Christy, Distinguished Professor of Atmospheric Science, Alabama’s State Climatologist and Director of the Earth System Science Center at The University of Alabama in Huntsville. I have served as Lead Author, Contributing Author and Reviewer of United Nations IPCC assessments, have been awarded NASA’s Medal for Exceptional Scientific Achievement, and in 2002 was elected a Fellow of the American Meteorological Society.
It is a privilege for me to offer my analysis of the current situation regarding (1) the temperature datasets used to study climate, (2) our basic understanding of climate change and (3) the effect that regulations, such as the Paris agreement, might have on climate. I have also attached an extract from my Senate Testimony last December in which I address (1) the popular notion that extreme climate events are increasing due to humaninduced climate change (they are not), and (2) the unfortunate direction research in this area has taken.

DCC 2GP further submissions [update]

Two updates were issued today by DCC on the 2GP further submission process.

In the first, DCC said it had withdrawn the 2GP Summary of Decisions, and the closing date for further submissions would be put back and publicly notified.

The second update made no reference to the closing date or public notification:

The Summary of Decisions Requested reports have been temporarily withdrawn from the website due to a technical error in exporting data. In the interim please use the search function on the Search the Submissions page to view the correct Summary of Decisions Requested. Updated Summary of Decisions Requested reports will be distributed online and to libraries as soon as practically possible.

IGNORE THIS DATE – The Further submission period is open from Wednesday, 10 February to Friday, 26 February.

What can a further submission cover?
A further submission can only be made in support or opposition to a point raised in an original submission on the 2GP.

Who can make a further submission?
The RMA limits who can make further submissions to:
● any person representing a relevant aspect of the public interest
● any person that has an interest in the proposed plan greater than the interest that the general public has
● the local authority (the Dunedin City Council).

It provides an opportunity for people who may be affected by an original submission to have their views considered. You do not have to have made an original submission to participate. If you have made an original submission you do not need to repeat submission points made in that submission as they will already be considered.

Summary of decisions requested
The Summaries of Decisions Requested are a concise summary of the decisions requested in the submissions on the 2GP which closed on 24 November 2015. It is not the full or exact content of submissions. It is prepared to enable the further submission process which is set out in Schedule 1 of the RMA.

█ The Summary of Decisions Requested and copies of all submissions will be available from midday Tuesday, 9 February.

Hard copies of the Summary of Decisions Requested reports will also be available for inspection at:
● 2GP drop-in centre, 11 George Street, Dunedin, 10am to 3pm, Monday to Friday

How do I make a further submission?

Online submissions
The RMA requires further submissions to be in a prescribed form (Form 6). An easy way to make a submission is using the 2GP on-line submission system, which ensures submissions are in the prescribed form and allows you to link to specific submission points

Hard copies of the submission form and submission guidelines can be downloaded below or paper copies can be picked up at the 2GP drop-in centre or from the DCC Customer Services Agency located on the ground floor of the Civic Centre at 50 The Octagon, Dunedin.

Hello Elizabeth,

Sue has asked me to email you with regard to the eplan format concerns you raise below. Apologies for the delay – we thought a response had already been sent to you have realised now this is not the case.

The eplan is effectively no different from a plan produced in word processing software (like Microsoft Word which was used for the current District Plan). It has the same ability to be printed and annotated by users.. While we do not offer print out of the whole plan, we are providing hard copies of sections on request.

The strength of the eplan format is making it easier to allow cross linking between plan provisions to locational information (e.g. search plan from property address), which will be added after the plan is finalised. It does not diminish its usability in print form.

The software used to produce our 2GP in the same system that has been used for the Auckland and Christchurch plans and is being used other councils who are currently working on their 2GPs. It is the new ‘norm’ for plan writing in New Zealand.

We have reviewed other District Plans and have found the 2GP is not longer than average. For example, Queenstown’s Residential Section has 68 pages, Christchurch’s has 180 and Dunedin’s has 87.

Much of the increased length from the current district plan is due to better cross-referencing between sections. The plan easier to use because it reduces the need to search through the whole plan to see what is relevant to a particular proposal in a particular location (which has involved more repetition of content rather than new content). This means that most people will need to look at fewer parts of the plan.

We have received positive feedback from planning professionals who work across several Council’s plans. The feedback is that the 2GP is well structured and easy to use. However, we accept it does take some time to get used to.

In additional to providing detailed help information on the website (see guide to the structure of the plan and how to videos) we provide one –on-one assistance to people to help them understand the new plan and most people seem very pleased with the level of help we are offering. We have helped over 1100 people in this way (often with multiple contacts). We invite you to come and see us for more help if you still require it.

For your information I’m not representing anyone other than myself in addressing letters to the Chief Executive on matters to do with the Proposed 2GP. In my letter (below) I reference need for extension as would apply to “the community” (meaning interested public) as a whole.

The RMA does not mention an ePlan.

The DCC ePLan (1600 pages) launched at us, as we’re well aware, is a horror to deal with for many.

In this regard the RMA requirement of 40 working days scarcely seems fair or practical. Months ahead of ‘back and forth’ through appeals with some parties will, I suggest, place ‘workability’ in sharper relief for the city council. I look forward to what unfolds.

The Otago Regional Council is taking aim at its district counterpart, by opposing a draft plan for the wider city area. The ORC has prepared two submissions on the Dunedin City Council’s second generation district plan. As a landowner, the ORC says the plan doesn’t represent sound resource management practice. It says the plan won’t promote efficient use or development of local resources, and is contrary to parts of the relevant government legislation. The ORC’s submission as an authority includes almost 50 separate requests for changes. But it also highlights the ORC’s support for other sections of the plan.
The DCC has received over 1000 submissions on its draft plan.

An OVERWHELMING observation….

RE Proposed 2GP – difficulty with ePlan document tracking

In thinking through the public’s approach to carrying through on their submissions, further submissions, and within mediation and hearing processes, or indeed formal appeal processes via Environment Court – how will individual and group submitters and their experts contend with ePlan document tracking in these settings.

● Not all members of the public have access to laptop computers or the ability to use them efficiently in a formal meeting or hearing setting;
● In any case, participants will be disadvantaged if there are inadequate numbers of chairs and tables provided to facilitate safe (ergonomic) use of laptop computers – this also applies for those actively listening from the public gallery;
● Due to the unwieldy size of the (draft) ePlan at 1600 pages it is highly unlikely individuals will want to request print editions in order to ‘keep up’ with business in whichever forum.

This perceived lack of accessibility and usability of the 1600-page ePlan in the delivery of written and oral submissions as well as the giving of expert evidence raises serious questions around fairness and justness – ultimately, a concern to all Dunedin ratepayers and residents, and the city council.

● I have absolutely no idea how submitters, experts, news media, council staff or commissioners will technically follow specific mention of ePlan sections and references, or achieve cross referencing swiftly and successfully, be it with or without laptops or printed copy.

Here looms a logistical and bureaucratic nightmare for all.

To be frank, I see no ready solution.

However, I invite council explanation if through media statement(s) or council website guides that might practically assist or calm the resolve of the interested public wanting to critically engage with the proposed second generation district plan in the coming months.

Due to the length (1600 pages) and comprehensive nature of the planning document (by ePlan), in that it no longer resembles the current Dunedin City District Plan at all, I request that the closing date for public submissions is extended into the 2016 new year.

This will allow the community to consult itself, the city council, and experts where need, more fairly and comprehensively than has been possible in the time since notification on Saturday, 26 September 2015.

It’s of collective mutual interest to enhance and facilitate the public’s understanding of the document and its likely effect(s) on physical, cultural and political determinants for sustainable management of our environment and resources. This means allowing more time for initial submissions.

It came to my attention on Friday, 2 October 2015, via the ODT article, Green perceptions spark row

that the makeup of the panel selected to hear public submissions on the proposed second generation district plan (2GP) lacks independence due to both the number and selection of city councillors “with appropriate Resource Management Act training” – namely, Kate Wilson, David Benson-Pope, Jinty MacTavish and Aaron Hawkins;

and further,

the lack of independence still pertains given the ‘internal’ appointments will be accompanied by selection and appointment of up to three Only external independent commissioners – see DCC’s advertisement at ODT 3.10.15 (page 5): 2GP Hearings Panel – Expressions of Interest Sought. The notice is no longer available online at the DCC website; I attach a photograph.

Given these numbers, there is potential for the ‘councillor-commissioners’ to vote in a bloc should they choose.

I strongly believe public submitters on the Proposed 2GP should be able to trust in a just and fair process; a process without bias and political taint.

I don’t believe this is possible under current arrangements and selections for the hearings panel.

Furthermore,

One or more of the ‘councillor-commissioners’ – or indeed the external commissioners – may have previously ruled on resource consent applications, notices of requirement (for a designation), proposed plan changes and the like within the greater Dunedin area, which may have significant bearing on how they receive, decide and recommend on the content of public submissions in regards to the Proposed 2GP and the resulting plan document, whether or not sections are formally appealed to the Court(s).

It is simply not enough for Mayor Dave Cull to deny bias (or perception of bias) in panel choices, as he has done through the media, see ODT (3.10.15): Cull denies bias in panel choices

In my opinion, for a fair and just process all those appointed to the 2GP hearings panel should not be city councillors; they should all be experienced independent commissioners sourced from outside Dunedin City Council’s geographic boundary area.

The PROPOSED 2GP at 1600 pages is the biggest TURN OFF in Dunedin Planning History, ever.

The 2GP is the second generation district plan; and YOU, THE COMMUNITY, OWN this regulatory document once it is fully operational. Unfortunately, City Planning thinks THEY own it for your own good. Forget that. Eyeball the bastards and be prepared to defend your realms. Expect to meet with senior management of DCC, get past the desk staff. Most important —go straight to the top: group and general managers, and the chief executive. Avoid lower pond life. Cut to the chase.

Make no mistake, your property if it lies in the City Rise will be GREATLY AFFECTED. There’s very serious stuff going on if you live in a natural hazards zone. But what about your business, read very carefully. Buy a Resource Management specialist if you want to truly defend your property, its use and its value – or if you seek something different, time to stop writing invective just DEAL to the 1600 pages before the submission deadline in November. Write further submissions. Appeal the 2GP to Glory at Environment Court. Go to the High Court if you must. Etc. Etc.

Start your submission with the fact that the hearings panel is not INDEPENDENT and you protest this – councillors should not be sitting on the panel – at the moment Cull’s followers have a voting majority to push their green agendas through. STOP THE ROT. Already, you haven’t been served natural justice. Demand experienced independent commissioners from out of district that DCC hasn’t got to.

The DANGER is, if you’re a Ratepayer and you think you can deal with the 2GP through a DCC-produced summary you are BARKING MAD, you will sign your life away immediately. Wise up.

█ Message: Below is the statement I gave to [Chris] Morris as I left the meeting today. Be interesting to see what he does to it. —I also gave him a copy of my initial apology.

I completely reject the claim that I misled the Audit and Risk committee, and that I was not open and honest.

– What I did do was voice my concern that the investigation into DCC Citifleet fraud was narrowed down to a single category of fraud, and that the blame has been narrowed to a single deceased individual.

– Since then I have seen no hard evidence of the DCC fraud investigation being widened.

– Accusers should have had hard evidence of a widened investigation as was continually promised but not delivered, before even considered accusing me of acting in bad faith – never mind now considering sanctions against me.

– I am still hopeful that the DCC Citifleet fraud investigation that I began in 2011 will be actually widened, seek my offered evidence, and fully investigate the whole range of fraud, including Citifleet.

Regarding complaints of loudness, due process has not been followed to allow me to defend anonymous claims that go beyond loudness, so I’m not in a position to recognise them.

I recognise today that I had become increasingly frustrated with the lack of CEO response to my earlier emailed governance complaints, and that an unacceptable Council agenda item was imminent as a result.

Happily some time was subsequently allowed for possible resolution of the Governance issues I complained of.

To prevent a recurrence of overheard unpleasantness, I undertake to make any future complaints of staff or elected representatives in a recorded medium.

Another Busy Year Ahead With Cycleways

Dunedin residents will be able to make the most of safer cycle routes in coming months as the city’s cycleway network continues to expand. Dunedin City Council Infrastructure Services Committee Chair Cr Kate Wilson says cycleways make the streets safer for all road users and hopefully encourage more people to get on bikes.

“For years people have been asking the Council for enhanced cycleways in Dunedin. We have a responsibility to provide networks that give people travel choices, whether that be cycling, walking or taking a bus or car. The more of the network that is completed, the more we can provide for people who want to use cycleways, whether it’s a child cycling to school, an adult cycling recreationally, or anything in between.”

It is also a central government priority to rapidly expand and enhance networks of cycleways around the country, recognising the benefits to health, the economy and the environment. The DCC has received $570,000 from the Government’s Urban Cycleway Fund and the Council has decided the funding will be used to enhance and expand the South Dunedin Cycle Network. The DCC also receives funding from the NZ Transport Agency to build the network.

“Taking advantage of Government funding now is important as we have a limited window of opportunity to capitalise on our position as one of only a few cities with the requisite Strategic Cycle Network Plan. We are a financially constrained Council and the more funding we get from outside sources the less we need from ratepayers.”

In August 2011, the Council adopted the Strategic Cycle Network for Dunedin, which gave the South Dunedin network of routes the highest priority for design and construction. Cr Wilson says 40% of people living in South Dunedin do not have access to a car, which is a key reason for South Dunedin cycle routes being prioritised.

“We understand introducing cycleways to our streets has been a big change for some people, but we’ve got a great opportunity here to improve our city in a very positive way for current and future generations.”

Here’s an outline of what’s happening with South Dunedin cycleways over the next month.
● Portobello Road (between Timaru Street and Portsmouth Drive) – wider consultation on a revised concept plan for this stretch of road.
● Hillside Road/McBride Street – staff are reviewing the proposed cycleway design after meeting with local businesses.
● Neville/Wilkie Streets – a final decision on the type of cycleway for these streets will be made in April. Construction is scheduled to begin in May.
● Harbourside/Roberts Street – the Harbourside Working Group will meet again in mid April.
● Richardson/Coughtrey, Fingall/Tedder, Bellona/New Streets – Construction of these ‘quiet streets’ and dedicated cycleway should be finished in the next couple of weeks.

Residents, businesses and property owners in areas where cycleways are planned will be contacted directly.

Long Term Plan Consultation Document Unveiled

‘Building a Great Small City’, the consultation document for the DCC’s Long Term Plan (LTP) 2015/16 – 2024/25, has been released.

Mayor of Dunedin Dave Cull says the LTP is designed to enable the Council to examine the bigger picture and set a strategic direction for the city covering the whole range of DCC activities. Now priorities have been proposed, the Council wants to hear from residents.

The consultation document is now available at http://www.dunedin.govt.nz/ltp
Public consultation on the LTP opens on Saturday (today) and closes at 5pm on 28 April. People are encouraged to provide their feedback early and, if possible, use the online form.

A snapshot of what is proposed, presented in a map fold newsletter, will be delivered to every Dunedin household. Once consultation has started, there will be further information on the DCC website and copies of the LTP consultation document will be available at DCC facilities such as libraries and the Customer Services Agency in the Civic Centre. There will also be public workshops and LTP stands in public places and at events, with the opportunity for face-to-face discussion with Councillors. These will be held around the wider city during the consultation period.

For the first time, comments on the DCC Facebook page and tweets to @DnCityCouncil using #LTP will also be considered as feedback.

█ 28.3.15 ODT: Council accepts social media feedback

Mr Cull says, “The LTP allows us to look at the aspirations outlined in our strategy documents and how we should prioritise these over the next 10 years. This means the LTP needs to balance our financial goals, such as debt reduction, and our desire to develop Dunedin to make it a more attractive place to live and do business. Our Financial Strategy imposes a 3% rate increase limit unless there are exceptional circumstances. This is in line with the average 3% ‘cost of living’ increases faced by local government. Under current proposals, an overall 3.8% rate increase is proposed for 2015/16. The exceptional circumstances are that, in addition to our usual inflationary pressures, we have had to provide an extra $1.5 million for the Forsyth Barr Stadium and budget for losing $4.5 million of dividend from Dunedin City Holdings Limited, which owns companies on the DCC’s behalf. We have absorbed some of those costs, but cannot absorb them all. We also need to balance rate limits against a range of new proposals in the LTP which the Council believes are worth investing in. We need public input on these, plus feedback on several other projects that have been included as unfunded items, such as new aquatic facilities for Mosgiel and lighting for the University of Otago Oval.”

Amendments to the Local Government Act have changed the way LTPs are developed and consulted on with the community. Past long term plans have involved first producing a full draft plan which was then put out for public consultation and feedback. Under the new system the DCC is required to produce this consultation document which sets out the issues the city is facing and the options for managing them. Key issues include putting the Stadium on a more achievable financial footing, tackling the city’s ageing infrastructure and addressing low economic growth.

The consultation period will be followed by hearings and deliberations in May and a final LTP will be adopted by the Council in June.

A range of supporting documents and an online submission form will be available at http://www.dunedin.govt.nz/ltp from 7am on Saturday (today).

Is there a political split forming in Greater Dunedin? – when indeed, historically, we’ve been told by the ‘loose connection with incorporated society’ that its members have no shared policy, that their elected representatives are free to (think) and vote independently…. with some cohesion, nevertheless.

Well might Cr Lee Vandervis provide a standing ovation to Cr Aaron Hawkins’ voicing of major concerns. It was incumbent on Cr Jinty MacTavish, practically and politically… to agree with her Green Party confederate.

Dear Chris and Co,

CEO Bidrose has this weekend confirmed in public, with a hug, that she has not made any complaint of me, that she was out of town when she received my latest email alerting her to a legal issue in the non-public section of the Council meeting underway when we spoke in the hallway, and that her secretary had not read through the email to the legal issue and alerted her prior to the meeting in which Mayor Cull attempted to push the issue through.
The legal issue related to Mayor Cull’s false claim that he was personally empowered to select the membership of the Code of Conduct Committee [against me], when this power is clearly that of the whole Council as detailed in Standing Orders J4.1 and in the Committee Structure and Delegations Manual.
This came on top of Mayor Cull’s falsely claiming statements supposedly made by me at the 3/11/14 Council meeting, and his then immediately demanding that I withdraw these statements which I did not make. Mayor Cull then used my refusal to withdraw the statements as a pretext to eject me from the meeting, all of which the video proves. This was the essence of my Code of Conduct Complaint against Mayor Cull of 10/12/14. Two subsequent Code of Conduct Complaints against me by Greater Dunedin Chairpersons do not mention any swearing or expletives and seem to be personal ‘tone’ attacks to deflect from on-going Mayoral abuses of his position and the Mayor’s attempts to silence my concerns.

Why is there no law to rein in dodgy ratbag local body politicians?

Former ARC Councillor Bill Burrill is not the first dodgy ratbag Councillor to trough from abuses of power to his own pecuniary advantage in recent years. A few years back in 2009 Council Watch was calling for a number of Councillors from the Canterbury Regional Council to be prosecuted and sacked from their positions after an investigation by the Auditor General Lyn Provost found that four individuals had broken the law by acting in conflict with their official role. Back then those Canterbury Councillors failed to declare a conflict on interest that [led] to a financial benefit for themselves by participating in discussion and voting on proposals before Council. Under investigation the Auditor General’s office chose not to prosecute stating that whilst the Councillors should have withdrawn as a matter of principle – they had each received and shared legal advice that they could participate. And here in lies the problem. The Auditor General and Office of the Ombudsmen publish clear guidelines for Councillors and council staff but the reality is that the law is erroneously filled with holes that are exploited and there is precious little oversight of Local Government leading to the Auditor General loathing to bother and the Courts uninterested.

Some Dunedin city councillors are urging a rethink on the sale of a council-owned car park near the Mayfair Theatre, but Mayor Dave Cull is adamant the sale should not be a political decision. Mr Cull said yesterday council chief executive Sue Bidrose had been delegated to make the sale, and it was not a matter for councillors. “That’s her job.” But three councillors want at least a discussion on the issue.

Cycle project scaled back

The Dunedin City Council has been forced to pare back original plans for the controversial South Dunedin Cycle Network, as the true costs of the project become apparent. Despite being reduced by almost half, the curtailed network is expected to cost about $5.5 million – $1 million more than original estimates for the whole network. The blowout may eat into funding set aside for the rest of the city’s cycle network.
