Breaches by pokie operators spark fee increase

Half of all inspections of pubs and clubs with pokie machines identify breaches or non-compliance with the law. Fees paid by pokie operators are to be increased as levels of fraud and other breaches challenge the Government’s ability to police the sector. Internal Affairs Minister Peter Dunne is overseeing consultation on proposals that will increase fees paid by clubs and pubs with gambling machines by 54 per cent.

OPERATION CHESTNUT NEAR COMPLETION
DIA, SFO and the Organised Financial Crime Agency NZ scrutinised $30 million in gaming grants made by trusts including Bluegrass. Bluegrass’ licence was cancelled after the DIA ruled its start-up funding was sourced from three racing clubs, rather than from South Canterbury Finance, as claimed.

The past three years have seen an increase in complex investigations into fraud and illegal activity at clubs and societies with pokies. That, and the declining number of pokie machines, has put severe financial pressure on the Department of Internal Affairs (DIA). Gambling enforcement is funded through fees paid by gambling operators.

DCHL: Aurora upgrade implicates Delta

The upgrade would cost DCC, as Aurora’s annual dividend – passed on to the council and used to offset rates – dropped by $2 million a year, to $7.5 million, from 2015-16.

Delta had shed almost 150 workers and closed its entire civil construction arm since mid-2012.

Aurora plans $139.2m upgrade

Dunedin City Council-owned lines company Aurora Energy says a planned $139.2 million investment in its network will create about 20 jobs and help ensure the lights stay on as growth picks up in Central Otago. The company’s five-year spending plan would result in upgrades and replacement of key pieces of ageing infrastructure across the network, which supplied 83,000 customers in Dunedin and Central Otago. […] The work would also generate spin-off benefits for another council-owned entity, infrastructure company Delta, which already managed Aurora’s network and shared the same management and directors.

ONE News: Victim’s relative feels ‘sorry’ for Easy Rider widow

A relative of one of the people who lost their lives in the Easy Rider sinking in 2012 says he feels sorry for the woman charged over the tragedy. Judge John Strettell released his judgement today, finding Gloria Davis and her company AZ1 Enterprises guilty of three charges under the Health and Safety in Employment Act and the Maritime Transport Act in relation to the tragedy. She originally faced five charges but two were dropped. Ms Davis is the sole director of the company that operated the fishing boat which capsized in Foveaux Strait on March 15, 2012, claiming eight lives, including Ms Davis’s husband, Rewai Karetai, who was skipper of the vessel. The New Zealand Institute of Directors agrees the judgement serves as a warning. “When you take on a role as a director you cannot sit there passively,” says NZID’s Stuart McLauchlan. “You’ve got to understand what the risks are, you’ve got to understand the operations of the business, and ultimately you’re responsible.”

The same applies in the failed Delta land deals at Luggate and Jacks Point. Board directors for Delta Utility Services Ltd, Delta Investments Ltd (previously, Newtons Coachways (1993) Ltd), and Dunedin City Council’s holding company (DCHL) are ultimately responsible to Dunedin ratepayers for the multimillion-dollar loss.

Note: Stuart McLauchlan has been a director for Delta Utility Services Ltd since 01 Jun 2007; Delta Investments since 16 Jul 2009; and Dunedin City Holdings Ltd from 01 Jun 2007 to 31 Oct 2011. Altogether, this represents a “perceived conflict of interest” and more.

NZC won’t name trio in corruption investigation

The news comes within a week of the Government releasing a long-awaited report into corruption in New Zealand sport in which it asserted there was little for Kiwi sports fans to be concerned about. Sports Minister Murray McCully revealed few details of the nine-month investigation which was prompted by the scandal in Australia around doping and betting in sport. But McCully promised New Zealand would ramp up its fight against corruption in sport by implementing greater information-sharing among government and sporting bodies to stamp out potential match-fixing, doping and illegal activity. He added that a national match-fixing policy would also be established in 2014.
“The report found no evidence of widespread drug use or organised crime in New Zealand sport,” McCully said. “But it would be naive to think New Zealand is insulated from these problems. This is why we are taking pre-emptive steps to safeguard our athletes and clean sporting reputation.”
The report was instigated after the Australia Crime Commission earlier this year linked organised crime and banned substances to several Australian sporting codes including rugby league and Australian Rules football. But Sport New Zealand (SNZ) concluded there was little need for the Government, sporting or law-enforcement agencies to conduct a similar investigation in New Zealand.

Secret Commissions Act aka ‘Backhanders Law’

Though it is perceived as one of the least corrupt countries in the world, New Zealand is among only a handful of countries including North Korea, Germany and Japan not to ratify the 2003 United Nations Convention on Corruption.

Century-old corruption law carries wrist-slap penalties

A private eye who has helped two clients lay bribery charges under the Secret Commissions Act in the past month says the penalties need updating as they haven’t changed in more than a 100 years. Danny Toreson of Thompson and Toreson Investigations would not name the clients, but said: “One is a commercial organisation and the other is a government body”.

“We have had an increase in dealing with matters concerning allegations of corruption and bribery,” Toreson said. Maximum penalties under the act amount to only a $2000 fine for a company and up to two years prison for a person, which Toreson says is a “bit light”. “It needs a massive overhaul.”

The Secret Commissions Act is the main law outlawing staff taking backhanders for awarding work and contracts without their employer’s knowledge. For example, a government worker could give a contract to a company in return for a secret payment or benefit.
But despite a rising tide of secret commissions charges being laid, an update of the act is long overdue.

ORFU report to stay confidential

A confidential report following the financial collapse of the Otago Rugby Football Union is likely to remain confidential.
The Dunedin City Council agreed to write off a debt of more than $400,000 and Dunedin Venues Management Ltd a debt of $80,000 to help the union avoid liquidation in March last year.
The New Zealand Rugby Union, which lent the cash-strapped union $500,000, commissioned a report by Cascade Consulting to look at the union’s involvement with pokie grants.
The report was later supplied to the Department of Internal Affairs, which declined to release the documents on the grounds it ”would be likely to prejudice the supply of similar information”.

”The department does not consider the withholding of the report on ORFU provided by NZRU would diminish public confidence in the department as a responsible regulator of the gambling sector and does not consider that these reasons for withholding the information are outweighed by other considerations which render it desirable, in the public interest, to make the information available.” –DIA

The Otago Daily Times lodged a complaint with the office of the Ombudsman on July 25, 2012, asking for the release of the information.
Chief Ombudsman Dame Beverley Wakem, in a provisional opinion released this week, said the department was entitled to withhold the information.
