Stadium costs $23.4144 million per annum

Cover note:
According to the latest DVL/DVML six monthly reports the debt is growing not reducing – that is a concern. The $146.6 million debt was passed over to DVL, many millions were poured into servicing the interest and capital repayments for this debt but even with that happening the combined short term/long term debt of DVML/DVL now stands at $157.6 million – $11 million more! The long term debt of $146.6 million has been reduced to $138.8 million but short term debt stands at $18.8 million. It is a major concern that the combined debt is growing not reducing – and this is during the stadium’s honeymoon period.

Dear Mayor Cull and Councillors

As a result of further discussions and more information obtained through further searching Council documents Calvin Oaten and I have updated the annual stadium costs which now stand at $23.4144 million. (See attached word document). No changes have been made to the spreadsheet I sent earlier which I prepared.
There are some costs which have not been included due to the difficulty in quantifying them to the accuracy of which I would be comfortable.

This $23.4144 million figure does not include any payments which may have not been fully transparent through the Council books.
By this I mean that I understand there were approaches by Darren Burden, former CEO of DVML, to obtain payments for bills which DVML were unable to pay but which another Council Department had shown some willingness to transfer their surplus unspent funds from that Department to DVML. In that particular case, I understand the transfer did not happen. However, I have no access to information as to whether this had occurred on previous occasions through other departments.

█ Also attached are Terry Wilson’s calculations coming from a different angle but which come to $23.1 million per annum. (See attached spreadsheet prepared by Terry Wilson).

Stadium costs ballpark at $21.337 million pa, Butler & Oaten

Message: During the presentation of my submission on the draft annual plan I was asked by Council to produce the figures to back up my claim that the stadium was costing approximately $20 million per annum. David Benson-Pope made a general statement questioning whether the claims in my submission were correct – though he didn’t elaborate when I asked him. I have followed up the Council’s request and the final figure is $21.337 million.

Please note there is a huge disparity between what the DCC has published in the Draft Annual Plan 2014/15 and what can be shown by the DCC’s own figures that are very difficult to find and interpret. The ratepayers should not continue to be kept in the dark – the real costs are more than double what is being published.

This has now been sent to the Mayor and Councillors.

Attached is a Word document prepared by Calvin Oaten outlining the annual stadium costs. The final figure of $21.337 million is based on figures sourced from and cross-referenced with DCC/DVML/DVL/DCHL documents.
Also attached is a spreadsheet, containing four spreadsheets, prepared by Bev Butler, showing the treatment of the $146.6 million portion of the stadium debt.

Explanatory Note for Calvin Oaten’s Word document:
I have expressly not mentioned nor quantified costs of what I would term ‘collateral’ effects of the Stadium Project. These of course are very real additional financial burdens to the citizens. These are: the realignment of SH88, the forgiving of considerable debt owed the city by the Otago Rugby Football Union, the costs of the purchase and sale of Carisbrook including the holding of same in the interim period. And of course, the ongoing operational losses of DVML’s operations. These particularly are proving to be a continual drag on the financial conscience of the ratepayer. It seems that if council cannot, or will not bite the bullet and raise the “pay to use” level to at least a break even figure then professional rugby is destined to have the last laugh at our expense. It is simply not fair.

Explanatory Notes for Bev Butler’s spreadsheets:
1. Sheets 1 & 2 titled “$117.541m” and “$29.059m” respectively outline the calculations for the two tranches of stadium debt outlined in the DVL six-monthly report, dated 31 December 2013. This report states that the $146.6m stadium debt has been divided into two tranches of $117.541m and $29.059m. The $117.541m is for a term of 17 years and the $29.059m is for a term of ten years with a weighted average of 6.05%pa. In the calculations I have assumed monthly compounding periods and assumed the first payment(s) were made between 30 June 2013 and 31 December 2013. If the compounding period is shorter then there would be a small reduction in the payments.
Note that in the DVL six-monthly report it states that a mortgage has been issued to pay for the two tranches. This is the first time this has been mentioned in the DVL reports so it is assumed that the mortgage was issued sometime between the last DVL Annual Report (YE 30 June 2013) and the DVL six-monthly report (31 December 2013). There is also mention of a GSA having been signed. I assume this is a General Security Agreement to secure the payment of the debt in the event of the stadium folding or the rental payments not being met. I acknowledge that I am unsure about this as I have no further information. Perhaps the Council staff could clarify this aspect.

2. Sheets 3 & 4 titled “$146.6m monthly” and “$146.6m weekly” respectively outline the calculations for the stadium debt had [regular repayments been made] from the time the stadium opened. It appears from the calculations and the DVL Annual Reports that this was not happening. If it was then the debt would have reduced to approximately $134 million. The DVL long term debt as of 31 December 2013 stands at $141.090m. So up until the mortgage was secured, it appears the debt repayments were for interest only on the bonds (and an average annual capital injection of $2m) which were issued to pay for the stadium land and other stadium debt.

Judge backs blogger’s fight against fraud

A fraudster’s victim who fought back has won a landmark battle to name and shame the man who scammed him and dozens of others.
Nearly two and a half years ago, Steve Taylor contracted Grant Norman King to build a sleepout for his elderly father behind the family home in West Auckland. Taylor paid three-quarters of the price – $23,500 – as a deposit. The sleepout was never built and the money was not returned.

In a bid to get even, Taylor brought civil proceedings against King but when the cost of continuing the case became prohibitive, he took a different tack, setting up the website grantnormanking.com with the intention of warning others who might be drawn in.

Within months other victims were clamouring to tell their stories and it was not long before Taylor built a comprehensive timeline of King’s offending. King then tried to turn the legal tables on Taylor by using the Harassment Act to sue Taylor and demand the website be taken down. Taylor was forced into Auckland District Court to defend himself. However, that was King’s mistake. “What he did was open up the opportunity for every other victim to tell their story, which was the very thing he was advocating against,” Taylor said. Affidavits in support of Taylor’s cause flooded in and he said it was surreal to be standing in court with the public gallery full of people backing him.

Taylor said more than 70 victims had come forward, across a 32-year span, claiming losses of more than $3 million.

In court Judge David Wilson sided with Taylor and said the website, with all its explosive accusations, could remain online. “It would be inappropriate if a man in Mr King’s position could close down postings of essentially factual material on the basis that it interferes with his commercial plans and deprives him of customers,” the judge said.

Apology requested from ORFU [email]

This after news the mayoral defamation suit has been settled out of court. So far, we know the action has cost ratepayers a minimum of $29,000 – it’s likely to cost all citizens far more, given everything that’s riding on ORFU not being investigated, and the relationship ORFU enjoys with Dunedin City Council and council-owned companies. You have Mayor Dave Cull to thank, in no small way.

In the Mayor’s apology in yesterday’s ODT, the Mayor says he understands that Laurie and other ORFU Board members contributed personal funds to pay small creditors. The Mayor also says he doesn’t question the honesty or sincerity of either of you in this process.
But, what about the honesty and sincerity of paying your food, booze and cleaning bill for the black tie dinner?
I still expect this bill to be paid along with an apology for late payment.

My understanding is that professional event organisers ALWAYS pay ALL the bills before handing over the ‘surplus’. Remember Jeremy Curragh stated that $52,000 went into the ‘pot’ but as we know some of the bills hadn’t been paid. Your mate, Ian Taylor, was obviously annoyed but as he has now quietened down, is it safe to assume he was paid off?

As for the defamation, if you get a nice wee tidy sum out of the ratepayers, what do you intend doing with it?
Will you pay the black tie dinner DVML bill then?
Or build another multi-million dollar house to make yourselves feel like you’ve really, really made it?
Maybe you could explain to me why you are suing Cull ie the city.
What did he say that was untrue? I read his comments and thought they were rather tame compared to what I think of the ORFU. As reported in the ODT I thought it was obscene the ORFU running off after their black tie dinner and not paying their bill for all the booze, food and cleaning. Still think that.

Spare a thought in your quieter moments, sitting in your multi-million dollar houses in Wanaka, for the little old ladies in South Dunedin who can’t afford to heat their homes in winter. Some of them go to bed during the day to keep warm. And you two still only see your glass as half full. Take another look. Your glasses are already bulging. Why do you want to take more money from the city, from the poor who barely have enough to keep themselves warm?

I hear your ‘feelings were hurt’ at the ORFU being referred to as ‘incompetent’.
Is it competent to run off without paying your bills?
Is it competent to put $52,000 in your own ‘pot’ and not pay those bills?
Is it competent to even call it a surplus when all the bills were not paid?
Is it competent to apply for grants from community trusts and then use that money for unauthorised purposes?
Is it competent to set up 3 pokies bars in South Auckland and siphon off the money ($6m) to ORFU?
Is it competent to run a business and spend more than you earn year after year after year?

A homeless Brazilian couple have found a garbage bag filled with money and promptly handed it to police.
Officials said the pair were out for a dawn stroll when they found a briefcase and a garbage bag filled with 20,000 reals ($A10,000).

They alerted police.

“When we arrived, the couple gave us the money. It might be the money stolen last week from a Japanese restaurant,” said military police spokesman Bruno dos Santos on Monday.

The pair “had the opportunity to flee with the money … What they did is commendable,” he said.
Jesus Silva Santos, the man who found the money, said he earned about 14 reals a day from collecting rubbish for recycling.

“My mother taught me never to steal,” he said.

Ratepayers stung for mayor’s defamation

A defamation case against Dunedin Mayor Dave Cull has been settled out of court, with the city’s ratepayers stumping up $29,000 towards legal costs of two former board members of the cash strapped Otago Rugby Football Union. However, Cull has not admitted liability to the two men. Dunedin City Council released details of an out of court settlement between Cull and former ORFU chairman Wayne Graham and board member Laurie Mains after a request under the Local Government Official Information and Meetings Act. The pair filed for defamation after Cull’s comments on Radio New Zealand in March in the wake of the union’s financial crisis. The previous day Dunedin City Council had voted to forgive almost $500,000 owed to it by the ORFU as part of a controversial financial package designed to prevent the rugby union from going in to receivership.

Two councillors — Lee Vandervis and Fliss Butcher — voted against the payment.

ORFU pokie papers withheld

Confidential documents relating to the Otago Rugby Football Union’s involvement with pokies are being withheld by the Department of Internal Affairs. The department declined an Official Information Act request to release the New Zealand Rugby Union-supplied documents on the grounds it “would be likely to prejudice the supply of similar information”. The Otago Daily Times has lodged a complaint with the Office of the Ombudsmen seeking the release of the information, citing public interest.

Whatever you think of Alan Jones, you owe it to yourself to listen to this before it’s removed from circulation. Give yourself about 25 minutes, but I reckon it’s the most informative broadcast you will hear.
Remember, this is not about Iran or Pakistan or some mad despot, but this is happening here in Australia and refers to our powerful, power hungry union leaders who are now in charge of running this great country of ours. Unfortunately, the widespread corruption appears to lead direct to the PM’s office itself and one can understand their eagerness to suppress the news media and freedom of speech.

For all who may be interested, Andrew Bolt ran an abbreviated version of this story yesterday at 10 AM.

At 11.30 AM yesterday he got 2 death threats and a separate phone call from Paul Howse current AWU Secretary telling Bolt that the AWU intended to sue Bolt.

This morning the TV station hosting ‘The Bolt Report’ was told that it could expect ‘all sorts of trouble from service suppliers and transport companies servicing the network unless it retracted the story and sacked Bolt’.

Don’t be surprised if Alan Jones is also silenced in some way.

Listen carefully to this radio broadcast. It will make your hair curl… And this recording may not last long on line…

This matter has been touted around for some time, but a tight lid has been put onto it. Small leaks here and there…

Prime Minister Julia Gillard says she never personally benefited from a union fund which she helped set up for free, and off the books, when she was a lawyer 17 years ago. Ms Gillard held an hour-long news conference at Parliament House in Canberra on Thursday to deal with “false and highly defamatory” claims about her work with law firm Slater & Gordon in the 1990s. I am very concerned about what Gambling Director, Maarten Quivooy is representing to the Dunedin Community.

Mr Quivooy claims to have no jurisdiction to investigate ORFU and the Centre of Excellence. He is playing you for fools – making you all believe that those two groups were your standard grant applicants just like Plunket, a local Kindergarten or some other worthy community group entitled to apply to TTCF for grants. Nothing is further from the truth.

The DIA have over many years, spent countless investigation hours, watching the abnormal money flow from South Auckland to Otago, always trying to prove ORFU’s interest in the Jokers Bars and hold those accountable. As was told to me, my testimony and documents provided the missing link for DIA.

The internal TTCF 2005 email between Hodder and the TTCF Trustees (in previous post) is pretty clear about the deal with Jokers. It refers to changes with the Jokers bars and that ORFU and Harness racing now each have a share in those bars and what each groups expectation is from the bars. There are more emails and DIA were provided with them in 2010.

This email makes it reasonably clear that ORFU did indeed have an “ownership” or “interest” in Jokers but it now seems DIA are the only ones who chose to ignore their previous concerns. Why you may ask?

Because any proof of “ownership” or “interest” in the Jokers pokie bars significantly changes things – it elevates ORFU into the legal definition of being a class 4 Venue Operator, over which DIA does have jurisdiction and a statutory obligation to act.

Even if TTCF Inc and Centre of Excellence no longer exist as entities it does not prevent DIA from holding TTCF’s Trustees to account for allowing what has occurred.

A homeless Brazilian couple have found a garbage bag filled with money and promptly handed it to police.
Officials said the pair were out for a dawn stroll when they found a briefcase and a garbage bag filled with 20,000 reals ($A10,000).

They alerted police.

“When we arrived, the couple gave us the money. It might be the money stolen last week from a Japanese restaurant,” said military police spokesman Bruno dos Santos on Monday.

The pair “had the opportunity to flee with the money … What they did is commendable,” he said.
Jesus Silva Santos, the man who found the money, said he earned about 14 reals a day from collecting rubbish for recycling.

“My mother taught me never to steal,” he said.

Defamation, word is

It will come as no surprise that Mayor Dave Cull The Ineffectual will definitely settle out of court.

An “incompetence” shared is an incompetence doubled. This will cost him the 2013 election.

God forbid DCC on behalf of the Dunedin community would want the ORFU and related entities’ books opened for full independent forensic audit. This is the missed opportunity that going to court – not settling – presents. However, depending on who independently commissioned the audits, DCC itself would show up badly in the dealings – not enough diligence, too much corruption, brotherly love, mass incompetence, you name it.

Wait for the DCC media release. Watch the council’s new five million dollar Spooks (communications) department cream it.

Dunedin mayor Dave Cull remains on course for a court date with the defamation case brought against him by former Otago Rugby Union members Wayne Graham and Laurie Mains. Associate High Court Judge Rob Osborne had a teleconference with lawyers representing all parties on Monday. Mr Cull’s solicitor Daniel McLellan said the teleconference was a routine chambers conference and declined to comment further. […] Another teleconference is scheduled for three weeks’ time.

Dunedin ratepayers borrowed money to cover naming rights funding while waiting for Forsyth Barr to stump up for Dunedin’s stadium. The revelation comes from stadium critic Bev Butler who said official documented forecasts showed under the original deal with the Carisbrook Stadium Trust, Forsyth Barr’s payments were ‘‘effectively two years overdue’’ by the time of its first single monthly payment towards naming rights in September 1, 2011. Details gleaned under the Local Government Official Information and Meetings Act showed Forsyth Barr made no payments until September 1, 2011, Butler said. “It is now plain that the much heralded millions of dollars promised upfront in 2009 by Forsyth Barr for the naming rights to the new Dunedin stadium just never happened.”

As biting the hand that feeds you goes, the lawsuit members of the Otago Rugby Football Union are proposing to take against Mayor Dave Cull takes some beating. The merits of the case are for the court to decide, but there is a different burden of proof in the court of public opinion. With its very existence hanging on the good grace of the Dunedin City Council – which decided, against strong public sentiment, to forgive half a million dollars of ORFU debt ratepayers could ill-afford to write off – the rugby union needed to be apologetic, and forthright in dealing with the circumstances which got it in trouble.

Dunedin extends helping hand (page 9)

Dunedin is gearing up to play a major role in the rebuild of Christchurch but is aware of the risks of losing tradespeople and future business further north. The South Island’s second city is positioning itself to supply materials and services to Christchurch while recognising the Canterbury earthquakes have also affected its economy. There is also a proposal to provide special train services to carry workers between the two cities. The Dunedin City Council has calculated that the expected $20 billion to $30b cost of the rebuild is up to 6.6 times Dunedin’s total annual gross domestic product. Otago Chamber of Commerce chief executive John Christie said Dunedin was not eyeing up Christchurch opportunities in any ‘‘predatory manner’’, but having a strong Christchurch was good for the South Island.
