May we know when you requested that the mudtanks were cleaned thoroughly?

I had thought that it was an initiative from Ruth Stokes, as part of the looking into and reporting back on the flood.

I am also interested in your “fact” that the stormwater system is not capable even at optimal condition and performance……. Do you mean that it was not then, or that it would not be even if we made adjustments and sorted out the mudtanks and fixed the screen/pump and made changes which we have signalled to the general stormwater system which flows through South Dunedin?

If council modelling showed the extent of the flooding would be precisely as it was in the event of that magnitude, what relevance had the problems with the screen/pump and the mudtanks? I guess all the problems in South Dunedin during the flood were localised problems and many of them as a result of water lying about, so did our modelling show that as well?

I understood that there was still more work to be done to understand what we could best do particularly about the interconnection between the water from various sources and what we could afford of the options available.

Do you see the governance part of the Council completely blameless in this process?
Since you have apparently arranged for the mudtanks to be cleared, surely you/we could have done something sooner.

Do we have a role at all in your view, apart from advising people they are wrong when it turns out we may have incomplete information?

As seems true for all of the information surrounding this horrible flood, the more information we receive the more questions we have.

Thank you for your email. I am puzzled by the apparent assertion that I have blamed the 2015 June flooding on Climate Change. While that may be the root cause I don’t recall saying that. The cause of the flooding, as has finally been comprehensively reported (for a meeting today) was the fact that the stormwater system in South Dunedin is not capable, even at optimum condition and performance, of coping with the amount of rain that fell over that period. That is a simple calculation given the capacity of the system in both volume and pumping terms, and the severity of the event. The mudbank maintenance failure was reprehensible from both a contractor and staff oversight perspective, especially as exactly the same issue had been raised some four years ago and assurances given that it would not happen again. The fact that some mudbanks were not up to scratch may have caused some localised problems and perhaps prolonged the water lying, but they did not cause the extent of the flooding. That was exactly as Council’s modelling showed it would be in an event of that magnitude.
Six years ago Council received reports stating (among other conclusions) two things. First that more frequent and severe rain events were likely. Second that the stormwater system in South Dunedin was not capable of handling those. So flooding was very likely. Last year the Parliamentary Commissioner for the Environment issued a report showing that rising ground water, pushed up by sea level rise will increasingly afflict South Dunedin.
It’s most important to recognise that while stormwater and groundwater can each affect the other, they are different and have different causes.
The failure was operational and managerial as Council was repeatedly assured that maintenance was up to scratch.
Council’s challenge now is to address both stormwater and groundwater issues. We have already, at my request, ensured that the stormwater system is in the best shape possible as winter approaches, by having all the mudbanks cleaned properly. Additionally the screen at the Portobello Rd pumping station, which was blocked by debris carried by the overwhelming amount of water, will be replaced by July.
Council will consider that report which has taken such a frustratingly long time to get to us, and determine the next necessary steps.

WE all know that climate warming is a fact but your glib PR spin and articles in the paper does nothing for your credibility and your lack apology shows that you and the council do not except responsibility for this lack of governance
It is sad that only one of the council appears to have enough bottle to ask you to do in an old fashion way the decent thing
My wish is that you pass this email as part of an agenda item a the next council meeting on how one ratepayer views your lack of understanding in the way a Mayor should carry out his role

It is with disappointment reading the failure of governance by the council I was a chairman in those days that was the title of a high school board If the school had a problem which effected the community you had to stand up and take the blame
I do not expect the council elected members to clean mud tanks but when there is failure of this size then the expectation of the community that something is seriously wrong with the governance of the council The glib excuses as regards rise in sea level is the catch cry of the council which you as a member are part of
In my view the council members should of put on gumboots and gone out with the CEO and inspected the mud tanks instead of waiting a year for a report It saddens me to find that people in South Dunedin were not accorded this Instead we had articles written that showed how out of touch the council members were These articles were part of the green PR spin which now blights any decision that this particular council makes All that was needed was clean mud tanks and clear governance by the members of the council not excuses I hope that this is a lesson that you as a council member takes on board when making decisions in the future

A series of emails released by Dunedin city councillor Lee Vandervis show he was raising concerns about the state of Dunedin’s mud-tanks as long ago as 2011. Cr Vandervis said he released the emails because only publicity forced the council to change its ways. “This publicity is going to make sure it really is sorted once and for all this time.” The release of the emails follows a report released by the Dunedin City Council last week into last June’s flood, which found 75% of mud-tanks in South Dunedin were not properly maintained.

Council staff were responsible for not properly overseeing mud-tank maintenance in South Dunedin, not councillors or the mayor, a senior staff member says. Council infrastructure and networks general manager Ruth Stokes started today’s council infrastructure services committee meeting by apologising on behalf of council staff for the failings identified in a report on last June’s flood. Dunedin Mayor Dave Cull and Crs David Benson-Pope and Lee Vandervis were among those who had raised mud-tank performance prior to the South Dunedin floods, and been given incorrect information by staff. “For that I would like to, on behalf of the executive, apologise,” Ms Stokes. The failure was a management failure and not governance one, she said.

Mayor Dave Cull outraged

Mayor Cull says he is outraged at the failure of Fulton Hogan and council staff to adequately ensure that the mudtanks were in working condition. He should also be outraged at his own poor leadership and failure to respond to developing problems. Under his leadership the city continued to build up a backlog of worn-out stormwater pipes and equipment waiting for funding to be allocated. With this lack of funding we have seen the inevitable result of a deteriorating stormwater system. The poor state of the stormwater system was the primary cause of the severity of the flooding at Kaikorai, Mosgiel and South Dunedin last year.

This under-funding of the stormwater renewals is not an accident. Every year the DCC Mayor and councillors decide and vote on this spending – and every year they vote to under-fund the stormwater renewals because they think that a new stadium and a new swimming pool and more bicycle lanes are more important than a functioning stormwater system. The Annual Plan shows that the under-funding will continue next year. Expect the deterioration to continue.

Subject: Why I continue to vote.

Dear Mr Morris,

Mayor Cull’s ambushed change to the Council Code of Conduct resolution item claims that my apology on which my responsibility for being able to vote apparently hangs “is to be judged by the CEO or her delegate.”

Standing Orders J4.2 clearly says that Council may take Code of Conduct action against a member by means of a three-fourths majority of those present, and the action taken was to demand a genuine apology which I have provided.
I can only genuinely apologise as far as the evidence I am allowed to see permits.
Standing Orders does not empower a CEO’s delegate to rule on the appropriateness of my apology which ruling has the effect of denying my responsibility to vote on behalf of the thousands of Dunedin people that voted for me. That is for Councillors to decide and they have not been given that opportunity.
My legal advice is that there is no legal basis for the Code of Conduct censure being delegated to the DCC chief accountant.
Councillors must vote for such a Code of Conduct action and I believe that Mayor Cull knows he does not have the Councillor numbers to vote for such an action.

Consequently I will continue to vote as before, and it is up to staff whether my votes are properly recorded.
All of this is on the back of a constantly corrupted Code of Conduct process where I have not been allowed to see the evidential statements made against me from Councillors or from CEO Bidrose, and have therefore been unable to defend myself against those evidential statements.
I have obtained consistent legal advice from two different sources in addition to ex-lawyer Cr. Calvert’s opinion printed in the ODT, and these sources do not want the DCC to know who they are as they believe that may prejudice their opportunities for other work in Dunedin. I do not intend to sue Mayor Cull or Council at this stage as I am still hopeful of getting the Deloitte’s information that would be pivotal in any Citifleet fraud cases brought.
I am still not permitted to see the Deloitte Citifleet fraud investigation evidence which would allow me to establish whether Police have in fact, recently investigated appropriately or not.
Time will tell who has been misleading who regarding the Citifleet frauds issue of substance.

I unreservedly acknowledge that my loudness behaviour to CEO Bidrose in the Council hallway [3/2/15], and my loudness in the non-public Audit and Risk meeting of [3/12/14] was wrong, unacceptable and in breach of the Code of Conduct. I am genuinely remorseful that I upset people with my loudness and that my initial apology was insufficient. I undertake to do my utmost to ensure that I do not repeat such behaviour.

I am also prepared to unreservedly apologise for misleading the Audit and Risk committee regarding the narrowing of the Citifleet fraud investigations, but can only do this in good faith if any dated hard evidence is available to show that the narrowed investigation revealed six months after the Citifleet manager’s death, was in fact widened, and that active investigators did not continue to misinterpret management instructions.

Recognising that such hard evidence may be difficult to locate within the 24 hours allowed for my apology, I am nevertheless prepared to make such an unreserved apology if I am given the full Citifleet Deloittes investigation report, staff report and Deloittes’ digitised DCC evidential files which until now have been refused me on the grounds of an ongoing Police investigation. Giving me this information on a strictly confidential basis as requested last November would indeed allow me to verify with hard evidence, how much the investigation had been limited, and the extent of any misleading.

I am happy to sign a confidentiality affidavit not to release or use any of the Deloittes’ Citifleet Fraud information until the Police investigation process has been completed. Only then would I consider any ratepayer value in pursuing private prosecutions that might be supported by the Deloittes information.

I am in receipt of your email entitled ”remorseful apology to CEO Bidrose, Sandy Graham, A&R members, Mayor Cull and Councillors” and provide the following response as the officer delegated by the Chief Executive:

For the breaches relating to the “loudness behaviour” relating to Dr Bidrose and the Audit and Risk Committee, it is my assessment paragraph 1 of your apology meets the requirements of the Council resolution.

In relation to “misleading the Audit and Risk Committee” I assess that the apology in paragraph 2 and following do not meet the requirements of the Council resolution because:

a) there are 2 apologies, that are both contingent on being provided with further evidence.
b) there is no acknowledgement that the behaviour was wrong, unacceptable and in breach of the code of conduct.
c) there is no commitment not to repeat such behaviour.

The Council resolution requires that an “appropriate apology for all breaches” is required. While your email goes someway to meeting the requirements of the resolution, it does not adequately cover the Audit and Risk Subcommittee matter. The resolution provided a twenty four hour window for any apology for all breaches. If you wish to resubmit your email in light of my comments above, then I will reconsider your response.

I note that you have once again requested full copies of the Deloitte Report and associated documents. This request was previously considered under the provisions of LGOIMA and the withholding grounds that were applied at that time remain. Your rights to have this decision reviewed by the Office of the Ombudsman is still available.

█ Message: Below is the statement I gave to [Chris] Morris as I left the meeting today. Be interesting to see what he does to it. —I also gave him a copy of my initial apology.

I completely reject the claim that I misled the Audit and Risk committee, and that I was not open and honest.

– What I did do was voice my concern that the investigation into DCC Citifleet fraud was narrowed down to a single category of fraud, and that the blame has been narrowed to a single deceased individual.

– Since then I have seen no hard evidence of the DCC fraud investigation being widened.

– Accusers should have had hard evidence of a widened investigation as was continually promised but not delivered, before even considered accusing me of acting in bad faith – never mind now considering sanctions against me.

– I am still hopeful that the DCC Citifleet fraud investigation that I began in 2011 will be actually widened, seek my offered evidence, and fully investigate the whole range of fraud, including Citifleet.

Regarding complaints of loudness, due process has not been followed to allow me to defend anonymous claims that go beyond loudness, so I’m not in a position to recognise them.

I recognise today that I had become increasingly frustrated with the lack of CEO response to my earlier emailed governance complaints, and that an unacceptable Council agenda item was imminent as a result.

Happily some time was subsequently allowed for possible resolution of the Governance issues I complained of.

CEO Bidrose has this weekend confirmed in public, with a hug, that she has not made any complaint of me, that she was out of town when she received my latest email alerting her to a legal issue in the non-public section of the Council meeting underway when we spoke in the hallway, and that her secretary had not read through the email to the legal issue and alerted her prior to the meeting in which Mayor Cull attempted to push the issue through.
The legal issue related to Mayor Cull’s false claim that he was personally empowered to select the membership of the Code of Conduct Committee [against me], when this power is clearly that of the whole Council as detailed in Standing Orders J4.1 and in the Committee Structure and Delegations Manual.
This came on top of Mayor Cull’s falsely claiming statements supposedly made by me at the 3/11/14 Council meeting, and his then immediately demanding that I withdraw these statements which I did not make. Mayor Cull then used my refusal to withdraw the statements as a pretext to eject me from the meeting, all of which the video proves. This was the essence of my Code of Conduct Complaint against Mayor Cull of 10/12/14. Two subsequent Code of Conduct Complaints against me by Greater Dunedin Chairpersons do not mention any swearing or expletives and seem to be personal ‘tone’ attacks to deflect from on-going Mayoral abuses of his position and the Mayor’s attempts to silence my concerns.

If it was thought that my Council hallway questioning of CEO Bidrose yesterday was considered to be too loud or inappropriate, I unreservedly apologize to those who thought so, especially if that included Dr. Bidrose.
I recognise today that I had become increasingly frustrated with the lack of CEO response to my earlier emailed governance complaints, and that an unacceptable Council agenda item was imminent as a result.
Happily some time was subsequently allowed for possible resolution of the Governance issues I complained of.
To prevent a recurrence of overheard unpleasantness, I undertake to make any future complaints of staff or elected representatives in a recorded medium.

Apology, payout to developer

Dunedin developer Tim Barnett has received a public apology and a $200,000 payout following a lengthy battle to recover his costs after the Dunedin City Council restricted his ability to develop his harbourside property. The property, at 41 Wharf St, has since been sold to developers who are hoping to build a 27-storey hotel on it.

DCC chief executive Paul Orders yesterday apologised to Mr Barnett, of Arthur Barnett Properties, for the inconvenience caused by the council’s decision-making since 2008. The formal apology, issued by Mr Orders yesterday, read:

”Council apologises for the inconvenience, and also thanks Mr Barnett for working with council in good faith as the parties explored options over some years. Mr Barnett has a long history of commitment to the city of Dunedin. Council trusts that the good working relationship that has developed between Mr Barnett and the council over the years will continue.”

The $200,000 covers Mr Barnett’s out-of-pocket costs (just under $118,000), the interest on his costs ($41,000) and a contribution to his legal fees during his lengthy attempt to first remove the restrictions on developing the site and then recover from the council the cost of those restrictions.
