News, and not in a good way. Heaven knows they could do with some – Building Consent Delays on the front page – Good Lord what next ! more cat pictures ?

Your correspondent can’t wait to read the emails around that board decision…. when the Auditor-General releases them. Will there be another email from a Delta Director stating in effect “if the subcommittee agrees then I agree with them?” (As there was for the ill-fated decision to proceed with Luggate).

Next we shall look at the “Strategic” reasons the DCC put forward as compelling reasons for retaining Delta in its report…. Irony and comedy abound….

Online voting in council elections will not go ahead later this year because of fears the system isn’t yet secure enough. Eight councils had planned to trial online voting in October’s local body ballot, but Associate Minister of Local Government Louise Upston has pulled the plug. Four months out, planned security tests had not yet been carried out, she said on Tuesday.

“Without seeing the results of testing we cannot be confident the systems are secure enough, and the trial could not be authorised.”

Public confidence in local elections was fundamentally important and given real concerns about security and vote integrity, it was too early for a trial, she said. She said councils had done a lot of work and would be disappointed, but maintaining public confidence and understanding was more important. Online voting could be trialled in 2019 but there was still much to learn about it, Ms Upston said. Selwyn, Wellington, Porirua, Masterton, Rotorua, Matamata-Piako, Palmerston North and Whanganui councils had all expressed interest in taking part in the trial.

Online voting not on the cards this year

The Government has pulled the pin on a trial of online voting in this year’s local body elections, saying it could not guarantee the security of the system in time. Internal Affairs Minister Louise Upston announced the plan for some councils to trial online voting would not go ahead because time was running out for councils to prove voting system addressed concerns about security and vote integrity.
“Due to timing restrictions, preparations for the proposed trial have not yet met the legislative requirements and cannot guarantee public confidence in the election results.” She said security testing was planned but had not yet taken place. “Without seeing the results of testing we cannot be confident the systems are secure enough and the trial could not be authorised.”
While local bodies are responsible for running their own elections, including deciding on a voting system and method, the Government has to decide whether new voting methods meet the requirements of the Local Electoral Act. All councils currently use postal voting.

Delta #EpicFail : What is Delta Worth ? $10.5M or $52.5M ? (Murray & Co)

Your correspondent was ruminating about the DCC over a cup of Choysa last week, and was in need of some light relief, so he had a quick read of the latest DCC “report” – (I use the term in the loosest possible sense) about the efficacy of its DCHL assets, including of course, Delta. Your correspondent urges readers with a taste for comedy and irony to read it. It will not disappoint.

The report starts by explaining why a holding company structure was set up in 1994. It was to “operate commercially”, the major benefit of which is helpfully explained as the interest can be tax deductible under a company structure whereas as a DCC entity it cannot. Let’s just think about this in light of the recent fuss about offshore trusts and tax planning : Accountants call it tax efficient, or tax minimisation. Some, including the Government might consider it a form of tax avoidance, particularly when the Owner of those companies constantly has its hand out to central government begging poverty, seeking handouts for capital projects. ($15M for the Stadium, $5M for Otago Settlers Museum, etc).

The humour starts when the report nonchalantly notes that Delta is valued using the current ($13.8M) asset valuation for the elderly Noble debt. In its words there is no allowance for any “additional impairment” – spot the careful euphemism, or excitingly, “any increase in value” : Yes readers, they actually wrote that. There is a useful biblical precedent to this statement in Luke 6:39. Readers’ homework is to look this up….

Delta is valued at “$45-60M”, but this clearly alarmed at least one of the DCHL Directors, Mr Keith Cooper, who as CEO of Silver Fern Farms has recent extensive experience trying to merge or flog off basket (brisket?!) cases to foreigners. Mr Cooper hurriedly said that “a lot of preparation” would be needed to get Delta ready for sale at anywhere near that figure. Your correspondent thinks that preparation would actually be a very good idea.

Getting Delta “prepared for sale” would require some clarity around the costs and revenues of each of its business activities, and each of its major contracts, not just aggregating everything as per the current annual reports.

However, your correspondent believes that level of detail won’t ever be revealed, for a reason which readers should be aware, and that is your correspondent has been advised by former Delta staff that Delta is propped up by its sweetheart contracts with Aurora, and they are the reason that Delta survives and makes a profit. Most of its other activities are awash in a sea of red ink.

Of course, if this is not true, then some detailed information can be released to show that your correspondent is barking up the wrong tree here. Now, is that likely to happen ?

Naturally, Christchurch-based merchant bankers Murray & Co did not provide detail about how the $45-60M valuation figure was arrived at.

What we know from previous Delta posts (Some Forensics, 30.1.16) is that Delta has shareholders’ equity of $15.804M. This is the difference between the alleged $59.705M in assets and the staggering $43.901M in liabilities, which includes $26.49M in term debt. The key factoid : average Delta net profit over the 5 year period 2011-2015 was $2.636M. It is not forecast to pay a dividend for the next three years. Remember, this includes the proceeds from the sweetheart Aurora contracts which are unlikely to be so generous if owned by a private non DCC entity. In 2015 Delta completed $35.4M, fully one third their turnover, on Aurora work.

Now, your correspondent has had a bit to do with valuing companies for sale. A contracting company such as this would sell for an average P/E (Price Earnings ratio) of between 3-5, over a 3-5 year period. With the 5 year $2.636M average net profit, and using a P/E of 4, that gives a value of $10.54M. That is a long, long way from $52.5M, the value DCC and Murray & Co say it is worth.

There is a case to be made that net profit before impairments should be used, but this will not get to anywhere near the $52.5M. On that basis the 5 year net profit would be $4.59M, which at a P/E of 4 gives a nominal value of $18.38M. Your correspondent says this is too much, no one is going to pay many millions over and above net asset backing for goodwill for an “impaired” contracting company.

Readers, who is right ? A tea drinking blogger, with an interest in the facts, or Ms Bidrose and Mr McKenzie, signatories to the report, assisted by Murray & Co ?

Your correspondent can hear the readers’ lament already – CD is a numbskull ! –what about the $15.804M in equity –it has to be worth at least that much !!

Sadly readers, as outlined in the earlier forensics post, it is my prediction that the $15.804M equity will be written down to $5-8M and quite likely less, when the Noble Debacle is finally dissolved, and the actual loss known.

The Owner of Delta is going to have to pump millions in to recapitalise Delta, otherwise it is a dead company walking – towards extinction.

Your correspondent says it is a feat of extreme positive thinking to get to a value of $52.5M, the figure used in the report. Edward de Bono would be proud. Murray & Co probably bend spoons as a warm up exercise.

This correspondent is incredulous that this figure saw the light of day. Your correspondent says it is completely unsupported by the facts.

WHY ALL CENTRAL PLANNING IS DOOMED TO FAIL

We’re still thinking about how so many smart people came to believe things that aren’t true.

They believe they can manipulate the future and make it better. Not just for themselves… but also for everyone else.

Where did such a silly idea come from?

After the Renaissance, Aristotelian logic came to dominate Western thought. It was essentially a forerunner of positivism – which is supposedly based on objective conditions and scientific reasoning.

“Give me the facts,” says the positivist, confidently.

“Let me apply my rational brain to them. I will come up with a solution!”

BEYOND THE HERALD’S CRY

This is fine, if you are building the Eiffel Tower or organising the next church supper.

But positivism falls apart when it is applied to schemes that go beyond the reach of the “herald’s cry”.

That’s what Aristotle said: Only a small community would work. Because only in a small community would all the people share more or less the same information and interests.

In a large community, you can’t know things in the same direct, personal way. You have no idea who made your sausage or what they put in it. You have to rely on “facts” that are no longer verifiable by direct observation or personal acquaintance.

So it’s hard for people to work together in the same way.

In a large community, central planners’ “facts” are nothing more than statistical mush, wishful thinking, and theoretical claptrap – like WMD, GDP, the unemployment rate, and the Übermensch.

Large-scale planning fails because the facts upon which it is built are always unreliable and often completely bogus.

It fails also because people don’t really want it.

HIDDEN AGENDA

In a small community, the planners and the people they are planning for are close enough to share the same goals.

But in a large community, the planners are a small minority.

And in a large community, the planners usually have their own agenda… often a hidden one.

They call for stricter law enforcement… while getting campaign contributions from the prison industry. They seek a cure for cancer… and depend on the pharmaceutical industry for job offers. They promote a united Europe… and hope to be its head man.

Large-scale planning provides almost countless opportunities for corruption. But it’s not the dirty dealing that dooms it. It is that the planners don’t know (or care) what people really want… and don’t have the means or the information necessary to achieve it anyway.

Following receipt of the newspaper clipping, I dredged family files. My great-great-grandfather [unnamed for privacy reasons], then in business at Maclaggan Street, was one of the signatories. He went on to prominently support, with other Dunedin businessmen, the provincial and national development aims, and political aspirations of the indefatigable Julius Vogel.

The Otago Daily Times was founded by W.H. Cutten and Julius (later Sir Julius) Vogel during the boom following the discovery of gold at the Tuapeka, the first of the Otago goldrushes. “Vogel had an elevated idea of the role of the press, believing it had the power to create public opinion. He took a strong, positive line on all the current major issues and used the Times to promote his own views and political career. He appointed a number of reporters, such as Edward Gillon, William Harrison and Ebenezer Fox, who later had notable careers in journalism, politics and the civil service.”

Life after politics Vogel has a reputation as the first New Zealander to write a science-fiction novel: Anno Domini 2000, or, Woman’s Destiny, published in 1889. It anticipated a utopian world where women held many positions of authority. New Zealand went on to become the first country to give women the vote, and, from 1997-2008, continuously had a female Prime Minister, while for a short period (2005–2006) women simultaneously held all five highest government positions (Monarch, Governor-General, Prime Minister, Speaker of the House and Chief Justice). In honour of this book, the Sir Julius Vogel Awards for New Zealand speculative fiction take their name from him.

Commission announces decision on representation arrangements for Dunedin City Council

The Local Government Commission today announced its decision on the Dunedin City Council’s membership and ward arrangements for the 2016 local elections.

The Council had proposed that:
• The council be elected at large (rather than from wards)
• The number of councillors remain at 14
• The boundaries of the Chalmers, Otago Peninsula, Saddle Hill and Waikouaiti Coast Community Boards be altered by transferring two areas between communities and excluding other areas from communities altogether
• A Rural Taieri Community Board be established comprising the Strath Taieri Community Board’s area and the rural part of the Mosgiel-Taieri Community Board’s area

There were 16 appeals against the Council’s proposal.

After hearing from the Council and the appellants the Commission has decided to:
• uphold the Council’s proposal for the Council to be elected at large
• retain the existing community board system (apart from renaming the Chalmers Community Board as the West Harbour Community Board and two boundary alterations).

The boundary alterations are the transfer of an area above Sawyers Bay from Waikouaiti Coast Community to West Harbour Community and the transfer of Quarantine Island from West Harbour Community to Otago Peninsula Community.

The Council’s representation arrangements for the 2016 local elections will therefore be as follows:
• A Mayor and 14 councillors elected from the City as a whole
• Six community boards as follows:

Strath Taieri Community Board
Waikouaiti Coast Community Board
Mosgiel-Taieri Community Board
Saddle Hill Community Board
West Harbour Community Board
Otago Peninsula Community Board

• Each community board will have six members and one councillor appointed to the board by the Council

Summary of the Representation Review process

Councils are required by law to undertake a representation review every six years. The following is a brief outline of the process:

• The Council makes its proposal
• The Council invites submissions on its proposal
• The Council considers submissions and makes a final proposal
• People can object to or appeal against the proposal to the Local Government Commission
• The Commission may hold an appeals hearing
• The Commission makes and releases its Determination
