New horse dung rule pleases, riles

Horse droppings must be cleaned from Dunedin tracks by riders but they can remain on footpaths and roads, a new bylaw states. A community board head says the new rules are a “step in the right direction”, but a horseman reckons the bylaw is “ridiculous”. Dunedin City Council recreation and planning facilities manager…said under the recently adopted Reserves and Beaches Bylaw, horse owners were expected to remove horse droppings from  or near access tracks as a courtesy to other users. The bylaw allowed for enforcement, [they] said. […] Council transport group manager Richard Saunders said  under the council’s Roading Bylaw owners were not required to clean up if their horse left droppings on a public road or footpath. The council received few complaints about the issue, he said. […] Horseman Keith Roberts (69), of Berwick, said he had ridden around New Zealand four times on his horse Zara and had never picked up her droppings. The bylaw would not change his behaviour, he said. “Never.”

ODT updates mayoral vehicle serious injury crash information

The wife of Dunedin Mayor Dave Cull is slowly recovering after being seriously injured in a crash which wrecked a new mayoral car. Joan Wilson was driving a 2016 Hyundai Santa Fe when she crashed near Roxburgh in late December. Documents obtained under the Local Government Official Information and Meetings Act (LGOIMA) by blog “What if? Dunedin” reveal the $55,659 vehicle had been in use for just five days before the crash. In a statement to the Otago Daily Times Mr Cull said his wife sustained “serious injuries” in the crash. “Joan was the sole occupant in the vehicle. Fortunately, she is making a gradual recovery and I would like to take this opportunity to thank the emergency services and members of the public who provided assistance at the scene,” Mr Cull said. The accident was a “private matter” and no further comment would be made, Mr Cull said. […] Mrs Wilson was an authorised driver. Insurers had not identified the cause of the accident, and no other vehicles were involved.

Postscript
The driver of the 2016 Hyundai Santa Fe is understood to have fallen asleep at the wheel resulting in the serious injury road crash as reported; their spouse was said to have been following in another vehicle at the time of the crash.

Yes. It is owned by DCC

2. What are the terms and conditions of the Mayor’s use of this vehicle? (including DCC insurance cover in regards to who may drive the vehicle and for what purpose(s) to retain the cover)
The Mayor pays for full private use of the vehicle as per the determination set out by the independent Remuneration Authority. The insurance cover for the mayoral vehicle is as for all other fleet vehicles. Any authorised driver is covered.

3. What is the make, model, colour, year and registration of the mayoral vehicle? Please state for all vehicles designated for mayoral use in the period October 2010 to April 2017, if any.
Please see the attached spreadsheet. I have not provided registration plate details and these are withheld to protect the privacy of natural persons pursuant to section 7(2)(a) of LGOIMA.

4. What has been the annual mileage clocked for the mayoral vehicle on official business in the period October 2010 to April 2017?
Annual mileage is not recorded and so the information requested does not exist.

5. Does the mayor also retain the vehicle for his own casual use when not on official business? If so, is this mileage logged separately and what has been that annual mileage clocked in the period October 2010 to April 2017? Or please supply the annual mileage clocked for all use of the vehicle in the period October 2010 to April 2017?

The vehicle is able to be driven by any authorised driver.

No mileage records are held.

Yes. A Hyundai Santa Fe was written off in Jan 2017 following an accident involving serious injury near Roxburgh.

Refer to the attached spreadsheet. DCC received a full insurance pay-out.

12. Further to 3. above, please confirm the make, model, colour, year and registration number of the present mayoral vehicle and its date of purchase or commencement of lease by DCC. Please respond by email within 20 working days. Thanks.

WE have the information, unreasonable delay providing it #LGOIMA

Contrary to DCC Bylaw 23 no camping restriction applied over summer

DCC’s delay in providing official information on freedom camping numbers (Which Is Available) appears to equate with what happened over LGOIMA requests lodged after the South Dunedin Flood of June 2015. Delay, derferment, and obfuscation occurred then as now. There is no reason to believe anything has changed internally, magnified by today’s ‘official response’.

DCC now has a laborious text response as first acknowledgement of the LGOIMA requests it receives. An associate has been working on improvements to the below on suggestion back to the system. The short information request is highlighted by whatifdunedin:

New information request – Warrington Domain

I have been informed that DCC recently ran a survey of the freedom campers at Warrington Domain, asking (in no particular order here):

1. where they were from
2. their age
3. how much they were spending
4. what activities they were doing in Dunedin, and
5. what type of vehicle they were in.

I’m told the survey ran for two weeks; and that it was conducted by Ashley Reid.

I request a full copy of the survey results (with names of campers redacted for privacy), to be received by email at earliest convenience.

I note hearings for the Proposed Reserves and Beaches Bylaw will be held this week. Prompt receipt of the survey information would be enabling. Thanks.

Points:

1. The Reserves and Beaches Bylaw review that had hearings this week did not include a review of freedom camping; freedom camping is specifically excluded from this bylaw review. The freedom camping bylaw review is heralded to take place in about a month’s time.

2. The point numbering error in the response of 13 March above is the DCC’s.

3. The running foot, or footer, italicised in red (“Dance like no one is watching; Email like it may one day be read aloud in a deposition.”) in the redacted screenshot above, has been raised with senior staff this afternoon and has since been sorted.

4. The LGOIMA response received today must be seen in light of a response to another request I made for information about Warrington Domain lodged on 22.1.17 [ref no. 570874]:

The Dunedin City Council bylaw allows freedom campers to stay a maximum of two nights in Dunedin on any council-owned gravelled or sealed land set aside for parking, except in cemeteries, scenic reserves and some prohibited zones on Otago Peninsula, as long as the vehicle was self-contained with a toilet, grey waste and waste capacity for three days.

Limited spaces for non-self-contained vehicles are available at Warrington Domain and in the car park at Ocean View Reserve.

The latest salvo came after Cr Lee Vandervis made public an email exchange with Crs Benson-Pope and Richard Thomson, copied to other councillors and staff, earlier this week.

Cr Vandervis did not respond to ODT requests for comment yesterday.

In his emails, published online, he blamed a lack of information coming from council staff for the “tedious” need to resort to Information Act requests.

Mick, the investigation brief to Deloitte, as weak as it was, was not limited to Citifleet. Of course Citifleet was the main focus, but the opportunity was given to carry out a general stocktake of DCC internal practices. Many of the internal interviews conducted had no relationship to Citifleet. Bad practices within other departments were identified with the help of staff, and recommendations given. As you say, the value of the report will be in how effectively the recommendations are enforced.

Terribly unfair. How will current Assistant department managers be able to get cheap maintenance from DCC contractors on their home air conditioning systems cheaply installed by DCC contractors now ? Or get their kitchen remodelled for half of the market rate ? How are these highly valued public servants supposed to survive if they have to live like normal people ?

I remember a few years ago when a (former) department manager telephoned all the contractors and asked them not to send Christmas gifts into the DCC offices. He offered instead to drive out to each contractor (presumably in a DCC fleet car) and collect the gifts himself. That’s going the extra mile.

Still on the list are the remainder of the senior staff who have been identified by Deloitte as being involved in serious and ongoing conflict of interest business dealings. Awarding uncontested contracts to family members with no internal checking, identifying a need for specialist equipment or services within their DCC department, buying the equipment/services privately, and then hiring it back to their own department. Most of the managers identified to date are long term managers with 20 years in the role. It seems that the younger staff elevated to management roles have a higher professional integrity level than their elder colleagues. I suspect a few more early retirements are on the horizon.

I’m more impressed (or depressed) by the revelation that there are 43 current DCC staff members who earn in excess of $100k a year. Given that there are nowhere near 43 departments within DCC (more like half that number) that means that ridiculous salaries are not merely confined to heads of departments.

Cars, the number of vehicles actually required by DCC is being included in the process. Specifically mentioned in the internal memo released to staff by the CEO today was the private use of DCC vehicles by staff, which is a positive and overdue move. DCC assets are no longer available for direct purchase by staff or elected officials. Any and all potential conflicts of interest are now required to be formally registered. I think that Sue Bidrose is handling this as well as anyone faced with such a situation could. She could not have foreseen this mess. It was interesting in discussions last night that one of the few people within the organisation who spanned the entire fraud period, which pre dates Brent Bachop, was Athol. How did he miss this, given that he had the finance portfolio the whole time ? Not suggesting that Athol is involved but when you are talking about $1.5m, the buck has to stop somewhere.

Well there’s an interesting development. In 2006, former DCC Group Manager, Grant Strang, buys a 1996 Hyundai Sonata for $2,500 from City Fleet. Hands a “Non Negotiable” stamped cheque to DCC Finance Department for said amount, and receives a receipt.

I have a couple problems with this story. In 2006 I was also working at the DCC. I was employed in a managerial role in the Civic Centre building although, to be fair, not at the level that Grant Strang was employed. But enough to see a few things. In 2006, Grant Strang ordered a $5,000 office chair for his room. I know this because I was shown the receipt by the 2 staff members who took delivery of the chair. I even took a spin in it. If you see a $5,000 office chair, you simply have to know what it feels like. Feels pretty good, I have to say. Anyway, the same man who thought he deserved a $5,000 chair, thought it was a good idea to buy a 10 year old Hyundai. Not knocking Hyundais, but sound like the same person ? We’ll get back to that.

As I said, I worked in the Civic Centre building in 2006. In the course of my duties, I had cause to be in the City Fleet garage about 4 times a week. For a few years either side of 2006. Most often I was there to make use of a City Fleet vehicle. Pretty uneventful stuff like going grocery shopping, taking the dog to the vet, picking up kids from school. Typical car pool activities. But one observation from that time bugged me today. Bugged me enough to contact a few of my former DCC colleagues. We all came to the same conclusion. In all our trips out in City Fleet vehicles, over all our years combined, not one of us could recall ever driving a fleet vehicle that was 10 years old. We struggled, in fact, to think of an instance when we drove a fleet vehicle that was more than 5 years old. How many companies find it economical to have 10 year old cars in their fleets ? Especially a company with the discount buying power like DCC. Sure, we had driven Hyundais, but they were all new models. We could only come up with one Sonata during that period and that was a car which, for some weird reason, was especially reserved for use only by one Rodney Bryant. We won’t get into that one.

The cheque. First up, how many people write cheques in this age of electronic bank transfers ? To the same company that you work for. In the same building. Grant Strang’s office was on the second floor of the Civic Centre building in 2006. Finance lived on the third floor. According to Grant Strang, he walked up one flight of stairs and delivered them a cheque for $2,500. He was so worried about the 15 metre internal journey, and so mistrusting of the staff in the Finance Department of the same company in which he was a senior manager, that he felt the need to cross the cheque as Non Negotiable. Seriously ? I worked probably 50m away from Finance and I knew them all by first name.

Now, I have no doubt that Grant Strang wrote a cheque for $2,500 and gave it to DCC Finance Department. And I have no doubt that he received a receipt for that $2,500 as the payment for a 1996 Hyundai Sonata. I’m sure that the financial paperwork is very clean and deliberate. My question is, what car did he drive away in that day ?

I’m trying to get my head around the numbers as well. I’m assuming that the Citifleet stocks include for the likes of the Water Dept, Library buses etc. From memory there are about 300 people working in the Civic Centre, so 200 vehicles is a hell of a lot to service just the Civic Centre. Some vehicles were permanently reserved for particular people, but even so.

The issue of “take home” vehicles has always annoyed me. The Chief Building Inspector does not need to take a DCC car home every night. He is not on the roster for after hours call-outs. Neither is the head of the Environmental Health department. On the subject of call-outs themselves, I would say that 80% of those who work in the Civic Centre live no more than a 10 to 15 minute drive from their home. Should they be required to attend something out of hours, it is not unreasonable to expect them to drive their own car to the Civic Centre, park it in the Civic Centre garage, and then take out a DCC car. It’s not a Health and Safety issue as they use private transport to get to their place of work every day. There is absolutely no reason why the car pool needs to get emptied out at 5pm every evening. Part of the problem, I believe, is that the majority of vehicles are unmarked. People would be far less likely to park up in the Countdown carpark on a Saturday evening if there was a thumping great DCC logo painted on the side.

If Paul Orders is hunting for more suggestions, he can take a look at the ridiculous “retention” money being paid to lower and middle DCC managers over and above their listed salary. Bumping up the gross income to between 30 and 50% higher than the salary listed for them. No staff member in the DCC is that indispensable. Likewise to the staff members receiving 105% of their graded salary, year after year, supposedly reserved for a “one off action”. This practice has been going on for so long now that staff are expecting it as a right.

Speaking of DCC and transport, I heard a big grizzle from inside the hallowed halls a couple of days ago. Paul Orders’ latest economy drive (pardon the pun) effort has been to put the brakes (another goody) on the practice of staff routinely taking home DCC cars at night. Good on you, Paul, and not a day too soon. A bouquet from me. This blatant abuse used to annoy the hell out of me. 50 cars in the DCC car pool that would disappear at 5pm every evening. You would get mowed down if you dared walk in front of the garage driveway at 30 seconds past 5pm. The majority of cars are now unmarked (big mistake), removing the ability to monitor private usage of publicly funded vehicles. They should all be marked. The only area potentially requiring stealth is noise control, and that’s carried out by private contractors (in their own MARKED vehicles, I might add). There is no reason why staff members need to take DCC cars home at night and weekends. 99.9% of the staff are not on a 24 hour callout. Of those who might be called out (once every 6 months), the majority live no more than 15 minutes from the DCC garage. They can easily drive to the Octagon and collect a DCC car if they need. The Chief Building Inspector does not need a DCC 4wd car parked up in his Wakari driveway every night. No one from the I.T. department should be driving to and from Fairfield to work in a DCC car. City Property staff do not need free undercover carparks 2 minutes from the Octagon. Rodney Bryant did not need a dedicated unmarked DCC car which no other staff member was allowed to use (although that may have been a passive smoking Health and Safety issue to protect the rest of the staff). My alltime favourite was the Environmental Health Officer who used to schedule his restaurant inspections for 8am every day (every day), so that he would “have” to take a DCC car home the night before. It’s childish behaviour and good on the CEO for doing what these supposed professionals should have had the decency to do themselves.

Then too, think of all the people who had access to the Deloitte reports (plural) – more specifically those without access to the digitised data report. That ‘narrows’ the field of leaks to Deloitte itself, NZ Police, private investigators, counsel, privileged council staff, privileged mayor and (some) councillors, those council staff whose lawyers worked on their ‘resignations’ / exit packages….
Who else? A veritable feast.

Tony Avery is “somebody’s” pet #gigatown lapdog

Tony Avery 3 Infrastructure and Networks General Manager Tony Avery resigned from Dunedin City Council on 28 August 2014, falling on his sword as a result of the Citifleet/Citipark fraud —something, the Council conveniently brushes under its carpet with ALL BLAME politically attaching (for insurance purposes) to the deceased former Citifleet manager Brent Bachop. Other council staff were clearly involved; one person alone does not dispose of 152+ cars, and related council assets. So Mr Avery, WENT…. But not really.
With all the scandal and corruption appearing, the Council supportively, extended “help” and salary repeatedly to Mr Avery, after initial news that he would work through to Christmas. Then, on Saturday 31 January the Council revealed that: “He would continue working fulltime, assisting [Ruth] Stokes and helping with the transition on key projects, until March 31, [Sue] Bidrose said.” (ODT 1.2.15).

Ruth Stokes has been appointed to the position of Infrastructure and Networks General Manager. She brings with her experience in senior policy development, planning and project management and has worked in both the public and private sectors. DCC Chief Executive Dr Sue Bidrose says she’s very pleased to announce Mrs Stokes appointment. “Ruth is a successful general manager with a financial background, strong public service values and a reputation for delivering. Her mix of skills will be an asset to the DCC.”

Mrs Stokes will take on the responsibilities of departing General Manager Tony Avery.

Mrs Stokes is the General Manager Operations for the Queenstown Lakes District Council (QLDC). She has been in that role for the past 16 months and Chief Executive Lakes Leisure (a council controlled organisation) prior to that. Before moving to Queenstown she worked at Auckland Council, Westpac and KPMG in various roles. She holds a Bachelor of Commerce from the University of Auckland and a Post Graduate Certificate in public management from Victoria University of Wellington. Mrs Stokes has a background in infrastructure planning, development, recreation, parks, and aquatics.

“The way these assets and facilities are managed often make a major difference to the perception of a city. I think the job is a terrific opportunity to work as part of Council’s leadership team to help Dunedin become the great small city it strives to be.”

She has enjoyed her time in Queenstown, and will stay in touch with her friends and colleagues. “But I am really looking forward to moving to Dunedin and experiencing the advantages the city has to offer. I am keen to meet the DCC leadership team, the Councillors, the stakeholders and the staff. Vandervis: Deloitte and Police Citifleet investigations

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

An hour and a half spent with Detective Matthew Preece and another Policeman called Regan has left me with deep concerns regarding the Police Citifleet investigation.
Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Can you please also now with urgency, forward to me all instructions to Deloitte regarding the Citifleet investigation as previously requested in my email of 26/10/14 as below.

Is it possible to meet with you at any time tomorrow at your convenience to learn whether you have broadened the DCC Police complaint or not?

I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are required.

A Dunedin city councillor says the council should have investigated its fraught Citifleet unit three years ago, when he expressed concerns that it shut out firms like car auctioneer Turners. Lee Vandervis said that in 2011 he alerted council chief executive of the time Paul Orders that the Dunedin branch of Turners was consistently shut out of contracts it sought, mainly for the disposal of used cars. The city council said in June this year it was investigating practices within its vehicle fleet unit Citifleet.
Unit team leader Brent Bachop had died suddenly in late May. His death has been referred to the coroner.
A subsequent Deloitte investigation, commissioned by the council, unravelled a vast network of alleged fraudulent activity, some with selected car dealers and other individuals, over 11 years, equating to more than a million dollars in lost council revenue. Some of the activity involved profits from the disposal of second hand Citifleet vehicles allegedly being pocketed instead of being paid into council coffers.
Vandervis said he was concerned about Bachop’s business dealings when he was told by Turners and other Dunedin businesses they were having difficulty even engaging with Citifleet. He began pressing Orders on the issue and made a raft of requests for information around Citifleet. Vandervis suggested Orders meet the manager “to attempt to normalise a Turners/DCC business relationship”. Vandervis said Turners’ staff had expressed “long and on-going frustration at trying to deal with Citifleet vehicle disposals”.

Message: In discussions with Sir Julian [Smith], apparently the ODT Editor has said, since Mr Cannan’s comment, that the actual reason for non-publication of my ‘Citifleet Years of Inaction’ letter was that I already had a letter printed on a similar topic recently.
My previous letter was not however on a similar topic or recent. My first letter which was printed, was sent on 24 August on the topic of Coroner and Police inaction.
My second ‘Citifleet Years of Inaction’ letter that the ODT have chosen not to print was on the topic of CEO Paul Orders’ inaction in 2011, and Mayoral misrepresentation.
It is a shame that most people will not now get the true story.
Feel free to publish so that at least some people get to know some of what has been misrepresented.

Dear Murray,

Why is the coroner taking more than 3 months to deliver a verdict on the DCC Citifleet manager’s sudden death?
Why have the Police only just begun an investigation when so much evidence has been floating around for years and was so tragically highlighted over 3 months ago?
I have been asking for Citifleet manager and other tender process investigations recorded back at least as far as 2011.
Justice delayed is justice denied. Or with so much public money gone is that perhaps the reason?

In fact DCC vehicle disposal and other Bachop issues had been flagged in verbal questions and emails from me to CEO Orders and other senior DCC staff in 2011 following many complaints from Turner’s Auctions and other motor industry businesses. I also set up a meeting to resolve DCC/Turners issues between CEO Orders and Turner’s Auckland based national accounts manager Asgar Kachwalla in November 2011. It seems that little was done until CEO Bidrose began an investigation almost three years later. Perhaps the ODT should be doing some more investigating of its own. [confirming email example below].

Further to my more general email this morning about building partnerships, Dunedin’s largest car auction business has contacted me regarding on-gong (sic) problems trying to do business with the DCC.
Turner’s Auctions big cheese Mr Kachwalla from Auckland will be in Dunedin on the 30th of this month, and was hoping to organise a brief meeting with you and local Turners management on the afternoon of the 30th to attempt to normalise a Turners/DCC business relationship.
I was hoping to bundle similar issues with other Dunedin business issues with Mr Bachop, but am still awaiting information ex DCC after over a month in order to do this.

Hopefully you will have time on the next Wednesday the 30th to accommodate Turners Management hopes for a meeting.

I have followed up your question of clarification about the SFO and can provide the following response:
Under the circumstances of a suspected fraud (as per the Citifleet situation at the beginning of the investigation), the normal course of events is that the SFO is informed of issues when they arise. Deloitte did this via a phone-call to the SFO on 12 June 2014, after a discussion with DCC staff at a meeting of the Investigation Steering Group. The steering group were fully aware of the fact that Deloitte was speaking with the SFO and were informed of the outcome of the call. The call to the SFO was us asking the SFO to consider an investigation.

The discussion on 12 June 2014 (which was with a case officer and with Nick Paterson, the GM Fraud and Corruption) summarised the facts and circumstances of the Citifleet issues and sought the view of the SFO.
It is then the SFO’s decision as to whether they commence their own investigation. This is based on the criteria set out on their website (copied below)

There are multiple victims (usually investors) of the suspected fraud

● The sum of money lost exceeds $2,000,000

● The alleged criminal transactions have significant legal or financial complexity beyond the resources of most other law enforcement agencies.

In the case of bribery or corruption matters, we focus on crimes involving public officials, which could undermine public confidence in the administration of laws

Based primarily on the fact that the main suspect was deceased and that the actions appeared to be those of one corrupt individual rather than fitting within the definition of bribery and corruption, the GM Fraud and Corruption decided that the best course of action was for Deloitte to complete its investigation and provide a copy of the report at the conclusion of its work. During the investigation and with permission from DCC, Deloitte provided an update on the investigation to SFO on 07 July 2014 via letter. A copy of the full report was provided on 21 August 2014. We have heard nothing back from the SFO to date.

As to confidentiality, these OIA replies are all able to be made public and as such they will be published on the website and I will be providing a copy of the information to all Councillors.

Your ‘operational only’ claim is generally questionable and in this case fails on all counts.
We will never know all the facts, especially if the withholding of the Deloitte report and more public muzzling continues.
In one of your media statements you say that Council have agreed not to comment until the Police have completed their belated investigation, but this is not true. Councillors have not been given the opportunity to even discuss a further number of months of no comment on Citifleet, leave alone agreed not to comment. I have certainly not agreed and do not agree.

Thank you for acknowledging my long standing demands that DCC ‘heads should roll’. My long political experience is that timely public disclosure will be necessary to ensure that the appropriate heads are dispatched, and that an embedded DCC culture of self-entitlement across many departments is permanently erased.

What we do not have a right to do is step outside our governance roles, interfere with legitimate operational matters particularly without knowing all the facts, and unilaterally jeopardize Council and ratepayer interests. If we do we should be fully held to account for that.

An independent investigation into an alleged fraud at the Dunedin City Council has been completed and the matter has now been passed to the Police.

DCC Chief Executive Officer Dr Sue Bidrose says the alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police last week following an independent investigation by Deloitte which began in late May. Citifleet Team Leader Brent Bachop died suddenly on 21 May. His death has been referred to the Coroner.

Deloitte was engaged by the DCC on 23 May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets.

Dr Bidrose says, “The matter is now with the Police and on their advice, and the advice of the Crown Solicitor, we are not releasing the Deloitte report at this stage, to ensure we do not prejudice any Police investigation.

It appears the alleged fraud was possible because of inadequate internal checks and balances within the DCC. Dr Bidrose says, “We are changing things here at the DCC and it is these changes that uncovered this alleged fraud, which occurred over at least a decade. This reinforces the need for these changes which, frankly, are long overdue.” Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. However, this will be an ongoing process that will take time.

“I want to emphasise that this is an organisation in which people can have confidence. The people who work here are overwhelmingly decent, hard-working public servants committed to the best interests of the city. We are committed to getting to the bottom of any issues and ensuring we have best practice across the board. The changes are well underway – in fact it was in making these changes that we uncovered the alleged fraud.”

Dr Bidrose says the DCC has employment processes underway relating to a small number of staff, primarily around the lack of checks and balances which should have been in place. Mayor of Dunedin Dave Cull says the fact these issues have been found now after more than a decade shows the Council has been right to push for more transparency and tighter processes. “We tasked Sue, and the previous Chief Executive Paul Orders, with reviewing DCC practices so any problems or issues could be fixed as part of our accountability to ratepayers. Paul started with our companies and made a huge improvement in their governance and oversight. Now Sue and her staff are having the same impact inside the DCC.”

Dr Bidrose says a wide range of work has been completed to tighten up DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A first review of internal audit work across the DCC has been completed.
● The risk management framework has been reviewed.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff so they know what may be signs of fraud.
● Increasing further the transparency of purchase card use.
● A review of key DCC policies, such as those relating to fraud and cash handling.
● Review the procurement/tendering processes across the DCC.
● A review of internal processes around issues such as the staff receiving gifts, tickets or hospitality.

The Deloitte report has been sent to both the Serious Fraud Office and DCC insurers QBE. To date, the investigation has cost about $200,000.

Background: Citifleet is responsible for the management of all DCC vehicles, the operation of an internal courier service and an internal chauffeuring service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are needed.

Police will investigate a suspected fraud involving dozens of Dunedin City Council cars allegedly sold and the proceeds pocketed. Sources say ratepayers may have lost as much as $1 million as a result of the alleged activity. Dunedin Inspector Jason Guthrie confirmed police had received a complaint from the council “in relation to a significant historical fraud matter involving the council’s vehicle fleet”. “The complaint is being assessed and will be investigated further,” Guthrie said. This investigation was likely to take months. Stuff understands the council’s Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was among an alleged network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit.

Investigations into alleged vehicle fraud at the Dunedin City Council Citifleet/Citipark unit have unravelled a vast network of vehicle transactions over the past 11 years, an informed source has told Stuff. The probe has been under way for more than a month. Accountancy firm Deloitte was commissioned to investigate whether dozens of Dunedin City Council fleet vehicles had been sold and the proceeds pocketed. The investigation was sparked when discrepancies appeared in the number of fleet vehicles recorded by the council’s fleet unit Citifleet/Citipark.

The investigation has shocked those in the Dunedin car retail, automotive, and enthusiast community.

Stuff has been told this week the council gave Deloitte investigators a list of council vehicle movements through a network of buyers and subsequent owners over the 11 years. It included buyers of the vehicles, who now owned the vehicles, and how long they had owned them. At least three people, who took ownership of many vehicles, are among those in a network under suspicion of being involved in the fraudulent activity.
Stuff understands Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was allegedly among the network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit. Bachop had worked in the unit for more than 20 years, the past 10 or so as manager.

Council fleet probe investigates fraud

Dunedin City Council has confirmed that a probe trying to find missing fleet vehicles has become a fraud investigation. The council called in financial specialists from Deloitte four weeks ago for what it now calls a far-reaching investigation of its Citifleet and Citipark departments. The inquiry is centred on what appears to be a discrepancy in the number of council-owned fleet vehicles. The investigation followed the sudden death, six weeks ago, of the departments’ longstanding team leader, Brent Bachop. Council chief executive Sue Bidrose has for the first time described Deloitte’s work as investigating possible fraud. Asked why the police were not doing the investigating, Dr Bidrose said the police were aware of the situation, but the council will need to have evidence of wrongdoing before referring the issues on.

The Dunedin City Council has launched an investigation into its Citipark/Citifleet unit. The unit is responsible for the council’s parking services and also for its management of its fleet of vehicles. Council chief executive Dr Sue Bidrose would not be drawn on the reason for the investigation which is being carried out by accountancy firm Deloitte. The investigation had just started and was being incorporated into a wider review of key accounting practices within the council, which was initiated last year. She said it would be inappropriate to release further details, such as what has sparked the probe. A council spokesman confirmed the unit’s manager Brent Bachop died suddenly last month. Dunedin police said his death had been referred to the coroner.

Stadium construction site #Dust #AirPollution

While there might be less of a problem when the Forsyth Barr Stadium was completed, it was an issue with any construction site.

Dust from roads and off wheels gets blame in Dunedin air pollution

Dust from roads and “off the wheels” of vehicles is being blamed for much of central Dunedin’s air pollution. As a result, tighter controls could be placed on the movement of vehicles from construction sites. The Otago Regional Council studied air quality in central Dunedin during 2010 to try to better understand air pollution around its Albany St monitor. It found dust from roads and “off the wheels” of vehicles was a major contributor to air pollution in the area.
