Threat to ‘double damages’

Councillor Lee Vandervis has threatened to “double the damages” from defamation action after Dunedin Mayor Dave Cull stood by calling him a liar. […] Cr Vandervis launched the defamation action this week, saying Mr Cull calling him a liar during a discussion on a new council procurement policy was incorrect and defamed him. A letter sent to Mr Cull by Cr Vandervis’ legal counsel, Alistair Paterson, said he would be willing to forgo defamation action if Mr Cull paid his legal costs and made a public apology in a full council meeting filmed by Dunedin Television and in the presence of Allied Press [Otago Daily Times] reporters.

Councillor asked to leave meeting
Councillor Lee Vandervis was instructed by Mayor Dave Cull to leave a Dunedin City Council meeting today. The request came after Cr Vandervis alleged that tender contracts could not be secured unless a relationship was developed with staff. The Mayor rejected his claims, saying he had no proof. Cr Vandervis then proceeded to continue discussing the matter and was asked to leave.

Mosgiel (2015): Destroyed community beautification project —a development

█ Message: The community board had a choice (2007) of which side of the road the footpath should go; and they chose to destroy the railway beautification project. Please note who the primary mover was. None other than Lester Harvey who received awards and whatever else for the beautification project. Surely he would’ve been the prime mover for the footpath to have been on the other side of the road (??), to preserve the beautification project that he claimed as his own.

DCC: Chairman denies true and correct Council record

This post, by clear and unequivocal video reference, captures the undemocratic conduct of Council; and the consequent failure of Council to honour and uphold the true and correct minute record of business proceedings.

Note Mayor Dave Cull’s chairmanship of the Council meeting 15 December 2014 in regards to (Item 4.) Confirmation of Minutes for (4a) the ordinary Council meeting of 3 November 2014.

Cr Lee Vandervis rightly claims that the minutes for confirmation are not a correct record of the meeting on 3 November, given reference to a remark* wrongfully attributed to him by the Mayor; and which remark is claimed to have caused the Mayor’s ejection of Cr Vandervis from that meeting.

*[allegedly, about the intentions of Council and staff and the objectives of the cycling strategy]

Cr Vandervis states he did not make that remark. He says the minutes are false and the video of the meeting verifies this.

Mayor Cull replies “the minutes are not [false]” and tells Cr Vandervis: “OK you can vote against it” [confirmation of the minutes].

With that, the Council vote is taken. It should be strongly noted that all Councillors with the exception of Cr Vandervis voted to confirm the minutes with no amendment.

Cr Vandervis abstained from voting “on the basis the mayor asked me to withdraw a remark that I did not make”.

Opponents scrap over stadium vote

Dunedin’s election campaign ignited yesterday, with mayoral candidate Cr Dave Cull fending off accusations he and fellow Greater Dunedin candidate Kate Wilson voted for the Forsyth Barr Stadium in 2008.

My notes when in attendance at the Finance and Strategy Committee meeting and the Extraordinary Council meeting held on 17 March 2008 show:

That at the finance and strategy meeting, Crs Dave Cull, Kate Wilson, Fliss Butcher and Teresa Stevenson voted against the stadium project. In accordance with the minutes received I agree that the meeting ended with a 10-4 vote to commit to the stadium, subject to conditions.

That at the Extraordinary Council meeting there was a procedural vote to confirm the resolutions taken from the finance and strategy meeting. Crs Cull and Wilson voted in the affirmative. The motion was won, 12-4.

At the time and since I did not infer a vote for the stadium by Crs Cull and Wilson.

It may have been ‘politically naive’ to vote the resolutions through given the events in the finance and strategy meeting where conditions were agreed – or perhaps it was sound procedurally.

Either way, the matter of how Crs Cull and Wilson voted on the motion to confirm the resolutions was not going to change the outcome.

The ‘opponents’ cited in the ODT are clutching at straws.
