New Zealand’s asbestos death toll will climb to about 5100, excluding deaths from asbestosis, which were difficult to determine, a WorkSafe spokesman said. It was expected the peak of asbestos-related disease would not be reached until sometime between 2030 and 2040, the spokesman said. (ODT)

HOW MANY Dunedin City Council (DCC) staff, work crews, contractors and subcontractors have been required to work with asbestos product and exposure to fibres over the years —without comprehensive safety training and correctly specified respirators and safety clothing for individual protection ?
The answer is likely to be unlimited numbers.
Has anything changed at DCC ?
Have all asbestos contaminated DCC-owned sites and work areas been identified to date ?
Are formal protocols and a register in place for personnel who believe they may have been exposed to asbestos and require admittance to a testing regime ?

Asbestos toll will grow

The death toll from asbestos-related disease in New Zealand will continue to climb for decades to come, despite a ban on imports of building materials containing the toxic mineral. Environment Minister Nick Smith on Wednesday announced New Zealand would join more than 50 other countries in banning the importation of asbestos-containing materials (ACMs), beginning on October 1, unless exemptions were granted. The move was designed to further reduce the “appalling” death toll caused by asbestos, used in building products for more half a century. It now claimed an estimated 170 lives a year, he said.

Asbestos may impact the financial health of the Dunedin City Council’s coffers in years to come but the extent of the cost remains unknown, councillors heard at yesterday’s annual plan deliberations. Group chief financial officer Grant McKenzie told councillors work was under way at present to establish the extent of asbestos use and issues in council-owned assets, but the cost to rectify it would not be known until the investigation was complete.

The Dunedin City Council says it will remove decaying asbestos pipes from public land after their existence at Sullivans Dam was noted by the Amalgamated Workers Union. The pipes are beside sheds near the entrance to the popular fishing spot in Leith Valley Rd. The council yesterday said it had not known the pipes were there.

The Dunedin City Council says there is no immediate threat to the public following the discovery of asbestos at Moana Pool. During a maintenance check of the building early last week, asbestos was discovered in the pump storage area under the pool level of the building and in restricted storage areas away from the pool.

A union says the public could easily have been exposed to cut and broken asbestos pipes left unsecured in a sometimes unattended Mosgiel yard. The Amalgamated Workers Union (AWU) said the pipes at the Dunedin City Council’s Mosgiel wastewater treatment plant were not in a safe state and could have been accessed by children in the residential street.

ASBESTOS (pronounced /æsˈbɛstəs/, /æzˈbɛstəs/ or /æzˈbɛstɒs/) is a set of six naturally occurring silicate minerals, which all have in common their eponymous asbestiform habit: long (roughly 1:20 aspect ratio), thin fibrous crystals, with each visible fiber composed of millions of microscopic “fibrils” that can be released by abrasion and other processes. They are commonly known by their colors, as blue asbestos, brown asbestos, white asbestos, and green asbestos.

Asbestos mining existed more than 4,000 years ago, but large-scale mining began at the end of the 19th century, when manufacturers and builders began using asbestos for its desirable physical properties: sound absorption, average tensile strength, resistance to fire, heat, electricity, and affordability. It was used in such applications as electrical insulation for hotplate wiring and in building insulation. When asbestos is used for its resistance to fire or heat, the fibres are often mixed with cement or woven into fabric or mats. These desirable properties made asbestos very widely used. Asbestos use continued to grow through most of the 20th century until public knowledge (acting through courts and legislatures) of the health hazards of asbestos dust outlawed asbestos in mainstream construction and fireproofing in most countries.

Prolonged inhalation of asbestos fibres can cause serious and fatal illnesses including lung cancer, mesothelioma, and asbestosis (a type of pneumoconiosis). Illness from asbestos exposure can be found in records dating back to Roman times. Concern in modern times began in the 20th century and escalated during the 1920s and 1930s. By the 1980s and 1990s asbestos trade and use was heavily restricted, phased out, or banned outright in an increasing number of countries.

The severity of asbestos-related diseases, the material’s extremely widespread use in many areas of life, its continuing long-term use after harmful health effects were known or suspected, and the slow emergence of symptoms decades after exposure ceased made asbestos litigation the longest, most expensive mass tort in U.S. history and a much lesser legal issue in most other countries involved. Asbestos-related liability also remains an ongoing concern for many manufacturers, insurers and reinsurers.

Myth: Asbestos Fibres are firmly locked in a cement matrix.
Fact: Asbestos Fibres are readily released from deteriorated or weathered surfaces.

Myth: Asbestos-cement cannot be crumbled to powder by hand pressure.
Fact: Products such as asbestos-cement corrugated siding become friable from damage.

Myth: Asbestos-cement products present no exposure hazard to building occupants.
Fact: Asbestos roofing and siding can release fibres inside as well as outside the building. Not all asbestos-cement roofing and siding remain in as good condition. In many countries, the inside of asbestos-cement roofing and siding is subject to the normal activities of the occupants that can release fibres from the surfaces. An asbestos-cement panel can be vibrated by wind, causing some abrasion of the edges.

Myth: Asbestos-cement pipes present no health or environmental hazard.
Fact: Health and environmental hazards start during the manufacturing process when the ends of the pipes are ground and the waste is disposed of carelessly. Fine dust produced during installation of the pipes is a hazard to the workers and community. When the pipes are dug up and removed, fibres are released as they are broken and crushed. Pressure pipe for water distribution was made with crocidolite and amosite as well as chrysotile.

Myth: Paint and encapsulants offer permanent protection against asbestos fibre release.
Fact: Paint and encapsulants deteriorate and take asbestos fibres with them when they peel off. Why is it necessary to protect a material that is touted for its weather-resistance and durability, yet encapsulants for asbestos-cement roofing and siding are widely marketed. Encapsulants are a form of paint, and a good paint job begins with surface preparation. The hope is that no one sands asbestos-cement roofing and siding before they paint or encapsulate it, because of the obvious dust and health hazard created.

█ NEW ZEALAND LEGISLATION

The Health and Safety at Work (Asbestos) Regulations 2016 came into force on 4 April 2016. They set out the new rules around the removal of asbestos, and the circumstances where WorkSafe must be notified.

New licensing system for asbestos removal
A national licensing system for asbestos removal was introduced on 4 April 2016. The licences available under the new asbestos regulations are:

Type of licence : What asbestos can be removed?

Class A
Any type or quantity of asbestos or asbestos containing material, including:
• any amount of friable asbestos or asbestos containing material (ACM)
• any amount of asbestos contaminated dust or debris (ACD)
• any amount of non-friable asbestos or ACM.

Class B
Any amount of non-friable asbestos or ACM
ACD associated with removing any amount of non-friable asbestos or ACM.

No licence is required for removing:
• up to 10 m2 of non-friable asbestos or asbestos-containing material over the whole course of the removal project for the site
• asbestos-contaminated dust that is associated with this volume of asbestos or asbestos-containing material, and/or any associated minor volume of asbestos-contaminated dust or debris.

A new role of asbestos assessor has been developed. A licensed asbestos assessor will provide air quality monitoring during removal work, inspect the finished job and provide a clearance certificate. A licensed asbestos assessor will be required to assess Class A asbestos removal work from 2018 onwards.

Current Certificate of Competence holders will be able to continue removing asbestos (in the categories specified on their certificate), and supervise asbestos removal, until their certificate expires.

DCC DRAFT Annual Plan 2016/17 —Harden up, Council

Dunedin City Council (creak, groan), still holds to notions of silly spend-ups —on Minor yet Very Costly items of…. faint if any benefit to the widest scope of Dunedin ratepayers and residents. It’s ELECTION YEAR. Overtly muddled thinking given to ‘pet projects’ and ‘bribes’ (vote chasing) is sorry Self-aggrandising Rubbish on the part of the local body politicians we’re stuck with until this October.

Some people can make a success of themselves living in Dunedin, some in the innovation sector are uniquely placed with developing capacity to export out; but these shining lights and bushells are frequently seen against a Dumb, overly Bureaucratic, In-fighting city council located within a generally stale and stalled non-productive urban economy. Dunedin is achieving only about half the growth of the rest of New Zealand.

This week, Councillors are deliberating to ‘stiff’ ratepayers and residents with the promoted…. steeply unattractive rates increase (supposedly) capped at 3%.

But shifting sands again at Council (what it’s only good for, in a bad way!) —the most inexperienced/unproductive/unbusinesslike gormless Councillors of green persuasion, together with the mayoral candidates and their aspiring pearl- or scarf-wearing deputies are in the Ugly mood to consider yet more unprincipled spending to take us beyond the 3% cap, if MSM news reporting of tendency is acurate (I’m sure it is).

Council staff are not emerging cleanly from this leaky-budget process either —since elected representatives tend to piggyback if they can, staff-driven shiny pet projects even when within very close sniffing distance of the highly questionable event of systemic DCC failure with core infrastructure services, monstrously demonstrated in June 2015.

The lack of brain power to analyse and offer principled leadership of the City of Dunedin is daily astounding. Not something practically-minded, fiscally prudent citizens should tolerate or support any longer.

If Shadbolt wants to come here as Mayor, by all means Jump In.

2.9% rates increase council consulted on now pushing to 3.5% – breaching council’s self-imposed limit of 3% – unless cuts made.

MacTavish sees rates increase at slightly higher than 3%, as squeezing staff resources becomes “detrimental” to the community.

A rates increase of more than 3% remains a possibility, despite Dunedin City councillors agreeing to stick within the council’s self-imposed limit. Councillors were faced with difficult decisions at yesterday’s annual plan deliberations after agreeing to pay for almost $700,000 worth of extra costs in the 2016-17 annual plan.

Spending millions upgrading Dunedin’s stormwater infrastructure to better withstand floods would not be possible in the next year and increases would have to be ramped up over time, councillors were told. Council water and waste group manager Laura McElhone made the comment when asked by Cr Kate Wilson whether it would be possible, as an example, for her staff to manage spending an extra $10million in the next year.

South Dunedin Cycle Network Changes Start Soon

Alterations to some parts of the South Dunedin Cycle Network will start shortly as the Dunedin City Council works to deliver safe, high quality and attractive cycleways in the city. General Manager Infrastructure and Networks Ruth Stokes says the DCC has listened to public feedback about existing South Dunedin cycleways and in response changes are being made to some intersections.

“We’ve accepted we didn’t get these designs right first time, but we have taken on board what the community has told us and we are making changes. As always, the priority will be safety, not just for cyclists, but for pedestrians and motorists too. There will also be a new urban design element to the construction that will enhance every street which has a cycleway.”

The first step is to remove sections of the existing South Dunedin Cycle Network (SDCN) that have given rise to public concern regarding vehicle access. As each section is due to be altered, residents and businesses in and near the affected streets will receive notification from the DCC and its contractor, Downer. The work is scheduled to begin later this month.

This remedial work incorporates the following:
● At the Hargest Crescent/Richardson Street and Richardson Street/Moreau Street intersections the ‘floating’ traffic islands will be removed to improve traffic flow (kerb protrusions will remain).
● The Marlow Street/Royal Crescent intersection will have two way traffic flow reinstated in response to residents’ requests. Two way traffic flow will also be reinstated at the Prince Albert Road/New Street and Churchill Street/Bellona Street intersections.
● Coughtrey Street and Richardson Street – ‘ghost’ road markings will be removed and new road markings laid.
● Signs and road markings will be installed across all the existing SDCN to improve intuitive way-finding for cyclists.

Over the next few months the design of these SDCN sections will be reviewed and improved with a focus on safety and ease of use for all road users. Residents will be asked for feedback before the designs are confirmed.

Designs to improve the Portobello Road cycleway between Timaru Street and Portsmouth Drive have been prepared in consultation with the community, aiming for a highly practical road and cycleway layout, improved road markings and signs, complemented by a vastly improved general environment providing a family-friendly atmosphere. The design will take residents’ and business access needs into account. The Princes Street cycleway past the Oval, on to Gordon Street and Vogel Street, is planned for completion in October 2015. This will include signs and markings on Princes Street and changing give way priorities to Vogel Street at two intersections. Ongoing Tedder Street construction is due to be finished by the end of 2015, using speed bumps to slow traffic.

Mrs Stokes says the vision for Dunedin’s first urban cycleway is to have high quality, attractive routes which cater for people travelling to work and school by bike, and leisure cyclists, while reducing accident rates for all road users.

Money wasting madness from DCC

$320,000 spent already for 700m of cycleway, that was already sealed, is madness. And now it has to be redone.
Just like the cycle crossing on Victoria Road that was rebuilt three or four times at a cost of tens of thousands of dollars, yet despite passing over it multiple times a day, including rush hour, I’ve seen it used by bicycles just once in nearly a year.
Similar money wastage is now happening with total redesigns of intersection kerbing around St Kilda, at the cost of many thousands of dollars, including intersections which are some of quietest and least used in all of Dunedin.
Yet not a dollar for the very busy intersection at Allendale/Forbury/Bay View Roads, where opposing right turning traffic on Forbury Road, is channelled into a head-on collision.
Heads should roll at the DCC – this is madness. It’s a waste of our money to spend hundreds of thousands on barely used or needed pet projects, often redoing them several times, while not spending a cent on dangerous intersections.

Parties at loggerheads over plans to develop the southern part of Portobello Road have reached an agreement. The Dunedin City Council and Automobile Association has met with cycling advocacy group Spokes and business owners about changes to the road. Representatives have come up with a mutually agreeable plan to widen the section of road between Timaru Street and Portsmouth Drive. It will provide room for large trucks to safely enter and exit industrial sites along the road. And there will be a 3m cycleway separated from traffic, allowing cyclists to travel in both directions along the road. Construction is expected to be completed by the end of the year.

Positive Meeting on Portobello Road Plans

A revised concept plan for the southernmost section of Portobello Road has been welcomed by key parties.
A meeting was held this morning between some Dunedin City Councillors, DCC staff and representatives from the Automobile Association (AA), cycling advocacy group Spokes Dunedin, local businesses and leaseholders. Those at the meeting, which was chaired by AA Otago District Councillor Norman Oakley, strongly supported the revised concept plan for the section of Portobello Road between Timaru Street and Portsmouth Drive. The proposed plan addresses concerns with the existing layout, by providing room for large trucks to safely enter and exit industrial sites along the road.
The revised concept plan increases the total road width to 10.1m, made up of a northbound and a southbound lane, with a 2.5m painted median strip between the lanes (such as in Hillside Road). A 3m wide, two way cycleway, separated from traffic, is still part of the plan. This concept means removing the current concrete median to make more room for the new lanes and the median strip. The intersections at either end of the road remain the same.
DCC Infrastructure Services Committee Chair Cr Kate Wilson says, “I congratulate all the groups involved for working collaboratively to reach such a positive result. Once the revised plans have been finalised, we will be asking other interested parties and the wider community for feedback.” Cr Wilson noted the revised concept plan did not propose major changes for residents on that stretch of road, who can still access their properties as they do now.
AA Otago District Councillor Hudson Biggs says the revised plan is a workable solution for all parties. “There has been a lot of work in the background to get to this point and what has been presented recognises the fact there needs to be cycle access from South Dunedin along Portobello Road, while still meeting the needs of other road users.” Spokes Dunedin Chair Robert Thompson also supported the revised layout. “It strikes the right balance between all road users, providing a high standard cycleway and improved vehicle access within a more intuitive road layout.”

CSL Containers Director Philip Chapman says the new plan addresses his concerns very well. “I couldn’t ask for anything better.”

DCC Group Manager Transportation Gene Ollerenshaw says the proposed design will now be finalised and released within the next two to three weeks for wider feedback from the community. Further consultation will include a mail drop to nearby residents, discussions with other parties such as Bayfield High School and signs to alert motorists who use that route. Following that feedback, the design will be finalised and construction completed as soon as possible before the end of the year.

The Dunedin City Council will work further with key parties to finalise a design for the southernmost section of Portobello Road.
DCC Infrastructure Services Committee Chair Cr Kate Wilson says the decision was made following a constructive meeting on Wednesday attended by Councillors, DCC staff and representatives from the Automobile Association (AA), cycling advocacy group Spokes, local businesses and leaseholders.
The meeting, which was chaired by the AA, discussed the recent changes to the section of Portobello Road between Andersons Bay Road and Portsmouth Drive. Discussions began with some context setting. The use of that part of Portobello Road has changed greatly, as has the land ownership in the area. Rather than being a high volume commuter route, it is now a relatively low volume road used by heavy transport, with industrial land on one side and residential on the other.
The road has been altered to accommodate one of the key cycleways in the new South Dunedin Cycle Network. The first stage of work was completed in May. The concept was not fully implemented then because of funding constraints, but the intention was to do further work if it was required as funds became available.
Cr Wilson says a preliminary layout for the second stage was developed in consultation with AA, Spokes and residents and businesses in the area. “However, further feedback from businesses, leaseholders and the public, conclusions we have drawn ourselves, issues around the look and feel of the road, access to the industrial properties and safety concerns at the Timaru Street end mean some further consideration of options is needed.” “We take seriously the concerns raised and following this week’s meeting we will seek further inputs from the affected businesses and leaseholders so we incorporate their concerns and needs into the options.”
DCC Group Manager Transportation Gene Ollerenshaw says in the meantime some interim improvements would be investigated with urgency, such as signage and road marking, particularly at the Timaru Street end. The DCC is still aiming to complete the project in the 2014/15 year.

Lee Vandervis releases emails #Citifleet investigation

What if? Dunedin has received a total of 17 emails from Lee Vandervis, including two with email attachments. A further three emails have been withheld from publication due to privacy reasons, and which may be actionable.

The first batch of seven emails feature at this post, with the remaining ten emails (some repeats to different recipients as Mr Vandervis follows up with Kyle Cameron of Deloitte, responsible for the Citifleet investigation) to be added at Comments after being photographed and stitched back together to retain threads.

To be noted, this is part document proof of Cr Vandervis’ efforts from 2011 forward to elicit information on suspicion of fraud occurring at Citifleet. The emails show DCC Senior Management were aware of fraud allegations well prior to 2013/14, despite Council’s formal media statements to the contrary last year. They also support the obvious need that existed for a wider fraud investigation in regards to Council tendering processes, service contracts, traffic of car parts and tyres, staff credit card spending (by multiple available cards) and more – quite apart from disposal of at least 152 Council vehicles in the period 2003-2013, the set arbitrary window for investigation by Deloitte.

The DCC chief executive having taken a fraud complaint to Dunedin police was advised police had insufficient resources for follow up. There was then a three-month gap before police received the Deloitte investigation report commissioned by the Council. Three months is long amount of time to minimise and remove critical evidence within Council and about town. Dunedin City Council knows that. Deloitte knows that. Dunedin police know that. We can assume the Council’s insurers know that, yet they paid out $1 million in two instalments, for the ‘lost’ vehicles only [see DCC media release]. The three-month gap in itself is a suspicious if not criminal activity against Dunedin ratepayers and residents.

It is completely ludicrous that our little Cr Thomson is today making public comment on DCC’s new Whistleblower Policy – given Cr Thomson as chair of DCC Finance Committee has had every opportunity to treat his colleague, Cr Vandervis, the Council’s most notoriously effective Whistleblower, with all fairness and due respect but has actively failed on that count, time and time again.

What is it with Cr Thomson, our import from Southern District Health Board and former Otago District Health Board. Doesn’t the Councillor see it as his mission to relieve Dunedin Ratepayers from the living hell of the nearly unsurpassable multimillion-dollar mountain of corruption and fraudulent activity perpetuated at the Council and through its CCOs. Whitewash is not removal, Councillor.

A quietly spoken SDHB informant tells me Susie Johnstone, a chartered accountant, was wheeled in by the Health Board after the Swann fraud, for mop up. Well, Detectives, who wheeled her in and what was the nature of the mop up?

Separately, following Cr Thomson’s uptake into local body politics, Ms Johnstone was recommended for the position of independent chair of the DCC Audit and Risk Subcommittee.

The ARS committee is now to deal with Whistleblowing (no surprises there). As we have already published in previous months, via intimations of the Draft Whistleblower Policy: the DCC contact for Whistleblowers has been a Balclutha woman, whether actively.

Connections regularly multiply. The timing of Council’s announcement of its new Whistleblower Policy is sheer craziness in light of yesterday’s illegitimate farce of a conduct hearing, held at the expense of the DCC Chief Whistleblower. A woman from Balclutha was a witness at the hearing….

Your claim that the Stadium review is not yet completed and is still in draft form directly contradicts the advice of the quoted Audit and Risk agenda of 7/10/14 which plainly says that the Stadium “external review has been completed”. If the former, since it can’t be both, why can’t I see it anyway? And why have we then been misled in the A&R agenda?

Being “of course entitled to have that decision reviewed by the Office of the Ombudsmen.” is a farcical affront, given the last response from this dysfunctional excuse for a government department took ELEVEN MONTHS to reply to my request to see the faults list for the long completed Town Hall redevelopment, which you also refused.

This systematic stonewalling of this elected representative by DCC staff is unacceptable to me.

Vandervis: Deloitte and Police Citifleet investigations

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

An hour and a half spent with Detective Matthew Preece and another Policeman called Regan has left me with deep concerns regarding the Police Citifleet investigation.
Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

and that consequently none of these fraud areas is being investigated!

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Can you please also now with urgency, forward to me all instructions to Deloitte regarding the Citifleet investigation as previously requested in my email of 26/10/14 as below.

Is it possible to meet with you at any time tomorrow at your convenience to learn whether you have broadened the DCC Police complaint or not?

I am deeply disturbed by what I have seen in parts of the investigation conclusions appearing without covering page or any details identifying them as parts of the Deloitte findings in non-public parts of the Audit and Risk subcommittee meetings.
I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Background
Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. On 8 September 2014, the Council’s interim financial result for 12 months to 30 June 2014 was tabled at a meeting of the Finance Committee. A week later, ODT (15.9.14) reported Mayor Cull as saying there was a “significant improvement” to the Council’s core debt position.

In the same item, “Council group chief financial officer Grant McKenzie said the turnaround was partly due to a significant change in the amount of cash held by the council. The forecast had included about $22 million in “cash on hand”, but, since Mr McKenzie’s arrival, the decision had been made to slash the amount to about $2 million, he said. How was the money spent, and who by?
Then, we completely lost sight of it.
As the following correspondence shows, Council spent $20 million of ratepayer funds but refuses to declare where the cash went. Mr McKenzie plays the convenient game of obfuscation —like so many before him, and alongside him now at DCC.

The Group Chief Financial Officer advises:

“This request cannot be completed for what they are requesting as I do not know what capital and operating activity we would assign to the $20 million. In addition the work involved in getting the invoices etc would be significant. What has happened is that we have used our cash on hand to fund council activity (operating and capital) instead of borrowing to do this.”

If you would like me to pursue the possibility of tracking down invoices, I would need to consider charging for this work because there would be significant collation and research required, and even then, we may not be able to fully answer your question. Let me know if you would like me to investigate this further.

The GCFO has indicated he is happy to meet and talk through the issues but is unable to provide any further information at this stage.

The beginning of the Annual Report seems very reassuring with your highlighting our billion dollars worth of saleable assets, and our debt levels in pretty good shape and improving.

Looking further into the body of the report there is a lot of tabulation of various kinds of assets, but I seem not to be able to find the same depth of discussion on debt or the historical debt graph that I fought for years to finally get included. [A Consolidated term liabilities figure of $622,843,000 does appear on p199. I had been led to expect a historical graph of DCC debt and of total consolidated debt]
Is it possible to also have a graph of all inclusive historical staff costs included? There was one a while ago but it seems to have been dropped again.

At the end of the document I find a number of graphs that feature a fetching orange colour bar that seems to indicate that our “thriving and diverse economy” under Affordability has exceeded our LTP quantified limit on rates income in 2013 and 2014, exceeded the quantified limit on rates increase this year, slipped below the balanced budget benchmark, and also slipped below the essential services benchmark for this year.
It is no surprise to me that Citipark has not achieved targets, but I am surprised that your opening comments are so upbeat when the closing benchmarks are not met and the quantified limits seem to be exceeded.
These benchmark and limit graphs may have been misinterpreted by me because despite reading them several times I remain unsure of their real import.
Is it possible for someone to explain to me how the ‘pretty good shape and improving’ overview is supported, especially in light of the $20 million cut [from $22 million] in cash on hand and various sales that we have apparently recently instituted, combined with further expected constraints on DCHL subvention payments?

Former ARC Councillor Bill Burrill is not the first dodgy ratbag Councillor to trough from abuses of power to his own pecuniary advantage in recent years. A few years back in 2009 Council Watch was calling for a number of Councillors from the Canterbury Regional Council to be prosecuted and sacked from their positions after an investigation by the Auditor General Lyn Provost found that four individuals had broken the law by acting in conflict with their official role. Back then those Canterbury Councillors failed to declare a conflict on interest that [led] to a financial benefit for themselves by participating in discussion and voting on proposals before Council. Under investigation the Auditor General’s office chose not to prosecute stating that whilst the Councillors should have withdrawn as a matter of principle – they had each received and shared legal advice that they could participate. And here in lies the problem. The Auditor General and Office of the Ombudsmen publish clear guidelines for Councillors and council staff but the reality is that the law is erroneously filled with holes that are exploited and there is precious little oversight of Local Government leading to the Auditor General loathing to bother and the Courts uninterested.

Citifleet ‘stonewalled’ auctioneer firm

A Dunedin city councillor says the council should have investigated its fraught Citifleet unit three years ago, when he expressed concerns that it shut out firms like car auctioneer Turners. Lee Vandervis said that in 2011 he alerted council chief executive of the time Paul Orders that the Dunedin branch of Turners was consistently shut out of contracts it sought, mainly for the disposal of used cars. The city council said in June this year it was investigating practices within its vehicle fleet unit Citifleet.
Unit team leader Brent Bachop had died suddenly in late May. His death has been referred to the coroner.
A subsequent Deloitte investigation, commissioned by the council, unravelled a vast network of alleged fraudulent activity, some with selected car dealers and other individuals, over 11 years, equating to more than a million dollars in lost council revenue. Some of the activity involved profits from the disposal of second hand Citifleet vehicles allegedly being pocketed instead of being paid into council coffers.
Vandervis said he was concerned about Bachop’s business dealings when he was told by Turners and other Dunedin businesses they were having difficulty even engaging with Citifleet. He began pressing Orders on the issue and made a raft of requests for information around Citifleet. Vandervis suggested Orders meet the manager “to attempt to normalise a Turners/DCC business relationship”. Vandervis said Turners’ staff had expressed “long and on-going frustration at trying to deal with Citifleet vehicle disposals”.

Message: In discussions with Sir Julian [Smith], apparently the ODT Editor has said, since Mr Cannan’s comment, that the actual reason for non-publication of my ‘Citifleet Years of Inaction’ letter was that I already had a letter printed on a similar topic recently.
My previous letter was not however on a similar topic or recent. My first letter which was printed, was sent on 24 August on the topic of Coroner and Police inaction.
My second ‘Citifleet Years of Inaction’ letter that the ODT have chosen not to print was on the topic of CEO Paul Orders’ inaction in 2011, and Mayoral misrepresentation.
It is a shame that most people will not now get the true story.
Feel free to publish so that at least some people get to know some of what has been misrepresented.

The initiative was run by Enterprise Dunedin but supported by the Grow Dunedin partnership, itself a product of the city’s economic development strategy, which recommended the funding increase to the council.

The rules allowed Mr [Des] Adamson to approve grants not exceeding $10,000, while those worth between $10,000 and $50,000 needed sign-off by three senior figures, including council chief executive Dr Sue Bidrose. In addition, individual grants worth more than $50,000 needed the approval of the finance committee.

Councillors at yesterday’s economic development committee meeting approved the request for $72,000, a $12,000 increase from last year, to help pay for the programme in 2014-15. Fairfax Media has obtained Audit NZ letters of management to the DCC from 2005 to 2012, released under the Local Government Official Information and Meetings Act. The letters show that in the years 2007-2010 auditors consistently urged the DCC to tighten up its risk-management policies and processes.

Audit NZ expressed concern over what it indicated could be inadequate controls over several internal processes, including verifying signatures of those authorised to sign invoices and purchase orders, independent review of creditor files, and controls of sensitive areas such as sale of council assets to staff. Dunedin council officers ‘not kids’

The Dunedin City Council (DCC) appears to have ignored calls by Audit New Zealand to improve its risk and fraud processes, saying its officers were “supposedly people with integrity … not kids”.

The DCC revealed in June it was investigating a suspected major fraud within its Citifleet unit. The fraud was suspected to have been carried out over a decade. Citifleet team leader Brent Bachop died suddenly in May. His death has been referred to the coroner. Council chief executive Dr Sue Bidrose said the alleged fraud of $1.5 million included alleged illegal transactions resulting in the loss of profits from the sale of 123 council fleet vehicles. The findings have been passed to the Dunedin police for further investigation.

It appears Audit NZ was compelled to repeat similar advice over the period and noted the DCC met only minimum requirements.

Council managers’ response to the Audit NZ findings in 2010 was to say the council had considered creating an audit and risk committee but concluded its finance and strategy committee adequately performed the role. In December 2010 Audit NZ raised the issue of reviews of areas “susceptible to fraud”, but management commented that specific audits in the “most sensitive areas” had found “no transactions of concern or deficiencies in controls”.

[Irony] Local Government New Zealand president Lawrence Yule yesterday told the ODT the “mind-boggling” alleged fraud was the biggest involving a local authority he could recall.

Dunedin Mayor Dave Cull concedes a chance to detect the alleged $1.5 million Citifleet fraud may have been missed, after the council twice overlooked advice from Audit New Zealand. The revelation came in Audit New Zealand’s annual reports to the council, obtained by the Otago Daily Times, which highlighted gaps in council processes dating back to 2003. An independent investigation into an alleged fraud at the Dunedin City Council has been completed and the matter has now been passed to the Police.

DCC Chief Executive Officer Dr Sue Bidrose says the alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police last week following an independent investigation by Deloitte which began in late May. Citifleet Team Leader Brent Bachop died suddenly on 21 May. His death has been referred to the Coroner.

Deloitte was engaged by the DCC on 23 May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets.

Dr Bidrose says, “The matter is now with the Police and on their advice, and the advice of the Crown Solicitor, we are not releasing the Deloitte report at this stage, to ensure we do not prejudice any Police investigation.

It appears the alleged fraud was possible because of inadequate internal checks and balances within the DCC. Dr Bidrose says, “We are changing things here at the DCC and it is these changes that uncovered this alleged fraud, which occurred over at least a decade. This reinforces the need for these changes which, frankly, are long overdue.” Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. However, this will be an ongoing process that will take time.

“I want to emphasise that this is an organisation in which people can have confidence. The people who work here are overwhelmingly decent, hard-working public servants committed to the best interests of the city. We are committed to getting to the bottom of any issues and ensuring we have best practice across the board. The changes are well underway – in fact it was in making these changes that we uncovered the alleged fraud.”

Dr Bidrose says the DCC has employment processes underway relating to a small number of staff, primarily around the lack of checks and balances which should have been in place. Mayor of Dunedin Dave Cull says the fact these issues have been found now after more than a decade shows the Council has been right to push for more transparency and tighter processes. “We tasked Sue, and the previous Chief Executive Paul Orders, with reviewing DCC practices so any problems or issues could be fixed as part of our accountability to ratepayers. Paul started with our companies and made a huge improvement in their governance and oversight. Now Sue and her staff are having the same impact inside the DCC.”

Dr Bidrose says a wide range of work has been completed to tighten up DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A first review of internal audit work across the DCC has been completed.
● The risk management framework has been reviewed.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff so they know what may be signs of fraud.
● Increasing further the transparency of purchase card use.
● A review of key DCC policies, such as those relating to fraud and cash handling.
● Review the procurement/tendering processes across the DCC.
● A review of internal processes around issues such as the staff receiving gifts, tickets or hospitality.

The Deloitte report has been sent to both the Serious Fraud Office and DCC insurers QBE. To date, the investigation has cost about $200,000.

Background: Citifleet is responsible for the management of all DCC vehicles, the operation of an internal courier service and an internal chauffeuring service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are needed.

Police probe into missing council cars

Police will investigate a suspected fraud involving dozens of Dunedin City Council cars allegedly sold and the proceeds pocketed. Sources say ratepayers may have lost as much as $1 million as a result of the alleged activity. Dunedin Inspector Jason Guthrie confirmed police had received a complaint from the council “in relation to a significant historical fraud matter involving the council’s vehicle fleet”. “The complaint is being assessed and will be investigated further,” Guthrie said. This investigation was likely to take months. Stuff understands the council’s Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was among an alleged network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit.

when we did the last finance forum there seemed general agreement that it was a worthwhile exercise and I suggested that we schedule another for after that adoption of the annual plan. That has now ocurred and we have set a date of 12th August for this. I would be grateful if you could advise your network on What if of this. As last time it would be really helpful if people could advise questions in advance. Often they require specific information and if we have them in advance we can provide that on the night which is good for others there as well. I am happy for these to be forwarded directly to me. The meeting will be held from 5.30 to 7.30 on the 12th August. Venue to be confirmed but I imagine it will be the same room in the Council chambers as we used last time.
