OPINION The Dunedin floods of June 3 should not have occurred with such devastating effects for so many. But it did. And the lack of response from Dunedin Civil Defence has simply posed more questions than answers. South Dunedin has long been a community of labourers – workers who epitomise the stoic and egalitarian attitude New Zealand prides itself on. It is communities like these which embrace a firm “can-do” attitude, staunch, resilient, and humble. It is for these people, this hard-hit community, along with those in Mosgiel, Brighton and other parts of Dunedin that answers are needed.

Official Information Act review finds ‘no deliberate misuse’

A high-level review of the Official Information Act will not uncover any widespread political interference in the release of information, its author says. The Ombudsman’s Office will release the findings from its comprehensive, year-long review next week. Chief Ombudsman Dame Beverley Wakem said today that the investigation had not discovered malicious or deliberate misuse of the Act by ministers’ offices or by Government departments.

“We’ve really shaken the tree over this and haven’t been surprised by what’s fallen out,” she told a Parliamentary committee this morning.

She admitted that she had suspected political interference, but had found no hard evidence of it. Dame Beverley said people who had complained to her office could be perceiving political spin or “bad behaviour” when it did not exist, and she could not make any findings “based on hearsay”.

Many will have read the article on Penny Bright in today’s Herald and the massive legal bills that the Auckland City has incurred pursuing her for arrears of rates. Penny tends to polarise. To some she is a folk-hero espousing the interests of a fair and just society, and to others she is a no-hoper who should “get a life” and pay her dues. The reality is that she has discovered the Achilles heel of local government, and all the whitewash from the Council, the defamatory put-downs, and all the legal pressure they are putting on her, is not going to alter that fact.

All local authorities in New Zealand have the legal right to charge rates but only if, and I repeat only if, they comply with the requirements of the LGA in respect of consultation and only if they comply with the LGRA in respect of rating processes and rating documents.

Ms Bright has refused to pay her rates until she knows where the council spends its money – particularly on private contractors – and acts in a democratic manner.

Unlike taxes which are levied by statutes that are unconditionally binding on all citizens, rates are only binding if they comply with the law. Local government in New Zealand has long suffered from a chronic case of ADOTROL* disease [Arrogant Disregard Of The Rule Of Law] which has caused it to adopt procedures and documentation that are lazy, slovenly and simply fail to comply with the law. That means that most of the rates set by local authorities are unlawful. Cont/

Dear Sue and Grant,

The timing of our CFO’s announcement of the budgeted $2m not spent half way through our last week’s LTP discussions was independently questioned by myself, Cr. Calvert, and DCC watchdog Calvin Oaten.
This overbudget was characterised by Cr. Thomson as an “underspend” and by Cr. Bezett as “a fortuitous fund to dip into”, and was promptly dipped into to fund Cr. Thomson’s moved $1million for International Cricket lights.

I asked CFO McKenzie in the following break why he had chosen that time immediately prior to Cr. Thomson’s International Cricket light’s motion to make the $2 million announcement and he replied “Because I was asked to”, which raises the further questions:

1 – Who it was that asked our CFO to make that $2 million announcement?
2 – When did that person ask our CFO to make that $2 million announcement?
3 – Whose decision was it to make the announcement at that particular time during our funding decision discussions?

Dear Councillor Vandervis,

I refer to your email of 24 May 2015 sent to both the CEO, Dr Bidrose and Group Chief Financial Officer, Grant McKenzie.

Your request has been considered under the provisions of the Local Government Official Information and Meetings Act 1987 (LGOIMA) and the following response is provided.

I have repeated and numbered your questions to give context to our response.

1 – Who it was that asked our CFO to make that $2 million announcement?

Finance staff were asked by the Chair of the Finance Committee to get an update on the current year’s underspend. Earlier estimates of the level of interest underspend had been supplied to all Councillors on a number of occasions previously. Most recently prior to the Long Term Plan (LTP) this information was provided through the monthly finance reports that went to the Finance Committee on the 4th of May (page 4.6) where the underspend on interest expense for the nine month period to March was $1.606 million. In addition, the underspend was also referred to in two reports that were provided to Council as part of the LTP process, specifically in report 9 – paragraph 12, and in report 22- paragraph 10.

An update was requested at the LTP process as another month had passed since the March update figures had been prepared, and the Chair of Finance wanted to know if the April result could be made available.

2 – When did that person ask our CFO to make that $2 million announcement?

Because the Chair of Finance had asked if the updated result was available and it was, the Mayor asked the update be provided as part of the deliberations for that day so that all the Councillors had the updated information. Mr McKenzie then wrote an additional memorandum explaining the underspend in the current financial year, following a request from Councillor Calvert to Dr Bidrose for this information.

3 – Whose decision was it to make the announcement at that particular time during our funding decision discussions?

As Chair of the meeting, the Mayor asked that the information be provided, as it was available, in order to ensure that all Councillors had access to the latest updated figures of interest underspend, as had been provided in the earlier reports referred to in our response to question 2.

Subject: Why I continue to vote.

Dear Mr Morris,

Mayor Cull’s ambushed change to the Council Code of Conduct resolution item claims that my apology on which my responsibility for being able to vote apparently hangs “is to be judged by the CEO or her delegate.”

Standing Orders J4.2 clearly says that Council may take Code of Conduct action against a member by means of a three-fourths majority of those present, and the action taken was to demand a genuine apology which I have provided.
I can only genuinely apologise as far as the evidence I am allowed to see permits.
Standing Orders does not empower a CEO’s delegate to rule on the appropriateness of my apology which ruling has the effect of denying my responsibility to vote on behalf of the thousands of Dunedin people that voted for me. That is for Councillors to decide and they have not been given that opportunity.
My legal advice is that there is no legal basis for the Code of Conduct censure being delegated to the DCC chief accountant.
Councillors must vote for such a Code of Conduct action and I believe that Mayor Cull knows he does not have the Councillor numbers to vote for such an action.

Consequently I will continue to vote as before, and it is up to staff whether my votes are properly recorded.
All of this is on the back of a constantly corrupted Code of Conduct process where I have not been allowed to see the evidential statements made against me from Councillors or from CEO Bidrose, and have therefore been unable to defend myself against those evidential statements.
I have obtained consistent legal advice from two different sources in addition to ex-lawyer Cr. Calvert’s opinion printed in the ODT, and these sources do not want the DCC to know who they are as they believe that may prejudice their opportunities for other work in Dunedin. I do not intend to sue Mayor Cull or Council at this stage as I am still hopeful of getting the Deloitte’s information that would be pivotal in any Citifleet fraud cases brought.
I am still not permitted to see the Deloitte Citifleet fraud investigation evidence which would allow me to establish whether Police have in fact, recently investigated appropriately or not.
Time will tell who has been misleading who regarding the Citifleet frauds issue of substance.

Stadium costs +$20M per annum, against one Fleetwood Mac concert….

I experienced Fleetwood Mac at Western Springs, Auckland in the 1980s, there is no way I want to see them live now in a crap-for-sound covered stadium at Dunedin. This cat has already eaten the cream. I might see them at Mt Smart, however.

How much has DCC/DVML paid to the promoter to get the band here?
They’ve spent $350,000 on tired roller Rod Stewart, who has yet to perform.

The rumours are true — Fleetwood Mac is coming to Dunedin. It was confirmed yesterday the group, one of the world’s best-selling bands, will perform its only South Island show at Forsyth Barr Stadium on Wednesday, November 18. Tickets costing between $100 and $300 plus fees will go on public sale from 10am on April 1, and a bumper crowd is predicted to pump millions of dollars into Dunedin’s economy. The British-American group’s Dunedin show will feature all five original band members, with Christine McVie having reunited with Mick Fleetwood, John McVie, Lindsey Buckingham and Stevie Nicks.

Half of all inspections of pubs and clubs with pokie machines identify breaches or non-compliance with the law. Fees paid by pokie operators are to be increased as levels of fraud and other breaches challenge the Government’s ability to police the sector. Internal Affairs Minister Peter Dunne is overseeing consultation on proposals that will increase fees paid by clubs and pubs with gambling machines by 54 per cent.

OPERATION CHESTNUT NEAR COMPLETION
DIA, SFO and the Organised Financial Crime Agency NZ scrutinised $30 million in gaming grants made by trusts including Bluegrass. Bluegrass’ licence was cancelled after the DIA ruled its start-up funding was sourced from three racing clubs, rather than from South Canterbury Finance, as claimed.

The past three years have seen an increase in complex investigations into fraud and illegal activity at clubs and societies with pokies. That, and the declining number of pokie machines, has put severe financial pressure on the Department of Internal Affairs (DIA). Gambling enforcement is funded through fees paid by gambling operators.

Moves are afoot to have the term of the appointed Commissioners extended beyond the set date of October 2015. This appears to be an effort to create a platform towards amalgamation of the whole of Northland into a single Local Authority. Given the parlous state of Kaipara’s finances and the stubborn refusal of Commissioners to listen to ratepayers and residents, amalgamation can only be detrimental to Kaipara’s best interests and would likely result in those who created this mess escaping scot free. We want the minister to:
(a) Ignore requests for extension of term of the Commissioners
(b) Be open on discussions regarding reorganisation of local government in Northland

ORFU chairman quits —no thanks to DCC for all its help *sniff

Of course —with Professional Rugby the sense of entitlement goes a terrible long way. The Dunedin City Council, cracked and broken, has been unfairly or dishonestly “short-changed” by Otago Rugby and big brother NZRU. So too is the community of South Auckland (history: Jokers Bars, Gambling money spent out of area on Otago Rugby and Racing). What a delightful experiential and lucrative background exists to the Otago Union.

Straight up and rational, in the course of a chairman’s work, it’s simply the case that there’s been no mandate to name the rugby sponges who misused millions of dollars of public funds; although Jeremy Curragh, former ORFU change manager, suffered a moment when he was forced to blurt that a lesser amount of charitable funds had been misused by the union in yet another of its darkest hours. Nor has prosecution of ‘the deserving’ been progressed (fact), but then NZRU and DIA are fully committed to ‘looking forward’ rather than back at their contentious and damning files that might be, suddenly(!), lost or misplaced, or smoothly sealed and suppressed. That’s the political climate, nefariously yet continuously supported by a line-up of senior government ministers along with NZ Police, IPCA, SFO, the Auditor-general, and yes, the Ombudsmen.

Rugby: Harvie stepping down after getting tough job done

Doug Harvie will step down from the Otago Rugby Football Union’s board with the sport in a much better position than when he arrived. Harvie, a Dunedin chartered accountant, became chairman of the newly structured board in May, 2012. He was shoulder-tapped to stand and felt he could not say no.
Harvie (57), a former loose forward for the University and Dunedin clubs, said the new board did not want to look back on why it found itself in such a tough position. It was focused on getting the business of rugby back into a good shape in Otago.

IPCA Role and powers
The Authority has the following functions and powers under the Independent Police Conduct Authority Act 1988.
Functions: Under section 12 of the Independent Police Conduct Authority Act 1988, the Authority’s functions are to:
● receive complaints (i) alleging misconduct or neglect of duty by any member of Police or (ii) concerning any Police practice, policy or procedure affecting a complainant; or
● investigate incidents in which a member of Police (acting in the execution of his or her duty) causes or appears to have caused death or serious bodily harm.
Action on complaints: Under the Act, when the Authority receives a complaint, it may carry out its own investigation, or refer the matter to the Police for investigation under the Authority’s oversight. If a complaint is referred to the Police for investigation, the Authority will take steps to ensure that it is properly resolved. This may include directing or actively overseeing the Police investigation, or reviewing or auditing the Police investigation once it is completed. The Authority may also decline to take action on a complaint – for example, if the complaint is very minor or outside the Authority’s jurisdiction. The period since the establishment of the Independent Police Conduct Authority in November 2007 has been one of transformation, as the Authority shifts its focus towards independent and transparent investigation of the most serious incidents and complaints. OPINION Police like to roll out statistics when it suits them so here’s one that hurts – 17 people killed on the roads during the holiday period. That’s more than double the death toll compared with last year. And it’s despite the police’s misguided efforts to target speeding drivers with the hopelessly designed zero tolerance for speeding campaign. It’s a campaign that has utterly failed. It’s a stupid policy that needs to be scrapped. Hundreds of thousands of us will have broken the zero tolerance policy over the holidays. Good on you. I did. It was safer to do so.

Uber taxi battle sees police vs cabbies

Police are cracking down on Uber, the cheap and trendy new-kid-on-the-taxi rank, leaving paying customers on the pavement. After complaints from the old-school taxi firms, police have begun fining the Uber drivers whose lower fares have been hurting the big cab companies. The private car hire service has hit back, lodging a complaint of police harassment with the Independent Police Complaints (sic) Authority. Uber operates as a private hire service which means the fare has to be set at the time of booking, rather than using a meter. This means Uber does not have to abide by taxi regulations, thus saving on operating costs.

Vandervis: Deloitte and Police Citifleet investigations

Deloitte and Police Citifleet Investigations – information I believe should be public in the public interest.

Message: I have had verbal and email responses from both CEO Bidrose and the Police denying that the scope of the Police investigation had been limited to missing or inappropriately sold DCC vehicles. These responses remain confidential currently because of other content they contain.
The fact remains that the investigating officer Detective Matthew Preece was adamant when he interviewed me on what I understood to be the last week of his investigation that he was not able to pursue my concerns of wider fraud other than missing vehicles, such as allegations regarding DCC contracts, and credit card and other financial spending fraud, because the complaint laid related just to missing vehicles.
Even more concerning was Detective Preece’s assertion to me that ‘all those that had acquired DCC vehicles needed to do, was to say that they understood Mr Bachop had the authority to dispose of them’ for them not to be liable for receiving or criminal prosecution. Detective Preece said that all those he had interviewed who had acquired DCC vehicles had said just that.

My worst fears that the tragic death of Mr Bachop would not be used to fully investigate the wider implications of a DCC staff self-serving culture were confirmed by the very limited scope of the belated Police investigation as relayed to me by Detective Preece. I wrote the following email to CEO Bidrose, Sandy Graham head of Governance, and Detective Mathew Preece that night. No demurring or other response to the email below has been received from Detective Preece.

Subject: Police Citifleet Investigation

Dear Sue,

An hour and a half spent with Detective Matthew Preece and another Policeman called Regan has left me with deep concerns regarding the Police Citifleet investigation.
Mr Preece has informed me that the scope of his investigation has been limited by the complaint the DCC has made to the Police, and that this complaint only concerns missing or inappropriately sold DCC vehicles.

Mr Preece says that because Police have not had a complaint from you or the DCC regarding;
– fraudulent Citifleet tender processes,
– fraudulent Citifleet tyre supply contracts,
– fraudulent Citifleet maintenance contracts
– fraudulent use of DCC Citifleet vehicle fuel
– fraudulent DCC accounting of Citifleet credit cards and other payment methods used and Citifleet managerial oversight
– and fraudulent use and conversion of DCC Citifleet vehicles [eg the conversion of a DCC-owned vehicle by Mrs Bachop]

and that consequently none of these fraud areas is being investigated!

Mr Preece did say that if you as CEO were to request that he broaden his investigation to include these other areas and not just the missing cars, that he would broaden his enquiry to include them. He insisted that he would have to have a broadened complaint from you as CEO for this to happen, and implied that a complaint from me as a City Councillor would not be enough to act on.

I have highlighted to Preece and Regan the urgent need to use the Citifleet manager’s tragic death to investigate and prosecute all Citifleet fraud areas, as a failure to do so will result in the loss of an unprecedented opportunity to clean out the culture of entitlement at Citifleet and in other DCC departments.

Can you please with urgency broaden the DCC complaint to include the 6 areas of potential Citifleet fraud listed above, so that Mr Reece can broaden his enquiry to include them.

Further to my verbal requests of a week or two ago please forward copies of all original correspondence and or other direction given to Deloittes in regard to their investigation of Citifleet.
I wish to have the original brief stating the terms of reference, the subsequent brief where the investigation needed to be extended, and any other direction written or otherwise given to Deloittes regarding the Citifleet investigation.
I am deeply disturbed by what I have seen in parts of the investigation conclusions appearing without covering page or any details identifying them as parts of the Deloitte findings in non-public parts of the Audit and Risk subcommittee meetings.
I note a severe slowing on responses to my recent LGOIMA requests, and hope this has been a temporary frustration.

In answer to the queries you had from Councillor Vandervis about the purchase of tyres.
Citifleet spend under $50,000 annually so we are not required to go to tender.
All tyres are purchased locally from Bridgestone NZ (trading as Firestone) through GSB Supply Corp (formally the Government Stores Board) giving us nation wide buying power so we get our tyres and repairs at a heavily discounted rate.
Most large Council’s and the likes of the Police etc use GSB not only for tyres but fuel as well as do we.
We have in the past used other suppliers but none of them could match the service and buying power we get through GSB.
I have looked into using other suppliers as recently as last Friday and after working through this issue with the Expenditure Manager in the Finance department we both came to same conclusion that Firestone is the best option for us at this point in time.
All tyres purchased are done so using our Fleetcard system.

The findings of an independent investigation into a fraud at the Dunedin City Council have been released publicly.

DCC Chief Executive Officer Sue Bidrose says, “The Police have advised their investigation is now at a point where the Deloitte report can be released. We have committed to keeping ratepayers informed and can now make the findings of the report public.”

Deloitte was engaged by the DCC in May to launch an investigation after staff identified what appeared to be a discrepancy in the number of Citifleet vehicles when implementing new financial procedures related to DCC assets. The alleged fraud totals more than $1.5 million and centres on the DCC receiving no proceeds from the sale of 152 vehicles from the DCC’s vehicle fleet. A formal complaint was laid with the Police in August following the Deloitte investigation. The Police were asked to investigate any matters arising from the Deloitte report.

Ms Bidrose says she cannot comment on the Police investigation.

Commenting on the Police investigation, Dunedin Clutha Waitaki Area Commander Inspector Jason Guthrie says, “This is a complex series of offending involving the significant misappropriation of DCC assets. There are a number of aspects to the Police investigation and whilst it is well progressed, it will be subject to a final review in the new year.”

The Deloitte report looks at a range of issues, including the ways the fraud was carried out and internal control failings at the DCC. Some parts of the report have been redacted for privacy reasons.

Ms Bidrose says, “The Deloitte report is clear that a single person committed the fraud in a number of different ways over an extended period of time. The fact this could happen was an indictment on our business processes and we have made considerable efforts to improve and modernise these. This work was already underway and was how the fraud was uncovered. Measures have been, and continue to be, taken to make sure the appropriate level of accountability and oversight is in place in the future across the organisation. We are committed to continuing our programme of work to ensure we have best practice across the board.”

Ms Bidrose says the DCC has completed all the employment processes identified in the Deloitte report. These relate to a small number of staff, but she will not be discussing individual employment matters in public. The DCC has received a $1 million insurance payment following the Citifleet fraud. The DCC had $1 million fidelity insurance and insurers QBE have paid out the total amount, in two separate payments.

Mayor of Dunedin Dave Cull says, “The Council has pushed for more transparency and tighter processes, with the clear aim of becoming a best practice public sector organisation. We totally support the work senior management has been carrying out and the changes which have resulted from this scrutiny.”

Ms Bidrose says a wide range of work has been completed to improve and modernise DCC processes, including:
● The introduction of a new Audit and Risk Subcommittee, with an independent Chair.
● All tenders that are awarded through the DCC Tenders Board are published on the DCC website for greater transparency.
● A central contracts register has been put in place.
● The ‘whistleblower’ policy has been updated.
● A review of fleet card processes and the issuing of cards.

Further work in progress includes:
● The appointment of a dedicated Risk and Internal Audit Manager. This position has been advertised.
● A fraud awareness campaign and training for all staff will begin in the new year.
● A risk management framework, which is almost complete.
● The development of new procurement and tendering processes across the DCC.

Background
Citifleet is responsible for the management of all DCC vehicles and the operation of an internal courier service. The fleet includes cars, trucks, motorcycles, vans and various trailers, plant and machinery. There are currently 122 vehicles, but the DCC is in the process of reviewing whether all those vehicles are required.

Government offices selected for OIA review

The Chief Ombudsman says a major review of the Official Information Act will scrutinise all 27 government ministers’ offices.
Dame Beverley Wakem today began her review of the way the public sector used the OIA, which she first announced in August.
Twelve government agencies have been selected for formal review, based on their size, number of OIA requests, complaints, and other criteria.
A further 63 agencies and all ministers’ offices have been asked to complete a detailed survey. At least one agency cited for good OIA practice would be included in the review.
The Ombudsman’s office would also seek input from past and present public servants, Opposition parties, journalists, academics and others.
Dame Beverley said the goal was to assess the quality and integrity of OIA practice in the public sector and to address any issues that were found.

Dear Editor,
Despite all the evidence, contributors like Bev Diehl still have everything wrong regarding the Stadium.
We do not “have it” – it has us till it is paid for. In the meantime the lenders have it and us by the debt short and curlies.
It is not “an asset” but a rates liability. We are not having major artists, they occasionally have us, as in the estimated $6 million Elton took back overseas for his one-off no-charge use of the Stadium. The mostly empty stadium has other events, mostly rugby, which are heavily subsidised by rates bail-outs and differential, Community Access fund, Event Attraction fund, and millions in interest, staff and maintenance payments. The DCC Stadium Review Committee was stacked with Stadium Management who recently succeeded in again increasing funding for their already wasteful operational spending.
Everything can never “fall into place”, until Stadium operational costs are reduced to the bare minimum required for the rare large events that only the Stadium can host, now that Carisbrook has been levelled.

DIA regulates what? Not white collar crime, not with govt looking on!

This one’s for Sue Ingram, DIA.

Charity expert Michael Gousmett has labelled the failure to pursue the investigation a cop-out. “To brush it under the carpet, [Internal Affairs] is basically abdicating their responsibility,” Gousmett said. “They tend to pick on the low-hanging fruit and you would have to question what the real purpose of the regulator is.”

Glenn charity probe dumped

Internal Affairs has abandoned an investigation into alleged irregular payments for a thoroughbred racehorse made by Sir Owen Glenn’s charity. After being under investigation for 18 months, the Glenn Family Foundation Charitable Trust charity was voluntarily deregistered on December 1. The charities regulator launched an investigation after emails appeared to show payments from the Glenn Family Foundation to a bloodstock company and Sir Owen’s personal bank account.
The alleged irregular payments surfaced in an email from former trust chief executive Peter McGlashan to Sir Owen, in which he wrote “large international transfer payments you requested be made to Bloodstocks Ltd and to your account in Sydney”. McGlashan’s email stated the payments “are not typical” of a charitable trust and will “no doubt need explaining” when the charity’s accounts were being prepared.
Charities service general manager Lesa Kalapu defended the length of the investigation, and lack of a resolution, saying there had been delays because Sir Owen lived overseas. “Purely because of the scale, and the international aspect to it, there were delays.” She said there was a “fair level of co-operation”.
Sir Owen told the Herald on Sunday negative media coverage had forced him to leave New Zealand.
The Charities Service came under the Department of Internal Affairs in July 2012.

The Department of Internal Affairs (DIA) has been deficient, dissembling and politically influenced to not pursue prosecution of innumerable persons — recognised pillars of society, professional trustees, lawyers and accountants amongst them — known to be involved in multimillion-dollar white collar crime.
A public disgrace, no less for the successive Ministers concerned.
But don’t worry, no-one is naïve in saying this.

Lax councils $7 billion behind in infrastructure

Ratepayers are facing a $7 billion bill to replace crumbling roads and water pipes caused, in part, by the “worry about it later” attitude of councils. A report released yesterday by Auditor-General Lyn Provost found councils nationwide have been failing to put enough money aside to maintain their collective $100b of infrastructure assets. The gap between funds needed and reality is tipped to reach $6b to $7b by 2020. Much of the country’s infrastructure was built in two waves, from 1910-30 and 1950-86, and many assets would reach the end of their lives at the same time, the report warned.

“They are storing up a problem for future generations, ” said Bruce Robertson, assistant auditor-general in charge of local government. Will councils step up and deal transparently and effectively with these issues?”

Keeping rates bills down to maintain political popularity was one reason assets were underfunded, and a “worry about it later” mentality also existed, the report stated.[…] Local Government NZ president Lawrence Yule said a $7b shortfall was significant, but it was too early for ratepayers to be pressing the panic button. It was not yet clear how accurate the auditor-general’s findings were, he said.
