No protection for Dunedin’s DARK Skies —Otago Peninsula subdivision decision #GrievouslySucks

Commissioner Colin Weatherall said the amended application was expected to have fewer adverse effects on the environment. He treated “with caution” some of the evidence received by submitters opposing the consent.

Historic waka find excites as peninsula gives up secret

The discovery of a historic waka unearthed from Papanui Inlet is a “significant find”, a local kaumatua says. A waka – believed to be a fishing waka (waka hi ika) – measuring 6.17m was excavated from the edge of the inlet over the weekend, and is now in storage. Otakou runanga kaumatua Edward Ellison said the “exciting” discovery “sheds new light [on] the historical use and occupation of the Papanui Inlet and surrounds”. It was likely the vessel dated from the Ngati Mamoe occupation of that part of the Otago Peninsula, before “Ngai Tahu came down and pushed some of them further south”.

‘I knew it was something significant’

If it were not for changing tidal flows, the fishing waka unearthed from Papanui Inlet on Otago Peninsula at the weekend might never have been discovered, Department of Conservation historic technical adviser Shar Briden said. The 6.17m waka was under 1.6m of sand and was discovered by chance in August by Ms Briden. She said the channel flow had changed, with the estuary water now cutting over the top of the waka. […] The waka was excavated and refloated using whale pontoons at the weekend, and moved across the estuary at high tide to where it could be retrieved. The waka is believed to be the only one found in Otago, and has archaeologists around the country buzzing.

Waka remnants give glimpse into past

A waka submerged in a locked wooden tank at the Otakou marae in Dunedin continues to reveal the past to archaeologists. Te Runanga o Otakou manager Rachel Wesley said the fishing waka, unearthed from Papanui inlet on Otago Peninsula in October, was on the marae and submerged in fresh water in a locked wooden tank. […] The waka was moved to the marae in early December […] Samples of the waka had been sent to Auckland and Dunedin to determine its age. The waka conservation work would take more than two years […] Department of Conservation historic technical adviser Shar Briden said other wooden artefacts were found before the waka was discovered and they revealed some more about it.

Waka believed from the 1500s

The historic waka unearthed from Papanui Inlet was used in the 1500s, it has been revealed. Dilys John, of Auckland University’s anthropology department, has dated the worked waka and the prepared fibres from inside the hull at being between 440 and 463 years old. Otakou runanga elder Edward Ellison said the waka remained in water at the marae, and the salt would slowly be removed out of the timber over the next two years. The waka would be preserved and then possibly be put on display […] It was believed the waka was used by Waitaha – the first occupants of the site – or Ngati Mamoe […] “The mere thought that the hands that made and used the hand-woven fibres belonged to ancestors who lived at Papanui Inlet at least 20 generations ago is quite breathtaking.” Dating the waka helped with comparisons with other sites around New Zealand and confirmed “the specialness of the Papanui Inlet”.

Seeking dark sky city status

The Dunedin City Council is to investigate ways of limiting light pollution, after councillors were told Dunedin could become the world’s largest “dark sky city”. Otago Museum director Ian Griffin spoke about the issue of light pollution at yesterday’s planning and regulatory committee meeting when he discussed the museum’s planetarium development, which is to open later this year. “We see the planetarium as not just a brilliant educational tool [but also] potentially an anchor for a new strand of tourism in this city.” There was a massive potential for growth in night sky tourism in the city and the council could support that by acting to limit light pollution in areas such as Otago Peninsula, where viewing conditions were best, Dr Griffin said.

The Papanui Inlet quarry operation, headed by Peninsula resident Steve Clearwater, was found to be in breach of its existing consent following an inspection by council staff early last year.

A “catch-22” legal problem involving a quarry on Otago Peninsula means all parties, including the applicant and many submitters, may have been wasting their time attending a consent hearing. […] The hearing involves a quarry, which had operated as a smaller farm quarry before a consent allowed it to expand in 2007. Steve Clearwater Contracting, headed by peninsula resident Steve Clearwater, has been accused by council staff of not complying with rules designed to restrict his quarry’s operation. […] Council officials say the quarry was found to be operating beyond its boundary early last year, by extracting rock from further up Geary’s Hill than was permitted. The applicant, Peninsula Holdings Trust, is seeking a variation on its existing consent, to legalise what has been done, but it is also seeking to expand its footprint for future operations. The application has prompted 40 submissions, including 32 from neighbours, many opposing it.

Quarry hearing adjourned

Independant commissioner Andrew Henderson has adjourned a Dunedin consent hearing to consider legal issues linked to a quarry overlooking Papanui Inlet in a “treasured ancestral landscape”. Mr Henderson, of Christchurch, said yesterday he would consider legal issues over how to proceed with an application, on behalf of the quarry operator, to vary conditions in an earlier 2007 consent, involving the quarry on Otago Peninsula.

A quarry operator accused of flouting rules on Otago Peninsula could seek to remove a hill overlooking Papanui Inlet, neighbours fear. Steve Clearwater Contracting, headed by peninsula resident Steve Clearwater, has been accused by Dunedin City Council staff of showing “contempt” for rules designed to restrict his quarry’s operation. […] “Geary’s Hill, at the head of Papanui Inlet, is an integral part of a wider wahi tupuna [ancestral landscape]” […] The Otakou runanga was concerned about the “incremental carving away at the basic elements of this ancestral landscape leading to greater and irreversible changes”.

Quarry expansion plans scuttled

Controversial expansion plans for an Otago Peninsula quarry have been declined by an independent commissioner, but quarrying will continue on the site. The Geary’s Hill quarry, overlooking Papanui Inlet, was last year found to have breached many of its 2007 resource consent conditions. It had extended further up and across Geary’s Hill than consented, while a paddock consented to receive fill to a depth of 1m had since received considerably more than that. Dunedin City Council staff concluded it was in breach of at least 10 consent conditions, while compliance with another five was questionable. Quarry operator Steve Clearwater Contracting, headed by peninsula resident Steve Clearwater, had been forced to seek a variation on its existing consent to legalise what it had done, while also seeking to expand its footprint for future operations. Neighbours feared the variation, if accepted, could eventually lead to the complete removal of the hill. But that variation was declined last week and was now subject to a 15-working-day appeal period. […] The council had accepted it had been deficient in monitoring the 2007 consent.

Subdivision bid opposed

A plan to subdivide 260ha of rural Otago Peninsula land in an outstanding natural landscape area has run into serious opposition, as a resource consent bid heads for a March hearing. Groups from Forest and Bird to Save the Otago Peninsula (Stop), and individuals from peninsula tourism and accommodation businesses, as well as astronomers and archaeologists, have lined up to oppose the project. Land owner Steven Clearwater described opposition from property owners in the area as “nimbyism”. He said the farm on which the subdivision was planned had been dotted with farmhouses a century ago, and he wanted to protect his right to build there again. The project is the work of the Peninsula Holdings Trust, made up of property owners Steven and Jacqueline Clearwater and Brian Hailes. The trust has applied to the Dunedin City Council to subdivide the rural zoned land at 78 Cape Saunders Rd. The land has a capital value of almost $1.9million.

City planner opposes subdivision

An application to subdivide 260ha of Otago Peninsula land in an outstanding natural landscape has hit another hurdle with a planner’s report recommending the application be declined. Dunedin City Council planner Lianne Darby recommended the council decline the bid to subdivide a property at 78 Cape Saunders Rd, citing negative effects on the environment and the potential  “undesirable” precedents it could set for rural zoning if approved. […] If such a proposal  were approved, there could be a “major change” to the appearance and character of the land, she found. The subdivision, on an isthmus of land between Hoopers Inlet and Papanui Inlet and the northern slopes of Mt Charles, was also inconsistent with aspects of the district plan relating to sustainability, land fragmentation, rural productive worth, roading and landscape, the report found. She did not believe the proposal, which would create 10 new sites, on which consent was sought for residential activity on eight, was a sustainable use of the city’s physical and natural resources. The proposed sites would be between 2ha and 194ha.

Papanui developer reduces sites plan

The developer of a subdivision on an Otago Peninsula isthmus has halved the number of houses planned for the site, surprising opponents ready to argue against the plan. Peninsula Holdings Trust came to a resource consent hearing in Dunedin yesterday with a proposal that reduced the number of houses in the outstanding natural landscape area from eight to four. Landowner Steven Clearwater told the hearing he had recently signed a conditional sale agreement for some of the land involved to nearby farmer. Plans for a covenanted area of wetland and a public walking track were withdrawn, after the buyer of the land made it “very clear” they were not to be offered. The change led hearing commissioner Colin Weatherall to adjourn the meeting after the trust made its submissions, allowing opponents time overnight to modify theirs.

Notification of Application for a Resource Consent – Under Section 93(2) of the Resource Management Act 1991.
The Dunedin City Council has received and notified the following application for Resource Consent:

Application description
Council has received an application to subdivide the above nine titles of 78 Cape Saunders Road into eleven lots and a balance parcel. The subdivision will create ten new sites of 2.0ha to 194ha. Eight of the new sites will be smaller than 15.0ha and are therefore considered to be undersized.
Land use consent is sought for new residential activity within proposed Landscape Building Platforms on Lots 1 to 2, 4 to 6, and 8 to 10. Lot 3 (38ha) has an existing quarry operation with an established dwelling. The amalgamated site of Lot 7 and 12 (194ha) will be a farming block with no dwelling, and will be subject to a covenant restricting all residential development of this site. The balance land of Part Lot 54 Papanui Maori Reserve Blk (residue CFR OT205/103) will be amalgamated with Lot 10.
The quarry operation will need to be reauthorised as it will be contained within a smaller site. It will be a discretionary (unrestricted) activity pursuant to Rule 6.5.6(v).
The subject sites are zoned Rural in the Dunedin City District Plan, and are within the Peninsula Coast Outstanding Landscape Area (Visually Recessive and Visually Prominent Areas). The general area is identified as being subject to land stability risks, and parts of the subject sites are potentially at risk to liquefaction.
Subdivision of a Rural-zoned site into lots smaller than 15.0ha is a non-complying activity pursuant to Rule 18.5.2 of the Dunedin City District Plan. The construction of buildings (dwellings) within a Landscape Building Platform is considered to be a controlled activity pursuant to Rule 14.6.1(a)(i). The proposed residential activity on those lots smaller than 15.0ha is also considered to be a non-complying activity pursuant to Rule 6.5.7(i).
The Proposed Second Generation District Plan (“the Proposed Plan”) was notified on 26 September 2016. Rules 16.7.4 (minimum site size for rural zones) and 16.9.5.5 (assessment of subdivision performance standard contraventions – minimum site size) were given immediate legal effect pursuant to section 86D of the Resource Management Act 1991 at the time of notification. Accordingly, the Proposed Plan rules also need to be considered alongside the Dunedin City District Plan rules.
The subject sites are zoned Rural – Peninsula Coast in the Proposed Second Generation Plan, and are within the Peninsula Coast Outstanding Natural Landscape. There are land stability risks identified for this site. Parts of the subject sites are shown as Hazard 2 – Land Instability, and Hazard 3 – Coastal. The coastal edges of the property are shown as Coastal Environment and Archaeological Alert Layer. There is a Wahi Tupuna Site 36 – Poatiri (Mt Charles) on-site.
Rule 16.7.4 specifies a minimum site size of 40.0ha for lots created by subdivision in the Rural – Peninsula Coast zone. The proposed subdivision is therefore a non-complying activity pursuant to Rule 16.7.4.3. The land use rules for the Rural zones are not yet in effect or operative.
The application is accompanied by Ecology, Landscape, Heritage, and Geotechnical Reports.

The submission period for this application has closed, and a hearing/decision is pending.

Streets of gold: High St
High Street has an association with the medical profession dating back to the 1880s, when the Mornington cable car started running and some impressive new houses were built along its route.

CAVENDISH CHAMBERS, 211 High St.
The company behind the venture, Medical Buildings Ltd, was incorporated on March 1, 1926, and the shareholders all took professional rooms in the new property. The building was completed in 1927. Architect: Eric Miller (1896-1948).

236 HIGH ST
This prominent residence (QV: c.1900?) with a turret and projecting windows was designed in 1888 for Scottish-born Dr Frank Ogston. Ogston gained his medical degree in Aberdeen and emigrated to Dunedin in 1886 to take up a position as a lecturer in medical jurisprudence and hygiene at the University of Otago. Architect: Henry Hardy (1830-1908), and builder-developer.

238 HIGH ST
An Arts and Crafts-style design, the house (QV: c.1909?) is finished in roughcast with brick exposed on the ground floor sills. It was built for Dr D.E. Williams and his family as a private residence and doctor’s surgery and was home to the Williams family until the 1960s. Architect: Basil Hooper (1876-1960).

296 HIGH ST
Built in 1904, the Chalet Hospital (a private facility) was described as being “finished in coloured and tuck-pointed brickwork … the whole of the relief and ornament is carried out in bold cornices over the windows”. Architect: John Louis Salmond (1868-1950).

Streets of gold: York Pl
York Place features two large homes once owned by members of the Speight family.

LARBERT VILLA – 371 York Pl
It is unclear exactly when the villa was built. Coppersmith Alexander Burt, of A and T Burt, married Janet Crawford in 1866 (they had a family of six sons and three daughters) and the couple were living in York Pl by July 1868 when Janet gave birth to a son at the house.

FORMER SPEIGHT RESIDENCE – 362 York Pl
Built for Jessie and Charles Speight after their marriage in 1898, the residence appears in the Dunedin City Council rates records in the 1899-1900 year. Architect: J.L. Salmond.

HAEATA – 273 York Pl
The residence of Charles and Jessie Speight from the time it was built in 1915, it remained in the Speight family until 1960. Bearing a strong resemblance to the Theomin family’s Olveston (built 1907, designed by Sir Ernest George). Architect: John Brown (1875-1923), a neighbour.

MRS TURNBULL’S GROCERY STORE – 324 York Pl
Known more than a century ago as Mrs Turnbull’s Grocery Store, this unusual wedge-shaped building began life as a home, stables and shop built for John and Janet Turnbull in 1875. In January 1875 tenders were invited for a two-storey dwelling and shop to be constructed of wood. Architect and Surveyor: E.J. Sanders [aka Saunders].

Streets of gold: Highgate
Highgate has a fascinating and storied collection of prominent dwellings.

RENFREW HOUSE – 111 Highgate
Thought to have originated as a single-storey bluestone house with a central front door and double hung windows on each side. A second storey was later added. The exterior walls were built of double stone – more than 70cm thick – and the interior walls of double brick. With its wrought iron lacework, it has been described as one of the “finest examples of classic Victorian architecture in Dunedin”. Home of businessman Andrew McFarlane (1842-1904) and his wife Jane Wilson (1847-1920). By the 1890s, the family referred to their home as “Renfrew House”. Architect: credited to Nathaniel Wales (1832-1903), a neighbour.
 
KAWARAU – 204 Highgate
Designed in 1900 for dredging tycoon Alexander McGeorge, this grand residence reflects the fortunes made in Otago’s gold dredging boom of the late 1890s and early 20th century. Trained at Dunedin firm Cossens and Black, McGeorge (1868-1953) held a variety of significant engineering posts. The two-storeyed house is built of brick, has a slate roof, ornate decorative detailing, and features Tudor influences in the half timbering and veranda details. Architect: J.L. Salmond.

FORMER HUXTABLE RESIDENCE – 233 Highgate
This 1907 brick and tile residence designed for Anna and Alexander Huxtable, is a beautifully detailed example of an Edwardian villa, one with historic and architectural significance. Anna Huxtable was granted the land in 1907; a survey on May 15, 1907, indicates the foundations for the new dwelling were already in place at that date. (QV: c.1910?). Alexander Murray Huxtable described himself as both a commercial agent and patent medicine manufacturer. Architect: Edward Walden (1870-1944).

MELROSE – 384 Highgate
Likely designed for lawyer Arthur Nation (1852-1927) around 1876. In October that year, tenders were called for the construction of a “brick cottage” in the suburb of Melrose (a private subdivision in what is now known as Roslyn). However, Nation appears to have built more than a cottage: when his property was offered for sale in 1879 it was described as “a substantially-built and well-finished brick house”, its original features including hand-painted ceilings, timber joinery and stained glass. Architect: credited to John McGregor (1838-1911), and harbour engineer.

Streets of gold: Royal Tce
Royal Terrace has a fascinating and storied collection of prominent dwellings.

DAISY BANK – 12 Royal Tce
Associated with the prominent Hudson family. An Italianate, two-storeyed symmetrical house with a large basement, “Daisy Bank” was built of concrete and wood, circa 1897. Architect: J.A. Burnside (1856-1920).

LINDEN – 22 Royal Tce
Built in the 1870s, a two-storied, two-bay Victorian residence of more than 15 rooms, with an exterior comprising plastered triple brick with quoins, foundations of Leith Valley andesite and a slate roof. Associated with the prominent Isaacs and Hudson families. Architect: Mason and Wales (likely Nathaniel Wales).

CLAVERTON – 30 Royal Tce

ALYTH – 34 Royal Tce
Built in the 1870s by prominent businessman, community leader and one-time Dunedin mayor Keith Ramsay (1844-1906). Named Alyth after Ramsay’s birth place, the house was completed, at the latest, by March 1875. Architect: Robert Arthur Lawson (1833-1902).

Archivists say some people want to restore their homes to their original states, are curious about former owners or simply want to know the age of their houses for insurance purposes. Others require archaeological assessments of pre-1901 properties or have reported seeing ghosts in their homes and wanted to work out who they might be. Uncertain future for venue

Demolition could be an option for Sammy’s, one of Dunedin’s most loved live music venues and one of the warehouse precinct’s largest buildings. On the market for “a few months” and with a list price of $240,000, the 1896 building had attracted attention from several potential buyers, owner Sam Chin said yesterday. Interest from one of those potential buyers was contingent on gaining a resource consent, Mr Chin said. He could not name the potential buyer and did not know what that resource consent was for.

The future of notable Dunedin music venue Sammy’s is uncertain, after the eviction earlier this week of the operators of the Crawford St business. Building owner Sam Chin told D Scene yesterday that he had moved into the venue on Monday night and changed the locks. “The venue is closed for now and we’re just cleaning things up.”

Nightclub owner angry over damage at venue

Sammy’s owner Sam Chin has experienced some wild nights at the nightclub over the years. But he was not prepared for the sight which greeted him when he changed the locks on the building three weeks ago, after not receiving rent from the lessee since November. La Maison House of Pleasure at 5 Queens Gardens is co-owned by city councillor and former Act MP Hilary Calvert. In 2011, her eyes featured on a sign at the top of the building (the image is still evident).

La Maison’s ground-floor ceiling was ornate and perfectly preserved, its below-ground vault still intact – original door included – although now it houses a “dungeon” stocked with items considerably different to those the vault was designed for. Upstairs, the building’s origin was harder to spot, although staff promised today’s tour would be comprehensive, including an all-access walk-through and details of the building’s changes through its 149 years. Surprises in old buildings

The doors to some of Dunedin’s historic buildings will be opened to the public today as the city’s heritage festival continues. The Dunedin Heritage Festival began yesterday with the “Dunedin 1865: A City Rises” photographic exhibition in the Dunedin Public Art Gallery. The festival finishes tomorrow. A major draw is the tours today and tomorrow of 64 historic buildings, which will be raising their customary barriers to the public […] the festival would also include a children’s heritage trail at Toitu Otago Settlers Museum, a walking trail following Dunedin’s original shoreline and a special service in First Church.

‘Absolutely incredible’ revamp of heritage building

An “absolutely incredible” conservation and adaptive reuse project is nearing completion in Dunedin. This work on the Standard Building in Princes St, including extensive earthquake strengthening [and restoration of the Italian-style facade] has been undertaken as momentum grows to further revitalise the Exchange area, and a wave of adaptive reuse work continues to transform the nearby warehouse precinct. […] The project also includes the Stanton Building, situated behind the Standard Building, and backing on to the council’s Dowling St car park. A crucial – and previously largely hidden – feature of the redevelopment is an innovative, light-filled multilevel internal atrium, making extensive use of glass, which will link the two buildings and provide access to the various floors.

Dunedin Shoreline Trail
The Dunedin 1865 Shoreline Trail will be launched by Dr Matt Schmidt (Heritage New Zealand) and Paul Pope (Dunedin Amenities Society) next Sunday, August 30, at 11.30am. The free hour-long walk will depart from the early settlers’ plaque at the top of Water St and proceed along the early shoreline to St Andrew St, with descriptions of interesting archaeological and built heritage features along the way.

Cr Hilary Calvert, an embarrassment

Only the day before the Winkle tried to “separate” DEBT from the STADIUM. She would do better sentenced to hard labour than try busting the rocks of the Autonomous Crown Entity, Heritage New Zealand —because she sure as hell won’t win.

Was it a frustrating anger-inducing process to get to this COMPROMISE ???
You betcha, for All concerned. Especially against the receiving environment at Dunedin where local developers and property investors hold a substantially different view to building conservation, sense of place, and sympathetic adaptive reuse for contemporary and future ownership, tenanting and business opportunities. However, all that is Cut Dead at this particular spot in Princes Street by a Christchurch personality who appears to be in no rush to build.
His buildings must remain safe and pose no threat to the general public in the meantime.

Heritage New Zealand

The New Zealand Historic Places Trust (NZHPT) – and now trading as Heritage New Zealand – is New Zealand’s leading national historic heritage agency and guardian of Aotearoa New Zealand’s national heritage. The environment in which NZHPT operates continues to be characterised by a growing interest in heritage, recognition of its social, cultural, environmental and economic benefits, and awareness of its importance to national identity.

The NZHPT was established by an Act of Parliament in 1954. The NZHPT is established as an autonomous Crown Entity under the Crown Entities Act 2004, and is supported by the Government and funded via Vote Arts, Culture and Heritage through the Ministry for Culture and Heritage. Its work, powers and functions are prescribed by the Historic Places Act 1993.

Heritage New Zealand – a change of name
In 2010, the Ministry for Culture and Heritage led a review of the Historic Places Act 1993 (HPA) and as a result of that work the Heritage New Zealand Pouhere Taonga Bill was drafted and is currently before the House. It is currently awaiting the committee stage, and its third reading. The Bill includes provisions that will result in some changes to how the NZHPT operates, and to archaeological provisions of the HPA. It also proposes a change in name to Heritage New Zealand. The Bill will complete NZHPT’s transition from NGO to Crown Entity. To facilitate the transition, the decision was made to proceed with the name change ahead of the legislation. From 14 April 2014, the organisation has been known as Heritage New Zealand.

The New Zealand Historic Places Trust (NZHPT) has changed its name to Heritage New Zealand. Chief Executive Bruce Chapman explains the reasons behind the change.

Heritage New Zealand will continue to work in partnership with others, including iwi and hapū Māori, local and central government agencies, heritage NGOs, property owners, and volunteers. We will continue to provide advice to both central and local government, and property owners on the conservation of New Zealand’s most significant heritage sites. We will continue to maintain the national Register of historic places, manage 48 nationally significant heritage properties, regulate the modification of archaeological sites, and manage the national heritage preservation incentive fund.

While Heritage New Zealand receives 80% of its funding from the Crown, like many other Crown agencies it continues to be dependent for the remainder of funding from supporters, donations, grants, bequests, and through revenue generated at the heritage properties it cares for around the country.

Three key things remain the same under the new name:
● commitment to the long-term conservation of New Zealand’s most significant heritage places, including own role as custodian of 48 historic properties
● connection through members (membership benefits are unchanged) and supporters to the wider community
● continued status as a donee organisation, dependent on the goodwill and ongoing financial and volunteer support of the wider community for many of the outcomes the organisation achieves for heritage.

Dunedin Harbourside: English Heritage on portside development

By properly and logically establishing the significance of a historic port, plans can be laid that enhance and build on that significance and that incorporate difficult heritage buildings and structures.

The New Zealand Historic Places Trust registered the Dunedin Harbourside Historic Area on 4 April 2008 (List No. 7767). The historic area takes in properties at 25, 31-33 Thomas Burns Street, Birch Street, Fryatt Street, Fish Street, Willis Street, Cresswell Street, Tewsley Street, Wharf Street, Roberts Street and Mason Street.

The Dunedin Harbourside Historic Area is made up of the core of the port operations and associated businesses surrounding the steamer basin at the Upper Harbour in Dunedin which had developed by the first decades of the twentieth century. It includes a major portion of the land in Rattray, Willis and Cresswell Streets which was reclaimed by the end of the nineteenth century. It also includes the Fryatt Street and Cross Wharves, including the wharf sheds on Fryatt Street Wharf, as well as the former Otago Harbour Board Administration Building at the Junction of Birch Street and Cross Wharves, the former British Sailors’ Society Seafarers’ Centre, and the former Briscoe’s Wharf Store and Works on the corner of Birch, Wharf and Roberts Streets [since lost to fire], and the walls and bridge abutment on Roberts Street which are the remnants of the bridge which linked that Street to the city.

Excitement is growing about the potential for fresh development of Dunedin’s harbourside, including a new marine science institute featuring a public aquarium being considered by the University of Otago. The Otago Daily Times understands university staff have already held preliminary talks with Dunedin City Council staff about a possible new marine science institute in the harbourside zone, on the south side of steamer basin. The Otago Regional Council has also met Betterways Advisory Ltd, which wants to build a waterfront hotel in the city, to discuss the ORC’s vacant waterfront site, it has been confirmed.

HERITAGE IN REGENERATION: INSPIRATION OR IRRELEVANCE?

I had better come clean at the start. I live in a port. As it happens, it is a port which was, in its time, and on a different scale, as successful as Liverpool was in its heyday. But that time is rather a long time ago now, in fact over four hundred years. In 1600 my home town of King’s Lynn was amongst Britain’s leading ports, bigger than Bristol in numbers of ships and with trading tentacles reaching into the Baltic and far into the Mediterranean. Lynn’s position as a port was destroyed by the railways and although it still has working docks today the tonnage that passes through is very small. Yet anyone visiting it can instantly see that this was once a port; the customs house, the old quays, the merchants houses, the big market places and the fishermen’s houses all add immeasurably to Lynn’s sense of place.

We not only ask developers to build new structures that respect the old, but we also require them to incorporate old ones that have value.

It is this sense of place, this character, that we at English Heritage will always say that needs to be understood. For us the first and most important thing is that any developer and the relevant local authority should have a full understanding of the place in which major change is are planned. Various tools have been invented over the years to try and help that process. These include characterisation, historical studies, view studies, urban analysis and more. But does this actually make any difference? What happens to the richly illustrated historical reports produced by consultants? Are they handed to architects who then use them as their bible? Are they taken up by the planners and turned into supplementary planning guidance? Or do they just get put on a shelf?

There can be a broad consensus about what constitutes successful development that preserves aesthetic values. The trick for planning authorities is finding a way to capture it.

The answer is that normally it just gets forgotten because for most developers and many local authorities heritage is just a hindrance. If a report on heritage is commissioned they will have ticked off a process that they need to say they have done, but once completed it can be set aside and everyone can get on with the business of making money. Ipswich is an example of this. Like many ports, it has refocused its commercial hub away from the historic centre leaving a lot of land in the historic trading heart for regeneration. The city decided to prepare what it called an Area Action Plan for the redevelopment of the historic port. This included some work on the history, archaeology and development of the area: all very useful. The process was then to take this forward to create a series of planning briefs and master plans to inform individual developments. This would reinforce general points in the action plan about storey heights, vistas and through routes as well as issues about historic character. Regrettably, this latter part was not done and what Ipswich got was lots of poorly designed high-rise flats built on a budget. And they got it with the heritage studies still sitting on a shelf.

Liverpool World Heritage Site
Liverpool was inscribed as a World Heritage Site as the supreme example of a maritime city and its docks are testimony to that claim. Jesse Hartley’s Albert Dock, opened in 1845, is the finest example of a nineteenth century wet dock in the world while the nearby Canning Graving Docks and Waterloo and Wapping Warehouses are also of note. North of Pier Head with its magnificent ‘Three Graces’, Stanley Dock, Victoria Clock Tower and Salisbury Dock lie derelict, awaiting re-use. Link

Wins and the odd loss in preservation game

Owen Graham, of Dunedin, counts the preservation of the Athenaeum Library in the Octagon as one of the highlights of his six years as the Otago-Southland area manager for the New Zealand Historic Places Trust.
Longtime heritage advocate Owen Graham hopes his grandchildren will benefit from his work to preserve Otago’s history.
Mr Graham recently ended his six-year tenure as the Otago-Southland area manager for the New Zealand Historic Places Trust (NZHPT).
The Dunedin resident spent about 26 years before that in a similar role for the Department of Conservation, and said going into the corporate industry after more than three decades working for the Government was a refreshing change.
His work to advocate the values of heritage throughout the region was often met with opposition and was not without controversy.

Gutting the RMA – it’s time to be concerned

OPINION | The Resource Management Act (RMA) has sadly become a much maligned and misunderstood piece of legislation: a kind of universal public punching bag – if mentioned in conversation, it is almost obligatory to put the slipper in. To most Kiwis it represents bureaucracy and inefficiency – pen-pushing do-gooders and paper shufflers who engage us in excessively long and costly processes that get in the way of us Kiwis doing stuff.
In fact the RMA – passed in 1991 – was a means of rectifying mistakes and providing at least some environmental and social integrity to development and planning process. It was recognised by legal minds to be a world-leading piece of legislation. It protected our environment and our economy based on the premise of sustainable resource management. What’s more, it was politically robust in that it received the blessing of both major parties.
It also gave New Zealanders a chance to be heard and it facilitated local decisions made by local people. While the country’s environmental indicators such as water quality and biodiversity loss have still gone backwards – the RMA has stemmed what would otherwise have been fatal haemorrhaging.
Similarly, the RMA has protected a set of fundamental Kiwi values: the notion of fairness and equity in regard to everyone having a right to their say; industry and other activities being required to take responsibility for avoiding, remedying or mitigating adverse environmental impacts; and developments being required to have regard to effects on such things as recreation, scenic values, private property rights, and the public’s access to rivers, lakes and beaches.
That’s all about to change.
The Government plans to alter the Act to give greater weight to economic development over environmental considerations, granting to itself the right to veto any issue. You don’t have to be legal-minded to see the impact of subtle word changes. While the consideration for the “benefits” of a project remains, gone are any references to the “costs”, making a cost-benefit analysis redundant because environmental “cost” is out of the equation.
Gone, too, are the words: “maintenance and enhancement of amenity values”. That’s basically any recreational activity – walking, running, swimming, fishing, kayaking. Who likes doing that stuff anyway? Thankfully the “importance and value of historic heritage” stays. But its cobber, “protection from inappropriate subdivision and development” gets the boot – making the first clause meaningless. And my personal favourite, “maintenance and enhancement of the quality of the environment” has been politely asked to leave. Clearly such an unruly clause has no place in a legal act that’s trying to protect the environment.

The Parliamentary Commissioner for the Environment, Jan Wright, has a different interpretation. She thinks the changes “muddy the overwhelming focus of the RMA, to protect the environment, and risk turning it into an Economic Development Act”. Similarly alarmed, the architect of the RMA, Sir Geoffrey Palmer, concludes: “The [proposed changes] will significantly and seriously weaken the ability of the RMA to protect the natural environment and its recreational enjoyment by all New Zealanders.”

The changes also grant considerable new powers to central government, giving it the ability to take individual consent decisions away from local councils and place them in a new national body. The changes go further still, by allowing government the right to insert provisions in local council plans without any consultation.

The City Council will be giving the community another opportunity to have your say on the proposal and the changes they have made to the plan since the consultation period in March 2013. This is an important issue for our township and community and the meeting is to be held at 7:00 pm on Monday, 13 May 2013 at the Coronation Hall. DCC Draft Annual Plan 2013/14: Portobello Harington Point Road Improvements Project

Something that seems to have slipped the radar in Dunedin news of late is the WIDENING of Portobello Harington Point Road on the Otago Peninsula.

Looking at the Draft Annual Plan, the City Council intends to spend the following on what amounts to an environmental and heritage damaging folly. That’s only 33-34 % of the budget, given NZTA will subsidise the remaining 66-67% of the project.

The road widening (including the Vauxhall and Macandrew Bay areas already completed) will reclaim nearly 11 hectares of the Otago Harbour — a conservative measurement given plans show significantly more reclamation if the topography requires it.

Consultation on the current design closed yesterday, Thursday 28 March, indicating approval of the plan is a given despite the consultation process for the Annual Plan this year and in years to come.

There will be irrevocable damage to the Peninsula and Harbour landscape, heritage features and the ecology if this misguided piece of engineering continues.

It is feared the Council has the bit between its teeth on this project — described as being about “liveability”, according to Mayor Cull at the Portobello Annual Plan ‘roadshow’.

It might be worth pointing out to your readers that they look closely at the Draft Annual Plan in regards to this area of Council expenditure.

Searching Council for cost benefit and recreational analyses fails to show much other than what is in the June 2008 Cycle Strategy (PDF, 787 KB).

Few will have problems with the desirability of access, but the lack of design sensitivity and impact on the values of the area seem inconsistent with the value of the Peninsula and Harbour to the community and our economy.

This is certainly an issue worth looking at more deeply.

I submit in the strongest terms, that resource consent for the building of the proposed hotel structure on the above site, NOT BE GRANTED because of the structure’s significant, detrimental effects on the city landscape.

If the applicant had had the courtesy to supply comprehensive spatial design drawings of this structure in the context of the whole city, it would be obvious to all how inappropriate in SCALE this structure is. At 96m in elevation, the structure overbears the entire city and harbour basin, obstructing the entire city centre’s experience of the harbour, the peninsula and Dunedin’s nestling hills, offering an absurd conflict with the human scale and nature of both the historic and current character of city structures and city activities.

Of greatest concern are the western and eastern elevations of the structure. I submit Photo 1 taken from the lookout in Mornington Park, a view celebrated by Dunedin artists numerous times over the years, by visitors to the city and of course, by the hundreds of Dunedin households. The approximate silhouette of the proposed structure is drawn in to show the obstructive nature and ‘selfish’ size and position of the hotel. The scale of the building is completely inappropriate. Photo 2 is from the same position, zoomed in and marked with the Wharf St railway lighting tower measured at 35m used to indicate the dominance of the proposed 96.3m hotel structure. The eastern elevation from the peninsula suburbs too, will experience the overscale of the building against the city and hill suburbs.

Photo 3 taken, on zoom from Bellevue Street, Belleknowes, again includes the structure’s silhouette scaled off the marked rail light tower. If the cladding of the proposed tower is mainly glass, with it being so high above the city, the western sun will create issues of sun strike on roads leading down from the suburbs, and obviously, serious effects and obstruction to the views enjoyed by thousands of households.

Photo 4 is from lower down the Belleknowes spur, from Adam Street, with an estimated, but conservative profile (photo lacks a known structure to measure off) drawn. Again the aesthetic values and scale of the harbour basin are entirely offended by an ill considered structure.

What concerns me most about this application for resource consent to build an inappropriate structure (by position and scale), is the inadequacy of the supplied application documents to present the structure in the context of the city. Widely published images are fantasy, such as an elevated, high angle view from well above the harbour, attempting to diminish the perceived size of the structure. The only humans to view the structure from this angle, position and elevation may be those wealthy enough to, by helicopter. These images are notable for their lack of contextual structures that make, in fact, the character of Dunedin. Buildings of 2, 3 or more storeys set the scale appropriate for development and are absent from the application documents precisely to obscure the real affect this structure will have on the city’s landscape and its aesthetic values. Design consultancy information only focuses on the very immediate surroundings and contains no spatial plan for this giant structure in the context of the city. I have attempted to show how 120 degrees of the city centre and its hill suburbs will have their harbour and peninsula views and joy of place seriously obstructed. The peninsula suburbs will view a structure absurdly contradicting the city structures and rounded hill suburbs. All incoming transport links, as a special feature of this city, enjoy delightful revelation of the ‘great little city’, its harbour and the waters of the Pacific. These heartening views enjoyed by all, citizen and visitor, will be irretrievable spoiled and dominated by a tower designed (and possibly built) for a city the scale of Hong Kong, Kuala Lumpur or Singapore.

Lastly, the attempt at this sort of inappropriate development is an affront to the careful planning [of] the city’s forefathers to create an egalitarian community enjoying the delightful natural environment Dunedin offers. The proposed structure stands at 96m. This is only a matter of metres below the elevation of much of the Green Belt. Jubilee Park is at a 100m elevation. The Green Belt designed and implemented so long ago and maintained for the benefit of all, is carefully placed so that wherever a person stands in the city centre they can look up the hills to the skyline and see only green, the suburbs beyond obscured by the angle of view. This creates a very special intimate city, a human scaled city, for the benefit and edification of those living or visiting here. This, in conjunction with historical character (now lost in Christchurch), a rich, intelligent, creative and industrious community is what makes Dunedin a destination, a special, memorable place that with sympathetic development will continue to attract visitors and citizens who will not find the likes, elsewhere in the world. Structures like the proposed hotel are notable for being the same the world over. In being built it will change the very character of the place visitors will be seeking to experience.

I submit in the strongest terms that the Dunedin City Council turn down this application for resource consent and I suggest that the non compliance of this application to the requirements of the Resource Management Act to protect the amenity, aesthetic and cultural values and wellbeing of the people of Dunedin will bring this matter to the Environment Court.

Recommended changes to RMA explode environmental protection

Technical advisory group’s report recommends significant changes to section 6 of the RMA…the proposal to drop the requirement for decision makers to provide for the preservation and protection of indigenous vegetation and habitats as matters of national importance ignores Environment Court case law built up over the last 20 years.

Proposed changes reduce RMA protection

A Government-appointed advisory group has recommended a significant rewrite of the Resource Management Act removing references to the protection of coastal areas, wetlands, lakes and rivers and indigenous flora and fauna. Environment Minister Amy Adams released the report from a technical advisory group established after the Canterbury earthquakes with the primary task of looking at natural hazard issues relevant to the RMA arising from the quakes. “After the Canterbury earthquakes, it became clear that consents for subdivisions had been granted without any consideration of the risk of liquefaction,” Ms Adams said in a statement. However, the group’s report addresses much wider issues and recommends significant changes to section 6 of the RMA.

As it stands [section 6] instructs local authorities to recognise and provide for the protection or preservation of the natural character of the coastal environment, wetlands, lakes and rivers when considering RMA applications. They must also provide for the protection of outstanding natural features and landscapes and areas of significant indigenous vegetation or wildlife. Protection must also be provided for historic heritage and protected customary rights while public access to and along the coastal marine area, lakes and rivers must be maintained. However the group’s recommendation proposes removing the words “protection” and “preservation” from the section entirely.

Senior planner Campbell Thomson addressing the Applicant on behalf of the Dunedin City Council as at 27 January 2012, writes:

“Your application for land use consent for the demolition of an existing building listed in Schedule 25.1 of the District Plan and located within a townscape precinct, at 191 King Edward Street, Dunedin, was processed on a non-notified basis in accordance with sections 95A to 95F of the Resource Management Act 1991. The application was considered by a Senior Planner under delegated authority on 27 January 2012.

“I advise that the Council has granted consent to the application with conditions. The decision and condition are shown on the attached certificate.”

Under ‘Planning Assessment’, Mr Thomson states:

Affected Persons
No written consents were submitted with the application. No parties are considered to be adversely affected by this proposal for the reasons outlined below in the section headed Effects on the Environment. It is noted that the New Zealand Historic Places Trust were consulted as a Statutory Body with an interest in the proposal. Their concerns will be addressed through the requirement for an Archaeological Authority which applies to the proposal. There are no special circumstances which warrant notification of this application. While demolition of heritage or townscape buildings generally raises issues of public interest, in this case, the structural condition of the building has reached a state whereby removal of the building façade has become necessary as a matter of public safety. The key environmental issue relevant to this proposal is how to mitigate the loss of the building.”

It is unreasonable and erroneous, in the context provided by the letter writer, for the Dunedin City Council to state that “the New Zealand Historic Places Trust were consulted”.

It is unreasonable and erroneous of the Council to claim “No parties are considered to be adversely affected by this proposal”, supported by following paragraphs that do not mitigate the wrongfulness of the unjust premise.

The letter granting consent carries other instances of pomposity and disregard for due process. Where does natural justice fit?

This forum isn’t the appropriate place to debate glaring technicalities, in light of what ‘affected party’ status requires as a burden of care on the part of the Dunedin City Council. Suffice to say, the Council is telling porkies.

Furthermore, the Dunedin City Council cannot hope to reduce or limit the work, powers and functions of the autonomous Crown Entity, New Zealand Historic Places Trust, empowered under the Historic Places Act 1993, to just that of regulatory responsibilities regarding archaeological sites — for the Council’s own undemocratic purposes.

Certainly, not by Mr Thomson’s convenient slip of the Council’s red pen.

When is a heritage building protected, and when is it not? That question is one that deserves closer attention as the effects of building neglect become more apparent in our city. In the coming months more gaps will occur in our city heritage precincts, particularly with buildings in Rattray St and King Edward St being readied for demolition. They were not damaged by earthquakes, rather by successive owners who have opted to diminish their attractiveness, economic viability and historical significance in what ultimately results in demolition by neglect. {continues} #bookmark

Urbanismplus report on Central City Framework

The Urbanismplus report on the Central City Framework is now online at http://www.dunedin.govt.nz/whats-on/central-city-plan [go to Documents]

A number of the concepts and proposals raised by the consultants in the Central City Framework have been included in the Draft Spatial Plan for public consultation through the submission process.

Other specific capital projects proposed in the Urbanismplus report are currently being investigated for cost and feasibility.

These will be put forward to Council in January 2012 for consideration towards inclusion in the draft Long Term Council Community Plan (LTCCP) which will open for public consultation early in the new year.

Dunedin Amenities Society: Craigieburn Reserve at Tanner Road

The open day will be the official opening of the reserve by the Mayor of Dunedin Dave Cull and the launch of the heritage interpretation trail developed on site for the Dunedin public.

Gain your first glimpse of the Society’s year-long restoration that has developed an area of regional significance for Dunedin. There will be time to explore the reserve and gain insight into part of Dunedin’s unique settler heritage.

Murals at Port Chalmers Garrison Hall – public viewing Sunday 12 June

The recently uncovered murals painted as back-drops to an 1892 Japanese Festival in the Port Chalmers Garrison Hall can be seen when the Hall is open to the public between 1.00 and 3.00 pm on Sunday 12 June.

This will be the only public opportunity to see them “in-situ” before they are taken down.
