ODT updates mayoral vehicle serious injury crash information

The wife of Dunedin Mayor Dave Cull is slowly recovering after being seriously injured in a crash which wrecked a new mayoral car. Joan Wilson was driving a 2016 Hyundai Santa Fe when she crashed near Roxburgh in late December. Documents obtained under the Local Government Official Information and Meetings Act (LGOIMA) by blog “What if? Dunedin” reveal the $55,659 vehicle had been in use for just five days before the crash. In a statement to the Otago Daily Times Mr Cull said his wife sustained “serious injuries” in the crash. “Joan was the sole occupant in the vehicle. Fortunately, she is making a gradual recovery and I would like to take this opportunity to thank the emergency services and members of the public who provided assistance at the scene,” Mr Cull said. The accident was a “private matter” and no further comment would be made, Mr Cull said. […] Mrs Wilson was an authorised driver. Insurers had not identified the cause of the accident, and no other vehicles were involved.

The driver of the 2016 Hyundai Santa Fe is understood to have fallen asleep at the wheel resulting in the serious injury road crash as reported; their spouse was said to have been following in another vehicle at the time of the crash.

1. I understand there is a DCC vehicle dedicated for use by the Mayor of Dunedin, is this correct? If so, is the vehicle owned by DCC, or is it leased?
Yes. It is owned by DCC

2. What are the terms and conditions of the Mayor’s use of this vehicle? (including DCC insurance cover in regards to who may drive the vehicle and for what purpose(s) to retain the cover)
The Mayor pays for full private use of the vehicle as per the determination set out by the independent Remuneration Authority. The insurance cover for the mayoral vehicle is as for all other fleet vehicles. Any authorised driver is covered.

3. What is the make, model, colour, year and registration of the mayoral vehicle? Please state for all vehicles designated for mayoral use in the period October 2010 to April 2017, if any.
Please see the attached spreadsheet. I have not provided registration plate details and these are withheld to protect the privacy of natural persons pursuant to section 7(2)(a) of LGOIMA.

4. What has been the annual mileage clocked for the mayoral vehicle on official business in the period October 2010 to April 2017?
Annual mileage is not recorded and so the information requested does not exist.

5. Does the mayor also retain the vehicle for his own casual use when not on official business? If so, is this mileage logged separately and what has been that annual mileage clocked in the period October 2010 to April 2017? Or please supply the annual mileage clocked for all use of the vehicle in the period October 2010 to April 2017?
The Mayor pays for full private use of the vehicle as per the determination set out by the independent Remuneration Authority. No records of annual mileage are kept.

6. Designated driver(s). Besides the mayor, are there other dedicated drivers specified for this vehicle? (see 2. above). Please identify the drivers – if for privacy reasons names cannot be supplied, state by position or role to include council staff, elected council representatives (councillors), or the mayor’s family.
The vehicle is able to be driven by any authorised driver.

7. See 4. above. How does this mileage compare with the annual mileage recorded for a mayoral vehicle (if any) used by previous mayors, where this is known? For example, for Richard Walls, Sukhi Turner and Peter Chin.
No mileage records are held.

8. In the period October 2010 to April 2017, have any vehicles assigned for mayoral use been badly damaged or written off? Yes. A Hyundai Santa Fe was written off in Jan 2017 following an accident involving serious injury near Roxburgh.

Refer to the attached spreadsheet. DCC received a full insurance pay-out.

12. Further to 3. above, please confirm the make, model, colour, year and registration number of the present mayoral vehicle and its date of purchase or commencement of lease by DCC. Please respond by email within 20 working days. Thanks.

ODT: On the buses over Easter weekend
Heritage buses will be back on the road over Easter weekend, providing public transport over the public holiday. Otago Heritage Bus Society treasurer/secretary Jacqui Hellyer said Dunedinites could ride the buses, which serviced St Kilda, St Clair, the Octagon, Brockville, Halfway Bush and Normanby, for a gold coin donation on Good Friday and Easter Sunday.
The services would run hourly and the timetable would be available on the Otago Heritage Bus Society’s Facebook page, Ms Hellyer said. Passengers could take service dogs or pet dogs on a leash.
The St Kilda service had stayed like its former route – to Brockville then Halfway Bush – and the other services took the routes used on non-public holidays, she said.

The Otago Regional Council, in a statement published on its website, said there would be no bus services on Good Friday or Easter Sunday. However, the standard Saturday timetable would apply on Saturday, and Easter Monday would run on the public holiday timetable. Normal services would resume on Tuesday.

The mother of murdered Christchurch infant Ihaka Stokes went nightclubbing last night just hours after her ex-partner was found guilty of the boy’s brutal killing. Mikala Stokes (21) posted a photo on social media in the early hours of this morning. The selfie caption read: “From court to club”. Earlier in the evening, after Troy Taylor, the man who blamed her for killing her 14-month-old son at their Christchurch home in July 2015, was found guilty, Stokes posted photographs of her playing beer pong. One of Stokes’ friends on Snapchat, Julie Stechmann, screen-grabbed the nightclub photo, which was posted at about 1am. She told the Herald today that she thought it was strange behaviour. Cont/

Police to start testing wastewater in NZ for drug use
Police are about to start testing wastewater in Auckland and Christchurch, to get a better idea of drug use in the community. Similar testing in Perth has found 31.6kg of meth was consumed in the city area each week, that’s 1.6 tonnes a year. Now police want to do the same here.
The testing, which will look for methamphetamine, cocaine, heroin, alpha PVP, MDMA and Creatinine, will take place in Christchurch and Auckland’s Rosedale treatment plants. Police say the results, which cannot be traced to individuals, will improve their understating of drug use in the population.
Assistant Commissioner Bill Searle … said the results will also inform treatment and enforcement strategies, allow comparison with international data, measure the effectiveness of education and enforcement and provide intelligence data … The testing will be undertaken by the Institute of Environmental Science and Research for one week each month for a year.

The continued drug use caused horrific damage to the drug users’ skin with sores and scarring – that can be caused by uncontrollable scratching during a hallucination when the addict imagines bugs are crawling under their skin. Auditor Deloitte Fined A Record $8 Million For Massive Fraud

Remember when auditors were, by their very definition, supposed to be the embodiment of credibility, trustworthiness and moral fibre? The Brazilian arm of Big Four auditing giant, Deloitte, forgot these simple prerequisites and as a result the US auditing watchdog fined the firm a record $8 million for what amounts to massive fraud: falsifying audit reports, altering documents and providing false testimony during an investigation that unearthed what it described as its “most serious” finding of misconduct.
The US Public Company Accounting Oversight Board, or PCAOB, also penalised or barred 12 former partners, including a national practice director, and auditors of the Brazil-based Deloitte Touche Tohmatsu Auditores Independentes.
The Deloitte Brazil case is the first time the PCAOB has “charged a member of the Big Four auditing firms with fraud and for failing to co-operate with an investigation” according to the FT [Financial Times]. Worse, unlike banks which resolve similar cases without admitting or denying guilt, in settling, Deloitte Brazil admitted it had violated quality control standards and failed to co-operate with the auditing board’s inspection and subsequent investigation.
“This is the most serious misconduct we’ve uncovered. It’s cover-up after cover-up after cover-up,” Claudius Modesti, director of enforcement at the PCAOB, said. “As an investor you’re expecting that the audit was done properly and sufficiently and that wasn’t the case here.”
Not only was that not the case, but the details read like straight out of a fictional account of third-world crime.

Otago students at Pitt St: No longer drunk possums in trees

Last night I heard (muted) sirens about, nothing more – not realising what was happening a few houses away up Pitt St. My place is tucked in off the road, nothing seemed out of the usual for a Thursday night, ‘student party night’ —just typical city noise that often includes sirens and choppers. Reading through a consent file for 97 Filleul St collected from DCC that afternoon, I was absorbed, completely missing the street action…. On waking this morning, I opened the first message on my phone, from a journalist asking if I’d heard the party on Pitt St last night? Hmm

Dunedin student seriously injured after jumping from roof

A Dunedin student in hospital with life-threatening injuries jumped from a roof just minutes after party-goers were told to turn their music down by noise control officers. Dunedin District Command Centre Senior Sergeant Brian Benn said police were called to the house on Pitt St about 11.30pm on Thursday. “A drunken student tried to jump off a roof. That didn’t end too well for him.” Benn said no one at the party saw the 21-year-old land after jumping from the roof, but when partygoers went to find out what happened they found him with “reasonably serious injuries”. Neighbours said the flat had been quiet during 2016 until Thursday night’s party. “It was a terrible racket,” one neighbour said. St John ambulance spokesman Andy Gray said the student’s condition was updated from serious to critical due to his “life threatening injuries”. He was taken to Dunedin Hospital but the large party continued.

ODT: Student ‘critical’ after jump off roof
A student is fighting for his life after jumping off the roof of a two-storey house at a large Dunedin flat party last night. Senior Sergeant Brian Benn, of Dunedin, said the 21-year-old was seriously injured after “an aerial stunt” at the Pitt St party went wrong.

An associate caught sight of a particularly juvenile and UNSAFE act that occurred next door [at 53]….
The scene.
Two storeyed house with dormer windows in the City Rise, tenanted by university 3rd or 4th year male students.
Constant noise and behavioural issues…. well-known to Noise Control, Campus Watch and Proctor [Police attention very much the next step – these young idiots have been told].

One of them had earlier broken his leg. Following recovery and some time later…. his so-called ‘friends’ egged him on to jump from a dormer roof (at second floor level) into a shallow paddling pool at ground level. He had to think about it for quite a while…. obviously he was facing serious injury or worse if he got it wrong, given the building height and shallowness of the water. Being a mental statistic he jumped – by luck not good management he did not need an ambulance.

What was that about safety nets – let the morons kill themselves, one less noise complaint.

The police have decided against opening a criminal investigation into a balcony collapse at a concert in Dunedin. […] A young woman studying at Otago University has been transferred to Christchurch Hospital, with what have been reported as spinal injuries. A young male student from Otago Polytechnic has undergone surgery at Dunedin Hospital. […] While police did not intend to investigate further from a criminal point of view, they would work with the reviews being carried out by Worksafe New Zealand and the Ministry of Business, Innovation and Employment.

Action was urgently needed to ensure people’s safety and preserve the reputations of the city and Otago University, [Mayor Cull] said.

Other events during this year’s orientation week, such as couch burning and concern about verbal abuse, including a rape threat and racial slurs, have prompted students themselves to call for action.

[Mayor Cull:] The council had no power to control the event at which the balcony collapsed as it was held on private property, and that might need to change. […]

Balcony ‘met building standards’
Mr Cull said the council’s chief building inspector had examined the balcony yesterday, and said it met the requirements of the building code. “I welcome the [Department of Building and Housing’s] further investigation to make it absolutely clear what caused it.” He said whether the partygoers were jumping up and down on the balcony was not the issue; it was that hundreds of people turned up to an event that would not normally be held in a domestic venue. “It’s just not acceptable to expect those kind of situations to not present more risk than if it’s professionally organised.”

Dealing with some issues here:

– on the claim that “the concert was impromptu” – it was “announced” via social media on Monday and the University was aware prior (Campus Watch were detailed). Animation Research Ltd had a 360 degree motion camera rig in operation (and captured footage of the collapse). A stage was erected and sound gear installed. This is not impromptu.

“Any planned activity where any structure, open area, roadway or other area will contain more people than normally found in that location at one time.”

– the venue was unsafe. Egress, crush barriers and evacuation were inadequate (a van was parked across the leg-in blocking access) as the band were performing (and ARL were working, and news media were reporting), this meets the definition of a “workplace” and both HSA and Worksafe legislation apply.

The event organizer has strict liability here. Those suggesting that the balcony collapse was the fault of those on it and that they should take “personal responsibility” are unfortunately misguided. It is up to the event organizer and those assessing the management plan to identify and control these risks. This was clearly inadequate in this case.

I would not want to be standing anywhere near the event organizers once the detailed investigation starts.

Publisher Ian Wishart says a new book will finally solve the infamous Marlborough Sounds murder case. Wishart will next week publish the book, Elementary — The Explosive File on Scott Watson and the Disappearance of Ben and Olivia. The book looks at the disappearance of Ben Smart, 21, and Olivia Hope, 17, in the Marlborough Sounds on New Year’s Day, 1998. Scott Watson was convicted of their murders in May 1999 and remains in prison. He has denied any involvement in their disappearance and death. The remains of Smart and Hope have never been found.
Wishart said he was “pitching” the book as “solving the case”.

Brent Bachop, the council’s Citifleet manager, died on May 21 last year, nearly a week after first being approached about irregularities within his department on May 15.

Official Information Act review finds ‘no deliberate misuse’

A high-level review of the Official Information Act will not uncover any widespread political interference in the release of information, its author says. The Ombudsman’s Office will release the findings from its comprehensive, year-long review next week. Chief Ombudsman Dame Beverley Wakem said today that the investigation had not discovered malicious or deliberate misuse of the Act by ministers’ offices or by Government departments.

“We’ve really shaken the tree over this and haven’t been surprised by what’s fallen out,” she told a Parliamentary committee this morning.

She admitted that she had suspected political interference, but had found no hard evidence of it. Dame Beverley said people who had complained to her office could be perceiving political spin or “bad behaviour” when it did not exist, and she could not make any findings “based on hearsay”.

Dunedin City Council to take widow of sole Citifleet suspect to court

The Dunedin City Council has launched civil proceedings against the widow of the man believed to be responsible for the $1.5 million Citifleet fraud. The council lodged the proceedings against Maria Frances Smith, the widow of Brent Bachop, with the Dunedin High Court. A hearing, understood to be about Bachop’s estate, was originally set down for Thursday but will now happen in February.

No-one charged with $1.5m Dunedin council fraud case

No-one will be charged with the $1.5 million Dunedin City Council Citifleet fraud, a final police report reveals. Dunedin Police have released the final report into the fraud, involving the theft of more than 150 council vehicles and misused fuel cards, after the earlier release of an investigation report to Fairfax Media. That report was reviewed by Detective Senior Sergeant Malcolm Inglis, who concluded there was “insufficient evidence to charge any of the purchasers of the vehicles with the offence of receiving”.

“No other charges have been identified.” –Police report

Deloitte interviewed 62 people in relation to the theft of the vehicles from the council and the “majority of those persons were council employees”, the police report said.

The University of Otago and NZ Police FAIL to monitor, DO NOT investigate, and DO NOT offer strong guidance on Student use of social media at Dunedin. These ‘encounters’ make the recent Roast Busters case at Auckland seem trivial if not ephemeral. The ‘Stewards of Dunedin’ reside in the Dark Ages, a place not enlightened by smartphone use for good or bad. There is BAD. Despite the law change based on the outcome of the Roast Busters investigation, sadistic criminal behaviours at Dunedin go unpoliced. And unreported to Police.

Keep partying why not. Sell more drinks, more party drugs?
No-one wants to talk about it. Jolly the young sweet things along.

Wellington’s Victoria University is being evacuated over bomb scare

Part of Victoria University in Wellington are being evacuated after a note was found claiming three bombs would explode on campus by lunchtime. Vice-Chancellor Professor Grant Guilford said a staff member had found the note about 9.30am by the lifts in the Murphy building on the Kelburn campus. It stated that three bombs were hidden somewhere on campus and would go off by midday. The note was short and offered no explanation or motive for the bombing, he said.

Massey University evacuated after threatening note

Massey University has become the third university to receive a threatening message. The campus has evacuated its registry building in Palmerston North after it received a threatening note aimed at staff on Wednesday afternoon. “We have received a note threatening the staff in our Contact Centre on our Manawatu campus and have evacuated everyone from our Registry Building as a precaution,” Vice-Chancellor Steve Maharey said. “We are aware there have been threats made against Otago University and Victoria University over the past two days. So far those threats have come to nothing but, at this stage, keeping our students safe is our key priority,” Maharey said.

Dunedin police are still working to finalise a report into the $1.5 million Citifleet fraud, despite announcing in June no charges would be laid, it has been confirmed. The development came as it was confirmed an earlier police report into the Dunedin City Council’s long-running fraud was released to media despite internal concerns from senior police it was out of date, emails showed.

A joint statement signed by 10 organisations signals a new approach to addressing the binge-drinking culture in parts of the city, Dunedin Mayor Dave Cull says. Entitled “Dunedin North Issues”, the statement released yesterday says “pressing action” is required to keep young people safe, curb excesses of alcohol-fuelled behaviour, and protect the livelihoods of Dunedin businesses and tertiary education institutions.

Generation of children brutalised in state care won’t get public apology

The Government will not offer a formal public apology to all children who were in state care during a 50 year period of brutal abuse. The final report of the Confidential Listening and Assistance Service has detailed the harrowing experiences of children at the hands of people who were meant to keep them safe. The report, which heard evidence from more than 1100 people, is still under consideration by the Government. The abuse detailed in the report covers foster homes, institutions, asylums, health camps and borstals from the early 1940s up to 1992. […] Judge Carolyn Henwood, who headed the panel that has been hearing grievances since 2008, said: “Foster caregivers and extended families, social workers and staff, teachers, the clergy, cooks, gardeners, night watchmen, even other children and patients, all took part in abuse. […] When we asked people why they had come, they said they wanted to be heard, they wanted an apology and accountability, and they wanted to improve state care for children, for the next generation.” Even now, New Zealand had no official “duty of care” towards children written into its law, Henwood said.

The final report of the Confidential Listening and Assistance Service which was established in 2008 as an independent agency to provide assistance for people who had suffered abuse and neglect in state care before 1992.

ODT: Level of child abuse ‘horrifying’
● A panel tasked with examining historical abuse in New Zealand’s state institutions has heard a litany of physical, emotional and sexual abuse, describing it as “horrifying” and “deeply shocking”.
● In its final report, released to Fairfax under the Official Information Act, chairwoman Judge Carolyn Henwood said the panel members were “profoundly affected” by what they heard.
● More than 1100 people came forward to speak to the panel between 2008 and June this year, covering child welfare care, psychiatric care and health camps, and residential education.

Police raised possibility of others involved in Dunedin City Council Citifleet fraud

It had been billed as the work of a sole suspect, but a police file into the investigation of the theft of 152 cars from the Dunedin City Council fingers the “highly suspicious” activity of another unnamed person. Police have released to Fairfax Media their investigation report into the Citifleet fraud.

WHY WASN’T THE SERIOUS FRAUD OFFICE CALLED IN RIGHT FROM THE VERY START WHEN CR LEE VANDERVIS ALERTED FORMER DCC CHIEF EXECUTIVE PAUL ORDERS TO CAR FRAUD ???

Then too, think of all the people who had access to the Deloitte reports (plural) – more specifically those without access to the digitised data report. That ‘narrows’ the field of leaks to Deloitte itself, NZ Police, private investigators, counsel, privileged council staff, privileged mayor and (some) councillors, those council staff whose lawyers worked on their ‘resignations’ / exit packages….
Who else? A veritable feast.

No-one named in the ODT today hasn’t been mentioned at What if? posts and comments previously – this includes the names of the car companies.

Nothing to hide, says car buyer

Wayne “Tubby” McFadyen says he has nothing to hide. Instead, the man identified as one of the main buyers of Citifleet vehicles says the Dunedin City Council should be looking “in the mirror” if it wants to point the finger. “If there’s anyone to blame, it all falls on their heads too. They can blame everyone else for buying vehicles and whatever they want to do, but at the end of the day the buck stops with them.”

Report reveals how car manager ripped off Dunedin council
17:20 An investigation into the Dunedin City Council’s missing cars has named Citifleet team leader Brent Bachop (bok-ip) as the man at the heart of the one and a half million dollar fraud. A Deloitte report released this afternoon details how he transferred vehicles to his name and sold them on, including some to fellow staff and councillors. It slams the council for not detecting the fraud sooner. Brent Bachop died suddenly in May. With us now is Dunedin’s mayor Dave Cull.

Thank you for this audio. In it Mayor Cull says that none of the managers in charge at the time of the Citifleet frauds are still at the DCC. Has he forgotten that Dr Bidrose is still there?

Mayor Cull also says that the frauds were discovered and investigated in the last year. Has he forgotten that I had discovered and was investigating Citifleet frauds since 2011, and that senior staff were prompted by me to investigate then but apparently allowed themselves to be fobbed off by the most superficial denials from some of the perpetrators themselves?
