DCC Citifleet, undetectable….

Message: In discussions with Sir Julian [Smith], apparently the ODT Editor has said, since Mr Cannan’s comment, that the actual reason for non-publication of my ‘Citifleet Years of Inaction’ letter was that I already had a letter printed on a similar topic recently.
My previous letter was not however on a similar topic or recent. My first letter which was printed, was sent on 24 August on the topic of Coroner and Police inaction.
My second ‘Citifleet Years of Inaction’ letter that the ODT have chosen not to print was on the topic of CEO Paul Orders’ inaction in 2011, and Mayoral misrepresentation.
It is a shame that most people will not now get the true story.
Feel free to publish so that at least some people get to know some of what has been misrepresented.

Dear Murray,

Why is the coroner taking more than 3 months to deliver a verdict on the DCC Citifleet manager’s sudden death?
Why have the Police only just begun an investigation when so much evidence has been floating around for years and was so tragically highlighted over 3 months ago?
I have been asking for Citifleet manager and other tender process investigations recorded back at least as far as 2011.
Justice delayed is justice denied. Or with so much public money gone is that perhaps the reason?

In fact DCC vehicle disposal and other Bachop issues had been flagged in verbal questions and emails from me to CEO Orders and other senior DCC staff in 2011 following many complaints from Turner’s Auctions and other motor industry businesses. I also set up a meeting to resolve DCC/Turners issues between CEO Orders and Turner’s Auckland based national accounts manager Asgar Kachwalla in November 2011. It seems that little was done until CEO Bidrose began an investigation almost three years later. Perhaps the ODT should be doing some more investigating of its own. [confirming email example below].

Further to my more general email this morning about building partnerships, Dunedin’s largest car auction business has contacted me regarding on-gong (sic) problems trying to do business with the DCC.
Turner’s Auctions big cheese Mr Kachwalla from Auckland will be in Dunedin on the 30th of this month, and was hoping to organise a brief meeting with you and local Turners management on the afternoon of the 30th to attempt to normalise a Turners/DCC business relationship.
I was hoping to bundle similar issues with other Dunedin business issues with Mr Bachop, but am still awaiting information ex DCC after over a month in order to do this.

Hopefully you will have time on the next Wednesday the 30th to accommodate Turners Management hopes for a meeting.

Stadium: Behaviours at Suite 29 (intrepid tales)

The Otago Daily Times was tipped off about its [Studio 29] closure by a caller who described it as a private bar for a “boys’ club”.

However, a number of girls were allowed in….

Mr Davies confirmed the room was now considered “outdated” for the stadium, and the decision to close it had been made in April.

That being said we had already done lots of photography!

Last drinks have been called for a male drinking bastion buried deep within the bowels of Forsyth Barr Stadium. The call has been made by Dunedin Venues Management Ltd chief executive Terry Davies, who confirmed the closure of “Suite 29” following a review launched earlier this year. The small room – in the main south stand near the venue’s service entrance – was used as a private social space for DVML staff, high-profile sports stars and other guests, with beer provided.

[Mr Davies] was not aware of any behavioural problems associated with the room, but expected staff would have to find other places to socialise after work.

Ahhh, the stories to tell from Carisbrook, the farm, and Fubar…. the whole continuance, but with the closure of Suite 29 where will DVML staff, executive and friends meet now? And Mr Hansen, we hear he’s doing terribly well and enjoying his flatscreen TVs (2).

Things that make us go Hmmm….
● Ask about Suite 29 and how it’s used to fund a staff member’s horse and racing car and how staff are bullied into buying space sold on the wall to fund the hobby.
● That tickets are sold to staff to fund Suite 29. It’s only for boys and invited girls who tow the line.
● Ask about the beer keg system installed into this area and who paid for that and the huge amounts of beer. [Also, worth asking where the plumbed-in keg came from and who paid for it. The free beer from Lion!!!]
● Ask if it’s ok for the staff member to use the corporate suites to carry out extramarital affairs.
● Ask the staff fired from the Dunedin Centre about the bullying tactics and how the technical staff had to be moved down there because they feared the staff member’s bullying.
● Use of stadium equipment at the farm.
● Use of language by the staff member in the office which creates a terrible unprofessional ‘rugby culture’ at the stadium.
● An invoice for a taxi to Big Stone Road! Worth over $100.

Dear Lee

I have followed up your question of clarification about the SFO and can provide the following response:
Under the circumstances of a suspected fraud (as per the Citifleet situation at the beginning of the investigation), the normal course of events is that the SFO is informed of issues when they arise. Deloitte did this via a phone-call to the SFO on 12 June 2014, after a discussion with DCC staff at a meeting of the Investigation Steering Group. The steering group were fully aware of the fact that Deloitte was speaking with the SFO and were informed of the outcome of the call. The call to the SFO was us asking the SFO to consider an investigation.

The discussion on 12 June 2014 (which was with a case officer and with Nick Paterson, the GM Fraud and Corruption) summarised the facts and circumstances of the Citifleet issues and sought the view of the SFO.
It is then the SFO’s decision as to whether they commence their own investigation. This is based on the criteria set out on their website (copied below)

There are multiple victims (usually investors) of the suspected fraud

● The sum of money lost exceeds $2,000,000

● The alleged criminal transactions have significant legal or financial complexity beyond the resources of most other law enforcement agencies.

In the case of bribery or corruption matters, we focus on crimes involving public officials, which could undermine public confidence in the administration of laws

Based primarily on the fact that the main suspect was deceased and that the actions appeared to be those of one corrupt individual rather than fitting within the definition of bribery and corruption, the GM Fraud and Corruption decided that the best course of action was for Deloitte to complete its investigation and provide a copy of the report at the conclusion of its work. During the investigation and with permission from DCC, Deloitte provided an update on the investigation to SFO on 07 July 2014 via letter. A copy of the full report was provided on 21 August 2014. We have heard nothing back from the SFO to date.

As to confidentiality, these OIA replies are all able to be made public and as such they will be published on the website and I will be providing a copy of the information to all Councillors.

Your ‘operational only’ claim is generally questionable and in this case fails on all counts.
We will never know all the facts, especially if the withholding of the Deloitte report and more public muzzling continues.
In one of your media statements you say that Council have agreed not to comment until the Police have completed their belated investigation, but this is not true. Councillors have not been given the opportunity to even discuss a further number of months of no comment on Citifleet, leave alone agreed not to comment. I have certainly not agreed and do not agree.

Thank you for acknowledging my long standing demands that DCC ‘heads should roll’. My long political experience is that timely public disclosure will be necessary to ensure that the appropriate heads are dispatched, and that an embedded DCC culture of self-entitlement across many departments is permanently erased.

I am not suggesting Councillors do not have the right to ask questions or make requests. What we do not have a right to do is step outside our governance roles, interfere with legitimate operational matters particularly without knowing all the facts, and unilaterally jeopardize Council and ratepayer interests. If we do we should be fully held to account for that.

DCC Chief Executive Officer Dr Sue Bidrose says the alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police last week following an independent investigation by Deloitte which began in late May. Citifleet Team Leader Brent Bachop died suddenly on 21 May. His death has been referred to the Coroner.

Deloitte was engaged by the DCC on 23 May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets.

Dr Bidrose says, “The matter is now with the Police and on their advice, and the advice of the Crown Solicitor, we are not releasing the Deloitte report at this stage, to ensure we do not prejudice any Police investigation.

It appears the alleged fraud was possible because of inadequate internal checks and balances within the DCC. Dr Bidrose says, “We are changing things here at the DCC and it is these changes that uncovered this alleged fraud, which occurred over at least a decade. This reinforces the need for these changes which, frankly, are long overdue.” Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. However, this will be an ongoing process that will take time.

“I want to emphasise that this is an organisation in which people can have confidence. The people who work here are overwhelmingly decent, hard-working public servants committed to the best interests of the city. We are committed to getting to the bottom of any issues and ensuring we have best practice across the board. The changes are well underway – in fact it was in making these changes that we uncovered the alleged fraud.”

Dr Bidrose says the DCC has employment processes underway relating to a small number of staff, primarily around the lack of checks and balances which should have been in place. Mayor of Dunedin Dave Cull says the fact these issues have been found now after more than a decade shows the Council has been right to push for more transparency and tighter processes. “We tasked Sue, and the previous Chief Executive Paul Orders, with reviewing DCC practices so any problems or issues could be fixed as part of our accountability to ratepayers. Paul started with our companies and made a huge improvement in their governance and oversight. Now Sue and her staff are having the same impact inside the DCC.”

Dr Bidrose says a wide range of work has been completed to tighten up DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A first review of internal audit work across the DCC has been completed.
● The risk management framework has been reviewed.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff so they know what may be signs of fraud.
● Increasing further the transparency of purchase card use.
● A review of key DCC policies, such as those relating to fraud and cash handling.
● Review the procurement/tendering processes across the DCC.
● A review of internal processes around issues such as the staff receiving gifts, tickets or hospitality.

The Deloitte report has been sent to both the Serious Fraud Office and DCC insurers QBE. To date, the investigation has cost about $200,000.

Background: Citifleet is responsible for the management of all DCC vehicles, the operation of an internal courier service and an internal chauffeuring service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are needed.

Sources say ratepayers may have lost as much as $1 million as a result of the alleged activity. Dunedin Inspector Jason Guthrie confirmed police had received a complaint from the council “in relation to a significant historical fraud matter involving the council’s vehicle fleet”. “The complaint is being assessed and will be investigated further,” Guthrie said. This investigation was likely to take months. Investigations into alleged vehicle fraud at the Dunedin City Council Citifleet/Citipark unit have unravelled a vast network of vehicle transactions over the past 11 years, an informed source has told Stuff. The probe has been under way for more than a month. Accountancy firm Deloitte was commissioned to investigate whether dozens of Dunedin City Council fleet vehicles had been sold and the proceeds pocketed. The investigation was sparked when discrepancies appeared in the number of fleet vehicles recorded by the council’s fleet unit Citifleet/Citipark.

The investigation has shocked those in the Dunedin car retail, automotive, and enthusiast community.

Stuff has been told this week the council gave Deloitte investigators a list of council vehicle movements through a network of buyers and subsequent owners over the 11 years. It included buyers of the vehicles, who now owned the vehicles, and how long they had owned them. At least three people, who took ownership of many vehicles, are among those in a network under suspicion of being involved in the fraudulent activity.
Stuff understands Citifleet/Citipark manager Brent Bachop, who died on May 21 in a suspected suicide, was allegedly among the network of buyers. It is understood Bachop had been told that discrepancies had been found in vehicle numbers within his unit. Bachop had worked in the unit for more than 20 years, the past 10 or so as manager.

Council fleet probe investigates fraud

Dunedin City Council has confirmed that a probe trying to find missing fleet vehicles has become a fraud investigation. The council called in financial specialists from Deloitte four weeks ago for what it now calls a far-reaching investigation of its Citifleet and Citipark departments. The inquiry is centred on what appears to be a discrepancy in the number of council-owned fleet vehicles. The investigation followed the sudden death, six weeks ago, of the departments’ longstanding team leader, Brent Bachop. Council chief executive Sue Bidrose has for the first time described Deloitte’s work as investigating possible fraud. Asked why the police were not doing the investigating, Dr Bidrose said the police were aware of the situation, but the council will need to have evidence of wrongdoing before referring the issues on.

Stadium costs $23.4144 million per annum

According to the latest DVL/DVML six monthly reports the debt is growing not reducing – that is a concern. The $146.6 million debt was passed over to DVL, many millions were poured into servicing the interest and capital repayments for this debt but even with that happening the combined short term/long term debt of DVML/DVL now stands at $157.6 million – $11 million more! The long term debt of $146.6 million has been reduced to $138.8 million but short term debt stands at $18.8 million. It is a major concern that the combined debt is growing not reducing – and this is during the stadium’s honeymoon period.

As a result of further discussions and more information obtained through further searching Council documents Calvin Oaten and I have updated the annual stadium costs which now stand at $23.4144 million. (See attached word document). No changes have been made to the spreadsheet I sent earlier which I prepared.
There are some costs which have not been included due to the difficulty in quantifying them to the accuracy of which I would be comfortable.

This $23.4144 million figure does not include any payments which may have not been fully transparent through the Council books.
By this I mean that I understand there were approaches by Darren Burden, former CEO of DVML, to obtain payments for bills which DVML were unable to pay but which another Council Department had shown some willingness to transfer their surplus unspent funds from that Department to DVML. In that particular case, I understand the transfer did not happen. However, I have no access to information as to whether this had occurred on previous occasions through other departments.

█ Also attached are Terry Wilson’s calculations coming from a different angle but which come to $23.1 million per annum. (See attached spreadsheet prepared by Terry Wilson).

The historical past of Dunedin’s transportation, however, should only be ignored at its peril. The unit is responsible for the council’s parking services and also for its management of its fleet of vehicles. Council chief executive Dr Sue Bidrose would not be drawn on the reason for the investigation which is being carried out by accountancy firm Deloitte. The investigation had just started and was being incorporated into a wider review of key accounting practices within the council, which was initiated last year. She said it would be inappropriate to release further details, such as what has sparked the probe. A council spokesman confirmed the unit’s manager Brent Bachop died suddenly last month. Dunedin police said his death had been referred to the coroner.

Norman Foster promotes “cycling utopia” above London’s railways
News: British architect Norman Foster has unveiled a concept to build a network of elevated pathways above London’s railways to create safe car-free cycling routes, following 14 cyclist deaths on the city’s streets in 2013.
Entitled SkyCycle, the proposal by architects Foster + Partners, landscape architects Exterior Architecture and transport consultant Space Syntax is for a “cycling utopia” of approximately 220 kilometres of dedicated cycle lanes, following the routes of existing train lines.
Over 200 entrance points would be dotted across the UK capital to provide access to ten different cycle paths. Each route would accommodate up to 12,000 cyclists per hour and could improve journey times across the city by up to half an hour.
“SkyCycle is a lateral approach to finding space in a congested city,” said Foster, who is both a regular cyclist and the president of Britain’s National Byway Trust. “By using the corridors above the suburban railways, we could create a world-class network of safe, car free cycle routes that are ideally located for commuters.”
If approved, the routes could be in place within 20 years, offering relief to a transport network that is already at capacity and will need to contend with 12 percent population growth over the next decade.
“To improve the quality of life for all in London and to encourage a new generation of cyclists, we have to make it safe. However, the greatest barrier to segregating cars and cyclists is the physical constraint of London’s streets, where space is already at a premium.”
According to the designers, construction of elevated decks would be considerably cheaper than building new roads and tunnels.

A giant glowing worm has appeared above ground at the Dunedin Botanic Garden. It is not a supernatural phenomenon, but the city’s latest piece of public art. The flexible worm, which can bend because it is constructed from thousands of pieces of interlocked and articulating marine-grade stainless steel, was installed over the past two days.

Interesting as always to read your columnist Peter Entwisle’s opinions of the stainless Ouroboros at the Botanic Garden (Art Beat, 23.12.13), and the shoddy process adopted by the city council. This alien is planted in an exceptionally poor section of ‘landscaping’ – a meaningless affront of professionally laid and poorly envisioned hard paving, with a ‘playground’ landing pad. The effect of this cynical deadening forecourt on the tea kiosk with its umbrella-style roof is harsh and fully remiss, architecturally – a boffin job of worst kind. Even the ducks are electing to rest for the evening on nearby lawn – having left their excrement across the pavers. Not sure this metalwork is composting!

On Sunday afternoon I was photographing the wormy presence, it’s bluntly phallic at the supported ‘head’ end… when a local resident asked me what I think of the whole thing. Not a good thing to say. He wasn’t terribly impressed either – he said the project in total was worth about $150,000. For such a cruel mess.

Poor Wendy and … Attendants, they need rescue! The fairy tale plot is lost, crashed, abused.

Editorial: How the worm turns
It seems there is nothing quite like the issue of public art to stimulate debate. Whether it be form, function, meaning, materials, longevity, cost, location, the work’s title, or the artist’s “qualifications”, the works inevitably prompt a great outpouring of comments from the public. When it comes to publicly-funded art in the outdoor public arena, it is understandable some ratepayers want to have their say. After all, they have to see it and they have to pay for it. One of the most-debated issues is often the cost, with many projects being deemed expensive.
In a city rich with educational institutions, heritage, and a strong artistic legacy, such projects have been deemed worthy of funding by the council for many years, and frequently indicated as important by the public in the likes of residents opinion surveys. There is no doubt striking the right balance is no easy task, particularly given art, by its very nature, is subjective, and cannot necessarily “please” everyone.
Given that the response to art works is the huge unknown – it is all the more important the areas that can be calculated are done so – and done so clearly: the artist, the artist’s brief, the art work’s purpose, visual expectations including height and size, suitability for its location, and of course, cost. And, sadly, it is in these fundamental areas in which the latest controversial public art proposal appears to have fallen down.

Anger over rabbit holes on Domain

Coaches and parents of players at the Hereweka Junior Football Club are livid the Portobello Domain is still not in any condition for games to be played there, with the start of the season only two days away.
None of the Hereweka Junior teams have been scheduled to play at the ground this weekend. A spokeswoman for FootballSouth said there had not been any instructions from the Dunedin City Council to move games away from the ground, and it was only by chance no games were to be played there this week.

All sports grounds in Dunedin were visited by contractors regularly but the council also had to look at prioritising grounds which got the most use.

As reported in The Star last month, the club was given assurances by the Dunedin City Council that the ground would be ready and prepared by the start of the season, after it had been damaged by rabbits during the summer.
