Council manager guilty of majority of corruption charges

A roading contractor and a council manager have been found guilty of corruption in a case exposing what the prosecution called a “culture of corruption” among Auckland council staff administering tens of millions of dollars in roading contracts. Justice Sally Fitzgerald delivered her verdict this in the High Court at Auckland this morning in the long-running trial of former Auckland Transport senior manager Murray Noone and roading engineer contractor Stephen Borlase. Noone was found guilty on six charges of receiving $1.2 million in bribes from Borlase. Borlase, in turn, was found guilty on eight charges of offering bribes to Noone and other council staff. Borlase was found not guilty on four charges of dishonestly using a document to allegedly inflate invoices to council. The corrupt relationship ran from 2006 until 2012, from Noone worked at Rodney District Council, continuing when he joined Auckland Transport following the supercity merger.

Dunedin’s historic courthouse to be restored

Courts Minister Amy Adams today announced that Cabinet has agreed to the strengthening and restoration of Dunedin’s historic courthouse.

“The Dunedin courthouse is one of New Zealand’s most notable historic buildings and Cabinet’s decision reflects its significance, both as a part of the city’s rich cultural heritage and its importance to the region’s legal fraternity,” Ms Adams says.

“From the beginning, I’ve maintained that it’s been my intention, expectation and desire to see court services returned to Dunedin’s historic courthouse and this decision delivers on that commitment.”

The project includes earthquake strengthening and restoration, as well as the cost of provision the buildings to operate as modern court facilities. The project is estimated to cost more than $15 million and this will include seeing the building strengthened to between 60 and 70 per cent of the National Building Standard.

“The strengthening project is anticipated to take two years to complete and the Ministry of Justice will continue to deliver quality services from the temporary court in High St in the interim,” Ms Adams says.

Ministry of Justice will call for tenders in the first half of next year and it was hoped a main contractor would be appointed later in 2016.

Ms Adams says the costings in the business case had been comprehensively investigated and peer reviewed by a number of independent specialist engineers, and costed by quantity surveyors, before being subjected to a robust review by The Treasury.

“The investigations showed that as a category one heritage building, strengthening the court house is a complex project and requires a significant capital investment.

“I acknowledge the deep support locals have shown for the historic courthouse throughout this process.”

The facility in Stuart St was closed in 2011 after engineers found that parts of the building fell well short of the minimum 34 percent rating required under the National Building Standard. A temporary facility has been established at High St to ensure court services could continue to be delivered to the people of Dunedin and Otago in the interim.

With Cabinet’s decision, managing the restoration process now becomes an operational matter for the Ministry of Justice.

Official Information Act review finds ‘no deliberate misuse’

A high-level review of the Official Information Act will not uncover any widespread political interference in the release of information, its author says. The Ombudsman’s Office will release the findings from its comprehensive, year-long review next week. Chief Ombudsman Dame Beverley Wakem said today that the investigation had not discovered malicious or deliberate misuse of the Act by ministers’ offices or by Government departments.

“We’ve really shaken the tree over this and haven’t been surprised by what’s fallen out,” she told a Parliamentary committee this morning.

She admitted that she had suspected political interference, but had found no hard evidence of it. Dame Beverley said people who had complained to her office could be perceiving political spin or “bad behaviour” when it did not exist, and she could not make any findings “based on hearsay”.

An online petition is the latest strategy of the Dunedin City Council backed group trying to pressure the Government to restore the historic Dunedin courthouse. Set up by Dunedin city councillor Aaron Hawkins, a member of the Dunedin Courthouse Task Force, it had more than 220 signatures last night. The courthouse is in limbo as it lies vacant with no plan yet for its future.

SAVE OUR COURTHOUSE

Dunedin’s Courthouse building has been the seat of justice in Dunedin since it was built in 1901. Following extensive renovation and restoration by the government in 2002, in 2011 it was declared an earthquake risk, and progressively mothballed.
There have been questions raised by reports detailing the further work that needs doing, and what it will cost, that remain unanswered. In the meantime, $6.8m has been spent fitting out temporary courts in an office building on High St, at an ongoing cost of $600,000 a year.
We’re calling on Justice Minister Amy Adams – and other Ministers who have a responsibility to the court – to commit to a timeframe for the return of the courts to their home on Lower Stuart St.

Mangawhai Ratepayers at Court of Appeal

Joel Cayford [‘Reflections on Auckland Planning’] updates the Court of Appeal hearing (25-26 August) – Mangawhai Ratepayers and Residents Association v Kaipara District Council – in front of Justice Rhys Harrison, Justice Mark Cooper, and Justice Forrest Miller.

Mangawhai Ratepayers and Residents Association (MRRA) is represented by Matthew Palmer QC and barrister Kitt Littlejohn. David Goddard QC represents the council.

Cayford summarises the “causes of action for this hearing – which followed the judicial review heard by Justice Heath (posts here and here)”:

“that the Kaipara District Council (KDC) does not have the power to rate for unlawful purposes. That KDC acted unlawfully in deciding to enter into and expand the Ecocare Wastewater Scheme, and that it could not then enforce rates on ratepayers.

“that the Validation Act did not retrospectively validate ALL matters stemming from those unlawful decisions. It only validated various historic rating defects. Significant matters – including the additional $30,000,000 loan were not dealt with or validated by the Validation Act.

“that the KDC acted inconsistently with the Bill of Rights Act by initiating Validation Legislation which had an effect of undermining MRRA judicial review proceedings – to which they had a right.”

Of critical interest, Cayford says Matthew Palmer, in his closing, “told the Justices, to the effect: “a consequence of adopting the arguments of my learned friend would mean that any Council in New Zealand can breech Local Government Act provisions with impunity, leave ratepayers with the bill, and mean that Long Term Plans all become window-dressing, ratepayer submissions become meaningless. That cannot have been what Parliament intended.””

Police and fire service were called to a false alarm at the Dunedin District Court building this morning after a sprinkler was tampered with. Senior sergeant Steve Larking, of Dunedin, said someone inside the High St building damaged the sprinkler, causing it to activate.

Your editorial last weekend (ODT 9.5.15) regarding the fate of the courthouse and your suspicion of the Ministry of Justice’s true agenda is sadly, prescient.

It is extremely unlikely that there is any will by the ministry at all to strengthen and retain the courthouse.

Lund South completed the restoration of the main courthouse in 2002. During that project we were party to candid discussions about the history of the courthouse restoration project and how it very nearly did not happen. The attitude of the courts even back then was that they weren’t getting any extra funding for restoration of the courthouse. They viewed the historical and heritage significance of the building as someone else’s problem. The courts had negotiations with the owners of an office building in the CBD, and very nearly signed a lease to put the courts there. It was only due to the hectoring of certain persons in the design team and a sympathetic official within the department that saw the project proceed, albeit very reluctantly, and with ongoing demands throughout the project to cut costs.

Of course the pressures on all government spending in the current Joycean environment are far worse than those benign days of the early 2000s. About $11 million was spent on renovation and extension of the courthouse in a project completed in 2003.

The department has now spent or will spend more than $6 million on a temporary facility, not the $3 million you noted in your editorial. That suggests that this is not a temporary fix.

We can be sure about this because we were also involved in the construction of the temporary courts in the old BNZ building in 2001.

That temporary facility that served very satisfactorily (apart from an issue with insufficient acoustic separation in the jury room that was easily fixed) and cost about 10%, just one 10th of the current expenditure on the new temporary facility.

The strategy employed by the department is quite obvious. They have commissioned a national engineering consultancy that is not known for creative or economic solutions. The firm is also well known for being unreceptive to alternative design proposals, their attitude being, “this is our project, we are going to do it our way”. Another government department had to threaten to sack them from a $30 million project in 2013 when they refused to consider an alternative structural proposal that ended up saving the department several million dollars.

Local engineers familiar with the building are convinced the scope and the cost of the work required would be dramatically less than the current proposal.

We have seen this scenario play out in the case of the Oamaru courthouse, where an alternative proposal at an estimated cost of one-third of the courts engineers’ estimate still was not enough to convince the courts to stay in the building.

Dunedin residents might well ask why this is? Surely, if the building can be strengthened at reasonable cost it is worth doing?

The answer is that this department, like others, simply sees old buildings as a money pit for ongoing repairs and maintenance and its budgets are blind to the wider benefits to the community of retaining heritage.

The Ministry of Justice is staying tight-lipped about a change of plan over earthquake-strengthening the Stuart St courthouse in Dunedin, after spending more than $600,000 on its design. This week, the ministry announced the indefinite closure of the historic courthouse, which has been partially closed since December 2011. Court staff and most hearings will be based in the temporary courthouse in High St from May 18.

Tena koutou, tena koutou, tena koutou katoa […] It is my privilege today to formally open this wonderfully refurbished building, which has been so important to the development of the law in New Zealand, and is the focus of so much interest for the people of Dunedin.
History of building
When Acting Premier Sir Joseph Ward opened this Courthouse just over 100 years ago, in June 1902, he described it as “the finest in the colony”. The Courthouse was, and remains, a showcase for local stone and the skill of its builders. Dunedin Courthouse - Justice (2012) via Heritage New Zealand. Photo by Phil Braithwaite [4374c_lg]However, the statue of Justice – which is directly above me – was imported from Italy. As Mayor Turner pointed out, the statue does not have a blindfold – the usual way the impartial processes of justice are portrayed. Although I am attracted to the Mayor’s explanation, I like to think of this omission as symbolising the farsighted vision of the pioneering women who took up the law in this city and set the stage for those of us who have followed.
While it has always been hailed as one of finest examples of Victorian Gothic architecture in New Zealand, this building became woefully inadequate as the century progressed. There was far too little space, the lighting, ventilation and heating systems were antiquated, and there were doubts about the safety of the structure in an earthquake. Then seven years ago, as we have heard, the sword fell from the presiding statue of Justice – perhaps she was trying to tell us something!
Courts rebuilding programme
The renovation and extension of this historic courthouse represents a significant capital investment – about $11 million in total. The work is part of a major building programme being undertaken by the Department for Courts. It is an investment that – as anyone involved will tell you, not just here but around the country – has been a long time coming.

Notable Features:
Its size and grandeur as a gothic building and its unmodified state.

Architect: John Campbell, Government Architect
Although John Campbell (1857-1942) designed the Dunedin Law Courts (1899-1902) in the Gothic style with a Scottish Baronial inflection, he established Edwardian Baroque as the government style for police stations, courthouses and post offices throughout New Zealand.
John Campbell served his articles under John Gordon (c1835-1912) in Glasgow. He arrived in Dunedin in 1882 and after a brief period as a draughtsman with Mason and Wales joined the Dunedin branch of the Public Works Department in 1883. His first known work, an unbuilt design for the Dunedin Railway Station, reveals an early interest in Baroque architecture. In November 1888 Campbell was transferred to Wellington where in 1889 he took up the position of draughtsman in charge of the Public Buildings Division of the Public Works Department. He remained in charge of the design of government buildings throughout New Zealand until his retirement in 1922, becoming in 1909 the first person to hold the position of Government Architect. Government architecture designed under his aegis evidences a change in style from Queen Anne to Edwardian Baroque. His best-known Queen Anne design is the Dunedin Police Station (1895-8), modelled on Richard Norman Shaw’s New Scotland Yard (1887-90). Among his most exuberant Edwardian Baroque buildings is the Public Trust Office, Wellington (1905-09). […] In 1911 Campbell won the nation-wide architectural competition for the design of Parliament Buildings, Wellington. Although only partially completed, Parliament House is the crowning achievement of Campbell’s career.

Construction Details:
The walls are built of Port Chalmers breccia with Oamaru stone window framing, parapets and pinnacles. (It is somewhat unusual for a Dunedin building to be completed in breccia rather than Leith Valley andesite with breccia foundations.) The roof is slate. The marble figure of Justice over the Stuart Street door in Italian and is not blindfolded. The High Court is lavishly gothic, with Rimu emblems and mouldings and with fine cast iron work fronting the jury and press seats and the witness stand. The major doors have gothic arches and the main staircase has a handsome cast iron balustrade. The Law Library still retains its fine built-in bookcases and heavy oak furniture.
An earlier law courts building existed to the east of the present site which was originally occupied by the Dunedin gaol. Later the courts moved to the Provincial Council building in the Exchange. Probably it was the availability of this latter building which delayed the erecting of the purpose-built home for the courts to as late as 1900.

Architectural Significance:
This is a late major gothic building for Dunedin. Only the University buildings around the archway are later in this category of building. It is reasonably pure in its styling, lacking the hybridisation with the classical apparent in some other buildings of this period.

Townscape/Landmark Significance:
The Law Courts form part of the impressive Castle Street precinct which includes the Florentine Railway Station across the road, the Central Police Station and the Otago Early Settlers building.

ORFU chairman quits —no thanks to DCC for all its help *sniff

Of course —with Professional Rugby the sense of entitlement goes a terrible long way. The Dunedin City Council, cracked and broken, has been unfairly or dishonestly “short-changed” by Otago Rugby and big brother NZRU. So too is the community of South Auckland (history: Jokers Bars, Gambling money spent out of area on Otago Rugby and Racing). What a delightful experiential and lucrative background exists to the Otago Union.

Straight up and rational, in the course of a chairman’s work, it’s simply the case that there’s been no mandate to name the rugby sponges who misused millions of dollars of public funds; although Jeremy Curragh, former ORFU change manager, suffered a moment when he was forced to blurt that a lesser amount of charitable funds had been misused by the union in yet another of its darkest hours. Nor has prosecution of ‘the deserving’ been progressed (fact), but then NZRU and DIA are fully committed to ‘looking forward’ rather than back at their contentious and damning files that might be, suddenly(!), lost or misplaced, or smoothly sealed and suppressed. That’s the political climate, nefariously yet continuously supported by a line-up of senior government ministers along with NZ Police, IPCA, SFO, the Auditor-general, and yes, the Ombudsmen.

Rugby: Harvie stepping down after getting tough job done

Doug Harvie will step down from the Otago Rugby Football Union’s board with the sport in a much better position than when he arrived. Harvie, a Dunedin chartered accountant, became chairman of the newly structured board in May, 2012. He was shoulder-tapped to stand and felt he could not say no.
Harvie (57), a former loose forward for the University and Dunedin clubs, said the new board did not want to look back on why it found itself in such a tough position. It was focused on getting the business of rugby back into a good shape in Otago.

IPCA Role and powers
The Authority has the following functions and powers under the Independent Police Conduct Authority Act 1988.
Functions: Under section 12 of the Independent Police Conduct Authority Act 1988, the Authority’s functions are to:
● receive complaints (i) alleging misconduct or neglect of duty by any member of Police or (ii) concerning any Police practice, policy or procedure affecting a complainant; or
● investigate incidents in which a member of Police (acting in the execution of his or her duty) causes or appears to have caused death or serious bodily harm.
Action on complaints: Under the Act, when the Authority receives a complaint, it may carry out its own investigation, or refer the matter to the Police for investigation under the Authority’s oversight. If a complaint is referred to the Police for investigation, the Authority will take steps to ensure that it is properly resolved. This may include directing or actively overseeing the Police investigation, or reviewing or auditing the Police investigation once it is completed. The Authority may also decline to take action on a complaint – for example, if the complaint is very minor or outside the Authority’s jurisdiction. The Authority’s powers in relation to complaints are set out in section 17 and section 19 of the Act. Read more

IPCA Vision and values
The Authority’s mission is to promote public trust and confidence in New Zealand Police. […] The Authority’s values include independence, trustworthiness, accountability, vigilance, and integrity. The Authority exists to support public expectations – as expressed by Parliament – for the justice system to be trusted and effective.
Outcomes: The Authority is funded through Vote: Justice and contributes to the overall justice sector outcome ‘A safe and just society’ and to the following three justice sector goals: accessible justice services, effective constitutional arrangements, and trusted justice system. IPCA Accountability
The Authority is an independent Crown entity, which means it is accountable to Parliament for its use of taxpayer funding. The Authority is independent in its day-to-day operations. It cannot be told how to handle an investigation, or what the outcome of any investigation should be. However, the Authority is taxpayer-funded and it must account to the responsible Minister and to Parliament for its use of those funds. Read more

IPCA Independence
The Independent Police Conduct Authority is fully independent – it is not part of the Police. ‘Independence’ means that the Authority makes its findings based on the facts and the law. It does not answer to the Police or anyone else over those findings. In this way, its independence is similar to that of a Court. The Independent Police Conduct Authority (IPCA) was established in November 2007, replacing the Police Complaints Authority.
The Police Complaints Authority had been established in 1989, following several years of debate about Police accountability, sparked in part by the role of Police during the 1981 Springbok Tour. Prior to 1989, complaints against the Police were investigated internally. Through most of its life, the Police Complaints Authority comprised a single person with a small number of support staff conducting reviews of Police investigations. Because of its reliance on Police investigations, the Authority was perceived as lacking independence. Recent changes, including the appointment of independent investigators, are addressing that perception.
Key milestones in the history of the Police Complaints Authority include:
● the October 2000 Review of the Police Complaints Authority by Sir Rodney Gallen, who recommended the appointment of independent investigators;
● the appointment in late 2003 of the first independent investigators;
● the March 2007 report of the Commission of Inquiry into Police Conduct, which recommended a number of changes to the Authority, including enhanced powers and improved communication with complainants;
● the Independent Police Conduct Authority Amendment Act 2007, which changed the Authority’s name and made changes to the Authority’s powers.
The period since the establishment of the Independent Police Conduct Authority in November 2007 has been one of transformation, as the Authority shifts its focus towards independent and transparent investigation of the most serious incidents and complaints. This period of change has included the appointment of additional investigators, and changes to the Authority’s legislation, structure and operations.

OPINION Police like to roll out statistics when it suits them so here’s one that hurts – 17 people killed on the roads during the holiday period. That’s more than double the death toll compared with last year. And it’s despite the police’s misguided efforts to target speeding drivers with the hopelessly designed zero tolerance for speeding campaign. It’s a campaign that has utterly failed. It’s a stupid policy that needs to be scrapped. Hundreds of thousands of us will have broken the zero tolerance policy over the holidays. Good on you. I did. It was safer to do so.

Uber taxi battle sees police vs cabbies

Police are cracking down on Uber, the cheap and trendy new-kid-on-the-taxi rank, leaving paying customers on the pavement. After complaints from the old-school taxi firms, police have begun fining the Uber drivers whose lower fares have been hurting the big cab companies. The private car hire service has hit back, lodging a complaint of police harassment with the Independent Police Complaints (sic) Authority. Uber operates as a private hire service which means the fare has to be set at the time of booking, rather than using a meter. This means Uber does not have to abide by taxi regulations, thus saving on operating costs.

Vandervis: Deloitte and Police Citifleet investigations

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

Dear Sue,

An hour and a half spent with Detective Matthew Preece and another Policeman called Regan has left me with deep concerns regarding the Police Citifleet investigation.
Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

and that consequently none of these fraud areas is being investigated!

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Can you please also now with urgency, forward to me all instructions to Deloitte regarding the Citifleet investigation as previously requested in my email of 26/10/14 as below.

Is it possible to meet with you at any time tomorrow at your convenience to learn whether you have broadened the DCC Police complaint or not?

Further to my verbal requests of a week or two ago please forward copies of all original correspondence and or other direction given to Deloittes in regard to their investigation of Citifleet.
I wish to have the original brief stating the terms of reference, the subsequent brief where the investigation needed to be extended, and any other direction written or otherwise given to Deloittes regarding the Citifleet investigation.
I am deeply disturbed by what I have seen in parts of the investigation conclusions appearing without covering page or any details identifying them as parts of the Deloitte findings in non-public parts of the Audit and Risk subcommittee meetings.
I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

Thank you for the limited response you have given me to below. I still hope to get 2007, 2008 and 2009 credit card spending details as per those already provided for 2010.
Regarding “spending by Brent Bachop, especially September 2007. I wish to have the details confirmed on a purchase of Falken tyres size 195/65-15 as fitted to an Alfa Romeo.” is it possible that these tyres may have been paid for by some other method that still ended up on the ratepayers’ account? Please advise if I have to discover the registration plate number of the particular Alfa Romeo to get the information on who paid for this set of tyres.
Re purchase of Mazda Bounty vehicle that it is alleged Mr Bachop sold to himself, surely complete information on this type of transaction must be on Council records?

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Background
Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are required.

Government offices selected for OIA review

The Chief Ombudsman says a major review of the Official Information Act will scrutinise all 27 government ministers’ offices.
Dame Beverley Wakem today began her review of the way the public sector used the OIA, which she first announced in August.
Twelve government agencies have been selected for formal review, based on their size, number of OIA requests, complaints, and other criteria.
A further 63 agencies and all ministers’ offices have been asked to complete a detailed survey. At least one agency cited for good OIA practice would be included in the review.
The Ombudsman’s office would also seek input from past and present public servants, Opposition parties, journalists, academics and others.
Dame Beverley said the goal was to assess the quality and integrity of OIA practice in the public sector and to address any issues that were found.

A Dunedin city councillor says the council should have investigated its fraught Citifleet unit three years ago, when he expressed concerns that it shut out firms like car auctioneer Turners. Lee Vandervis said that in 2011 he alerted council chief executive of the time Paul Orders that the Dunedin branch of Turners was consistently shut out of contracts it sought, mainly for the disposal of used cars. The city council said in June this year it was investigating practices within its vehicle fleet unit Citifleet.
Unit team leader Brent Bachop had died suddenly in late May. His death has been referred to the coroner.
A subsequent Deloitte investigation, commissioned by the council, unravelled a vast network of alleged fraudulent activity, some with selected car dealers and other individuals, over 11 years, equating to more than a million dollars in lost council revenue. Some of the activity involved profits from the disposal of second hand Citifleet vehicles allegedly being pocketed instead of being paid into council coffers.
Vandervis said he was concerned about Bachop’s business dealings when he was told by Turners and other Dunedin businesses they were having difficulty even engaging with Citifleet. He began pressing Orders on the issue and made a raft of requests for information around Citifleet. Vandervis suggested Orders meet the manager “to attempt to normalise a Turners/DCC business relationship”. Vandervis said Turners’ staff had expressed “long and on-going frustration at trying to deal with Citifleet vehicle disposals”.

Good afternoon everyone. I am David Fisher, a reporter with the NZ Herald. I have worked as a journalist for 25 years, mainly in New Zealand but across a number of other countries.

At the moment, there is an inquiry underway into whether a blogger gained some advantage in receiving information from the SIS for political purposes. There are also allegations of preferential treatment over the OIA involving the same blogger and the former Justice Minister.
The police are also facing allegations of trying to cover up juked stats by burying an OIA. And a former Customs lawyer has said his organisation preferred to let requests languish in the Ombudsman’s office than dealing with them.
In the 25 years I have worked as a journalist, there have never been so many questions, or such a loss of faith, all at once.

167968722PW011_John_Key_HolI see that the mighty NZ Police have now decided to prosecute Nicky Hager over the fact that as a journalist he will not reveal who gave him copies of the emails that implicated so many of the National Party in downright crude manipulation and God only knows what else. Even that very friendly Speaker of the House has been forced to find that Key is a devious, slippery sod by not revealing his relationship with that scumbag Cameron Slater (watch the interesting exchange at yesterday’s question time here. http://www.inthehouse.co.nz/video/34526)
Isn’t it extraordinary that the NZ Police – such an independent body of public servants – jump so quickly whenever Donkey Jonkey and his mates want action, yet they are pleading under-resourcing for really serious crimes? Remember the infamous John Banks (you know, the little forgetful coot from Auckland) cup of tea PR stunt with Key? Key lays a complaint about the recording and the cops jump immediately. Collins, Key and others are shown to be dirty manipulators in Hager’s book and the cops immediately follow up. And how many others could say that their well-documented complaints have been diligently followed? I know of a few for starters, but let’s start with the Crewe murders and the bent cops who planted evidence. Did the cops diligently pursue anyone else when Thomas was pardoned? Not even when Rochelle Crew asked them to do so. The two bent cops were praised for their integrity and diligence by the very top cop after they died.
I could go on, but the perception out there is that the cops are politically driven.

DCC Citifleet, undetectable….

Message: In discussions with Sir Julian [Smith], apparently the ODT Editor has said, since Mr Cannan’s comment, that the actual reason for non-publication of my ‘Citifleet Years of Inaction’ letter was that I already had a letter printed on a similar topic recently.
My previous letter was not however on a similar topic or recent. My first letter which was printed, was sent on 24 August on the topic of Coroner and Police inaction.
My second ‘Citifleet Years of Inaction’ letter that the ODT have chosen not to print was on the topic of CEO Paul Orders’ inaction in 2011, and Mayoral misrepresentation.
It is a shame that most people will not now get the true story.
Feel free to publish so that at least some people get to know some of what has been misrepresented.

Why is the coroner taking more than 3 months to deliver a verdict on the DCC Citifleet manager’s sudden death?
Why have the Police only just begun an investigation when so much evidence has been floating around for years and was so tragically highlighted over 3 months ago?
I have been asking for Citifleet manager and other tender process investigations recorded back at least as far as 2011.
Justice delayed is justice denied. Or with so much public money gone is that perhaps the reason?

In fact DCC vehicle disposal and other Bachop issues had been flagged in verbal questions and emails from me to CEO Orders and other senior DCC staff in 2011 following many complaints from Turner’s Auctions and other motor industry businesses. I also set up a meeting to resolve DCC/Turners issues between CEO Orders and Turner’s Auckland based national accounts manager Asgar Kachwalla in November 2011. It seems that little was done until CEO Bidrose began an investigation almost three years later. Perhaps the ODT should be doing some more investigating of its own. [confirming email example below].

Further to my more general email this morning about building partnerships, Dunedin’s largest car auction business has contacted me regarding on-gong (sic) problems trying to do business with the DCC.
Turner’s Auctions big cheese Mr Kachwalla from Auckland will be in Dunedin on the 30th of this month, and was hoping to organise a brief meeting with you and local Turners management on the afternoon of the 30th to attempt to normalise a Turners/DCC business relationship.
I was hoping to bundle similar issues with other Dunedin business issues with Mr Bachop, but am still awaiting information ex DCC after over a month in order to do this.

Hopefully you will have time on the next Wednesday the 30th to accommodate Turners Management hopes for a meeting.

The Office of the Ombudsmen is in “crisis”, with a bulging backlog of cases due to lack of investigators and existing staff underpaid and in some cases being worked to death, Ombudsman Beverley Wakem says. Appearing before Parliament’s government administration committee yesterday, Ms Wakem said the office was under “considerable pressure” in terms of staffing and funding and had been for the past three years. Ms Wakem said the office’s baseline funding had been established on the basis it would be actively working on 800 to 1000 cases at any one time. However, actual case numbers had been far higher than that for some time and been close to 2000 at one point last year. It was currently handling about 1854.
