Botched cycleway estimate short by $13m

A bungled Dunedin City Council cost estimate to complete safety improvements and a cycle/walkway on Otago Peninsula has left the project more than $13 million short. The council announced yesterday an estimate for the project on Portobello Rd and Harington Point Rd that includes a cycle/walkway from Taiaroa Head to the city had risen from $20 million to $49 million. The earlier estimate, drawn up  in 2011, did not include parts of the cycleway to be built, land that had to be bought and a contingency fund to cover unforeseen expenses. Meanwhile WE will be paying for our Otago power network TWICE, at a crippling cost to business and residential power consumers well into the future —thanks to Dunedin City Council’s unsatisfactory governance of the companies Aurora Energy / Delta Utility Services and Dunedin City Holdings and, above all, the Council’s unfettered use of public funds to realise the dream of the Tartan Mafia and Professional Rugby to build the now frequently empty and under-utilised Forsyth Barr Stadium. (three concerts by Ed Sheeran in highly doubtful acoustic conditions inside ‘the roof’ does not a Christmas make).

All this because the Council conveniently fails to ensure it covers the infrastructural basics (in this instance: the safe, secure and continuous supply of electricity) – affordably – for the static if bearly stable City of Dunedin, and the sparcely populated Otago region in the mode of fast pumping growth. (There are simply too few permanent ratepayers to uphold ‘big bloated dreams’ and money siphoning on the rates take).

The Council did not ensure that Aurora Energy / Delta Utility Services were sufficiently well structured to Avoid profligate spending, making subvention payments to the stadium companies, or borrowing to pay dividends to the Council. (Probably the least of it).

There have been YEARS of dangerous neglect, embellishing the lack of repair and upgrade to the Community of Otago’s electricity network.

The Council is not well enough controlled (corporate and financial oversight) in order to Avoid its own profligate spending —so to protect, support and upgrade Otago’s power network as the solid basis for regional economic development and SAFE living —with CERTAINTY and SECURITY OF SUPPLY.

Instead, The People will now be plunged into further debt by the circus wheel of local body politicians and the morally thin and rather malevolent boards of directors (masters of spin) controlling the companies.

It’s time the People of Dunedin and Otago took control of their power infrastructure. Resolving, if they will, to adopt a different ownership and delivery model – one option is to form a democratically elected Community Power Trust to own and oversee the network; this is a sound regional model that is proven to work in other jurisdictions, with all due care.

WE have to Safeguard our future.
Not leave decision-making to unvetted members of the Tartan Mafia.
Especially not those in thrall to the likes of Gordon Stewart and his ilk (a vague reference to Delta’s speculative dealings at Yaldhurst, Christchurch – Delta is presently in a discovery process via an action brought to the Christchurch High Court by Caveators claiming Constructive Fraud).

DO NOT sell the ‘fragments remaining’ of the Otago Power Network (as bleated by some in power who can’t/won’t maintain a local body balance sheet – like you trust them, already?!) – to overseas corporates who will hike power prices disastrously to satisfy their shareholders.

Proceed carefully, OTAGO.

ASK QUESTIONS. RESEARCH. DO YOUR SUMS.
DON’T BE TOLD WHAT TO DO. ACT RESPONSIBLY FOR THE FUTURE PROSPERITY OF YOUR KITH AND KIN.
DO NOT PLACE FAITH IN OLD SPIN MAESTERS AND THEIR DEPUTIES.

We’ve seen them all before and have the new $1+ BILLION ‘invoice’ from Aurora Energy to prove it. Yes, we thought we had already paid over that amount in electricity and lines dues.

The suited ones bringing the clamour are looking after themselves – not US, not OUR COMMUNITY.

This is now a ransom.

The UGLY sister companies remain joined at the hip : Delta is Aurora Energy’s “preferred contractor”. And Steve is new, so don’t blame him! ….Really?

Aurora chairman Steve Thompson said it had been under the “spotlight and the heat lamp” since accusations broke last October that it was endangering the public and workers by leaving its network, and in particular power poles, to deteriorate. That pressure turned ugly at times and workers had been verbally abused, including while out doing their supermarket shopping. Mr Thompson blamed the abuse on what he described as unfair criticism and media coverage. But Mr Thompson said in the face of adversity, Aurora and its sister company Delta had achieved a “hell of a lot” in a short space of time. The two companies were well on their way to splitting up in a divorce which Mr Thompson said would cost money in the short-term but reap huge benefits in the long-term. Aurora was also mid-way through an ambitious accelerated pole replacement programme and this week announced a $720million plan to upgrade its ageing network.
….Mr Thompson said its actions should help renew the public’s faith in both companies, but emphasised he believed that faith had been unfairly shaken by what he described as over-the-top criticism in the past seven months. He said safety concerns about the 2910 red-tagged poles across Dunedin, Central Otago and Queenstown Lakes had been overblown. At the same time, Delta and Aurora’s efforts to confront the problem, both before and after the story broke in October, had been under-reported, he said.
….Despite his anger at the way Aurora had been treated by critics and in the Otago Daily Times, he was under no illusion the network was in top shape, saying it was the second oldest network in New Zealand and acknowledged major work was needed to improve it in the next 10 years. But he would not be drawn on whether the situation had come about as a result of decades of underinvestment, which has been one of the main criticisms levelled at Aurora since October. He said he was not in a position to comment given he only started midway through last year.

The father of one of the men killed in the Pike River mining disaster says the families have always believed the Government wasn’t telling the truth about mine safety.

The Government has long said high concentrations of methane inside the mine make it too risky to re-enter to retrieve the bodies of the 29 men killed in the November 2010 blast, because the gas could explode. But footage leaked to Newshub yesterday showed two Mines Rescue workers inside the mine three months after the explosion, with no gloves, apparently relaxed as they fashioned a makeshift cover for a robot out of cardboard and tape. The robot is seen to be steaming or smoking well inside the mine, but the workers do not panic – and nothing explodes. Bernie Monk, whose son Michael was killed in the November 2010 explosion in the West Coast coal mine, said the newly leaked footage did not come as a surprise. Cont/

Pike River families believe photos show bodies

It is understood that a decision from Solid Energy on whether it will allow recovery teams to re-enter the drift of the Pike River mine is imminent. The drift is not the mine itself, but the two-kilometre tunnel that leads to the mine.
Families of the victims are desperate for a mission to collect evidence and to see if there are any bodies in the drift.
They say if Solid Energy won’t do it, they will. They say they know there are bodies in the mine, and tonight, with their blessing and for the first time, we can show you their evidence. Dean Dunbar, the father of lost miner Joseph Dunbar, spoke with Campbell Live producer Kate McCallum. Watch the full interview with Dean Dunbar.

The piece was first performed at a concert attended by members of the miners’ bereaved families and was recorded by Radio NZ Concert. The choral arrangement is by Mark Dorrell. Also performing are Wellington Young Voices, Mark Vanilau (piano), Jo Barus (bass), Ross Burge (drums) and Chris Clark (cornet). With special thanks to TVNZ and Satellite Media – taken from the TVNZ documentary ‘Dreams Lie Deeper’.

I wish to follow up further on some of the attached invoices.

The following was reported in the ODT (28/11/16):

“On the issue of the corporate suite, Mr Cameron said like any large business, “from time to time we host our customers to strengthen the working relationships”.

In the past financial year, Delta spent about $9000 on food and beverage hosting customers at the suite…….” 

In light of Mr Cameron’s comments in the ODT, there are a number of invoices on which I request further information as follows:

1. Carisbrook Stadium Trust Invoice PSF-26, dated 5 December 2009, 10 Lounge Club Memberships $40,000+gst. Please state the names of those who have access to the 10 Lounge Memberships paid for by Delta. I note on the Forsyth Barr Stadium website the following: “As a Member of Forsyth Barr Stadium you can attend any of our scheduled events and take in the view from your own designated premium seat in the Speight’s Stand (South).”

This is obviously 10 premium seats in the Speight’s Stand on top of the seating in the Delta corporate suite.

2. Invoice 1343, dated 29/06/2012, Highlanders vs Chiefs includes Beverage $711.30+gst and 20 3 course meals @ $67.00 = $1340+gst.

How many of these guests were:

(a) Delta management staff

(b) Other Delta staff

(c) Delta directors

(d) DCHL directors

(e) Mayor and/or councillors

(f) DCC executive management team

(g) DCC staff

(h) Carisbrook Stadium Trustees (CST trustees/rich listers have reputation for receiving ‘gifts’ of tickets/catered meals at the expense of the ratepayers)

(i) Delta clients

(j) other – please state

The Forsyth Barr rugby stadium has now been open for over five years and as such the corporate boxes on a five year contract recently came up for renewal.
Given that Delta purchased a corporate box at $45,000 per annum, as outlined in your response below dated 1 July 2011, I request the following:
1. Has Delta renewed their corporate box contract for another five years?
2. If so, what is the new annual cost of Delta’s corporate box?
3. The name of those who made the decision to renew the corporate box contract.
4. A copy of all documents relating to the decision for Delta to renew their corporate box membership.

You have stated below:
“DELTA has a range of commercial sponsorship and advertising arrangements with organisations such as Otago Rugby Football Union, Alexandra Ice Skating Rink, ASB Otago Sports Awards and the arrangements are commercially sensitive between the parties.”

Given that you are claiming commercial sensitivity for declining to release the information re commercial sponsorship and advertising arrangements with the organisations mentioned above, I request the overall total amount Delta is paying in commercial sponsorships and advertising arrangements to the three organisations mentioned, namely the Otago Rugby Football Union, Alexandra Ice Skating Rink, ASB Otago Sports Awards.

Note that by releasing the total amount given to the three organisations, then the “commercial sensitivity” argument would not apply as none of the individual organisations would be able to be identified. A precedent has already been set with the Office of the Ombudsman in a previous complaint I made relating to stadium sponsorships.
The Ombudsman recommended release of the sponsorship information in totality so as not to interfere with the “commercial” arrangements.

I, therefore, expect full co-operation with this urgent request.

DELTA’s Chief Financial Officer is unchanged and is Mr Stephen Wilson.  The role of Chief Financial Officer is being advertised in advance of his planned retirement. The individual who approved the lounge membership application is no longer with DELTA and was not the Chief Financial Officer. As a point of clarification, the term “overzealous” that appeared in the Otago Daily Times report of 9 February was attributed to Mr David Davies and was not made by me.

1. DELTA has made approximately $50,000 of donations to outside organisations over the past three years linked to our Health & Safety related Charity Challenge. Organisations which benefited from these donations included, but were not limited, to:

Alexandra Scouts Group
Cancer Society
Otago SPCA
Otago Community Hospice
Make-A-Wish Foundation of NZ
St John Ambulance Service
Diabetes NZ Otago

In the past three years, DELTA employees have also participated in an annual Volunteers Day:

2010 – Alexandra Kindergarten tidy-up
2009 – PACT House (Mosgiel) working bee

3. a) No, DELTA has not spent or allocated any money, except for a corporate box at $45,000 per annum.
b) DELTA has successfully won and completed contracts for the Stadium project to the value of $4,039,267. These were secured under a [competitive] tender process operated by Hawkins Construction and Arrow International Limited. 
c) DELTA is not a party to the Guaranteed Maximum Price Contract for construction of the Forsyth Barr Stadium. Accordingly, your question should be directed to Hawkins Construction or Arrow International Limited. DELTA does not hold any information in relation to the Guaranteed Maximum Price Contract.

4. DELTA’s budgets are contained in the Dunedin City Holdings Statements of Intents which were presented to the Dunedin City Council on 7 February 2011 and are publically available on the Dunedin City Council website at http://www.dunedin.govt.nz/__data/assets/minutes_agenda/0006/166353/ma_fsd_r_dchl_2011_02_07.pdf . I have attached a copy for your information.

ORFU chairman quits —no thanks to DCC for all its help *sniff

Of course —with Professional Rugby the sense of entitlement goes a terrible long way. The Dunedin City Council, cracked and broken, has been unfairly or dishonestly “short-changed” by Otago Rugby and big brother NZRU. So too is the community of South Auckland (history: Jokers Bars, Gambling money spent out of area on Otago Rugby and Racing). What a delightful experiential and lucrative background exists to the Otago Union.

Straight up and rational, in the course of a chairman’s work, it’s simply the case that there’s been no mandate to name the rugby sponges who misused millions of dollars of public funds; although Jeremy Curragh, former ORFU change manager, suffered a moment when he was forced to blurt that a lesser amount of charitable funds had been misused by the union in yet another of its darkest hours. Nor has prosecution of ‘the deserving’ been progressed (fact), but then NZRU and DIA are fully committed to ‘looking forward’ rather than back at their contentious and damning files that might be, suddenly(!), lost or misplaced, or smoothly sealed and suppressed. That’s the political climate, nefariously yet continuously supported by a line-up of senior government ministers along with NZ Police, IPCA, SFO, the Auditor-general, and yes, the Ombudsmen.

Rugby: Harvie stepping down after getting tough job done

Doug Harvie will step down from the Otago Rugby Football Union’s board with the sport in a much better position than when he arrived. Harvie, a Dunedin chartered accountant, became chairman of the newly structured board in May, 2012. He was shoulder-tapped to stand and felt he could not say no.
Harvie (57), a former loose forward for the University and Dunedin clubs, said the new board did not want to look back on why it found itself in such a tough position. It was focused on getting the business of rugby back into a good shape in Otago.

IPCA Role and powers
The Authority has the following functions and powers under the Independent Police Conduct Authority Act 1988.

Action on complaints: Under the Act, when the Authority receives a complaint, it may carry out its own investigation, or refer the matter to the Police for investigation under the Authority’s oversight. If a complaint is referred to the Police for investigation, the Authority will take steps to ensure that it is properly resolved. This may include directing or actively overseeing the Police investigation, or reviewing or auditing the Police investigation once it is completed. That’s more than double the death toll compared with last year. And it’s despite the police’s misguided efforts to target speeding drivers with the hopelessly designed zero tolerance for speeding campaign. It’s a campaign that has utterly failed. Uber taxi battle sees police vs cabbies

After complaints from the old-school taxi firms, police have begun fining the Uber drivers whose lower fares have been hurting the big cab companies. Uber operates as a private hire service which means the fare has to be set at the time of booking, rather than using a meter. This means Uber does not have to abide by taxi regulations, thus saving on operating costs.

Vandervis: Deloitte and Police Citifleet investigations

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

An hour and a half spent with Detective Matthew Preece and another Policeman called Regan has left me with deep concerns regarding the Police Citifleet investigation.
Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

and that consequently none of these fraud areas is being investigated!

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Can you please also now with urgency, forward to me all instructions to Deloitte regarding the Citifleet investigation as previously requested in my email of 26/10/14 as below.

Is it possible to meet with you at any time tomorrow at your convenience to learn whether you have broadened the DCC Police complaint or not?

Further to my verbal requests of a week or two ago please forward copies of all original correspondence and or other direction given to Deloittes in regard to their investigation of Citifleet.
I wish to have the original brief stating the terms of reference, the subsequent brief where the investigation needed to be extended, and any other direction written or otherwise given to Deloittes regarding the Citifleet investigation.
I am deeply disturbed by what I have seen in parts of the investigation conclusions appearing without covering page or any details identifying them as parts of the Deloitte findings in non-public parts of the Audit and Risk subcommittee meetings.
I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Background
Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are required.

Charity expert Michael Gousmett has labelled the failure to pursue the investigation a cop-out. “To brush it under the carpet, [Internal Affairs] is basically abdicating their responsibility,” Gousmett said. “They tend to pick on the low-hanging fruit and you would have to question what the real purpose of the regulator is.”

Glenn charity probe dumped

Internal Affairs has abandoned an investigation into alleged irregular payments for a thoroughbred racehorse made by Sir Owen Glenn’s charity. After being under investigation for 18 months, the Glenn Family Foundation Charitable Trust charity was voluntarily deregistered on December 1. The charities regulator launched an investigation after emails appeared to show payments from the Glenn Family Foundation to a bloodstock company and Sir Owen’s personal bank account.
The alleged irregular payments surfaced in an email from former trust chief executive Peter McGlashan to Sir Owen, in which he wrote “large international transfer payments you requested be made to Bloodstocks Ltd and to your account in Sydney”. McGlashan’s email stated the payments “are not typical” of a charitable trust and will “no doubt need explaining” when the charity’s accounts were being prepared.
Charities service general manager Lesa Kalapu defended the length of the investigation, and lack of a resolution, saying there had been delays because Sir Owen lived overseas. “Purely because of the scale, and the international aspect to it, there were delays.” She said there was a “fair level of co-operation”.
Sir Owen told the Herald on Sunday negative media coverage had forced him to leave New Zealand.
The Charities Service came under the Department of Internal Affairs in July 2012.

Why is there no law to rein in dodgy ratbag local body politicians?

Former ARC Councillor Bill Burrill is not the first dodgy ratbag Councillor to trough from abuses of power to his own pecuniary advantage in recent years. A few years back in 2009 Council Watch was calling for a number of Councillors from the Canterbury Regional Council to be prosecuted and sacked from their positions after an investigation by the Auditor General Lyn Provost found that four individuals had broken the law by acting in conflict with their official role. Back then those Canterbury Councillors failed to declare a conflict on interest that [led] to a financial benefit for themselves by participating in discussion and voting on proposals before Council. Under investigation the Auditor General’s office chose not to prosecute stating that whilst the Councillors should have withdrawn as a matter of principle – they had each received and shared legal advice that they could participate. And here in lies the problem. The Auditor General and Office of the Ombudsmen publish clear guidelines for Councillors and council staff but the reality is that the law is erroneously filled with holes that are exploited and there is precious little oversight of Local Government leading to the Auditor General loathing to bother and the Courts uninterested.

I have followed up your question of clarification about the SFO and can provide the following response:
Under the circumstances of a suspected fraud (as per the Citifleet situation at the beginning of the investigation), the normal course of events is that the SFO is informed of issues when they arise. Deloitte did this via a phone-call to the SFO on 12 June 2014, after a discussion with DCC staff at a meeting of the Investigation Steering Group. The steering group were fully aware of the fact that Deloitte was speaking with the SFO and were informed of the outcome of the call. The call to the SFO was us asking the SFO to consider an investigation.

The discussion on 12 June 2014 (which was with a case officer and with Nick Paterson, the GM Fraud and Corruption) summarised the facts and circumstances of the Citifleet issues and sought the view of the SFO.
It is then the SFO’s decision as to whether they commence their own investigation. This is based on the criteria set out on their website (copied below)

There are multiple victims (usually investors) of the suspected fraud

● The sum of money lost exceeds $2,000,000

● The alleged criminal transactions have significant legal or financial complexity beyond the resources of most other law enforcement agencies.

In the case of bribery or corruption matters, we focus on crimes involving public officials, which could undermine public confidence in the administration of laws

Based primarily on the fact that the main suspect was deceased and that the actions appeared to be those of one corrupt individual rather than fitting within the definition of bribery and corruption, the GM Fraud and Corruption decided that the best course of action was for Deloitte to complete its investigation and provide a copy of the report at the conclusion of its work. During the investigation and with permission from DCC, Deloitte provided an update on the investigation to SFO on 07 July 2014 via letter. A copy of the full report was provided on 21 August 2014. We have heard nothing back from the SFO to date.

As to confidentiality, these OIA replies are all able to be made public and as such they will be published on the website and I will be providing a copy of the information to all Councillors.

I am not convinced that Police requests for a further unspecified number of months of ‘no public comment’ is in the public interest, and my discussion with the Crown Solicitor was also unconvincing on this point.
You say below that ‘the investigation is not a process which you as a Councillor (or I) in our governance roles have a right to’, yet you have the right and have read the Deloitte Citifleet Investigation Report and made numerous public comments, and I have been denied seeing it even on a ‘grey papers’ basis and am being muzzled. Your ‘operational only’ claim is generally questionable and in this case fails on all counts.
We will never know all the facts, especially if the withholding of the Deloitte report and more public muzzling continues.
In one of your media statements you say that Council have agreed not to comment until the Police have completed their belated investigation, but this is not true. Councillors have not been given the opportunity to even discuss a further number of months of no comment on Citifleet, leave alone agreed not to comment. I have certainly not agreed and do not agree.

Thank you for acknowledging my long standing demands that DCC ‘heads should roll’. My long political experience is that timely public disclosure will be necessary to ensure that the appropriate heads are dispatched, and that an embedded DCC culture of self-entitlement across many departments is permanently erased.

I am not suggesting Councillors do not have the right to ask questions or make requests. What we do not have a right to do is step outside our governance roles, interfere with legitimate operational matters particularly without knowing all the facts, and unilaterally jeopardize Council and ratepayer interests. If we do we should be fully held to account for that.

Praise for DCC’s new internal controls

The Dunedin City Council’s move to tighten internal controls has been praised by the Office of the Auditor-general, even as the investigation into an alleged $1 million Citifleet fraud continues. The words of encouragement came from Auditor-general Lyn Provost as she addressed a meeting of the council’s new audit and risk subcommittee during a visit to Dunedin yesterday. But, despite the headlines and unanswered questions about why the alleged fraud was not detected, including by auditors, the word “Citifleet” was not uttered yesterday.

The Department of Internal Affairs has welcomed a decision by the Gambling Commission which has found that a Blenheim based gaming machine society, Bluegrass Holdings Limited, obtained its licence to operate pokie machines by deception and that a decision to cancel its Class 4 operator’s licence was warranted. The Commission’s decision, published today, 5 August 2014, comes after a two year protracted and complicated process between Bluegrass Holdings and the Department.

Internal Affairs’ Acting Director of Gambling Compliance, Raj Krishnan, says action was taken to cancel Bluegrass’s licence in July 2012 because of concerns about the suitability of Bluegrass’s operations including the actions of particular key individuals.

“Bluegrass’s deliberate and repeated efforts to deceive the Secretary were intolerable. There is no room for such behaviour in the gambling sector and we are pleased that those involved will now need to move on. We put a lot of effort into this case as we believe ensuring the integrity of the gambling sector is of great importance. Gaming machine societies exist to distribute funds for the community. Millions of dollars are involved and the utmost integrity is required,” says Mr Krishnan.

The Gambling Commission found that Bluegrass provided false and misleading information to Internal Affairs about its funding, those involved in the society and the role of Blenheim man Mike O’Brien in particular. Mike O’Brien is well-known in the harness racing community and is the son of Patrick O’Brien, former chairman of Harness Racing New Zealand and former chair of Bluegrass, which primarily provided grant money to the racing sector. The Commission says documentary evidence indicates Mike O’Brien “covertly exercised influence over the society’s grants and operation….” (Paragraph 66)

The Commission’s decision notes that the efforts to deceive the Department were repeated and took place from the time of Bluegrass’s initial application, through the investigation process and continued during the course of formal proceedings. The deceit stemmed from Bluegrass’s failure to advise the true source of funding to establish the society as well as the role of Mike O’Brien.

“It is unlikely that the Secretary [of Internal Affairs] would have granted the licence application if he had known either that the money had been advanced by Mike O’Brien or that its ultimate source was three racing clubs. The Appellant obtained its licence by providing materially false and misleading information to the Secretary.” (Paragraph 82)

The Commission also found there was evidence that Bluegrass was open to being influenced by its venue operators, contrary to the Gambling Act 2003 and it believed that allowing venue operators to exercise influence over grants was necessary to its survival. (Paragraph 65)

The Commission found the evidence of Bluegrass’s present chair, Blenheim electrician, Peter Gurr not to be sufficiently credible and compelling to remove the doubts as to Bluegrass’s suitability. The Commission says the nature of the deception means it is appropriate for Bluegrass’s licence to be cancelled to “deter other applicants from similar attempts in the future”.

“The circumstances of the case illustrate that detection of this sort of deception is difficult and it is important therefore that the consequences following detection are sufficiently serious to prevent the operation of licensing regime being undermined by the provision of false or misleading information for the advantage of applicants.” (Paragraph 89)

Mr Krishnan says: “This type of behaviour detracts from the good work of many others who distribute pokie grants for the benefit of the community. We’d encourage operators to take close note of this decision and let it serve as a benchmark as to what is expected from them. This type of deceptive conduct and efforts to mislead are also captured in investigations presently being conducted by Internal Affairs, the Serious Fraud Office and Police.”

Bluegrass Holdings Ltd owns 144 gaming machines (pokies) at eight pubs around New Zealand.

“Internal Affairs is currently assessing the behaviour of the people who are responsible for the gaming machines at those venues. We have a duty to the wider community to ensure that venue operators are ethical and uphold the law. Whether those pubs will be allowed to continue operating pokies will depend on whether we are satisfied that all the relevant criteria are met,” says Mr Krishnan.

In accordance with the Commission’s decision the licence cancellation will come into effect on 18 August 2014.

Questions and Answers

1. What happens on 18 August to the pokie machines owned by Bluegrass?
Once Bluegrass’s licence to operate is cancelled on 18 August all its machines are turned off. We’d expect the machines to be sold possibly to another gaming machine society. (See Q5 for further details)

2. Doesn’t this action mean less money will go into the community?
There is no evidence to suggest that overall gambling profits will decrease if the venues in question cease to offer gambling. Those who gamble at these venues are likely to simply gamble elsewhere if the venues lose their licences.

3. What happens to the money already collected from people gambling on the machines?
The Gambling Act (2003) specifies that once a society’s licence is cancelled the remaining net proceeds from its Class 4 gambling must be distributed to authorised purposes in the community within 20 working days, unless a further period is agreed to by the Secretary (for Internal Affairs). Internal Affairs will be working with Bluegrass to ensure the correct distribution takes place.

4. What happens to the organisations which received money from Bluegrass last year?
No organisations which have had their funding applications already accepted by Bluegrass should lose out. Bluegrass was set up to primarily distribute funds to the racing sector. There is nothing to stop the racing clubs (or other community organisations) that received funds from Bluegrass from applying for pokie grants from other gaming machine societies, which are the organisations responsible for distributing the proceeds from gaming machines to the community.

5. What happens to the eight pubs which have Bluegrass machines? Can they transfer to another society?
Yes they can, however this requires a fresh licence application to be made to the Department for each venue, and we will assess each application on a case by case basis. We will assess in detail both the behaviour of the venues and the history of compliance of the societies applying to take the venues on. We have a duty to the wider community to ensure that the operators in the gambling sector are ethical and uphold the law. Each time the Secretary (of Internal Affairs) makes an approval decision in respect of an application by a society to take on a new venue, he must be satisfied of both the venue’s ability and the society’s ability to operate in a compliant fashion. We will not grant a venue application until we have worked through the enquiries we need to make to be sure that these venues and societies are compliant in all respects. It should be noted a recent decision by the Gambling Commission emphasises that the onus is on the applicant society to satisfy Internal Affairs that the relevant criteria are met.

6. Does the action of DIA mean that those pubs will go under?
If a venue is compliant with the law and aligns with a compliant gaming machine society, then there is no reason why is should not continue to be able to operate pokie machines. We should point out that pubs host pokie machines voluntarily, and when they do, they are only able to recover the cost associated with hosting those machines, up to a limit. The Gambling Act did not intend for pubs to make profits from hosting pokie machines. Therefore, if these venues are dependent on the money from pokies for their survival something is wrong with the underlying viability of the venue

7. Does this action mean that those involved in Bluegrass will never be able to operate in the pokie sector again?
Yes, it is our intention to ensure the integrity of a sector which generates approximately $800 million per annum in turnover. Given the large amount of funding generated by gambling the highest levels of sector integrity are vital to make sure that the community doesn’t lose out on much needed grant money, and that those in the sector, who comply and do the right thing, aren’t undermined. Our recent actions demonstrate that we will detect unlawful and dishonest behaviour, and take whatever action necessary to reduce and eliminate non-compliance.

Brownlee lashes ‘tosspot’ journalist

The Australian journalist who fled New Zealand after being labelled a “boorish tosspot” by National minister Gerry Brownlee for his insensitive approach to the Pike River mine disaster has declared it the finest moment of his career. Brownlee, however, has told the Sunday Star-Times that Ean Higgins remained a tosser, but had also proven himself a fantasist and an “obnoxious twerp”.
[…] Higgins’ self-congratulatory essay about his brief Pike River coverage was certainly inflammatory.

He called New Zealand “a small, meek and mild democracy” and said: “The New Zealand journalists didn’t ask any uncomfortable questions, being happy to accept whatever the police, the company and the miners’ rescue people told them . . . the Australian journalists, coming from a more robust tradition . . . did ask the tough questions”.

He describes the two groups of journalists dining separately in “the only good restaurant” in Greymouth and the Aussies deciding “we were really going to get stuck into the company and the authorities and show the Kiwis real journalism and workshopped a few really brutal questions”.

Serious Fraud Office faces cutback

A 25 per cent funding cut means the Serious Fraud Office will take on less cases, MPs were told this week. Funding to the agency is forecast to decline by 24.7 per cent from $10.180 million in 2013/14 to $7.670 in 2014/15. Parliament’s law and order select committee heard that the number of complaints received has more than doubled from around 200 to 435. But chief executive Julie Read told MPs the agency will have to prioritise the work it does, taking on two out of six low level cases as a deterrent.

“I think it is fair to say that the way we prioritise cases probably changed at the beginning of the Global Financial Crisis overall…I’ve anticipated that foundation will continue but we may have to adopt some additional tactics depending on the nature of the cases.”

The committee heard the agency is starting to see more corruption and bribery complaints often at the lower level, than bigger finance company cases. In the year ending June 2013, 30 new investigations were launched.

Super City elections 2013: West’s ‘ugly’ culture has Tamihere fuming

Colourful talk radio host MP John Tamihere wants to change what he sees as liquor trusts’ unhealthy monopoly from the inside but they defend set-up as democracy in action, saying proportion of payouts to turnover is about to pick up.

What we’ve just seen [on the crawl], he says, is an example of how West Auckland’s alcohol licensing trusts use their control of the region’s pubs to maximise gambling revenue through pokies. The gambling money, he says, is then used to peddle influence and spread pro-trust propaganda, which reinforces the position of the liquor trusts.

The West’s drinkers are suckers, says Tamihere. They pay over the odds for their booze at the trusts’ bottle stores, are forced to drink in dives and are subjected to banks of pokies when they do. “It’s an ugly drinking culture,” says Tamihere. “It sets up a false world where the leadership of the trusts can make out that we don’t have any drinking problems out West. That is because we migrate them into town or over on to the Shore. No right-minded youth or family will go out anywhere in the West because they are dives. The culture has been perverted by the way the trusts just want to monopolise pokies.” Tamihere wants to get elected so he can change things from the inside. But is change really necessary? Like many things involving the colourful talk radio host, the answer is not straightforward.

Two weeks later we take another tour, this time with Ross Clow, the long-serving president of the Portage Licensing Trust and chairman of The Trusts Community Foundation.

As well as rebutting Tamihere’s ugly drinking culture claims, Clow’s aim is to show where the money from the liquor trusts’ combined $100 million turnover is going. Money, it will surprise no one, is at the heart of this issue. TTCF’s accounts show it paid $10.57 million in pokie revenue to West Auckland causes last year. Clow stands firmly by the claim that 97 per cent of the cash raised out West is returned to the West. He should know. As president of the Portage trust he is responsible for making the recommendations to TTCF on how money raised in its venues should be spent. Given he is also chairman of TTCF, Clow could be accused of making recommendations to himself. He defends the system as a sound way of making sure the money goes to the right places and insists he recuses himself when TTCF votes on Portage’s recommendations.

Tamihere disputes figures surrounding the return of money to West Auckland, but says he won’t be able to prove his case until he gets access to the trusts’ full accounts. “If I have to go to the High Court to break it open I will,” he says. “There is something not right here. I know my community. There is nothing like that being spent out here.”

Then there is the question of who really distributes the money. For years statements issued by the liquor licensing trusts have indicated the money comes from them. It doesn’t. It comes from TTCF, which is a separate financial entity.

Otago Racing Club president Dean Lawrence has one request for this season – a little less rain, please. Lawrence, who was re-elected unopposed as president at the club’s annual meeting last night, rued the bad weather which plagued the first half of his maiden tenure as he presented his annual report to the committee at Wingatui last night. The loss of a race meeting due to bad weather at the start of last season got the club’s season off on the wrong foot and the bad luck continued with wet and cold conditions on Melbourne Cup day and Boxing Day, Lawrence said.

Sports clubs feeding off gamblers

Sport in New Zealand is propped up by around $180 million in gambling revenue each year, creating a cycle of dependency health experts have likened to big tobacco sponsorship. While proceeds from Lotto and a levy on TAB sports betting boost the bank balances of most national sports bodies and help fund high performance athletes, pokie gaming trusts are by far the biggest contributor.

Payouts in 2013 have taken the total pokie money contribution to sports funding past the billion-dollar mark over the last seven years.

In 2012 gaming machines contributed $134,202,165 across the sporting sector. A controversial pokie trust paid out nearly $100,000 to a racing group to buy a small piece of racetrack from one of its own club members. The grant made to Gallop South – thoroughbred racing’s umbrella body for Southland and Otago – was then paid to the Oamaru Jockey Club to buy a section of the Oamaru racecourse.

The move has been slammed by industry sources as “pure naked greed” and a “desperate way” to grab pokie funds.

The grant was made by The Trusts Community Foundation (formerly the Trusts Charitable Foundation), subject of several critical stories by the Sunday Star-Times, including its close relationships and multimillion-dollar grant funding of the racing industry. One source close to TTCF said it was a clear case of racing interests “coming up with desperate ways to rort gaming funds with the tacit aproval of an ineffective regulator”.

Multimillion-dollar pokie scams just won’t go away.

ORFU logoDIA/SFO parade their joint investigations in the media at the same time they appear to avoid TTCF. Why? Remember it was our own ORFU that started the Jokers rorts in 2005 – they bought the Jokers Bars in Auckland and after 18 months sold a 50% stake in Jokers to Mike O’Brien and Harness Racing interests.

It seems Rugby has total immunity in New Zealand, as do Licensing trusts, and on that basis TTCF are just too big to fail.

“On 3 December 2014, the Wellington District Court (with Mr Molloy’s consent) issued an Order under the Harassment Act.

The court order sets out a series of conditions including that Mr Molloy cannot publish or caused to be published or retain online any statements concerning or about me [Greg Purcell]. You will note that the offending material about me has been removed from the Racecafe website, including the posts which you have republished.

You may be aware that on 20 December 2013 Mr Molloy published an apology to me, stating:

“Over the past three years I have made a number of comments and statements on the Race Cafe website about you and others which have been offensive, insulting or abusive.

Some of my comments have said, or implied, that you are corrupt, fraudulent or dishonest.

I acknowledge and accept that is not the case.

I am sorry that I made these statements and regret any hurt or distress that this has caused. As you know, I am in the process of withdrawing them from the website and have undertaken to stop making such statements in the future.

I fully and sincerely apologise to you for making them.
