“There may be issues with cats but they also serve a useful purpose in controlling pests. The cat population doubled to two at my place last year, and we have more tui and bellbirds around than ever, as well as visits by kereru and eastern rosellas and fantails and waxeyes. The cats occasionally catch a bird but most often it is a sparrow or a thrush. But it looks like the Dunedin council and some others are keen on requiring the herding of cats. They kept as quiet as they could on cats during the local body elections, and now mid term they try to foist it on the public. Devious.” –Pete George at YourNZ

Councils seek greater powers to control cats

The country’s councils are calling on the government to give them extra powers to protect wildlife from cats including microchipping, de-sexing and registration. Local bodies have the power to control dogs and their behaviour, but they only have jurisdiction over cats when they become a health risk. While the remit presented by Dunedin City Council at the meeting acknowledged the companion role of animals, it noted cats are a danger to wildlife. […] The controversial remit scraped through with just 51 percent of the vote at the Local Government New Zealand annual general meeting.
….Auckland mayor Phil Goff said his council abstained from the vote because it was not sure what it would mean for the 500,000 cats in the country’s largest city. “We are in favour of practical measures to protect native birdlife …. We’re not in favour of bureaucratic measures that might involve millions of dollars of council time and energy but doesn’t achieve the objectives that we set out to achieve,” Mr Goff said.

The local government sector will voted on four issues when it gathers for its annual AGM in Auckland on Tuesday 25 July. There is a focus on litter legislation, local government funding, cat management and health in this year’s remits. The AGM follows this year’s LGNZ Conference, when over 600 delegates from local government and its stakeholders, industry and community will gather in Auckland for the two day event [23-25 July]. The theme of this year’s conference is Creating pathways to 2050: Liveable spaces and loveable places. Remits are voted on in a secret ballot and if passed will become official policy and be actioned by Local Government New Zealand. Local government will also be voting for a new LGNZ President to replace Lawrence Yule, who steps down after nine years in the role.
….National legislation to manage cats
The third remit was proposed by Dunedin City Council and asks that LGNZ lobby the Government to take legislative action as a matter of urgency to develop national legislation includes provision for cost recovery for cat management.
Throughout New Zealand councils are tasked with trying to promote responsible cat ownership and reduce their environmental impact on wildlife, including native birds and geckos.  Yet, territorial authority’s powers for cats are for minimising the impact on people’s health and wellbeing, and regional councils’ powers are restricted to destruction of feral cats as pests.  The remit seeks the protection of our wildlife and native species by seeking regulatory powers for cat control, including cat identification, cat de-sexing and responsible cat ownership.
….The LGNZ AGM is open to members only. Following the meeting, LGNZ will advise of the outcomes of all votes.

Dunedin council proposes registration of cats in New Zealand
A Dunedin proposal that could result in the registration of cats in New Zealand will be discussed nationally. The proposal from the Dunedin City Council, in consultation with seven other councils, will next month go to a Local Government New Zealand (LGNZ) vote. If it is successful, LGNZ would make it a policy, and begin lobbying the Government to have it made law. The proposal could see the Government called upon to develop legislation for cats similar to the Dog Control Act. It already has the support of the Otago Regional Council, one of 78 councils which will vote on the idea.

DCC seeks support for cat control
The Dunedin City Council will seek support from other New Zealand councils to gain greater control of cat management. If additional support from councils was gained, a remit would ask Local Government New Zealand to call upon the Government to give councils statutory power to control cats. The DCC was researching a Wellington City Council bylaw on microchipping cats. However, the current bylaw could not be enforced by non-compliance fees. Cat management would focus on the control of wild cats.

The father of one of the men killed in the Pike River mining disaster says the families have always believed the Government wasn’t telling the truth about mine safety.

ODT: Pike video shows men in mine after blast
The Government has long said high concentrations of methane inside the mine make it too risky to re-enter to retrieve the bodies of the 29 men killed in the November 2010 blast, because the gas could explode. But footage leaked to Newshub yesterday showed two Mines Rescue workers inside the mine three months after the explosion, with no gloves, apparently relaxed as they fashioned a makeshift cover for a robot out of cardboard and tape. The robot is seen to be steaming or smoking well inside the mine, but the workers do not panic – and nothing explodes. Bernie Monk, whose son Michael was killed in the November 2010 explosion in the West Coast coal mine, said the newly leaked footage did not come as a surprise. Cont/

Pike River families believe photos show bodies

It is understood that a decision from Solid Energy on whether it will allow recovery teams to re-enter the drift of the Pike River mine is imminent. The drift is not the mine itself, but the two-kilometre tunnel that leads to the mine.
Families of the victims are desperate for a mission to collect evidence and to see if there are any bodies in the drift.
They say if Solid Energy won’t do it, they will. They say they know there are bodies in the mine, and tonight, with their blessing and for the first time, we can show you their evidence. Dean Dunbar, the father of lost miner Joseph Dunbar, spoke with Campbell Live producer Kate McCallum. Watch the full interview with Dean Dunbar.

‘This Love’ by Dave Dobbyn with the Orpheus Choir of Wellington is a moving tribute to the 29 men who died in the Pike River Mine explosion.
The piece was first performed at a concert attended by members of the miners’ bereaved families and was recorded by Radio NZ Concert. The choral arrangement is by Mark Dorrell. Also performing are Wellington Young Voices, Mark Vanilau (piano), Jo Barus (bass), Ross Burge (drums) and Chris Clark (cornet). With special thanks to TVNZ and Satellite Media – taken from the TVNZ documentary ‘Dreams Lie Deeper’.

Consternation of Various Sorts

We note the Dunedin City Council’s very poor financial position generally, in face of the ‘explosive’ DCC-owned Aurora/Delta collapse of the Otago power network – notable for continuing poor governance and management, with contingent lack of transparency and accountability – affecting ratepayers and residents in three distinct council areas (DCC, CODC, QLDC); the city council’s snail-like attendance to infrastructure maintenance and upgrades including implementation of three waters strategy; the city council’s ongoing out-of-control stadium fiasco; and ALL The Council Debt / debt servicing costs etc etc – for the very low, ever passive and aging ratepayer base.
FANTASTIC TIMES.

How interesting then that DCC has – as yet – failed to appoint a new Group Chief Financial Officer following the resignation of Grant McKenzie last year (see announcement 11 June 2016 via ODT).

The departure of the Dunedin City Council’s group chief financial officer, Grant McKenzie, has triggered a minor reshuffle within the organisation. The rejig includes a temporary structure while Mr McKenzie’s replacement is recruited, but the council has also taken the opportunity to realign job titles and responsibilities for two of the council’s senior managers. […] Council financial controller Gavin Logie has also been named acting chief financial officer until Mr McKenzie’s replacement is named.

Announcing the appointment of Mr McKenzie to this newly-created role, DCC Chief Executive Paul Orders says, “Grant will bring a wealth of knowledge and experience to the role and will be instrumental in ensuring the effective and efficient management of DCC group finances.” […] The new position of Group Chief Financial Officer replaces the DCC’s Chief Financial Officer (currently a vacant post), with the role expanded to include the provision of financial advice and support to the Board of Dunedin City Holdings Limited (DCHL). Our loss-making public bus system, as for the colours *spew

Inner city Dunedin is NOT a freaking circus or Disneyland.
Obviously, the bozos at ORC/DCC think differently.

Here is something CHEAP-NASTY-like:

Troughing consultants, transportation planners and those who purport to be ‘urban design’ from both councils appear to be barely out of grade school —my god, it shows (see video).

PRIMARY SCHOOL
Colouring in, by non-learned non-contextualists —who manage do it so very BADLY. This is absolute proof that Landscape Architecture at Dunedin is DEAD, BANKRUPT and bloody SMELLY. My cardboard box of pet maggots could design “the interchange” better. They could: swiftly, cleanly, without the disease that is ‘the carnival-scathed’ at local government.

Junior short-term work experience only, no proven local body management expertise or ‘factory floor’ experience whatsoever, now make for ‘team leader’ placements at Dunedin. That’s how tragic the workpool is. Low shoulder-tapping at the tertiary institution is no substitute for a smart council workforce, not that we have a hope in hell of attracting one.

Business leaders need to Take Dunedin!

None! This is All down to leaders, councillors, directors and executives at DCC, DCHL, Delta and Aurora.

And ORC/DCC think the sorry ratepayers and residents can afford an improved, convenient and efficient bus system. Ho. Ho. Ho.

Apart from or because of the buses making losses….

Clearly, the proposed changes to the bus system are NOT designed to embrace the Accessible Journey —to enhance the experience of city travel for mobility impaired citizens.

The Regional Public Transport Plan 2014 and the Dunedin City Integrated Transport Strategy 2013 DO NOT anticipate the growth of Uber, new technology or ‘other’ vehicular modes of travel, or indeed anything that is the future of transport at (Our Place) Dunedin.

The proposed changes are NOT subject to ANY ECONOMIC STUDIES to safeguard businesses, vehicle users, and the users of public transport, city-wide. None! So Predictable. So Deficient. So Grossly Negligent.

Coloured road markings, a Fun Distraction when there’s a MASSIVE POWER BLACKOUT at Dunedin.

*Note: DCC does not have a spare ONE BILLION DOLLARS in the bank to right Aurora/Delta’s wrongs.

OPINION Public transport is essential in any major centre and now Dunedin faces its own challenges with the release of the long-awaited central-city bus hub plans. The Otago Regional Council is seeking community feedback on the hub planned for Great King St, near the central police station. It includes five parking bays on each side of the street. […] The idea of a Great King St hub cannot be taken seriously if people are going to be forced off one bus and on to another in quick time. The Otago Regional Council has unveiled its long-awaited central Dunedin bus hub plans and is seeking community feedback. The bus hub, also termed the “bus interchange”, is, as previously signalled, in Great King St, near the central police station. It includes five parking bays on each side of the street. […] The size and style of bus shelters are partly dependent on public feedback, and also on any negotiations required with owners of nearby land, to be undertaken early next year. It is also proposed to use paints or other coloured materials, including on part of the street, to give the hub area a more lively appearance.

Northland rates rebels win partial victory

The rebel ratepayers of Mangawhai in Northland have won a partial victory in the High Court. The court has found that rates levied from 2011 to 2014 by the Northland Regional Council, via Kaipara District Council rate demands, were unlawful. In an interim decision, Justice Duffy found the Northland Regional Council (NRC) has no power to delegate the assessment of rates or the recovery of arrears to other councils. “The errors I have identified are serious and substantial,” the judge said. “In short, the NRC has failed to exercise its statutory powers properly when determining rates resolutions and it has unlawfully sought to delegate the performance of a number of its functions in relation to rates to the Kaipara District Council.” […] The Mangawhai ratepayers’ chair, Bruce Rogan, said the ruling was very welcome, although the court did not uphold the group’s challenge to penalties and GST imposed by the Kaipara District Council. The council should now agree to negotiate a deal to end the six-year-old Kaipara rates row, Mr Rogan said.

INTERIM HIGH COURT JUDGMENT RELEASED 16.09.2016
Duffy J has made an interim judgment in respect of the judicial review brought by the MRRA and Bruce and Heather Rogan challenging the lawfulness of rates set by the NRC and the KDC.

She has made the following decisions:

NRC
1. The NRC rates were not set lawfully for the 2011/2012, 2012/2013 and 2013/2014 rating years. [27]
2. The NRC’s delegation to the KDC of the assessment of rates and recovery of rates for the rating years between 2011/2012 and 2015/2016 inclusive was unlawful. Accordingly those rates were not lawfully assessed. [58]
3. The NRC’s delegation to the KDC to add penalties to NRC rates was unlawful. Therefore the penalties imposed on rates in respect of NRC rates was unlawful. [74]
4. The Validation Act only validated the unlawful rates of the KDC. It did not validate the unlawful rates of the NRC. [111]

Result
[129] I make the following declaration: The NRC’s rates for the KDC region have not been lawfully set or assessed for the rating years from 2011/2012 to 2015/2016 inclusive.

Duffy J has not yet decided what order to make in respect of ordering the NRC to refund the unlawful rates charged. She has invited the NRC to make further submissions and especially to examine how this ruling might affect the legality of the rates that it has set for its other constituent areas – Whangarei and the Far North. Those rates might also be unlawful.

She will make her final decision once both parties have made further submissions.

Cracking the truth : June 2015 South Dunedin flood

Richard Stedman produces (below) a succinct review of the causes of, and failures after, the South Dunedin flood of June 2015. His frustrations appear to match those of Hilary Calvert that were published a few hours earlier. My reviews previously published on What if? Dunedin commencing back around February give more detail.

For your readers’ further consideration, Richard has highlighted the ‘200mm increase’ in flood level as a result of Portobello Road pumping station failures. The figure was derived by me, and appears in my review of the first DCC flood report. To my knowledge the only clear comparable DCC concessions have come from chief executive Sue Bidrose who admitted the figure publicly at the 20 June 2016 (yes, 2016) South Dunedin Action Group-organised public meeting, and subsequently.

The first DCC flood report (30 Nov 2015) is adamant that high groundwater was the cause of the flooding, and enough Councillors bought right into that excuse at the following Infrastructure Services Committee meeting. Just go back and view the video, if you’ve forgotten.

The second (mudtank) DCC report of 26 April this year states: “Although Portobello Road’s performance did explain some of the length of time flooding was evident, much of the flooded area was below road level…” (para 31). No mention of increased depth of flooding there either, you will note.

Neither DCC report mentions the additional depth of flooding caused by inaction at the Musselburgh pumping station.

History and ongoing design may rely on written commentaries. For the wellbeing of South Dunedin people, we must therefore continue to counter the misinformation contained in DCC reports, and in the more recent ORC (DCC-backed) South Dunedin “hazards” report. Even if ODT has switched off.

The ODT editorial department is peopled by closed minds, a number of whom subscribe to the climate change/rising sea level mantra and therefore manipulate their content to support their distorted view of the world. Mr Morris is captured by the former/present regime at city hall, a fate which befalls every reporter assigned to that round once they get their feet under the table.

Two weeks ago I prepared an opinion piece re the election and South Dunedin, outlining some of the issues as I see them in the hope that it might be published. I thought it was honestly held opinion, but it was rejected because it added “nothing new” to the debate, yet they run to Cull at every turn and run column after column of repetitive nonsense.

The following is my submission submitted on 24/8 and rejected the same day in this message: “Thanks for this submission, but we have had a “deluge” of flood letters and op eds from all sides so I don’t feel the need to highlight the issue again at the moment – certainly if there’s not anything new in it, as such”.

I have seen little evidence of the cited “deluge”.

The South Dunedin flood of June 2015 may be a tipping point during next month’s local body election. Many voters will look at the burgeoning candidates list for the Dunedin City Council and ask “who will provide the cornerstone elements of responsibility, accountability and integrity?”

Residents and business owners in South Dunedin have been sorely tested in recent times through the failure of the DCC to maintain its infrastructure. Among those adversely affected were elderly residents at Radius Fulton Home, including a number of dementia patients, the most vulnerable in our community, who were subjected to floodwaters containing sewage and transferred from the safety of their home in a crisis beyond acceptance. Some were accommodated as far away as Balclutha and Oamaru and three months passed before the facility was re-opened.

Following the flood, obfuscation clouded the failures that led to the inundation of homes and businesses and the investigation and report into the affair was 12 months in gestation. Officials and councillors, captured by the twin mantras of climate change and rising sea level, avoided any suggestion of culpability to limit the likelihood of litigation, and offered no solace that might have been construed as admission of liability.

The mayor and others were quick to blame rising sea level causing increased groundwater, combined with an “extreme weather event”, the result of climate change, and went so far as suggesting that a planned retreat from South Dunedin may be necessary in the future. The rainfall was described as a one-in-100-year event then gradually downgraded, but none of these pretexts are realistic. Questions arise over who is responsible for what, and how serious are the threats of rising sea level, more frequent adverse weather caused by climate change, and the “sinking of South Dunedin”, not to mention “retreat”.

Dunedin and environs have been subjected to much larger weather events in the past. Flooding of the entire city is well recorded and in particular photographs of the 1923 flood depict rowing in floodwaters in the city as well as inundation in South Dunedin. During a storm in 1898 large tracts of St Clair Esplanade were destroyed by the sea which damaged many houses, leaving some partly suspended. More recently, the storms of 1968 were greater than last year’s, delivering 10% more rainfall. In 1968 there were 90 properties invaded by floodwater, whereas last year some 1200 properties were flooded and many contaminated with effluent. Clearly last year’s event was exceptional only for the damage created and lives disrupted.

At a public meeting in South Dunedin on June 20, more than 12 months after the event, those affected had an opportunity to hear an explanation in the hope that someone might take responsibility for the extent of the damage. Despite a good representation of councillors there was no empathy and no likelihood of accountability. What the meeting heard was a long explanation of how the three-waters system works, or doesn’t work, as the case may be, and of failure at the pumping station from chief executive, Dr Sue Bidrose and other staff. The question is “when did the city’s councillors abdicate?”

It can be argued that the damage and distress was the result of neglect, but the DCC says problems at the pumping station added only 200mm to the flooding which would have occurred anyway. Which 200mm was it? Maybe the first 200mm flowed across the ground, reached blocked drains then deepened throughout the area, or perhaps the last 200mm increased the depth and entered homes and business premises carrying undesirable flotsam. Without the extra 200mm would the water have stopped at the thresholds rather than flowing inside?

What of the rising sea level threat? Is it as urgent and as devastating as the commissioner for the environment, some DCC councillors and the Green Party say? The Greens proffer that the Government should help to pay for the reconfiguration of South Dunedin. Why? There has been no disaster on the scale of the Canterbury earthquakes and there is no immediate danger condemning South Dunedin, for if sea level were to rise according to some projections, north Dunedin and other areas are also in jeopardy meaning protection on the coast is futile because the flat land would be inundated from the harbour.

Could it be that models of sea level rise around New Zealand are exaggerated and distorted by the multiplier effect have been grossly over stated? And do the $7 million apartment complex at the Esplanade to be completed next year and the DCC’s belated discussion on a South Dunedin hub indicate mixed messages on the subject?

There is no doubt that the infrastructure must be maintained to the highest level and upgrading implemented with haste. The seafront calls for a level-headed approach to protect the sandhills which shelter the city from the ocean. In the past a network of groynes captured the sand, maintaining a broad beach to dissipate the energy of the waves. The network succeeded for nearly 100 years, but without maintenance fell victim to the ocean, so is it time to reinstate a similar system and then plan carefully for the next 100 to 200 years?

Council says that infrastructure will require “tens of millions of dollars” we cannot afford, but plans to spend some $37 million on George Street and the Octagon, followed by development of the harbourside. These “tens of millions” surely must be re-allocated to South Dunedin for infrastructure, to build a second pumping station, and provide realistic coastal protection.

Dunedin needs new councillors who will make hard decisions, reduce spending on fripperies and attend to basics; people who are prepared to drill deep into reports and costings and who are not afraid to make unpalatable decisions when needed rather than govern with slogans and platitudes.

OPINION In the past three years Dunedin City Council has functioned just as central government does, with a government and an opposition. But the problem is that in Dunedin it means central government-style politics without the checks and balances. Because the mayor of the day is allowed to choose the chairs of the council committees, if the mayor anoints those who are similar in their views to him or her, effectively a “government” is formed. Those on the “government” side support each other, forming a version of the “cabinet”, with meetings between themselves alongside senior council staff to discuss the issues of the day. Those who are not part of this grouping are obliged to form a loose “opposition”, because this is the only place where any public challenges and questions are likely to come from.
In Dunedin […] the chairs of committees forming the “cabinet” meet secretly and without any minutes which can be accessed. They may be part of working parties with other groups, which never report back to the council, for example groups meeting with NZTA about cycleways. They may have information either before the rest of the council or outside the rest of council papers, never to be seen by council. […] In Dunedin, the ODT describes what happens in council meetings, talks to the chairs of the meetings, and prints press releases, having clarified the situation with a relevant staff member. There is little chance for any challenge of prevailing views unless a major debate happens during meetings, or unless the issues raised are ones which the ODT chooses to follow up in an in-depth way.

Mr Cull made the comments while outlining the council’s response to its vote last month to “immediately engage” the Government over the threat groundwater and sea-level changes pose to the low-lying area. Mr Cull said that in recent weeks he and chief executive Sue Bidrose briefed local MPs on the situation in South Dunedin and in the past he had spoken to ministers Bill English and Paula Bennett about the possibility of “collaboration” between local and central government in addressing South Dunedin’s issues.

There is little or no RISING GROUNDWATER at South Dunedin – this is an attack on the local community by Anthropogenic Global Warming (manmade climate change) believers like Curran, Clark, and Cull.

So-called ‘authorities’ are running their Politics over the top of the local Community, Failing to canvass the views of the local residents, property owners, service providers and businesses through agreed consultation methods Before pronouncing upon the area. This is disrespectful, dangerous behaviour. Unwarranted.

A lot of us will remember Labour MP David Clark’s importune speech on climate change at the public meeting held at South Dunedin on 20 June. He completely didn’t register the mood and understandings of the local audience.

Greenie Cull and the Labour Party are deliberately or inadvertently using South Dunedin as a Political Football. There are few votes to be earned from bullying and interference, thank god.

Listening —what is that.

Speaking after the tour, Mr Little said the area was a “prime candidate” for urban renewal under the party’s proposed Affordable Housing Authority.

Dunedin City Council staff have been vindicated by peer reviews which backed their findings over the cause of last June’s devastating floods. The reviews, carried out by infrastructure consultancy firm Opus, backed the council’s findings South Dunedin and other parts of the city would have been flooded even if the city’s stormwater system was running at full capacity.

Opinion: Report skims surface of South Dunedin flood saga

OPINION Readers of the Dunedin City Council-funded independent peer review of its post-flood reporting (ODT, 7.7.16) should be wary. The council’s delight with the review may prove short-lived. In brief, the Opus review:

● Recognises the 1968 rainfall event was bigger than that of June 2015 (contrary to repeated council claims).
● Fails to explore the reasons why the 2015 flood was a disaster, and the 1968 event was not.
● Makes assumptions about groundwater levels without referencing the actual data.
● Appears to consider the council’s assumption of zero ground infiltration has merit (note: the data disproves this).
● Believes mud-tank blockage impacts of the flood were “localised” (too bad if you were a local), but fails to consider the likely widespread impacts on South Dunedin of blocked mud-tanks in the St Clair catchment.
● States council reviews “suggest” its failures at the Portobello Rd pumping station caused an increase in flood levels of about 200mm.
● In fact, the first council review leaves the reader with no more than an opportunity to infer this, while the second council review only states that the failures may have influenced “the length of time flooding was evident”.
● I do not recall the council actually publicly admitting the 200mm figure before the South Dunedin Action Group meeting of June 21.
● Fails to address the flood impacts of the council’s total failure to operate its Musselburgh pumps for stormwater relief.
● Makes general statements to the effect that “primary” flooding would have occurred under any circumstance. South Dunedin residents know that “overwhelming” of stormwater infrastructure was not the concern; the avoidable flooding of our people’s houses and businesses was.

For all of the above reasons, and more, the Opus finding the council report’s conclusions were “robust” is concerning. A truly independent inquiry into the council’s performance pre, during and post-flood, at staff and political levels, is long overdue. ODT Link

The following report by Anna Johnson shows that very little was done [public consultation] in 2014. In fact only 17 people turned up to the DCC workshop in South Dunedin and their Appendices show that less than 10 people commented on their draft natural hazard policy.

Dunedin council concedes flood worsened by faulty pumping station

Dunedin City Council has admitted a faulty pumping station made last year’s South Dunedin flood 20cm deeper than it would have otherwise been. The Council made the admission at a rowdy public meeting at the Nations Church last night about the flooding a year ago which damaged 1200 homes and businesses. Chief executive Sue Bidrose […] made a major concession, saying the council now accepted a key pumping station was blocked, adding an extra 20cm of water to the area. […] Shortly after the flooding, Mr Cull linked the event to climate change and warned South Dunedin may have to beat a managed retreat. Local woman Kathinka Nordal Stene said she was shocked Mr Cull undermined the community at the time when it most needed his support. She said the future of South Dunedin had become a major election issue, on which Mr Cull would be judged. Mr Cull was not at the meeting because he was visiting China. […] Leaders of the newly formed South Dunedin Action Group accused the council and its leaders of having a secret plan to abandon the suburb and blame it on climate change.

Anger about South Dunedin’s future

Unanswered questions about the long-term future of South Dunedin and the city’s response to climate change loomed large at a heated public meeting last night. Residents concerned about the risk of flooding during future rain events were among about 170 people who packed the Nations Church for the meeting organised by the South Dunedin Action Group (SDAG) and attended by councillors and senior staff members. Attendees heard about the short-term measures the council had taken or was about to take to ensure South Dunedin’s infrastructure would run at full capacity should there be a repeat of last June’s devastating flood.

South Dunedin residents have been waiting for a year for its council to front up for the flooding – and last night it did so en masse. At least eight city councillors, the chief executive and her two deputies were quizzed by 200 locals about what happened last June, and what will stop it happening again. […] But it will take more than [the chief executive’s] words to sort out the ill feeling with residents, who said they felt neglected and betrayed by the council, and especially by Dunedin Mayor Dave Cull. ODT: ‘Significant benefits’ for city in pipeline
DCC Asset and Commercial Manager Tom Osborn says old cracked earthenware wastewater pipes, mostly laid in the 1900s, have been allowing groundwater to enter the wastewater system, leading to flooding after heavy rain, resulting in overflows. “This also adds to flooding in areas such as the northwest corner of South Dunedin, when pipe flows coming from Kaikorai Valley meet flows from other parts of the city and flatten out, creating a bottleneck effect.”

DCC DRAFT Annual Plan 2016/17 —Harden up, Council

Dunedin City Council (creak, groan), still holds to notions of silly spend-ups —on Minor yet Very Costly items of…. faint if any benefit to the widest scope of Dunedin ratepayers and residents. It’s ELECTION YEAR. Overtly muddled thinking given to ‘pet projects’ and ‘bribes’ (vote chasing) is sorry Self-aggrandising Rubbish on the part of the local body politicians we’re stuck with until this October.

Some people can make a success of themselves living in Dunedin, some in the innovation sector are uniquely placed with developing capacity to export out; but these shining lights and bushells are frequently seen against a Dumb, overly Bureaucratic, In-fighting city council located within a generally stale and stalled non-productive urban economy. Dunedin is achieving only about half the growth of the rest of New Zealand.

This week, Councillors are deliberating to ‘stiff’ ratepayers and residents with the promoted…. steeply unattractive rates increase (supposedly) capped at 3%.

But shifting sands again at Council (what it’s only good for, in a bad way!) —the most inexperienced/unproductive/unbusinesslike gormless Councillors of green persuasion, together with the mayoral candidates and their aspiring pearl- or scarf-wearing deputies are in the Ugly mood to consider yet more unprincipled spending to take us beyond the 3% cap, if MSM news reporting of tendency is acurate (I’m sure it is).

Council staff are not emerging cleanly from this leaky-budget process either —since elected representatives tend to piggyback if they can, staff-driven shiny pet projects even when within very close sniffing distance of the highly questionable event of systemic DCC failure with core infrastructure services, monstrously demonstrated in June 2015.

The lack of brain power to analyse and offer principled leadership of the City of Dunedin is daily astounding. Not something practically-minded, fiscally prudent citizens should tolerate or support any longer.

If Shadbolt wants to come here as Mayor, by all means Jump In.

2.9% rates increase council consulted on now pushing to 3.5% – breaching council’s self-imposed limit of 3% – unless cuts made.

MacTavish sees rates increase at slightly higher than 3%, as squeezing staff resources becomes “detrimental” to the community.

A rates increase of more than 3% remains a possibility, despite Dunedin City councillors agreeing to stick within the council’s self-imposed limit. Councillors were faced with difficult decisions at yesterday’s annual plan deliberations after agreeing to pay for almost $700,000 worth of extra costs in the 2016-17 annual plan.

Spending millions upgrading Dunedin’s stormwater infrastructure to better withstand floods would not be possible in the next year and increases would have to be ramped up over time, councillors were told. Council water and waste group manager Laura McElhone made the comment when asked by Cr Kate Wilson whether it would be possible, as an example, for her staff to manage spending an extra $10million in the next year.

Notes from meeting 3 May 2016
South Dunedin Action Group (SDAG) and mayor + senior management

Mayor Cull
– acknowledged that there was collective concern, that they were pleased to meet with the group and that the meeting provided the best place to provide clarifications
– Acknowledged that the process had been lengthy and frustrating, and “sloppy”
– Council was now very sceptical about evidence relating to the flood and had been let down. He added that they would not make any changes to anything without evidence.
– If the event occurred again even with the proper maintenance there would have been severe flooding
– Determined to make the system we have work the best that it can
– Agreed need another mechanism other than the ODT to communicate with the community
– Will consider the discussion and come back with a proposal for the next meeting with a smaller group

Laura McElhone. Group Manager Water and Waste
– All mudtanks had been cleaned in South Dunedin (marked with green spray)
– Screen has been redesigned at pumping station, work about to go to tender, installation expected July/August
– Screen currently cleaned weekly by contract with photograph for proof
– Proposed screen modifications would see a 4 part screen to allow for safer and easier cleaning – could not confirm bar spacing
– Approx. 100 manholes had been lifted (Oct/Nov 2015) to identify any siltation – none identified as a problem – map can be provided of manholes checked – this exercise will be repeated in Oct/Nov 2016
– Confirmed that with the work carried out or in progress expected reduction in level of water would be about 200mm – however difficult to predict because too many variable to undertake modelling
– On issue of foul sewage infiltration confirmed that work being undertaken in Kaikorai Valley was to reduce the pressure on the system before it came through to Caversham
– On the issue of diverting foul sewage to Green Island treatment works stated that it was only able to handle a certain amount as it had been set up for a different type of sewage
– With regard to pumping out to sea, confirmed that they now know who to contact at the ORC and will maintain valves to enable this to happen if necessary
– Advised Musselburgh pumping capacity cannot run at maximum [this is disputed by Darrel]
– Forecast received on 2 June was for 1/3 less rain – only after midday on 3 June did they receive prediction on the size of the event
– Definitely had contractors and staff monitoring and out in South Dunedin, but did not have enough people to cover the scale of event
– Door-knocking by DCC did not record the number of flooded houses [DCC has not been back to check]
– 1968 flood had two peaks so had time to recover [disputed by Darrel]
– Too many variables to accurately measure topographical data
– Understand need to reassure and quantify but have to be careful not to give false impression
– Advised that 4/5 engineers employed in planning and 6/7 at the delivery end – acknowledged the identified lack of a storm water specialist – currently under recruitment

– Contractors have been asked to verify status of periphery areas
– Need to build resilience in the community – have recognised need to contact secondary schools and community groups and extend beyond the ‘What’s the plan Stan” initiative

– Unable to provide a figure on the number of roads closed by DCC as the water washed the cones away.
– Civil defence, Fire and Police all advised DCC that only 20-30 houses had been flooded – suggested that volunteers sandbagging were not part of the information loop and therefore message did not get through to emergency services

Kate Wilson. Councillor
– Have been advocating for a rain radar for a number of years on the Taieri

David B-P. Councillor
– Not just South Dunedin affected but other areas also, we need answers to give the community reassurance that the system is operating

May we know when you requested that the mudtanks were cleaned thoroughly?

I had thought that it was an initiative from Ruth Stokes, as part of the looking into and reporting back on the flood.

I am also interested in your “fact” that the stormwater system is not capable even at optimal condition and performance……. Do you mean that it was not then, or that it would not be even if we made adjustments and sorted out the mudtanks and fixed the screen/pump and made changes which we have signalled to the general stormwater system which flows through South Dunedin?

If council modelling showed the extent of the flooding would be precisely as it was in the event of that magnitude, what relevance had the problems with the screen/pump and the mudtanks? I guess all the problems in South Dunedin during the flood were localised problems and many of them as a result of water lying about, so did our modelling show that as well?

I understood that there was still more work to be done to understand what we could best do particularly about the interconnection between the water from various sources and what we could afford of the options available.

Do you see the governance part of the Council completely blameless in this process?
Since you have apparently arranged for the mudtanks to be cleared, surely you/we could have done something sooner.

Do we have a role at all in your view, apart from advising people they are wrong when it turns out we may have incomplete information?

As seems true for all of the information surrounding this horrible flood, the more information we receive the more questions we have.

Last year the Parliamentary Commissioner for the Environment issued a report showing that rising ground water, pushed up by sea level rise will increasingly afflict South Dunedin.
It’s most important to recognise that while stormwater and groundwater can each affect the other, they are different and have different causes.
The failure was operational and managerial as Council was repeatedly assured that maintenance was up to scratch.
Council’s challenge now is to address both stormwater and groundwater issues. We have already, at my request, ensured that the stormwater system is in the best shape possible as winter approaches, by having all the mudbanks cleaned properly. Additionally the screen at the Portobello Rd pumping station, which was blocked by debris carried by the overwhelming amount of water, will be replaced by July.
Council will consider that report which has taken such a frustratingly long time to get to us, and determine the next necessary steps.

WE all know that climate warming is a fact but your glib PR spin and articles in the paper does nothing for your credibility and your lack apology shows that you and the council do not except responsibility for this lack of governance
It is sad that only one of the council appears to have enough bottle to ask you to do in an old fashion way the decent thing
My wish is that you pass this email as part of an agenda item a the next council meeting on how one ratepayer views your lack of understanding in the way a Mayor should carry out his role

It is with disappointment reading the failure of governance by the council I was a chairman in those days that was the title of a high school board If the school had a problem which effected the community you had to stand up and take the blame
I do not expect the council elected members to clean mud tanks but when there is failure of this size then the expectation of the community that something is seriously wrong with the governance of the council The glib excuses as regards rise in sea level is the catch cry of the council which you as a member are part of
In my view the council members should of put on gumboots and gone out with the CEO and inspected the mud tanks instead of waiting a year for a report It saddens me to find that people in South Dunedin were not accorded this Instead we had articles written that showed how out of touch the council members were These articles were part of the green PR spin which now blights any decision that this particular council makes All that was needed was clean mud tanks and clear governance by the members of the council not excuses I hope that this is a lesson that you as a council member takes on board when making decisions in the future

A series of emails released by Dunedin city councillor Lee Vandervis show he was raising concerns about the state of Dunedin’s mud-tanks as long ago as 2011. Cr Vandervis said he released the emails because only publicity forced the council to change its ways. “This publicity is going to make sure it really is sorted once and for all this time.” The release of the emails follows a report released by the Dunedin City Council last week into last June’s flood, which found 75% of mud-tanks in South Dunedin were not properly maintained.

Council staff were responsible for not properly overseeing mud-tank maintenance in South Dunedin, not councillors or the mayor, a senior staff member says. Council infrastructure and networks general manager Ruth Stokes started today’s council infrastructure services committee meeting by apologising on behalf of council staff for the failings identified in a report on last June’s flood. Dunedin Mayor Dave Cull and Crs David Benson-Pope and Lee Vandervis were among those who had raised mud-tank performance prior to the South Dunedin floods, and been given incorrect information by staff. “For that I would like to, on behalf of the executive, apologise,” Ms Stokes. The failure was a management failure and not governance one, she said.

Mayor Cull says he is outraged at the failure of Fulton Hogan and council staff to adequately ensure that the mudtanks were in working condition. He should also be outraged at his own poor leadership and failure to respond to developing problems. Under his leadership the city continued to build up a backlog of worn-out stormwater pipes and equipment waiting for funding to be allocated. With this lack of funding we have seen the inevitable result of a deteriorating stormwater system. The poor state of the stormwater system was the primary cause of the severity of the flooding at Kaikorai, Mosgiel and South Dunedin last year.

This under-funding of the stormwater renewals is not an accident. Every year the DCC Mayor and councillors decide and vote on this spending – and every year they vote to under-fund the stormwater renewals because they think that a new stadium and a new swimming pool and more bicycle lanes are more important than a functioning stormwater system. The Annual Plan shows that the under-funding will continue next year. Expect the deterioration to continue.

Report on South Dunedin infrastructure performance during June 2015 flood released

The report on the South Dunedin infrastructure performance during the June 2015 flood event was released today as part of the agenda for the Infrastructure and Services Committee meeting next week.

The report concludes that while a number of factors contributed, the main factor was the highest 24-hour rainfall total in Musselburgh since 1923.

General Manager Infrastructure and Networks Ruth Stokes says the report outlines the known challenges with managing the South Dunedin catchment and highlights concerns about the performance of mudtanks and the Portobello Road pumping station during the event.

“Changes in the South Dunedin catchment since the stormwater network was designed, combined with operational challenges and high ground water levels, all contributed to the effects of the extreme rainfall event that occurred in June 2015.”

Mrs Stokes says the report shows that mudtanks weren’t maintained as required. As a result, a number of steps, including a full review and retendering of road maintenance contracts have been adopted. Other measures include accurately capturing data on the status of the mudtanks, a redesign of the Portobello Pumping station screen and the development of a communications plan to inform the community of the local infrastructure challenges and how to best plan for future events.

“However, given the volume of rainfall and the system at capacity during the June event, the water would have been unable to enter the network even if all mudtanks were clear.”

She says the DCC must now look at what measures can be taken to mitigate such events in future.

The DCC will soon be engaging with the community about these issues and what the long term responses might be.

The Mangawhai wastewater scheme cost about $63.3 million. Overall costs were not just financial, the Auditor-General’s report said. “They included a failed council, councillors replaced with commissioners, the departure of a chief executive, a severely damaged relationship between the council and community, an organisation that needed to be rebuilt, and much more.”

Dispute settlement sees Auditor General pay nearly $5.4 million to Kaipara District Council
About $5.375 million will be paid to the Kaipara District Council by the Auditor-General’s office now that a dispute between the two has been settled. Mediation of the dispute over audit issues around the controversial and costly Mangawhai wastewater scheme was held by retired High Court judge Rodney Hansen QC, without any admission of liability and for each party to cover their own litigation costs.

Auditor-General Lyn Provost’s scathing inquiry report to Parliament in December 2013 outlined “a woeful saga” surrounding the community wastewater scheme, managed by the then-council between 1996 and 2012. It covered roles played by other agencies, including the Controller and Auditor-General’s office. The inquiry found the council failed to adequately perform its responsibilities to the community in connection with the wastewater scheme. The council itself alleged the Auditor-General did not identify these failings in a timely manner and take appropriate steps to bring them to the council’s attention. It also alleged some of the poor decisions it made could have been averted if the Auditor-General’s office had performed its responsibilities appropriately.

The Auditor-General offered an unreserved apology in the report to the Kaipara district community for the office’s failings in some of its work, but disputed the council’s damages claim. In particular, the Auditor-General considered the council had the responsibility to comply with its statutory obligations, and its failure to do so is not attributable to the Auditor-General’s office. The dispute was settled with neither party admitting liability but the Auditor-General’s office agreeing to pay $5.38 million to Kaipara District Council.

A rates revolt began as costs were included in Mangawhai rates, with some properties connected to the new scheme now paying around $3000 annually in rates. Kaipara District Council commissioner John Robertson said the council was pleased to see a positive outcome from the High Court action it took against the Auditor-General in 2014. “If we hadn’t got an outcome we would be back in court and facing all the risks of whatever judgments go on these sorts of things.”

The Kaipara District Council has two more court battles pending with Mangawhai ratepayers.

I was informed in person, in January, that the Water and Waste Services department report, ‘Infrastructure Performance During June 2015 Flood Event’, tabled at the full council meeting on 30.11.15, had been “peer reviewed” and the time taken for review was cause for delay of the report’s release.

We now learn an “internal review” happened at the council, with some external scrutiny. In considerable doubt, since DCC does not provide the evidence in its official response (21.2.16), is the claim that “Feedback from these individuals was that the report was thorough and the numbers and analysis stood up to scrutiny.”

An internal review is a long way short of an independent peer review – peer reviews are typically formally briefed as to scope etc with binding agreement of the parties.

How does the ‘internal review’ stand against the news story,
Flooding: lack of maintenance blamed
(ODT 13.2.16) —where Bruce Hendry is cited: “A man who helped build South Dunedin’s drainage network says a lack of maintenance exacerbated problems caused by last year’s record-breaking flood. […] “Eight months after what has probably been the biggest and most expensive disaster in Dunedin since the 1929 floods, answers relating to the future and safety of those most affected, particularly residents of South Dunedin, have not been given,” he said in the report.” What report? DCC fails to produce it.

What will happen in April with the release of the report from the DCC’s Transport department on the performance of drains and mudtanks during the flood, and which in recent times have been subject to poor maintenance and lack of upgrade?
